Introduction: Lawyers As Conservators?, Joan W. Howarth
Introduction: Lawyers As Conservators?, Joan W. Howarth
Scholarly Works
This Symposium reminds us of our most important work, to protect legal institutions and the rule of law, and asks this most provocative question: Will 21st Century Business, Regulatory, and Educational Challenges Destroy the Lawyer's Role As Guardian of Legal Institutions and the Rule of Law?To some Symposium participants, the question posed is too dystopian. Is survival of the rule of law really at stake? For others, the Symposium question suggests a prior, even darker one: How can we conserve what is already lost? How, indeed, will we conserve legal institutions and the role of law? Are we, as lawyers, …

Physical Therapy Faculty Articles and Research
This study evaluated the effects of four different weekly stretching protocols on the rate of gain and decline in hamstring flexibility over an 8-week period, across sex. Using a randomized single-blind design, 53 healthy subjects aged 18–46 years were assigned to 1 of 4 stretching protocols or a control group. The stretching protocols consisted of either daily or 3 times per week stretching and performed once or twice each day. These protocols differed in terms of frequency and total weekly stretching time. All the subjects stretched their hamstring muscles for 4 weeks and were measured weekly for their hip range …
The Un "Surrogate State" And The Foundation Of Refugee Policy In The Middle East, Michael Kagan
The Un "Surrogate State" And The Foundation Of Refugee Policy In The Middle East, Michael Kagan
Scholarly Works
Many challenges surrounding refugee protection relate to a de facto shift of responsibility from sovereign governments to the UN Refugee Agency (UNHCR) to directly administer refugee policy. This phenomenon is legally anomalous, and it is UNHCR policy to avoid the operation of such "parallel structures." Yet the existence of a UN "surrogate state" offers important advantages to some host governments, which makes state-to- UNHCR responsibility shift difficult to reverse. Using the Arab Middle East as a case study, this article argues that, while not ideal, UNHCR's state substitution role offers important symbolic and material benefits to governments that host refugees …

Bio-Cultural Knowledge And The Challenges Of Intellectual Property Rights Regimes For African Development, Ikechi Mgbeoji
Bio-Cultural Knowledge And The Challenges Of Intellectual Property Rights Regimes For African Development, Ikechi Mgbeoji
Articles & Book Chapters
African states have, since the colonial encounter, been part of the international regimes on intellectual property rights. Formal accession to various treaties and conventions on intellectual property rights instruments should not be mistaken for actual internalization of the policies, structures and norms required for reaping the promised benefits of participation in such regimes. There is ample evidence showing that most African states do not have the requisite structures for fruitful engagement with international intellectual property rights regimes. Until this anomaly is rectified, African states' engagement with international intellectual property regimes will remain structurally flawed and inimical to the human development …

Biofiltration For Treatment Of Gases Contaminanted By Beta-Caryophyllene, Weili Hu
Biofiltration For Treatment Of Gases Contaminanted By Beta-Caryophyllene, Weili Hu
LSU Master's Theses
Fixed-film biological treatment processes, commonly referred to as biofilters, have been applied to successfully treat a wide variety of volatile organic compounds (VOCs) present in air emitted by a wide variety of industrial operations. The ability of biofilters to treat some classes of VOCs, however, has not been well established. In particular, the performance of biofilters treating sesquiterpenes has not been widely studied. In the research described herein, a laboratory-scale biofilter was operated to treat a synthetic waste gas stream containing â-caryophyllene, a sesquiterpene emitted by conifer trees and industrial wood processing operations. An enrichment culture developed in an initial …

Gymnasium-Based Unsupervised Exercise Maintains Benefits In Oxygen Uptake Kinetics Obtained Following Supervised Training In Type 2 Diabetes, Oscar Mac Ananey, D O'Shea, S Warmington, S Green, M Egana
Articles
Abstract
Supervised exercise (SE) in patients with type 2 diabetes improves oxygen uptake kinetics at the onset of exercise. Maintenance of these improvements, however, has not been examined when supervision is removed. We explored if potential improvements in oxygen uptake kinetics following a 12-week SE that combined aerobic and resistance training were maintained after a subsequent 12-week unsupervised exercise (UE). The involvement of cardiac output (CO) in these improvements was also tested. Nineteen volunteers with type 2 diabetes were recruited. Oxygen uptake kinetics and CO (inert gas rebreathing) responses to constant-load cycling at 50% ventilatory threshold (V(T)), 80% V(T), and …
Maternal Nutrition During Mid-Gestation Influences Gene Expression Essential For Intramuscular Adipose Tissue And Muscle Development In Bovine Fetuses, Tracy D. Jennings
Maternal Nutrition During Mid-Gestation Influences Gene Expression Essential For Intramuscular Adipose Tissue And Muscle Development In Bovine Fetuses, Tracy D. Jennings
Electronic Theses and Dissertations
Given the potential variation in forage quantity and quality available to gestating cows, it is possible to encounter periods of nutrient restriction, while supplementation decisions could lead to periods of over-nutrition. Maternal nutrition during mid-late gestation has shown to influence adipose development and myogenesis in the fetuses of various species; however, bovine research is limited. The objective of this experiment was to determine whether maternal nutrition during mid-gestation alters genetic expression of fetal adipogenic and myogenic regulatory factors, resulting in differences in adipose development and muscle characteristics of the bovine fetus. Twenty-two bred Angus crossbred heifers (BW = 527.73 ± …

The Global Food System, Environmental Protection, And Human Rights, Carmen G. Gonzalez
The Global Food System, Environmental Protection, And Human Rights, Carmen G. Gonzalez
Faculty Articles
The global food system is exceeding ecological limits while failing to meet the nutritional needs of a large segment of the world’s population. While law could play an important role in facilitating the transition to a more just and ecologically sustainable food system, the current legal framework fails to regulate food and agriculture in an integrated manner. The international legal framework governing food and agriculture is fragmented into three self-contained regimes that have historically operated in isolation from one another: international human rights law, international environmental law, and international trade law. International trade law has taken precedence over human rights …

Understanding And Developing Use Of Self After Graduation, Hanina L. Stettin
Theses and Dissertations
After graduation from a master's program, organization development (OD) practitioners are responsible for their own continued growth and learning. This research was conducted in order to provide the diverse, and relatively young, field of OD with some sense of (a) what methods practitioners are employing to develop and improve their Use of Self and (b) how they feel it helps them be better practitioners. The research was conducted in two stages. Firstly, alumni participated in an online survey gathering information about personal and professional practices. The data collected in the survey was enriched through second-stage research consisting of interviews with …
What Predicts Terrestrial Invertebrate Subsidy Use By Brook Trout (Salvelinus Fontinalis) In Headwater Streams?, Matthew Kestrel Wilson
What Predicts Terrestrial Invertebrate Subsidy Use By Brook Trout (Salvelinus Fontinalis) In Headwater Streams?, Matthew Kestrel Wilson
Graduate Student Theses, Dissertations, & Professional Papers
Spatial subsidies provide critical resources for organisms in receiving habitats, particularly when production in those habitats is low. While it is clear that terrestrial invertebrates provide a critical subsidy for trout, including eastern brook trout (Salvelinus fontinalis), we have limited understanding of what causes input and use of these subsidies to vary among streams. Among the watershed characteristics that may influence input and use of terrestrial invertebrates, I predicted that forest succession stage would be especially important due to differences in terrestrial invertebrate biomass in early and late successional habitats. To test this prediction, I measured terrestrial invertebrate biomass, input …

Environmental Perceptions And Objective Walking Trail Audits Inform A Community-Based Participatory Research Walking Intervention, Jamie Zoellner, Jennie L. Hill, Karen Zynda, Alicia D. Sample, M. Kathleen Yadrick
Faculty Publications
Background: Given the documented physical activity disparities that exist among low-income minority communities and the increased focused on socio-ecological approaches to address physical inactivity, efforts aimed at understanding the built environment to support physical activity are needed. This community-based participatory research (CBPR) project investigates walking trails perceptions in a high minority southern community and objectively examines walking trails. The primary aim is to explore if perceived and objective audit variables predict meeting recommendations for walking and physical activity, MET/minutes/week of physical activity, and frequency of trail use. Methods: A proportional sampling plan was used to survey community residents in this …
Criminal Child Neglect And The "Free Range Kid": Is Overprotective Parenting The New Standard Of Care?, David Pimentel
Criminal Child Neglect And The "Free Range Kid": Is Overprotective Parenting The New Standard Of Care?, David Pimentel
Utah Law Review
Parenting in American society is a far more demanding enterprise than it once was, and the changes over a single generation are startling. Intensive Parenting is becoming the norm in the dominant American subcultures, which are embracing safety-conscious parenting approaches that might once have been viewed disapprovingly as “overprotective” parenting. Most of the change is motivated by a well-intentioned desire to protect and promote children’s safety and welfare— more specifically to (1) insulate them from risks of physical harm and victimization, and (2) increase their access to educational and cultural advantage. De facto legal standards appear to be evolving right …
Standards For Health Care Decision-Making: Legal And Practical Considerations, Kim Dayton
Standards For Health Care Decision-Making: Legal And Practical Considerations, Kim Dayton
Utah Law Review
In contemporary guardianship systems, it is likely that most court-appointed guardians will eventually be called upon either to make or to assist the ward to make health care decisions of many sorts. These decisions may involve matters as simple as scheduling physician or dental appointments for the ward, helping her to complete medical history forms, and authorizing nonemergency treatment for minor illnesses or injuries. They may also involve such critical decisions as whether to permit risky surgical procedures, to switch from curative care that is unlikely to cure in favor of palliative care and aggressive pain management, or to direct …
Person-Centered Planning In Gaurdianship: A Little Hope For The Future, A. Frank Johns
Person-Centered Planning In Gaurdianship: A Little Hope For The Future, A. Frank Johns
Utah Law Review
This Article has examined the potential for person-centered planning within the American system of guardianship. Guardians’ current exercise of authority is not person-centered because it gives little attention to the person of those relegated to its paternalistic protections. Person-centered planning, though, may be a solution to this problem. This Article explained how person-centered planning can be incorporated in guardianship and included three case studies using person-centered tools in assessing the wants and needs of clients being served. Finally, this Article examined the extent to which the UGPPA and some states have incorporated person-centered planning into guardianship.
Floklore 2.0: Preservation Through Innovation, Sean A. Pager
Floklore 2.0: Preservation Through Innovation, Sean A. Pager
Utah Law Review
The WIPO draft treaty on TCE/folklore is intended to be legally binding. Yet, the exclusive rights it would establish are largely untested. They risk unintended consequences that may cause far more harm than good. This Article has argued that by placing undue restrictions on adaptation and commercialization, a strong property rights model of TCE protection would inhibit the creative renewal on which the long-term survival of traditional culture depends. Placing a “no trespassing sign” on intangible heritage may preserve folkloric traditions in their “authentic” state, but to do so is to adopt the preservationism of a taxidermist.
Parental Care And The Development Of The Parent Offspring Conflict In Discus Fish (Symphysodon Spp.), Jonathan Buckley
Parental Care And The Development Of The Parent Offspring Conflict In Discus Fish (Symphysodon Spp.), Jonathan Buckley
School of Biological and Marine Sciences Theses
Parental care has evolved across the animal kingdom to increase the probability of offspring surviving in an environment fraught with danger. While parental care is common among mammals and birds, it is relatively rare in fish with the vast majority of fish showing no form of parental care at all, whilst those that do, often just provide parental care to developing eggs pre-hatch. The provision of parental care in discus fish (Symphysodon spp.) is, therefore, interesting in that parents provide mucus to offspring as a source of nutrition during the first few weeks of care. In mammals this post-birth provision …
Fifth Graders' Discussions Of Graphic Novels Facilitated By De Bono Thinking Skills, Kimberly Ann Jennings
Fifth Graders' Discussions Of Graphic Novels Facilitated By De Bono Thinking Skills, Kimberly Ann Jennings
Graduate Research Papers
The effectiveness of graphic novels, heavily illustrated novels and traditional novels as a reading teaching tool has not been heavily researched. During the 5th grade school year of the 2011-2012, 24 students were required to read six novels, two in each format. During and after the reading, students were required to complete assigned assessments. The results of the study were graded based on a rubric system and by the number of responses per novel. The graphic novel received the highest scores in all categories. The graphic novel should be considered as an alternate method of teaching reading to 5th graders.
