Incorporating Rural And Farm Novels In The Secondary School Classroom: Where We Come From Is Who We Are, Jesse Moon Longhurst
Incorporating Rural And Farm Novels In The Secondary School Classroom: Where We Come From Is Who We Are, Jesse Moon Longhurst
Journal of Inquiry and Action in Education
Place-based education has received significant attention in recent years. This article briefly surveys common place-based education models and then argues for a more place-focused English language arts classroom in secondary schools where rural and regional literature is often absent from the curricula. The author posits that teacher-education programs do not usually address rural or regional literature and consequently, teachers enter the classroom unprepared to teach it. The article presents a rationale for focusing on rural literature written before 1965 as well as a rationale for foregrounding the rural experience in such a course. The author then describes the process of …
Contextualizing Disclosure's Effects: Wikileaks, Balancing And The First Amendment, Christina E. Wells
Contextualizing Disclosure's Effects: Wikileaks, Balancing And The First Amendment, Christina E. Wells
Faculty Publications
This essay responds to Professor Fenster’s article in the Iowa Law Review, Disclosure’s Effects: WikiLeaks and Transparency, assessing the effects of the recent WikiLeaks disclosures. The essay agrees with many of Professor Fenster’s conclusions regarding the promise and peril of those disclosures, especially his concern regarding the problematic balancing approaches used to assess the likely impact when confidential information is revealed. It specifically elaborates on courts’ current application of the Espionage Act, a criminal law likely to be applied to the WikiLeaks disclosures, and the implications of that deferential application for WikiLeaks, Julian Assange and journalists in general.

Of Trayvon Martin, George Zimmerman, And Legal Expressivism: Why Massachusetts Should Stand Its Ground On "Stand Your Ground", Louis N. Schulze Jr.
Faculty Publications
This essay suggests that the expressive impact of Stand Your Ground laws alters the shared norms governing our collective understanding of the moral limits of “self-defense.” The essay argues that the theory of Legal Expressivism can explain the widespread misunderstanding of the limits of self-defense, as demonstrated by the institutional and popular reactions to the killing of Trayvon Martin by George Zimmerman. To support this thesis, the piece briefly explains Stand Your Ground statutes and legal expressivism. It then details the nature of the expressive function of these statutes and asserts that Massachusetts, which recently considered the adoption of such …
The Roberts Court And The Civil Procedure Revival, Howard Merrill Wasserman
The Roberts Court And The Civil Procedure Revival, Howard Merrill Wasserman
Faculty Publications
In the six terms since John G. Roberts became Chief Justice in September 2005, the Supreme Court has decided numerous, significant, and potentially far-reaching cases on core civil procedure subjects, including pleading, summary judgment, personal jurisdiction, subject matter jurisdiction, class actions, and the Erie/Hanna Doctrine. This renewed interest in civil procedure and the Federal Rules is an important, but little-discussed, jurisprudential theme of the early years of the Roberts Court. This essay explores the Court’s emerging reengagement with civil procedure; it identifies several organizing themes in the recent cases and examines the existing ambivalence and hostility among the competing rulemaking …

The Origins, Evolution, And Future Of Preference Assessments In Applied Behavior Analysis, Hamilton Rech
The Origins, Evolution, And Future Of Preference Assessments In Applied Behavior Analysis, Hamilton Rech
Research Papers
For nearly thirty years, preference assessments have been utilized in determining items of interest for individuals afflicted with developmental disabilities. Originally, preference assessments were conducted on individuals with severe and profound disabilities, however over time, preference assessments have been adapted to suit individuals with various levels of functioning, as well as those with physical disabilities. Five primary methodologies have become widely accepted for conducting such assessments, and as new techniques have emerged, researchers have conducted a wide range of comparative studies, in hopes of sorting out each respective assessment’s strengths and weaknesses, as well as identify which specific populations for …

The Vascular Flora Of Breaks Interstate Park, Pike County, Kentucky, And Dickenson County, Virginia, Julie Bennett Clark
Online Theses and Dissertations
The vascular flora of Breaks Interstate Park was documented during two growing seasons, 2008 and 2009; with supplemental collections made in 2010 and 2011. The project area is located in eastern Kentucky and western Virginia at the northeastern terminus of Pine Mountain along the Appalachian Plateau. A total of 118 families, 341 genera, and 549 species, varieties, and subspecies were documented from Breaks Interstate Park. Six main vegetative communities were described: mesophytic forest, upper slopes and ridgetops, ponds/wetlands, river bottomland and floodplain/streamside, sandstone outcrops, and disturbed/open areas. Eleven rare species with state rankings were identified: Adlumia fungosa, Hydrastis canadensis, Juglans …
Subversive Liminality And Ideological Warfare: The Zombie Mash-Up As Resistance To Hypermasculine Revenge Narratives Post-9/11, Veronica L. Cooper
Subversive Liminality And Ideological Warfare: The Zombie Mash-Up As Resistance To Hypermasculine Revenge Narratives Post-9/11, Veronica L. Cooper
Online Theses and Dissertations
This project plots the coincidence of the "zombie renaissance" and system-justifying nationalist rhetoric post-9/11. The project discusses this cultural cross-section with zombie mash-up fiction, using masculinity and trauma theories, in an attempt to illuminate the motives of "us vs. them" rhetoric and hypermasculine revenge narratives in the post-9/11 decade. First, I use Adventures of Huckleberry Finn and Zombie Jim (2009) to examine liminality as subversive counter-discourse to the masculine hegemony post-9/11. Second, I use Pride and Prejudice and Zombies (2009) to look at the effects of revenge culture and how non-emphasized femininity and hegemonic (hyper)masculinity co-construct each other.
The Perception Of School Board Members And Their Role In Improving College And Career Readiness, Sara Elaine Farris
The Perception Of School Board Members And Their Role In Improving College And Career Readiness, Sara Elaine Farris
Online Theses and Dissertations
The national focus of graduating America's students ready for college and a career has heightened the importance of and the need for school board members to rethink their purpose on what and how they spend their time. Improving the college and career readiness of K-12 students will need school boards that are willing to receive the training to ensure that district leadership and schools are using the appropriate strategies that will impact college and career readiness.
School boards have always recognized student achievement as central to their role in governing public schools; however, the impact they actually have on promoting …
Exploring Military Service As An Alternative Sanction: Evidence From Inmates' Perspectives, Travis Wade Milburn
Exploring Military Service As An Alternative Sanction: Evidence From Inmates' Perspectives, Travis Wade Milburn
Online Theses and Dissertations
A large body of research exists that examines the punitiveness of prison compared to a wide variety of alternative sanctions. Generally, this research finds that there are numerous demographic and contextual differences in the way that people experience the punitiveness of prison. In this paper, I expand that research by using data from over 900 inmates to examine whether they view military service as more punitive than incarceration.
The research suggests females, Blacks, and those who have not had prior military service are more likely to desire imprisonment as opposed to military service. However, Whites and veterans appear to embrace …
The Effectiveness Of Homeland Security Training For Rural Communities: A Comparative Analysis Of Web-Based And Instructor-Led Training Delivery, Ryan K. Baggett
The Effectiveness Of Homeland Security Training For Rural Communities: A Comparative Analysis Of Web-Based And Instructor-Led Training Delivery, Ryan K. Baggett
Online Theses and Dissertations
The development of advanced training technologies such as Web Based Training (WBT), coupled with the proliferation of computer and Internet availability, has increased training opportunities for rural communities. This advancement is critical to meeting the training needs of emergency response personnel in rural communities who routinely face the challenge of providing continuous services to their community with limited resources. Despite the perceived convenience of WBT for emergency responders, little research has been conducted in homeland security on the knowledge acquisition of those who are trained using an electronic medium as compared to those in a traditional, Instructor-Led Training (ILT) delivery. …
Constructing Evil: U.S. Media Discourse And The Iranian State Murder Of Neda Agha-Soltan, Justin Turner
Constructing Evil: U.S. Media Discourse And The Iranian State Murder Of Neda Agha-Soltan, Justin Turner
Online Theses and Dissertations
On June 20, 2009, one image became not only a symbol of unbridled state violence, but a rallying cry for a movement contesting the disputed election of hardline Iranian President Mahmoud Ahmadinejad. The particular image in question was of Neda Agha-Soltan, a 26 year old woman whose murder was recorded by cellphone camera during a political protest and subsequently posted to social media networks showing a graphic fist-hand account of the savagery of a state crime. Media discourse presented the idea that Neda's murder was committed by the Iranian government unafraid to implore repressive measures to control its population. The …

Measuring Tasks, Time, And Priorities: A Study Of An Alternative School Leader In Action, Gregory Michael O'Bryan
Online Theses and Dissertations
This study explored whether conventional means to evaluate principal instructional leadership were appropriate in alternative school settings. The mixed methods research included shadowing an alternative school principal over two days during the fall semester, 2011. Data was collected using the Vanderbilt Assessment of Education in Leadership's (VAL-ED) Time Task Analysis ToolTM checklist supplemented by naturalistic observations and ongoing explanations by the principal. Leader activities were categorized within three major categories: instructional, management, and personal. Additional activity descriptions were based on instrument subcategories, multiple cycles of coding, and analytic memoing. Conclusions indicated that the VAL-ED instrument failed to accurately define …
The Moderating Effects Of Need For Closure On The Common Ingroup Identity Model, Bradlee Wayne Gamblin
The Moderating Effects Of Need For Closure On The Common Ingroup Identity Model, Bradlee Wayne Gamblin
Online Theses and Dissertations
The current study looked at the Common Ingroup Identity Model and its link to need for closure, a cognitive construct that causes individuals to seek out quick and finite answers. Based on previous research, I predicted that participants high in situational and dispositional need for closure would be more responsive to the Common Ingroup Identity Model than participants who were not. Results indicated that need for closure does not have a direct relationship with the model; however, a three-way interaction suggests that a more complex relationship may exist. These results give the Common Ingroup Identity Model more applicability within real-world …
Synthesis Of Novel Ionic Liquid Tagged Porphryin Media Designed For The Oxidation Of Lignin, Joseph Hugh Franklin Baker
Synthesis Of Novel Ionic Liquid Tagged Porphryin Media Designed For The Oxidation Of Lignin, Joseph Hugh Franklin Baker
Online Theses and Dissertations
The ever growing need for a viable renewable fuel source has led to this thesis project; the biomimetic lignin degradation by means of a homogeneous oxidative catalyst in corresponding ionic liquids. Lignin comprises nearly a third of lignocellulosic biomass and is cross-linked to both cellulose and hemicellulose. Current utilization methods of lignin do not generate the full value of the polymer, because they do not yield many of the valuable feed stock chemicals it is comprised of. To improve the value of the biomass as a whole and create a viable economy for the US's transition to biofuels, better utilization …

New Non-Toxic Holographic Photopolymer Material, Dervil Cody, Izabela Naydenova, Emilia Mihaylova
Articles
There is an increasing need for environmentally friendly holographic recording materials which can be produced in bulk with little risk to the health of workers in manufacturing. This is why the development of non-toxic photopolymer materials is crucial, and has attracted attention in recent years. Composition and preliminary characterization of a new non-toxic photopolymer material are presented. It operates well at a range of spatial frequencies, and achieves diffraction efficiencies and refractive index modulation comparable to the known acrylamide-based photopolymers.

Reproductive Success Of The Rare Endemic Orchis Galilaea (Orchidaceae) In Lebanon, Nisrine Machaka Houri, Mohammad Souheil Al-Zein, Duncan Brian Westbury, Salma Nashabe Talhouk
Turkish Journal of Botany
The biology and ecology of Orchis galilaea Schltr., a species endemic to Lebanon, Palestine, and Jordan, is poorly studied, a fact that hinders present and future management and conservation efforts concerning this species. In this paper, we report findings of a field investigation that assessed the impact of altitude, population density, and plant size on the reproductive success of O. galilaea. The results revealed that plant size and population density were significantly correlated with reproductive success while altitude was not. This study is part of ongoing research on the ecological responses of O. galilaea and provides a baseline for understanding …
Defining The Badges And Incidents Of Slavery, Jennifer Mason Mcaward
Defining The Badges And Incidents Of Slavery, Jennifer Mason Mcaward
Journal Articles
Most agree that Section Two of the Thirteenth Amendment empowers Congress to legislate regarding the “badges and incidents of slavery.” Few, however, have explored in depth the precise meaning of this concept. The goal of this Article is to provide a historical and conceptual framework for interpreting and identifying the badges and incidents of slavery. It examines the original public meaning of the terms “badge of slavery” and “incident of slavery” as well as how the “badges and incidents” concept has been incorporated into and used in Thirteenth Amendment jurisprudence. It considers several analytical variables from historical, jurisprudential, and policy …
Dastar's Next Stand, Mark P. Mckenna
Dastar's Next Stand, Mark P. Mckenna
Journal Articles
A series of recent cases implicate the extent to which trademark law can be used to control creative content. The possibility of using trademark law for that purpose obviously creates a potential conflict with copyright law, which ordinarily sets the rules for use of creative material developed by others. Unfortunately, despite its attraction to boundary questions in trademark law, the Supreme Court‘s Dastar decision—its lone decision demarcating trademark and copyright law—remains controversial and its scope somewhat unclear. This Essay argues that Dastar should be understood, or at least should be extended, to rule out any claims based on confusion that …
The Rise Of National Security Secrets, Sudha Setty
The Rise Of National Security Secrets, Sudha Setty
Faculty Scholarship
Professor Aziz Rana urges a broad and populist reconsideration of the idea that the administration and military are best positioned to make decisions about national security issues. This Article calls for a rethinking of national security secrecy as well. The centralization of security decision-making power in the early Cold War era fostered a culture of government secrecy, with Congress and the judiciary enabling the rise of national security secrecy out of fear that they were ill-equipped to make security-related decisions, and public fear of internal and international security threats trumping concerns about legitimacy or democratic accountability. This culture of secrecy …

Illich (Via Cayley) On Prisons, Giovanna Shay
Faculty Scholarship
This Article considers whether, more than a dozen years after publication of Cayley’s book "The Expanding Prison: The Crisis in Crime and Punishment and the Search for Alternatives," Illich’s theories help us to make sense of America’s “prison-industrial complex.” The Author concludes that our current situation reflects in part the dynamics of his theory of “counterproductivity,” but that Illich did not take sufficient account of the salience of race and class in American criminal punishment.

The eight articles in this Symposium issue reflect the divergent topics that Ivan Illich managed to reflect upon in his life’s works. The topics include discussion of prisons, education, family law structures, privatization of welfare services and its impact on labor consciousness, media, and the rule of law.
The Symposium was a daylong conference of ideas that invited the engagement of those who joined. The students of Illich and students of students of Illich shared with those of us who had not studied at his side, his passion for ideas, his insights, and his invitation for anyone with or without …
