Morphological, Phylogenetic, And Ecological Analyses Of The New Model Grass Species Setaria Viridis (Poaceae) And Its Close Relative Setaria Faberi, Daniel J. Layton Nov 2012

Morphological, Phylogenetic, And Ecological Analyses Of The New Model Grass Species Setaria Viridis (Poaceae) And Its Close Relative Setaria Faberi, Daniel J. Layton

Theses

Species limits as defined by herbarium taxonomists are nearly always based on intuitive morphological comparisons with little concrete data or statistical analysis. Setaria viridis (tribe Paniceae, subtribe Cenchrinae), an emerging model organism for the study of C4 photosynthesis, is one such inadequately defined species. In order to evaluate its relationship with the morphological intergrading Setaria faberi, a “total data” approach was taken. Statistical morphology, cytology, molecular phylogenetics, and growth experimentation were employed to examine the putative species boundary in this group. Principal components analysis of 70 morphological characters in 85 individuals revealed consistent separation between the two species in morphospace, …

Body Mass Index Trends And Nutrition Goals Of College Students Between 2007–2011, Alison L. Lynn

Department of Nutrition and Health Sciences: Dissertations, Theses, and Student Research

The incidence of overweight and obesity has become a major public health concern in the United States. The college years are a time during which many dietary and physical activity habits are formed. Health professionals on college campuses have the ability to reach large numbers of people and provide nutrition education to help reduce the rising rates of obesity. The purpose of this study is to examine the body mass index (BMI) trends of college students at the University of Nebraska-Lincoln, between the years 2007-2011 and to determine the nutrition-related goals of these students. Data was previously collected from NUTR …

Metabolic Syndrome And Migraine., Amit Sachdev, Michael J Marmura Nov 2012

Metabolic Syndrome And Migraine., Amit Sachdev, Michael J Marmura

Department of Jefferson Headache Center Papers and Presentations

Migraine and metabolic syndrome are highly prevalent and costly conditions. The two conditions coexist, but it is unclear what relationship may exist between the two processes. Metabolic syndrome involves a number of findings, including insulin resistance, systemic hypertension, obesity, a proinflammatory state, and a prothrombotic state. Only one study addresses migraine in metabolic syndrome, finding significant differences in the presentation of metabolic syndrome in migraineurs. However, controversy exists regarding the contribution of each individual risk factor to migraine pathogenesis and prevalence. It is unclear what treatment implications, if any, exist as a result of the concomitant diagnosis of migraine and …

The Development Of A Dyadic Assessment For Families Experiencing, Sarah Cline Nov 2012

The Development Of A Dyadic Assessment For Families Experiencing, Sarah Cline

Master's Theses and Doctoral Dissertations

Adolescent idiopathic scoliosis (AIS) is a chronic disease involving curvature of the spine that is typically diagnosed in late childhood and early adolescence. The timing of most AIS diagnoses and subsequent treatment occur at a critical point developmentally and may place strain on the parent-adolescent relationship. The present study developed a measure, The AIS Dyadic Assessment, of the parent-adolescent relationship affected by AIS. This measure assessed three aspects of the parent-adolescent relationship: Communication Skills, Emotion Regulation, and Mutual Agreement about AIS. Twenty-six female adolescents who were currently prescribed a brace as part of their AIS treatment, and their mothers, participated. …

Are Long-Lasting Insecticidal Nets Effective For Preventing Childhood Deaths Among Non-Net Users? A Community-Based Cohort Study In Western Kenya, Osuke Komazawa, Satoshi Kaneko, James K'Opiyo, Ibrahim Kiche, Sheru Wanyua, Masaaki Shimada, Mohamed Karama Nov 2012

Are Long-Lasting Insecticidal Nets Effective For Preventing Childhood Deaths Among Non-Net Users? A Community-Based Cohort Study In Western Kenya, Osuke Komazawa, Satoshi Kaneko, James K'Opiyo, Ibrahim Kiche, Sheru Wanyua, Masaaki Shimada, Mohamed Karama

All Peer-Reviewed Publications

Background: Increasing the distribution and use of insecticide-treated nets (ITNs) in Sub-Saharan Africa has made controlling malaria with ITNs more practical. We evaluated community effects induced by ITNs, specifically long-lasting insecticidal nets (LLINs), under ordinary conditions in an endemic malaria area of Western Kenya. Methods: Using the database from Mbita Health and Demographic Surveillance System (HDSS), children younger than 5 years old were assessed over four survey periods. We analyzed the effect of bed net usage, LLIN density and population density of young people around a child on all-cause child mortality (ACCM) rates using Cox PH models. Results: During the …

Student Speech Rights In The Digital Age, Mary-Rose Papandrea Nov 2012

Student Speech Rights In The Digital Age, Mary-Rose Papandrea

Florida Law Review

For several decades courts have struggled to determine when, if ever, public schools should have the power to restrict student expression that does not occur on school grounds during school hours. In the last several years, courts have struggled with this same question in a new context—the digital media. The dramatic increase in the number of student speech cases involving the Internet, mobile phones, and video cameras begs for a closer examination of the scope of school officials’ authority to censor the expression of minors as well as the scope of juvenile speech rights generally. This Article takes a close …

The Perspective Of A Junior Circuit Judge On Judicial Modesty, William H. Pryor Jr. Nov 2012

The Perspective Of A Junior Circuit Judge On Judicial Modesty, William H. Pryor Jr.

Florida Law Review

My topic today is judicial modesty, which some critics of the federal judiciary might say is an oxymoron. After all, these critics, in recent years, have dubbed it “the imperial judiciary,” “the most dangerous branch,” and “our judicial oligarchy.” Modesty is not a typical charge against the federal courts. After I provide an overview of judicial modesty based on what the Chief Justice and Judge Posner have said about it, I will address two aspects of my work that provide opportunities to display judicial modesty. First, I will address an aspect of the adjudicative work of the courts of appeals: …

Constitutional Advocacy Explains Constitutional Outcomes, Stephen A. Higginson Nov 2012

Constitutional Advocacy Explains Constitutional Outcomes, Stephen A. Higginson

Florida Law Review

This Article seeks to show that scholars, especially constitutional scholars, must pay more attention to the ways advocates frame their controversies at the "capital of the world." If the Anti-federalists' prophecy was that an overly complex constitution would accrete power around its ambiguities, then the perpetual refinement of the Constitution by lawyers in controversy—from article to section to sentence to clause to phrase to word—has given the best protection against inflexibility. This thesis is timely because lawyering is more accessible with the Court's recent decision to post oral arguments "on the same day an argument is heard by the Court." …

Much Ado About Nothing? The Antitrust Implications Of Private Equity Club Deals, Jessica Jackson Nov 2012

Much Ado About Nothing? The Antitrust Implications Of Private Equity Club Deals, Jessica Jackson

Florida Law Review

This Note addresses the antitrust issues that clubbing raises and argues that the antitrust laws should not restrict clubbing—absent some egregious conduct—and that courts should apply rule of reason analysis rather than per se rules to these sorts of antitrust claims. Part II provides a general background of antitrust law and the various standards that courts apply to private equity clubs. Part III explains private equity and fleshes out what a club deal is and how it works. Part IV discusses antitrust law within the context of joint ventures and sets out the varying standards that could apply to private …

Confusion And Unpredictability In Shareholder Derivative Litigation: The Delaware Courts' Response To Recent Corporate Scandals, Ann M. Scarlett Nov 2012

Confusion And Unpredictability In Shareholder Derivative Litigation: The Delaware Courts' Response To Recent Corporate Scandals, Ann M. Scarlett

Florida Law Review

The Delaware courts responded to the recent wave of corporate scandals, exemplified by Enron and WorldCom, by changing their approach to shareholder derivative litigation. This Article analyzes the Delaware courts’ response to these scandals and concludes that the courts have created doctrinal confusion and introduced unpredictability into derivative litigation. This Article also analyzes the future negative consequences for shareholders, corporations, directors, investors, and other litigants. Finally, this Article proposes improvements for derivative litigation that may alleviate the confusion and unpredictability created by the Delaware courts’ response to the recent scandals

Florida's Eminent Domain Overhaul: Creating More Problems Than It Solved, Scott J. Kennelly Nov 2012

Florida's Eminent Domain Overhaul: Creating More Problems Than It Solved, Scott J. Kennelly

Florida Law Review

This Note initially discusses how the Florida Legislature’s reaction to Kelo v. City of New London was unnecessary. However, accepting that the legislature felt the influence of the body politic to enact significant eminent domain reform, this Note argues that the legislature did not fully consider the consequences of its actions. Instead, the legislature’s measures were overly broad and created ambiguity. Additionally, the measures will have unintended consequences that could leave landowners and the community worse off than under the previous system. Finally, this Note offers solutions that would both provide Florida with a more comprehensive eminent domain framework and …

Two Wrongs Don't Negate A Copyright: Don't Make Students Turnitin If You Won't Give It Back, Samuel J. Horovitz Nov 2012

Two Wrongs Don't Negate A Copyright: Don't Make Students Turnitin If You Won't Give It Back, Samuel J. Horovitz

Florida Law Review

In a “cut-and-paste” Internet environment where plagiarism is easier than ever, academic institutions face the daunting challenges of promoting honesty and respect for the work of others and of ensuring the integrity of the learning and grading processes. Many academic institutions have accordingly turned to commercial plagiarism prevention and detection services, such as those provided by a company called Turnitin. Yet those institutions that use the Turnitin system may be fostering infringement of the intellectual property rights of their students. When Virginia’s McLean High School recently announced plans to use Turnitin, students balked and collected 1,190 student signatures on a …

Against Libertarianism, Alicia Finch Nov 2012

Against Libertarianism, Alicia Finch

Faculty Articles, Papers, and Other Scholarship

The so-called Mind argument aims at the conclusion that agents act freely only if determinism is true. The soundness of this argument entails the falsity of libertarianism, the two-part thesis that agents act freely, and free action and determinism are incompatible. In this paper, I offer a new formulation of the Mind argument. I argue that it is true by definition that if an agent acts freely, either (i) nothing nomologically grounds an agent’s acting freely, or (ii) the consequence argument for incompatibilism is unsound. I define the notion of nomological grounding, and argue that unless an agent’s acting freely …
