Text Work As Identity Work For Legal Writers, Erika Abner, Shelley M. Kierstead Jan 2012

Text Work As Identity Work For Legal Writers, Erika Abner, Shelley M. Kierstead

All Papers

The authors conduct an analysis of a number of first year and practitioner legal writing texts in order to examine whether and how these texts focus on the development of a legal identity, in particular, through creation of a personal, professional, or discoursal voice. The question of creation of a legal identity is significant, in part, because of the increased focus on teaching and learning professionalism and professional behaviors, both within law schools and in practice. The authors conclude that there is a limited focus within the texts on the identity work inherent in learning to write with authority under …

Administrative Justice And Adjudicative Ethics In Canada, Lorne Sossin Jan 2012

Administrative Justice And Adjudicative Ethics In Canada, Lorne Sossin

All Papers

In this article, I explore both the idea and practice of adjudicative ethics in the context of administrative justice in Canada. This is a large topic and one which is particularly timely as accountability, transparency and conflict of interest are all renewed areas of interest for governments across Canada. Elsewhere, I have suggested it is time to approach administrative justice as a justice system rather than as a disparate set of tribunals and boards. One way in which this coordination can be expressed is through a shared process of accountability for the conduct of adjudicators. My hope in elaborating adjudicative …

Language As A Performance Parameter: The Marcel Bitsch Vingt Etudes, Evan Benjamin Duke Jan 2012

Language As A Performance Parameter: The Marcel Bitsch Vingt Etudes, Evan Benjamin Duke

Theses and Dissertations--Music

The Bitsch Vingt Études are a significant part of the trumpet performers repertoire. They are taught in many university trumpet studios across the United States. David Baldwin, professor of trumpet at the University of Minnesota, has recorded all of them for the International Trumpet Guild. The editor, Raymond Sabarich, is considered the founder of the modern French school of trumpet playing.

Articulation is a significant component in performing on a brass instrument. By varying the attacks of the tongue, different timbres can be successfully achieved on the trumpet. Because of the volume the trumpet can generate, any defective articulation will …

Educating English Learners: Reconciling Bilingualism And Accountability, Rosemary C. Salomone Jan 2012

Educating English Learners: Reconciling Bilingualism And Accountability, Rosemary C. Salomone

Faculty Publications

(Excerpt)

In late July 2011, an estimated 5,000 individuals converged on Washington, D.C., to protest the direction of state and federal education policy. Fueled by social media, the Save Our Schools March and National Call to Action was a grassroots effort organized largely by teachers, with principals, school board members, and activists lending support. Featured speakers included prominent education figures, like historian Diane Ravitch and Jonathan Kozol, a former teacher known for his writings on school inequalities. Specific points of contention focused on high stakes testing and test-based accountability, key elements in the Obama Administration’s Blueprint for Reform and Race …

Overcoming Our Global Disability In The Workforce: Mediating The Dream, Elayne E. Greenberg Jan 2012

Overcoming Our Global Disability In The Workforce: Mediating The Dream, Elayne E. Greenberg

Faculty Publications

The unparalleled global support for the 2008 United Nations Convention on the Rights of Persons with Disabilities ("CRPD") highlights the global schism between the public extolling of human rights for individuals with disabilities and the private castigating of such individuals in their daily lives and in the workforce. The CRPD explicitly mandates that work is a right accorded to individuals with disabilities, and global employers are now being challenged to implement that right. Yet, in order to ensure meaningful, universal compliance with its directives, the CRPD imposes affirmative duties on Supporting States to develop a customized, workable plan that effectively …

Multilingualism And Multiculturalism: Transatlantic Discourses On Language, Identity, And Immigrant Schooling, Rosemary C. Salomone Jan 2012

Multilingualism And Multiculturalism: Transatlantic Discourses On Language, Identity, And Immigrant Schooling, Rosemary C. Salomone

Faculty Publications

(Excerpt)

In September 2010, an eye-catching article appeared on the front page of the New York Times “Arts” section. The headline read, “Cultures United to Honor Separatism.” Basque and Catalan nationalists, Sinn Fein leaders, and others were convening on the island of Corsica, not to chart out war strategies, as might have been expected, but rather to discuss cultural politics. As time would tell, pitched battles over sovereignty and independence seemed to be yielding to equally passionate calls for linguistic and cultural recognition. Facing the pressure of English as the global lingua franca, historically militant groups were placing their …

Cultural Competence--Does It Matter?: Lessons From A Mixed-Methods Study Of Wraparound Practice, Jennifer James Rose Jan 2012

Cultural Competence--Does It Matter?: Lessons From A Mixed-Methods Study Of Wraparound Practice, Jennifer James Rose

Dissertations

This mixed methods study investigated whether caregivers' ratings of wraparound fidelity and satisfaction with the wraparound process differed based upon their facilitators' self-assessed cultural competence and caregivers' reported stress. An explanatory sequential design was used. The quantitative phase was completed first. Survey methodology was used to measure reported cultural competence, wraparound fidelity, satisfaction with the wraparound process, and parental stress. Facilitators (n=58) completed a self-assessment instrument, the Multicultural Counseling Knowledge and Awareness Scale (MCKAS; Ponterotto, 1997). The MCKAS survey yielded a 43% response rate. The MCKAS descriptive data found levels of reported cultural competence comparable to previously published studies. Telephone …

Overcoming Our Global Disability In The Workforce: Mediating The Dream, Elayne E. Greenberg

St. John's Law Review

(Excerpt)

This Article focuses on the challenges of designing such effective, culturally sensitive mediation and conciliation programs to resolve global workplace discrimination against individuals with disabilities. Part One explains the CRPD and its mandates, focusing on its workplace imperatives. Part Two illustrates the scope and magnitude of the discrimination through harrowing statistics. Part Three highlights how Supporting States must address the gap, in all its cultural variants, between the global, public support for the CRPD and the more private societal and personal biases towards individuals with disabilities. Part Four offers the ideological, functional, and cultural considerations to be incorporated when …

Facebook, Twitter, And The Uncertain Future Of Present Sense Impressions, Jeffrey Bellin Jan 2012

Facebook, Twitter, And The Uncertain Future Of Present Sense Impressions, Jeffrey Bellin

Faculty Publications

The intricate legal framework governing the admission of out-of-court statements in American trials is premised on increasingly outdated communication norms. Nowhere is this more apparent than with the hearsay exception for “present sense impressions.” Changing communication practices typified by interactions on social media websites like Facebook and Twitter herald the arrival of a previously uncontemplated—and uniquely unreliable—breed of present sense impressions. This Article contends that the indiscriminate admission of these electronic present sense impressions (e-PSIs) is both normatively undesirable and inconsistent with the traditional rationale for the present sense impression exception. It proposes a reform to the exception that would …

The Use Of Fuck: A Sociolinguistic Approach To The Usage Of Fuck In The Bnc And Blog Authorship Corpus, Ryan Howe Jan 2012

The Use Of Fuck: A Sociolinguistic Approach To The Usage Of Fuck In The Bnc And Blog Authorship Corpus, Ryan Howe

Master's Theses and Doctoral Dissertations

The present study is a corpus-based approach using both the British National Corpus (BNC) and the Blog Authorship Corpus (BAC) to identify variance in spoken use of fuck between genders, age groups, and social classes. The resulting analysis shows that there is little variance in use between male and female speakers, while use is most prevalent during the teens and early 20s. This study offers further support of the idea that there are two distinct meanings of fuck that can be separated into two distinct words, fuck1 and fuck2, by showing that a non-referential definition of fuck (fuck2 …

Do You Have A Conscience?, Jeremy Bendik-Keymer Jan 2012

Do You Have A Conscience?, Jeremy Bendik-Keymer

Faculty Scholarship

“Do you have a conscience?” There was a time when this would have been a question that was immediately intelligible to people, like asking whether a person holding a ball can throw it. For much of the history of philosophy—that ancient Greek invention—the name for what allows one to stay in touch with moral principles in the midst of particular decisions was “conscience” (Langston 2001). To ask whether I have a conscience was tantamount to asking whether I can keep my decisions moral, whether I was capable of being a mature human being. Since morality is the domain of duties …

‘If It Be Love Indeed, Tell Me How Much’: Elizabeth Taylor, Richard Burton And White Pleasure After Empire, Gloria Shin Jan 2012

‘If It Be Love Indeed, Tell Me How Much’: Elizabeth Taylor, Richard Burton And White Pleasure After Empire, Gloria Shin

Reconstruction: Studies in Contemporary Culture

In this paper, I use the iconicity of 1960s Elizabeth Taylor and Richard Burton to theorize the visualization and formation of an ecstatic postcolonial whiteness.

To begin with, I adapt Edward Said’s formulation of orientalism to discuss Elizabeth Taylor’s exotic turn and emergence as a white oriental that buttresses the production of her film Cleopatra (1963). Through archival research, I map out Taylor’s orientalism, in this case the malleability of her image to exoticization evidenced by her enthusiastic conversion to Judaism in 1959, her influence as “Cleopatra” to set style trends in women’s makeup, hair and fashion in the 1960s, …

Emotional Availability And Touch Among Deaf And Hearing Mother-Infant Dyads, Grace Silvia Jan 2012

Emotional Availability And Touch Among Deaf And Hearing Mother-Infant Dyads, Grace Silvia

Graduate Student Theses, Dissertations, & Professional Papers

Much attention has been paid in past literature to deaf children's development, especially in regard to how they compare to their hearing peers over time. Most deaf children (approximately 90%) are born to hearing parents. In these cases, the child's hearing impairment can be difficult to accommodate due to the parents' lack of familiarity with ways of interacting without heavy reliance on the auditory modality. Using Deaf parents as a model for comparison, previous research has found that frequent use of touch for purposes of gaining attention is an important strategy when interacting with a deaf child.

The purpose of …

Tradewinds And Traditions: Exploring The Archaeology Of German Gulch, William Travis Norman

Graduate Student Theses, Dissertations, & Professional Papers

The German Gulch Archaeological Collection, a result of archaeological investigation at German Gulch by Butte, Montana cultural resource management firm GCM and the Beaverhead-Deerlodge National Forest during the late 1980s and early 1990s, represents a unique opportunity to explore ethnic relationships in rural Montana mining communities during the last half of the 19th century. The German Gulch site was a location of cultural interaction, between Overseas Chinese, European, and European American communities all focused on mining the mineral resources of the gulch. The collection presents an opportunity to test assumptions about bounded ethnic relationships as well as the process of …

Framing In Cognitive Clinical Interviews About Intuitive Science Knowledge: Dynamic Student Understandings Of The Discourse Interaction, Rosemary S. Russ, Victor R. Lee, Bruce L. Sherin Jan 2012

Framing In Cognitive Clinical Interviews About Intuitive Science Knowledge: Dynamic Student Understandings Of The Discourse Interaction, Rosemary S. Russ, Victor R. Lee, Bruce L. Sherin

Instructional Technology and Learning Sciences Faculty Publications

Researchers in the science education community make extensive use of cognitive clinical interviews as windows into student knowledge and thinking. Despite our familiarity with the interviews, there has been very limited research addressing the ways that students understand these interactions. In this work we examine students’ behaviors and speech patterns in a set of clinical interviews about chemistry for evidence of their tacit understandings and underlying expectations about the activity in which they are engaged. We draw on the construct of framing from anthropology and sociolinguistics and identify clusters of behaviors that indicate that students may alternatively frame the interview …

The Fulbright Program's Contemporary Relevance, Julia Catherine Starr Jan 2012

The Fulbright Program's Contemporary Relevance, Julia Catherine Starr

CMC Senior Theses

The most valuable contribution of the Fulbright Program, at its founding in 1946 and today in 2012, remains its ability to inculcate mutual understanding, which represents a vital component in the success of multilateral cooperation necessary to create a secure and thriving international community. During the Cold War, promoting mutual understanding was valued for its ability to share the ideals and benefits of American democracy and create strong relationships between Americans and foreigners in direct competition with the Soviet Union’s projection of communist ideology. This thesis demonstrates how, through the lenses of leadership, multiculturalism, soft power, and public diplomacy, the …

Novas Cartas Portuguesas: The Making Of A Reputation, Ana Margarida Dias Martins Jan 2012

Novas Cartas Portuguesas: The Making Of A Reputation, Ana Margarida Dias Martins

Journal of Feminist Scholarship

Novas Cartas Portuguesas (New Portuguese Letters), co-authored by Maria Isabel Barreno, Maria Teresa Horta, and Maria Velho da Costa, was banned in 1972 in Portugal for exploring sensitive issues such as women's oppression under the Catholic patriarchy. Given that police action against the authors soon became the focus of an international feminist protest in 1972-73, existing discussions of the book's reception often focus almost exclusively on what may be called its political life. I propose to approach the book from a new angle, with the purpose of uncovering its theoretical dimension as a literary-critical text that may have played an …

The Politics Of Writing, Writing Politics: Virginia Woolf’S A [Virtual] Room Of One’S Own, Tegan Zimmerman Jan 2012

The Politics Of Writing, Writing Politics: Virginia Woolf’S A [Virtual] Room Of One’S Own, Tegan Zimmerman

Journal of Feminist Scholarship

This article revisits A Room of One’s Own, Virginia Woolf’s foundational 1929 text on women’s writing. I examine from a feminist materialist perspective the relevance of Woolf’s notion of a “room” in our globalized and technological twenty-first century. I first review Woolf’s position on the material conditions necessary for women writers in her own time and then the applicability of her thinking for contemporary women writers on a global scale. I emphasize that the politics of writing, and in particular writing by women, that Woolf puts forth gives feminists the necessary tools to reevaluate and rethink women’s writing both online …

Irish American Women: Forgotten First-Wave Feminists, Sally Barr Ebest Jan 2012

Irish American Women: Forgotten First-Wave Feminists, Sally Barr Ebest

Journal of Feminist Scholarship

Numerous books have been written about American feminism and its influence on education and society. But none have recognized the key role played by Irish American women in exposing injustice and protecting their rights. Certainly their literary heritage, inherent knowledge of English, and membership in the single largest ethnic group gave them an advantage. But their dual positions as colonized, second-class citizens of their country and their religion gave them their political edge, a trait that has been evident since the Irish first stepped off the boat and that continues to this day. This essay focuses on the first wave …

Student Interpreters Show Encoding And Recall Differences For Information In English And American Sign Language, Jesse R. James, Kara I. Gabriel Jan 2012

Student Interpreters Show Encoding And Recall Differences For Information In English And American Sign Language, Jesse R. James, Kara I. Gabriel

All Faculty Scholarship for the College of the Sciences

This study investigated whether student interpreters encode and recall words differently in signed and spoken languages. Participants viewed and then recalled word lists, half of which were related through specific encoding strategies (i.e., experimental lists), and half of which lacked the availability of those strategies (i.e., control lists). Total words recalled and the temporal recall order were compared across experimental and control lists. Student interpreters utilised different strategies to remember words in English and American Sign Language (ASL), suggesting that student interpreters do not default to first-language (English) spoken strategies when encoding second-language (ASL) signed lists. However, the total number …

The Adaptation And Appropriation Of Shakespeare In Neil Gaiman's Graphic Novel The Sandman, Bianca Beebe Jan 2012

The Adaptation And Appropriation Of Shakespeare In Neil Gaiman's Graphic Novel The Sandman, Bianca Beebe

Theses & ETDs

This thesis addresses the adaptation and appropriation of both William Shakespeare's plays and his identity in contemporary graphic novels. It argues that there is a great disparity between historical accounts of Shakespeare and the way he is currently perceived in Western society, and this disparity greatly influences contemporary adaptations. The graphic novel, as a medium of popular literature, is presented as a useful and appropriate genre for contemporary adaptations of Shakespeare; this argument stems from the analogous relationship displayed between Renaissance theater and graphic novels. To support this argument, the introduction of this thesis contains a brief history of the …
