The Impact Of The Civil Jury On American Tort Law, Michael D. Green Jan 2012

The Impact Of The Civil Jury On American Tort Law, Michael D. Green

Pepperdine Law Review

This article, a contribution to a symposium on the what American tort law can contribute to the rest of the world expresses skepticism that a considerable swath of U.S. tort law would be of interest to the rest of the world. The thesis is that American tort law has been shaped by the existence of the civil jury, unique to the U.S, and areas of domestic tort law so influenced have no utility internationally. The article catalogues many such areas and discusses several of them.

The early African experience in the Americas is marked by the transatlantic slave trade from ~1619 to 1850 and the rise of the plantation system. The origins of enslaved Africans were largely dependent on European preferences as well as the availability of potential laborers within Africa. Rice production was a key industry of many colonial South Carolina low country plantations. Accordingly, rice plantations owners within South Carolina often requested enslaved Africans from the so-called “Grain Coast” of western Africa (Senegal to Sierra Leone). Studies on the African origins of the enslaved within other regions of the Americas have been limited. …

From The Subaltern To The Precariat, During Simon Jan 2012

From The Subaltern To The Precariat, During Simon

Theoretical Studies in Literature and Art

This essay argues that, given the global dominance of neo-liberal capitalism, the concept of the subaltern now needs to be replaced by that of the precariat, a term first used by Pierre Bourdieu. It further argues that the category of the subaltern emerged in key post-disciplines of cultural studies, postcolonialism and subaltern studies, all of which themselves belong to the aftermath of the West's 1968 revolutions. In our era of global capitalism, their usefulness is in decline. Indeed the precariat is a broader category than the subaltern since it covers not just those who live on the margins of the …

Formal models serve in many roles in the programming language community. In its primary role, a model communicates the idea of a language design; the architecture of a language tool; or the essence of a program analysis. No matter which role it plays, however, a faulty model doesn't serve its purpose.

One way to eliminate flaws from a model is to write it down in a mechanized formal language. It is then possible to state theorems about the model, to prove them, and to check the proofs. Over the past nine years, PLT has developed and explored a lightweight version …

Integrating Methods And Strategies From Language Teaching And Business Studies In Languages For Specific Business Purposes Courses, Judith A. Ainsworth Jan 2012

Integrating Methods And Strategies From Language Teaching And Business Studies In Languages For Specific Business Purposes Courses, Judith A. Ainsworth

Global Advances in Business Communication

It has been argued that acquisition of skills in the use of foreign languages is comparable to the development of competence in other skills (Drew & Ottewill, 1998). The foreign language learner must actively participate in the learning process and practice the skills required in order to achieve success. Thus, learning to communicate in a foreign language emphasises experimentation and concrete experience. On the other hand, abstract conceptualisation, reflective observation, and the development and testing of theories and ideas are more important for business studies. However, language studies and skills acquired are often related to the development of the soft …

Foreign Language Careers For International Business And The Professions, Ronald C. Cere

Global Advances in Business Communication

The U.S. work and market places are becoming more global, multilingual, and multicultural in nature and are making foreign language and cultural studies, particularly those of Asia and Latin America, an important part of career planning and development. Many jobs demand knowledge of one or more languages and their attendant cultures and require experience in international and/or cross cultural areas. They also demand specialized interdisciplinary training such as that offered at many schools, colleges, and universities, and encourage internships that can lead to promising careers. Job sources for foreign language-based careers also abound and with guidance and research can be …
