The Politics Of Incivility, Bernard E. Harcourt Mar 2012

The Politics Of Incivility, Bernard E. Harcourt

Public Law and Legal Theory Working Papers

The Flemish painter, Pieter Bruegel, portrayed in his artwork men relieving themselves, cripples begging, and peasants toiling—as well as butchery and the gallows. In his masterful work, The Civilizing Process, Norbert Elias revealed how the “late medieval upper class” had not yet demanded, as later generations would, that “everything vulgar should be suppressed from life and therefore from pictures.” For centuries now, defining incivility has been intimately connected with social rank, class status, political hierarchy, and relations of power. The ability to identify and sanction incivility has been associated with positions of political privilege—and simultaneously has constituted and reinforced political …

Conducting Qualitative Data Analysis: Managing Dynamic Tensions Within, Part One, Ronald J. Chenail

The Qualitative Report

In the third of a series of “how-to” essays on conducting qualitative data analysis, Ron Chenail examines the dynamic tensions within the process of qualitative data analysis that qualitative researchers must manage in order to produce credible and creative results. These tensions include (a) the qualities of the data and the qualitative data analysis of these qualities, (b) errors of deficiency and exuberance, (c) tacit and public knowledge, (d) separation and connection, and (e) verticality and horizontality.

Homosexual Identity, Translation, And Prime-Stevenson's Imre And The Intersexes, Margaret S. Breen Mar 2012

Homosexual Identity, Translation, And Prime-Stevenson's Imre And The Intersexes, Margaret S. Breen

CLCWeb: Comparative Literature and Culture

In her article "Homosexual Identity, Translation, and Prime-Stevenson's Imre and The Intersexes" Margaret S. Breen examines the role of translation in lesbian, gay, bisexual, and transgender studies. Breen's focus is Edward Prime-Stevenson, who, under the penname Xavier Mayne, wrote two works: a short novel, Imre: A Memorandum (1906), and a general history of homosexuality, The Intersexes: A History of Similisexualism as a Problem of Social Life (1908). Breen argues that Prime-Stevenson's texts are relevant to late nineteenth- and early twentieth-century discussions of (homo)sexuality because they point to the importance of translation in writings concerning sexual and gender identities and …

Davis's Poetic Dialogue With Leiris's Autobiography, Jonathan Evans Mar 2012

Davis's Poetic Dialogue With Leiris's Autobiography, Jonathan Evans

CLCWeb: Comparative Literature and Culture

In his article "Davis's Poetic Dialogue with Leiris's Autobiography" Jonathan Evans analyzes Lydia Davis's translation of the first two parts of Michel Leiris's autobiography, which shows an encounter between two writers. Davis has also written stories which reference Leiris and thus position him as a precursor. Evans proposes that Leiris is not only a source of influence for Davis, but that their texts can be read as a dialogue. Using a methodology that draws on Lacanian psychoanalysis, Evans shows how Leiris focuses on sound and graphological patterns in order to understand his own conscious and unconscious relationship with words. Davis, …

Free Indirect Discourse In Farsi Translations Of Woolf's Mrs. Dalloway, Zohreh Gharaei, Hossein Vahid Dastjerdi Mar 2012

Free Indirect Discourse In Farsi Translations Of Woolf's Mrs. Dalloway, Zohreh Gharaei, Hossein Vahid Dastjerdi

CLCWeb: Comparative Literature and Culture

In their article "Free Indirect Discourse in Farsi Translations of Woolf's Mrs. Dalloway" Zohreh Gharaei and Hossein Vahid Dastjerdi discuss the degree to which free indirect discourse is reproducible in Farsi translations of Virginia Woolf's Mrs. Dalloway. Gharaei and Vahid Dastjerdi's analysis reveals that while it is possible to employ free indirect discourse in Farsi, the grammatical features of the technique represent the most problematic areas of translation to Farsi. Although some studies have attributed deviations from the style of the original writer to the structural differences between Farsi and English or domesticating strategies on the part of …

Comparative Law As Rhetoric: An Analysis Of The Use Of Comparative Law In International Arbitration , Frédéric Gilles Sourgens Feb 2012

Comparative Law As Rhetoric: An Analysis Of The Use Of Comparative Law In International Arbitration , Frédéric Gilles Sourgens

Pepperdine Dispute Resolution Law Journal

The bulk of the comparative work of an arbitration counsel will go towards finding effective means of persuading a tribunal. It is part of his advocacy tool kit. Typically, there are three distinct ways in which counsel would then deploy these tools in practice: (1) he could use comparative law to explain law foreign to the tribunal in a manner helpful to his case, (2) he could use it as a means to close legal gaps in the law applicable to the dispute, and (3) he could use it to extract general principles of international law or trade usages. This …

The Institutional Role In Arbitrating Patent Disputes, Murray Lee Eiland Feb 2012

The Institutional Role In Arbitrating Patent Disputes, Murray Lee Eiland

Pepperdine Dispute Resolution Law Journal

This paper will address, in particular, the nature of an international patent dispute and how the rules of the main arbitral institutions influence the unfolding arbitration. The main issue considered here is if institutional rules address the particular needs of patent disputes. Arbitral institutions are prepared to resolve many kinds of disputes, but because they operate under different rules, some may be more or less prepared for the special nature of IP. Patent related disputes are even more specialized. Even small differences in institutional rules can have a large impact upon the unfolding arbitration. After a brief consideration of arbitrability, …

Wawasan Dan Persepsi Guru Bahasa Indonesia Terhadap Program Pengintegrasian Materi Anti-Kkn Dalam Pembelajaran Bahasa Indonesia, Sumadi Sumadi

Bahasa dan Seni: Jurnal Bahasa, Sastra, Seni, dan Pengajarannya

Teachers have a very strategic role in combating corruption, collusion, and nepotism in Indonesia, which have reached an alarming level. This can be achieved because, through education, teachers can internalize the values of anti-corruption, collusion, and nepotism to the next generation of the nation in a natural, programmed, and systematic way. This research aims to reveal teachers’ visions and perceptions toward the program of integrating anti-corruption, collusion, and nepotism materials into the Indonesian language teaching–learning process. The results of this research can be used as a starting point for integrating anti-corruption, collusion, and nepotism materials into Indonesian language teaching and …

Bahasa Melayu Di Kerajaan Buton (Studi Berdasarkan Naskah Kuno Koleksi Abdul Mulku Zahari Di Buton), La Niampe

Bahasa dan Seni: Jurnal Bahasa, Sastra, Seni, dan Pengajarannya

Buton is one of the Malay Kingdoms located in Southeast Sulawesi. As time went by, more and more people from the Malay world came to Buton. This was due to the strategic position of Buton as a trade route in Eastern Nusantara. In addition, this movement was encouraged by the intention to spread Islam. As part of the Malay Kingdoms, the use of the Malay language was indispensable. The script collection of ancient texts of the Buton Kingdom (Abdul Mulku Zahari’s collection) indicates that the Malay language was taken as one of the official languages used in the kingdom, alongside …

Learning English Through Poetry For Efl Students, I G A Lokita Purnamika Utami Feb 2012

Learning English Through Poetry For Efl Students, I G A Lokita Purnamika Utami

Bahasa dan Seni: Jurnal Bahasa, Sastra, Seni, dan Pengajarannya

Poetry can help students become more sensitive to language. However, in an EFL situation, students may object to learning poetry. Thus, English teachers should know how to use poetry in their teaching. Teachers should also ensure that EFL learners do not feel worried about understanding poetry, as not all poems are difficult. Moreover, what matters most is learning English through poems rather than learning about the poems themselves. In short, it is suggested that EFL teachers encourage learners to explore poems and write their own. Poetry provides abundant language exposure that improves students’ language sensitivity and creativity in using English.

Culture In International Parental Kidnapping Mediations, Melissa A. Kucinski Feb 2012

Culture In International Parental Kidnapping Mediations, Melissa A. Kucinski

Pepperdine Dispute Resolution Law Journal

Mediating an international parental kidnapping case involves much more than knowing some family law-it involves complex emotions, strict time constraints, multiple nations' laws and policies, intricate international treaties, juggling interpreters, attorneys, government officials, judges, and parents who may be physically located thousands of miles apart, and the blunt reality that you may have no understanding of either parent's cultural customs or the way each will communicate with the other parent or with you. While the "culture" part of the mediation may appear to be the least significant element, it could be key to the success of the mediation. Nonetheless, "culture" …

The Missing Link: Enhancing Mediation Success Using Neuro-Linguistic Programming, Mariam Zadeh Feb 2012

The Missing Link: Enhancing Mediation Success Using Neuro-Linguistic Programming, Mariam Zadeh

Pepperdine Dispute Resolution Law Journal

What is it that separates the best from the rest? Generally speaking, the highly coveted litigators and mediators draw people to them over and over again because of that something extra they possess. In Neuro-Linguistic Programming (NLP), that something extra is often referred to as "the difference that makes the difference." Outstanding performers in any field instinctively know the "difference that makes the difference." Successful trial lawyers, for example, have a keen knack for connecting with the jury and persuading them to follow their lead in support of the client's case. Similarly, parties prefer some mediators over others in large …

Jailhouse Encounter: A Sixteenth-Century Jewish-Christian Tale And Its Historiographical Ramifications, Daniel Jütte

Early Modern Workshop: Resources in Jewish History

This presentation examines two excerpts from the little known early seventeenth-century German memoirs of the non-Jewish Swabian merchant Hans Ulrich Krafft (1550–1621).1 Krafft was born into one of the most respected families in the city of Ulm, in southern Germany. In the 1570s, he served as a factor for the Augsburg-based Manlich trade company in the Levant. 2 In the summer of 1574, however, the Manlich Trade Company went bankrupt, and Krafft, who did not have the means to pay off the debts he had guaranteed on behalf of his employers, was arrested and imprisoned in Tripoli (now in Lebanon). …

A Jewish Merchant Family And A Moroccan Ruler, Daniel Schroeter

Early Modern Workshop: Resources in Jewish History

These three documents are from the Lévy-Corcos archives, a private collection of family documents in Paris, which I photographed in 1985. A few comments on what Jewish family archives reveal about Muslim-Jewish relations in Morocco: It was not uncommon for elite Jewish families to pass down from generation to generation various kinds of Muslim and Jewish legal documents, including Arabic decrees of rulers (dahirs) and letters from Muslim governmental officials. Such documents were kept as records of property, debts, or special privileges. Significantly, literate Jews did not read or write in the Arabic script, and thus could not read the …

Commit Patterns And Threats To Validity In Analysis Of Open Source Software Repositories, Alexander Curtis Maclean Feb 2012

Commit Patterns And Threats To Validity In Analysis Of Open Source Software Repositories, Alexander Curtis Maclean

Theses and Dissertations

In the course of studying the effects of programming in multiple languages, we unearthed troubling trends in SourceForge artifacts. Our initial studies suggest that programming in multiple languages concurrently negatively affects developer productivity. While addressing our initial question of interest, we discovered a pattern of monolithic commits in the SourceForge community. Consequently, we also report on the effects that this pattern of commits can have when using SourceForge as a data-source for temporal analysis of open source projects or for studies of individual developers.

Intersectionality Of Ethno-Cultural Identities And Construal Of Distant Suffering Outgroups, Marek Palasinski, Jackie Abell, Mark Levine Feb 2012

Intersectionality Of Ethno-Cultural Identities And Construal Of Distant Suffering Outgroups, Marek Palasinski, Jackie Abell, Mark Levine

The Qualitative Report

In this paper, we explore how white Catholic men talk about the indirect dilemma of non-intervention for black ethnic outgroups. We illustrate how they mobilise global categorisation (all humanity) and use various forms of denial to deal with their non-involvement. Having analyzed representative fragments of their prejudice avoidance talk, we conclude with some observation about the strategic deployment of categories and denial forms as part of identity management talk. In contrast to quantitative research that oversimplifies the ingroup-outgroup distinction, we show how the status and outgroupness levels of the needy appear to be both flexible and intricate, which depends on …
