What Can The Brothers Malone Teach Us About Ficher V. University Of Texas?, Charlie Gerstein Jun 2012

What Can The Brothers Malone Teach Us About Ficher V. University Of Texas?, Charlie Gerstein

Michigan Law Review First Impressions

In 1975, the Brothers Malone took the entrance exam for the Boston Fire Department. At the time, the Department was under a court-ordered affirmative action plan: it divided its pool of test-takers into groups of black and white applicants and gave substantial preference to those in the former. The Brothers listed themselves as white and didn't make the cut. In 1977, the Brothers Malone again took the entrance exam for the Boston Fire department, this time listing themselves as black. The Brothers became firemen. Within a few years, someone at the Fire Department grew suspicious of the Malones. An investigation …

Brain Mapping Of The Mismatch Negativity Response In Vowel Formant Processing, Elizabeth Anne Perry Jun 2012

Brain Mapping Of The Mismatch Negativity Response In Vowel Formant Processing, Elizabeth Anne Perry

Theses and Dissertations

The mismatch negativity (MMN) response, a passively-elicited component of the auditory event-related potential (ERP), reflects preattentive identification of infrequent changes in acoustic stimuli. In the current study, the MMN response was examined closely to determine what extent natural speech sounds evoke the MMN. It was hypothesized that a significant MMN response results during the presentation of deviant stimuli from which spectral energy within formant bands critical to vowel identification has been removed. Localizations of dipoles within the cortex were hypothesized to yield information pertaining to the processing of formant-specific linguistic information. A same/different discrimination task was administered to 20 adult …

Shakespeare Reception In India And The Netherlands Until The Early Twentieth Century, Vikram Singh Thakur Jun 2012

Shakespeare Reception In India And The Netherlands Until The Early Twentieth Century, Vikram Singh Thakur

CLCWeb: Comparative Literature and Culture

In his article "Shakespeare Reception in India and The Netherlands until the Early Twentieth Century" Vikram Singh Thakur locates Shakespeare in two different cultural contexts by looking at its reception in The Netherlands and India. His analysis is based on the fact that Shakespeare was a foreign playwright to both cultures yet both have gradually assimilated his works into their respective cultures and made him, probably, the most performed foreign playwright since the 1870s. Thakur aims at understanding how the reception of a work in different cultures is mediated by various social, cultural, historical, and ideological sieves through which the …

Bias And Equivalence In Cross-Cultural Research, Jia He, Fons Van De Vijver Jun 2012

Bias And Equivalence In Cross-Cultural Research, Jia He, Fons Van De Vijver

Online Readings in Psychology and Culture

Bias and equivalence are key concepts in the methodology of cross-cultural studies. Bias is a generic term for any challenge of the comparability of cross-cultural data; bias leads to invalid conclusions. The demonstration of equivalence (lack of bias) is a prerequisite for any cross-cultural comparison. we first describe considerations that are relevant when choosing instruments in a cross-cultural study, notably the question of whether an existing or new instrument is to be preferred. We then describe the definition, manifestation, and sources of three types of bias (construct, method, and item bias), and three levels of equivalence (construct, measurement unit, and full …

Using Gardner’S Theories Of Intelligence In The Teaching Of Early Childhood Education, Eileen Mcpartland

Irish Journal of Academic Practice

This small-scale qualitative study was carried out to examine a perceived gap in the teaching and learning experiences of a group of students in a two-year childcare course of a specific College of Further Education. The distinction between teaching and learning will be discussed, while acknowledging Gardner's theories and encouraging cross-curricular interactions within the Further Education setting. Students were asked to identify how they thought they learnt material in the context of Gardner's Theories of Multiple Intelligences to see if it would assist them in addressing a persistent assessment problem. The research involved an individual interview at tutorial, a follow-up …

Wine Tasting Through Typography, Dayna Goldman Jun 2012

Wine Tasting Through Typography, Dayna Goldman

Graphic Communication

The purpose of this study is to find the connection, if any, between the design and typography of wine labels with the flavor attributes of the wine itself. If there is a lacking connection, wineries can use this information to better market their wines so that consumers know more about the wines they are purchasing and can make a more informed decision. This allows these wineries to better market themselves and differentiate from their competitors.

The research focuses mainly on smaller, local wineries because these are the businesses that need more assistance or direction in creating and marketing their brand. …

Finding A Country To Call Home: A Framework For Evaluating Legislation To Reduce Statelessness In Southeast Asia, Alec Paxton Jun 2012

Finding A Country To Call Home: A Framework For Evaluating Legislation To Reduce Statelessness In Southeast Asia, Alec Paxton

Washington International Law Journal

Statelessness is a problem that affects 12 million people worldwide, with severe social, economic, and political consequences. This problem is particularly acute in Southeast Asia. Over the last sixty years, Southeast Asian states have attempted to reduce existing stateless populations through nationalization. These attempts have been met with varying degrees of success. The United Nations High Commission on Refugees and other non-governmental organizations have recently started to evaluate the outcome of these legislative attempts to reduce statelessness. These ad hoc evaluations provide valuable lessons for those who are drafting legislation to reduce existing stateless populations as well as legal scholars …

Enhancing Listening And Spoken Skills In Spanish Connected Speech For Anglophones, Elena Paz Vizcaya Jun 2012

Enhancing Listening And Spoken Skills In Spanish Connected Speech For Anglophones, Elena Paz Vizcaya

Doctoral

Native speech is directed towards native listeners, not designed for comprehension and analysis by language learners. Speed of delivery, or economy of effort, produces a speech signal to which the native listener can assign the correct words. There are no discrete words in the speech signal itself therefore there is often a linguistic barrier in dealing with the local spoken language.
The creation, development and application of the Dynamic Spanish Speech Corpus (DSSC) facilitated an empirically-based appreciation of speaking speed and prosody as obstacles to intelligibility for learners of Spanish. “Duologues”, natural, relaxed dialogues recorded in such a manner that …

Courts And New Democracies: Recent Works, Tom Ginsburg Jun 2012

Courts And New Democracies: Recent Works, Tom Ginsburg

Public Law and Legal Theory Working Papers

Recent literature on comparative judicial politics reveals a variety of roles that courts adopt in the process of democratization. These include, very rarely, serving as a trigger for democratization, and more commonly, serving as downstream guarantor for departing autocrats or as downstream consolidator of democracy. In light of these roles, this essay reviews six relatively recent books: Courts in Latin America, edited by Helmke and Rios-Figueroa (2011); Judges Beyond Politics in Democracy and Dictatorship: Lessons from Chile, by Hilbink (2007); Cultures of Legality: Judicialization and Political Activism in Latin America, edited by Couso, Huneeus and Sieder (2011); The Legacies of …

Food For Thought: Sustainability, Community-Engaged Teaching And Research, And Critical Food Literacy, Dianna Winslow

Writing Program – Dissertations

Eric Schlosser's Fast Food Nation. Marion Nestle's Food Politics. Michael Pollan's The Omnivore's Dilemma and In Defense of Food: An Eater's Manifesto. The films Food, Inc. and The Future of Food. Debates over the industrialized food and farming system currently circulating in nonfiction books, documentaries, and public forums have immediacy for college students--and for anyone who eats. Food for Thought: Sustainability, Community-Engaged Teaching and Critical Food Literacy argues that fostering the development of critical food literacy is necessary for college students to have a voice in current and future public conversations on food politics and environmental sustainability, and the social …

Public Attitudes And Gender Policy Regimes: Coherence And Stability In Hard Times, Jing Guo, Neil Gilbert Jun 2012

Public Attitudes And Gender Policy Regimes: Coherence And Stability In Hard Times, Jing Guo, Neil Gilbert

The Journal of Sociology & Social Welfare

Drawing upon data from the European Social Survey on public attitudes and social welfare, this paper analyzes the extent to which attitudes toward gender equality in work and family life vary among 13 countries which represent different welfare regimes. The analysis also examines how these attitudes have changed with the onset of the economic recession in 2007. The findings suggest that public attitudes toward gender issues are largely consistent with welfare regimes, and most notably, reveal a clear direction of moving away from traditional views of gender, family and work issues in economic hard times.

At Home, At Work: Indian Immigrant Women In Colonial East Africa (C.1920-1940), Savita Nair Jun 2012

At Home, At Work: Indian Immigrant Women In Colonial East Africa (C.1920-1940), Savita Nair

Wagadu: A Journal of Transnational Women's & Gender Studies

Situated in the broader context of the South Asian diaspora, Indian Gujarati merchant families in colonial East Africa participate in creating a modern history of migration. Building on preexisting connections between western India and eastern Africa, families create networks and recreate community in a unique diasporic context. Constituted not only of men, but also women who accompany and follow their entrepreneurial, adverturer husbands, and later daughters and wives, Gujarati business families are ensured a place in the historical record as a constituent community in British East Africa. In this new colonial site, newly marked by the railway systems, market towns, …

Communication-Based Assessment Of Developmental Age For Young Children With Developmental Disabilities, Shari L. Deveney, Lesa Hoffman, Cynthia J. Cress

Special Education and Communication Disorders Faculty Publications

Purpose: In this study, the authors compared a multiple-domain strategy for assessing developmental age of young children with developmental disabilities who were at risk for long-term reliance on augmentative and alternative communication (AAC) with a communication-based strategy composed of receptive language and communication indices that may be less affected by physically challenging tasks than traditional developmental age scores.

Method: Participants were 42 children (age 9–27 months) with developmental disabilities and who were at risk for long-term reliance on AAC. Children were assessed longitudinally in their homes at 3 occasions over 18 months using multiple-domain and communication-based measures. Confirmatory factor analysis …

Skirting The Issue: How International Law Fails To Protect Traditional Cultural Marks From Ip Theft, Sonali Maulik Jun 2012

Skirting The Issue: How International Law Fails To Protect Traditional Cultural Marks From Ip Theft, Sonali Maulik

Chicago Journal of International Law

Countries have different levels of intellectual property (IP) protections. While developed countries tend to prefer more stringent IP laws, developing countries prefer weaker ones. With the enactment of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), which established minimum standards of intellectual property rights (IPRs) for states party, the level of IPRs became much higher globally. However, despite affording strong protection to many types of IP, this Comment argues that TRIPS fails to provide adequate protection for traditional cultural marks (TCMs), particularly those used in developing countries. As a result, companies in developed countries have been able to …

History And Politics In Parthasarathy's Play Aurangzeb, Shubh Brat Sarkar Jun 2012

History And Politics In Parthasarathy's Play Aurangzeb, Shubh Brat Sarkar

CLCWeb: Comparative Literature and Culture

In his article "History and Politics in Parthasarathy's Play Aurangzeb" Shubh Brat Sarkar analyzes the use of history in a dramatic text, the underlying politics and ideology of a literary product, and the modes by which the materials are shaped through dramaturgy. The name Aurangzeb, the title of the play, has a strong presence in history textbooks and has perhaps become an integral part of a grand historical, "Indian" nationalist discourse. In the play multiple contradictions co-exist and find new projections in translations and theater adaptations in different historical contexts. Indira Parthasarthy's 1974 play is based on events leading …
