Beyond The First Amendment: Shaping The Contours Of Commercial Speech In Video Games, Virtual Worlds, And Social Media, Jon M. Garon

Utah Law Review

By using the intersection of existing trade law with the traditional publicity rights doctrine, the developing law of cyberspace can be applied to digital interactive media in predictable ways designed to protect against consumer fraud and protect the legitimate commercial interests of endorsers without impinging on the First Amendment. The system requires the more granular analysis that courts and regulators have applied in traditional media for decades. By using the core principles of existing law, the concerns about technological innovation diminish and continued advancement of free speech can be promoted. The FTC and FCC provide an established road map to …

The Sophisticates: Conflicted Representation And The Lehman Bankruptcy, Milan Markovic Jan 2012

The Sophisticates: Conflicted Representation And The Lehman Bankruptcy, Milan Markovic

Utah Law Review

This Article has suggested that attorney conflicts of interest can impact the representation that even sophisticated clients like Lehman receive. Although Sullivan undoubtedly attempted to represent Lehman to the best of its ability and may have not violated any disciplinary rules in representing Lehman, Sullivan’s ability to act in the best interests of Lehman and achieve the bank’s objectives was frustrated by its close relationships with Merrill and Barclays, as well as its desire to maintain its strong reputation among Treasury and Federal Reserve officials. The history of Sullivan’s representation of Lehman during the financial crisis illustrates that technical compliance …

A Call For Standards: An Overview Of The Current Status And Need For Guardian Standards Of Conduct And Code Ethics, Karen E. Boxx, Terry W. Hammond

Utah Law Review

The role of trust in guardianships is rarely discussed, perhaps because of the assumption that court supervision of guardians reduces their power to act in any way other than trustworthy. However, as the number of persons needing guardianship protection increases while the resources available to courts to finance supervision decreases, the role of guardian is starting to become a more conventional fiduciary relationship complete with a hallmark downside—lack of supervision. Because of this trend, the concept of delineated standards for performance of a guardian’s duties has taken on critical importance.

Standards For Guardian Fees, Catherine Seal, Spencer Crona Jan 2012

Standards For Guardian Fees, Catherine Seal, Spencer Crona

Utah Law Review

Given the size of the baby-boomer generation, the number of guardianship cases is expected to increase in the coming years. The problems revealed in this article—including the dismaying failure of courts to adequately monitor guardians and their wards, taken together with the resulting misfeasance and malfeasance by fiduciaries—can only be expected to multiply with the increase in cases. In doing so, states should consider the traditional tools used to regulate the profession, such as the use of licensure and certification. Also, the pressure to locate funding for guardians and the need for public guardian programs will become even more apparent …

Violence Against Adolescent Girls: A Fundamental Challenge To Meaningful Equality, Judith Bruce Jan 2012

Violence Against Adolescent Girls: A Fundamental Challenge To Meaningful Equality, Judith Bruce

Poverty, Gender, and Youth

Societies, rich and poor alike, are increasingly articulating commitments that guarantee girls safe and equal access to entitlements, services, social participation, and economic opportunities. yet threats of violence in many forms intervene to prevent girls from claiming their rights. Many countries stipulate equality between males and females in their constitutions. Theoretically, safe access to resources and facilities is equally afforded to girls and boys, however a far higher proportion of boys and a smaller subset of usually more privileged girls may actually claim their rights and opportunities. The experience of violence is devastating at the individual emotional and physical level. …

Reproductive Health

An increasingly popular strategy for addressing sexual gender based violence (SGBV) is through the establishment of one-stop centers‘ (OSCs), which provide integrated, multi-disciplinary services in a single physical location. The goals of this assessment were two-fold: first, to assess the effectiveness of different OSC models in terms of health and legal outcomes for survivors, and the cost-effectiveness of these models; and second, to identify lessons learned in OSC implementation with recommendations for both start-up and scale-up. Findings from this study offer the first form of systematic evidence on the effectiveness of OSCs, which can guide national-level policymakers and program managers …
