Beyond The Core: Incorporating Transnational Crimes Into The Rome Statute, Regina Menachery Paulose Oct 2012

Beyond The Core: Incorporating Transnational Crimes Into The Rome Statute, Regina Menachery Paulose

Cardozo Journal of International and Comparative Law

The article argues that the International Criminal Court (ICC) should expand its jurisdiction to include transnational organized crime, such as drug trafficking, counterfeiting, and arms trade, to address the growing global threat posed by these crimes. While the Rome Statute currently excludes such crimes, the ICC’s role as a court of last resort and its independence make it an ideal institution to prosecute transnational organized crime, fostering international cooperation and enhancing deterrence. The article advocates for a unified definition of transnational organized crime and the inclusion of select crimes from the United Nations Convention against Transnational Organized Crime (CATOC) and …

Home Games: Legal Issues Concerning The Displacement Of Property Owners At The Site Of Olympic Venues, Jessica Blumert

Cardozo Journal of International and Comparative Law

The Olympics, as the world's largest mega event, often lead to human rights violations, particularly regarding the right to adequate housing, as host cities displace residents and businesses. The International Olympic Committee (IOC) has the unique ability to address these issues by incorporating binding human rights protections into its contracts with host countries, yet it has failed to enforce such standards effectively. The article argues that the IOC should amend its Charter to include specific housing rights criteria, drawing on international law and precedents from the European Court of Human Rights (ECtHR), to ensure compliance and protect vulnerable populations.

Turning Counseling Students Into Researchers: Enhancing Quantitative Research Courses With An Experiential Learning Activity, Mark C. Rehfuss, Dixie D. Meyer

Counseling & Human Services Faculty Publications

Research methods and application are crucial aspects of most counseling practitioners and scholars’ lives, yet practical experience with development and implementation of research projects is usually limited to doctoral level dissertations. This article describes an experiential research project that has been integrated into counseling research methods courses at both the master’s level and the doctoral level. In this mentored research activity, students move through the entire research process in one semester. They begin with a notion and finish with a submission for publication. Based on student responses, implementing this process in a research methodology course is recommended.

Negotiating Federalism Past The Zero-Sum Game, Erin Ryan Oct 2012

Negotiating Federalism Past The Zero-Sum Game, Erin Ryan

Scholarly Publications

Countless instances of intergovernmental bargaining offer a means of understanding the relationship between state and federal power that differs from the stylized model of “zero-sum” federalism that has come to dominate political discourse. The zero-sum model sees winner-takes-all jurisdictional competition between the federal and state governments for power, emphasizing sovereign antagonism within the federal system. Yet real-world interjurisdictional governance show that the boundary between state and federal authority is really an ongoing project of negotiation, taking place on levels both large and small. Reconceptualizing the relationship between state and federal power as one heavily mediated by negotiation reveals just how …

Predictive Value Of Alpha-Fetoprotein In The Long-Term Risk Of Developing Hepatocellular Carcinoma In Patients With Hepatitis B Virus Infection--Results From A Clinic-Based Longitudinal Cohort., Hie-Won Hann, Xiaoying Fu, Ronald E. Myers, Richard Hann, Shaogui Wan, Su Hee Kim, Natalie Au, Jinliang Xing, Hushan Yang

Division of Gastroenterology and Hepatology Faculty Papers

BACKGROUND: Although serum level of alpha-fetoprotein (AFP) has long been used to complement imaging tests in the screening and diagnosis of hepatocellular carcinoma (HCC), whether it can be used as a predictive marker of long-term risk for developing HCC in patients with hepatitis B virus (HBV) has not been extensively evaluated and thus remains controversial.

METHODS: We retrospectively conducted a clinic-based longitudinal cohort study including 617 Korean American patients with HBV who had been followed for up to 22 years (median follow-up time, 6.2 years) to evaluate the association between baseline serum AFP level and the long-term risk of HCC. …

THE DETERMINANTS OF HELMINTH INFECTION IN BABOONS

Summary Paragraph:

Intestinal parasitic helminths are common in wild primate populations [1, 2] and can impose a significant burden on their host’s fitness. Numerous factors can affect the prevalence and diversity of intestinal parasites in natural populations including environmental factors [3, 4], the host’s behavior and genetics [5, 6]. How these different factors interact in natural populations remains unclear. This is in all probability due to the fact that previous studies have seldom looked at the prevalence and diversity of parasitic helminths in the same species but in different habitats over periods longer …

There's No Place Like Home: Realizing The Vision Of Community-Based Mental Health Treatment For Children, Yael Cannon Oct 2012

There's No Place Like Home: Realizing The Vision Of Community-Based Mental Health Treatment For Children, Yael Cannon

Faculty Scholarship

On the heels of the recession, the recent U.S. Census data reveals that the percentage of children living in poverty in the United States has grown to almost a quarter. Because children from low-income families are more likely to be exposed to high levels of stress, violence, abuse, overcrowding and other risk factors, they are far more likely to develop a mental health disorder--and to have their mental health needs go unmet. Rather than receive the necessary educational and mental health services, these children are often suspended and expelled, funneled through the school-to-prison pipeline' into the juvenile and criminal justice …

About My Father's Business: Pastoral Succession From Father To Son, Clifford Hartley Oct 2012

About My Father's Business: Pastoral Succession From Father To Son, Clifford Hartley

Doctoral Dissertations and Projects

A son who follows in his fathers' footsteps is not unique to many situations but it is to the office of pastor of the local church. Such a succession raises several questions: Is this a call of God, or the passing on of a dynasty? Is this a healthy transition for a church to consider? What are the associated problems and benefits? What biblical foundations should be considered? Are there common factors that make this transition successful? It is evident that unique planning and caution is necessary that is different from other successions patterns of pastoral ministry. This paper will …

Returning Counselor Education Doctoral Students: Issues Of Retention, Attrition, And Perceived Experiences, David Burkholder Oct 2012

Returning Counselor Education Doctoral Students: Issues Of Retention, Attrition, And Perceived Experiences, David Burkholder

Journal of Counselor Preparation and Supervision

A phenomenological research design was utilized to illuminate the experiences of counselor education doctoral students who had voluntarily departed from study and successfully returned. No studies exist in the counselor education literature examining this phenomenon. Themes derived from the data suggest a common experience across participants, including the salient nature of leaving and returning to study, the importance of faculty-student interactions, and that departure is informed by personal factors and academic culture. The findings have implications for student retention and attrition, as well as counseling departments, counseling faculty, and counselor education doctoral students.

The Use Of Cognitive Ability Measures As Explanatory Variables In Regression Analysis, B. Junker, Lynne Steuerle Schofield, L. J. Taylor Oct 2012

The Use Of Cognitive Ability Measures As Explanatory Variables In Regression Analysis, B. Junker, Lynne Steuerle Schofield, L. J. Taylor

Mathematics & Statistics Faculty Works

Cognitive ability measures are often taken as explanatory variables in regression analysis, e.g., as a factor affecting a market outcome such as an individual’s wage, or a decision such as an individual’s education acquisition. Cognitive ability is a latent construct; its true value is unobserved. Nonetheless, researchers often assume that a test score, constructed via standard psychometric practice from individuals’ responses to test items, can be safely used in regression analysis. We examine problems that can arise, and suggest that an alternative approach, a “mixed effects structural equations” (MESE) model, may be more appropriate in many circumstances.

Changing And/Or Funding Opeb Promises: A Typology Of Local Government Responses To Gasb 45 And The Realization Of Opeb Liabilities, Juita-Elena Yusuf, Thomas Musumeci Oct 2012

Changing And/Or Funding Opeb Promises: A Typology Of Local Government Responses To Gasb 45 And The Realization Of Opeb Liabilities, Juita-Elena Yusuf, Thomas Musumeci

School of Public Service Faculty Publications

GASB Statement No. 45 addresses how governmental units account for employees' other post-employment benefits (OPEB), requiring government employers to replace OPEB reporting on a pay-as-you-go basis with an accounting of the cost of current and future benefits. This requirement and the resulting OPEB liability may prompt government employers to reconsider key questions regarding their OPEB provision. The size of the OPEB liability depends on both the benefit promises made to employees and the assets to fund these promises. We propose a typology that defines four approaches for governments to respond to GASB 45 and their OPEB liabilities. These approaches represent …
