The Psychological Wellbeing Of Women Operating Mining Machinery In A Fly-In Fly-Out Capacity, Anne Bailey-Kruger
The Psychological Wellbeing Of Women Operating Mining Machinery In A Fly-In Fly-Out Capacity, Anne Bailey-Kruger
Theses: Doctorates and Masters
The present study aimed to address the gap in the current mining research by investigating women’s experiences of working in the mining industry in a “bluecollar” work role and the impact of fly-in fly-out (FIFO) mining on their wellbeing. An Interpretative Phenomenological Approach (IPA) was used as a framework to explore the experiences of 19 female machine operators through in-depth interviewing at one mineral mine site in Queensland, Australia. IPA analysis revealed three themes as identified by the participants. The first theme described how workplace barriers to job progression were salient issues for the women, particularly in respect to discrimination …
Relationships Between Gender, Socioeconomic Status, Math Attitudes, And Math Achievement: An International Investigation, Sunny R. Duerr
Relationships Between Gender, Socioeconomic Status, Math Attitudes, And Math Achievement: An International Investigation, Sunny R. Duerr
Open Access Dissertations
Investigations into the factors related to math achievement have traditionally been studied within individual countries, despite the existence of large international data sets available for analysis. This dissertation investigated the relationships among gender, socioeconomic status, math attitudes, and math achievement based on information from 50 participating countries in the Trends in International Mathematics and Science Study (TIMSS).
Countries were grouped into clusters using hierarchical cluster analysis. Six cluster solutions were investigated based on average mathematics scores, average science scores, and average math attitude. The clusters were then validated on a separate sample using discriminant function analysis. The validation process utilized …
The Dialectics Of Teacher Change Wtihin A Community Of Practice, Armand R. Pires
The Dialectics Of Teacher Change Wtihin A Community Of Practice, Armand R. Pires
Open Access Dissertations
Teacher change is at the heart of school reform. The research on teacher change has been primarily focused on teacher change from an individualistic perspective and has identified three possible paths of teacher change: beliefs precede change, change precedes beliefs, or change is nonlinear and recursive. This study looked at teacher change within a middle school during a time the school was undergoing a district-driven change in student grouping practices.
The study was conducted during the 2009-2010 school year and included ten teachers of science, social studies, and English in a grade 6-8 middle school. A qualitative study approach was …
Transnational Conservation Contracts, Natasha Affolder
Transnational Conservation Contracts, Natasha Affolder

Transnational environmental law is the subject of growing scholarly interest. Yet, much work remains to be done to fill in both the conceptual and empirical contours of this field. One methodological challenge that transnational law poses is the need to look beyond traditional sources of international and national law. This article contributes to efforts to understand transnational law's multilayered architecture by drawing attention to the use of transnational contracts as a mechanism to protect habitats and species. The diverse and proliferating examples of conservation contracts discussed in this article – which include forest carbon agreements, conservation concessions, debt-for-nature swaps, conservation …
Transparency Norms, The World Trade System And Free Trade Agreements: The Case Of Ceta, Ljiljana Biuković
Transparency Norms, The World Trade System And Free Trade Agreements: The Case Of Ceta, Ljiljana Biuković
All Faculty Publications
Canada and the European Union (EU) are negotiating an ambitious Comprehensive Economic and Trade Agreement (CETA). While the content of the agreement has not yet been officially disclosed by its negotiators, the general public and the business community are already concerned about the scope and effect of CETA on the two economies and their societies. This article deals with CETA’s transparency provisions. It claims that, whereas CETA has not yet utilized external transparency to ensure support for the negotiations, it does have the potential for greater regulatory transparency in technical barriers to trade (TBT)- and sanitary and phytosanitary (SPS)-related matters …
Transport And Partitioning Of Organochlorine Pollutants In The Open Oceans, Lin Zhang
Transport And Partitioning Of Organochlorine Pollutants In The Open Oceans, Lin Zhang
Open Access Dissertations
Remote open oceans were traditionally considered as sinks of persistent organic pollutants (POPs) such as industrial chemicals (PCBs) and organochlorine pesticides (OCPs). In the context of reduced primary emissions as well as global warming, previous polluted reservoirs such as soil, large water bodies, and glaciers may act as secondary sources returning these POPs back to the atmosphere and ocean. It was also hypothesized that biogeochemical activities associated with phytoplankton in the water column would lead to the coupling of air-plankton systems to draw down the lipophilic POPs from the overlying atmosphere, similar to the biological pump taking up CO2 …
Teachers’ Perception Of Bullying Among Youth: Hindsight Bias In Relation To Victim Responses, Karen J. Sherman
Teachers’ Perception Of Bullying Among Youth: Hindsight Bias In Relation To Victim Responses, Karen J. Sherman
Open Access Dissertations
Bullying, a common, persistent, and detrimental occurrence in schools, adversely affects the social, emotional, behavioral, and psychological well-being of children and youth. Independent variables that have been studied among children and youth involved in bullying in school settings are delineated, ways that bullying has been assessed and reported are described and critiqued, and the effect of hindsight bias is reviewed. Forty-eight vignettes were constructed by crossing (a) four kinds of social contact (physical aggression, verbal aggression, relational aggression, and non-aggression) with (b) male and female actors, (c) male and female and receivers, and (d) reaction of the receiver (aggressive, passive, …
Measurement Timing In Growth Mixture Modeling Of Alcohol Trajectories, Anne M. Fairlie
Measurement Timing In Growth Mixture Modeling Of Alcohol Trajectories, Anne M. Fairlie
Open Access Dissertations
A more nuanced understanding of individuals' patterns of alcohol use during adolescence, a key developmental period for the onset of use, is of critical importance for refining preventive interventions in this population. To this end, growth mixture modeling (GMM) is a statistical technique that may be used to identify latent subgroups of individuals who exhibit distinct patterns of alcohol use over time. Decisions regarding the timing and interval of survey assessments are particularly challenging in the context of GMM. Latent subgroups exhibit different trends in alcohol use, and these trends must be adequately captured by the survey assessments. Accordingly, the …
Decoding First Amendment Coverage Of Computer Source Code In The Age Of Youtube, Facebook And The Arab Spring, Jorge Roig
Scholarly Works
Computer source code is the lifeblood of the Internet. It is also the brick and mortar of cyberspace. As such, it has been argued that the degree of control that a government can wield over code can be a powerful tool for controlling new technologies. With the advent and proliferation in the Internet of social networking media and platforms for the publication and sharing of user-generated content, the ability of individuals across the world to communicate with each other has reached truly revolutionary dimensions. The influence of Facebook in the popular revolutions of the Arab Spring has been well documented. …

Honey, It’S All The Buzz: Regulating Neighborhood Beehives, Patricia E. Salkin
Scholarly Works
Beekeeping’s popularity has surged in recent years, perhaps culminating in the introduction of the first ever White House bee hive. Local Apiaries provide a wide variety of benefits to communities, ranging from pollination services for gardens to producing honey that can be used in a wide array of foods and products. Apiaries are not always welcome in a community, however, perhaps because of their potential to cause a nuisance, or to harm crops or people. Although beekeeping regulation implicates both state and federal concerns a number of localities have developed unique and practical regulations that promote backyard beekeeping, while maximizing …

Engaging Deliberative Democracy At The Grassroots: Prioritizing The Effects Of The Fiscal Crisis In New York At The Local Government Level, Patricia E. Salkin, Charles Gottlieb
Scholarly Works
Part I of this Article discusses many of the factors contributing to the fiscal crisis at the local level in New York including historic decreases in federal and state revenue sharing, the imposition of a new property tax cap, the failure of New York to address meaningfully the subject of unfunded mandates on local governments, and the dependency of some local jurisdictions on the timely adoption of a state budget. Part II discusses concepts of deliberative democracy and how local residents might be engaged to become partners with local officials in making difficult fiscal decisions that impact all community residents. …
Sustainability As A Means Of Improving Environmental Justice, Patricia E. Salkin, John C. Dernbach, Donald A. Brown
Sustainability As A Means Of Improving Environmental Justice, Patricia E. Salkin, John C. Dernbach, Donald A. Brown
Scholarly Works
This article explains why environmental justice provides much of the foundation for sustainable development, and shows how sustainability can improve our ability to achieve environmental justice. The article first explains a basic but often unrecognized truth about environmental policy: environmental pollution and degradation, sooner or later, harms humans. Both sustainable development and environmental justice respond to this problem, though in somewhat different ways. Sustainable development, however, suggests a broader set of tools to address this problem than are often employed for environmental justice. The article shows how four broad approaches — more and better sustainability options, law for sustainability, visionary …

Many studies have documented the growing fragility of a majority of the globe's ecosystems. Policymakers and resource managers often frame such ecosystem challenges as primarily about protecting natural systems in rural areas. However, that conception misses a key part of the story: the rapid growth of urbanizing areas. Home to more than 50 percent of the world's human population for the first time in modern history, urbanizing regions concentrate pressure on ecosystem services, which are necessary to sustain healthy urban living conditions and vibrant commerce. This dramatic urbanization presents both challenges and opportunities for novel ecosystem services management. A transdisciplinary …

This short prelude to Professor James Oldham’s 2nd Annual DeLloyd J Guth Visiting Lecture in Legal History, “Habeas Corpus, Legal History and Guantanamo Bay,” discusses some of ways that the writ of habeas corpus plays an important role in promoting access to justice and protecting basic liberty interests in contemporary Canadian law. The focus will be on developments in the law since the Canadian Charter of Rights and Freedoms was enacted, touching on two important features of a modern doctrine of habeas corpus, namely flexibility and gap-filling, both of which Professor Oldham also develops in his essay.

Globally, there is increasing discussion about corporate social responsibility (CSR). Many large multinational enterprises, particularly in mining and other resource sectors, have voluntarily adopted CSR programs, having concluded that social, economic, and environmental sustainability measures are good for the "bottom line" and fro the communities in which they operate. Companies in Japan have yet to move in that direction, although there are a few notable exceptions. In part, this lack of adaptation to the growing interest in CSR internationally is due to cultural and social norms in Japan that suggest that many aspects of CSR properly belong to the domain …
The Basics Of Species At Risk Legislation In Alberta, Shaun Fluker, Jocelyn Stacey
The Basics Of Species At Risk Legislation In Alberta, Shaun Fluker, Jocelyn Stacey
All Faculty Publications
This article examines Alberta's Wildlife Act and the federal Species at Risk Act (SARA) to assess the legal protection of endangered species in Alberta. Most of the discussion related to provisions contained in SARA, as there is comparatively less to discuss under the Wildlife Act. The fact that legal protection for endangered species in Alberta consists primarily of federal statutory rules is unfortunate, as wildlife and its habitat are by and large property of the provincial Crown, and it is a general principle of constitutional law that the federal government cannot in substance legislate over provincial property under the guise …
Learning From Bilingual Family Literacies, Luz A. Murillo
Learning From Bilingual Family Literacies, Luz A. Murillo
Teaching and Learning Faculty Publications
This ethnographic study explores the literacies of bilingual families living in the Rio Grande Valley on the U.S.—Mexico border. Murillo argues that immigrant families living on the border play an important role in their children’s literacy development, but that their voices are seldom heard in schools due to powerful and persistent deficit views of Spanish and Spanish-speaking families. To counter these views, Murillo describes the literacy practices that bilingual families engage in on a daily basis, and reports bilingual parents’ views about literacy in Spanish and English. To encourage and guide language arts educators who wish to use bilingual family …

An alarming number of women are in abusive relationships where violence and threats of violence pervade their lives. This article examines the offence of uttering threats in the Canadian Criminal Code, using the Manitoba Court of Appeal decision in R v O’Brien as a backdrop. We make two arguments. First, we argue that, in intimate relationships, threats of death and bodily harm are a form of domestic violence, often used by men in concert with physical violence and other forms of intimidation to control and dominate women. The Canadian criminal justice response to charges of uttering threats in intimate partner …

Two provincial Courts of Appeal have recently released unanimous decisions that clarify the law regarding the obligation imposed upon people living with HIV to disclose their HIV status prior to sexual relations. The decision of the Manitoba Court of Appeal in R v. Mabior and of the Quebec Court of Appeal in R c. D.C. must be seen against a background of increasing criminal prosecutions in Canada of people with HIV who allegedly do not disclose their HIV status to sexual partners. Since the first HIV nondisclosure prosecution in 1989, there have been over 120 prosecutions. A high proportion of …

The Normal Ones Take Time': Civil Commitment And Sexual Assault In R. V. Alsadi, Isabel Grant

This comment addresses the issue of whether a woman who is civilly committed in a psychiatric facility can ever give a valid consent to sexual activity with someone employed by that facility to ensure her safety and protection. The paper argues that such a consent would be involuntary and invalid because it was obtained as a result of an abuse of a position of trust. It is argued that the imbalance of power between a civilly committed psychiatric patient and, in Alsadi, a security guard employed by the hospital is so significant that no meaningful or voluntary consent can be …

In 1979. China introduced the legislation of the One-Child Policy to be implemented as a temporary means of curbing such high population growth. Over thirty years have passed since its implementation. and this family planning policy still continues to be controversial. Much of academia has focused on the problems stemmingfrom this policy. such as increased abortions. the underreporting of live births. infants abandoned and/or left at orphanages. female infanticide and an imbalanced ratio of males to females among the Chinese population. Not much scholarship has focused on the benefits of China 's One-Child Policy. especially for women. Since this policy …
The Obama Administration’S Decision To Defend Constitutional Equality Rather Than The Defense Of Marriage Act, Dawn E. Johnsen
The Obama Administration’S Decision To Defend Constitutional Equality Rather Than The Defense Of Marriage Act, Dawn E. Johnsen
Articles by Maurer Faculty
When President Barack Obama announced his view that the Defense of Marriage Act1 (DOMA) violated the Fifth Amendment’s guarantee of equal protection,2 he joined a storied line of Presidents who have acted upon their own constitutional determinations in the absence of, and on rare occasion contrary to, those of the U.S. Supreme Court. How best to proceed in the face of a federal statute the President considers unconstitutional can involve complex judgments, as was true of the difficult decision to enforce but not defend DOMA. Ordinarily the Department of Justice should adhere to its tradition of defending statutes against constitutional …

Background: Despite overwhelming evidence that major depression is highly heritable, recent studies have localized only a single depression-related locus reaching genome-wide significance and have yet to identify a causal gene. Focusing on family-based studies of quantitative intermediate phenotypes or endophenotypes, in tandem with studies of unrelated individuals using categorical diagnoses, should improve the likelihood of identifying major depression genes. However, there is currently no empirically derived statistically rigorous method for selecting optimal endophentypes for mental illnesses. Here, we describe the endophenotype ranking value, a new objective index of the genetic utility of endophenotypes for any heritable illness.
Methods: Applying endophenotype …
Reconfiguring Sex, Gender, And The Law Of Marriage, Deborah Widiss
Reconfiguring Sex, Gender, And The Law Of Marriage, Deborah Widiss
Articles by Maurer Faculty
This article brings together legal, historical, and social science research to analyze how couples allocate income-producing and domestic responsibilities. It develops a framework—what I call the marriage equation—that shows how sex-based classifications, (non-sex-specific) substantive marriage law, and gender norms interrelate to shape these choices. Constitutional decisions in the 1970s ended legal distinctions between the duties of husbands and wives but left largely in place both gender norms and substantive rights within marriage, tax, and benefits law that encourage specialization into breadwinning and caregiving roles. By permitting disaggregation of the marriage equation, the new reality of same-sex marriage can serve as …

Multiple Perspectives On Academic Service-Learning Partnerships At The American University In Cairo: A Mixed Method Study, Neivin Mahmoud Marzouk Shalabi
Electronic Theses and Dissertations
This mixed method study aimed to redress the gap in the literature on academic service-learning partnerships, especially in Eastern settings. It utilized Enos and Morton's (2003) theoretical framework to explore these partnerships at the American University in Cairo (AUC). Seventy-nine community partners, administrators, faculty members, and students from a diverse range of age, citizenship, racial, educational, and professional backgrounds participated in the study. Qualitative interviews were conducted with members of these four groups, and a survey with both close-ended and open-ended questions administered to students yielded 61 responses. Qualitative analyses revealed that the primary motivators for partners' engagement in service-learning …

Between A.D. 650 and 950, there was a near total reorganization of society in the northern Southwest. In some areas, intensive agriculture, high population growth rates, and large villages appeared. In others, diverse mixes of subsistence strategies enabled the creation of aggregated communities and semi-sedentary settlements within the same landscape. A third pattern of high mobility and seasonal use of smaller settlements defined much of the periphery. In many areas, people pursuing more than one of these patterns resided simultaneously. We propose that the patterns established by A.D. 800 were integral in the shaping of later Pueblo history.

Association Between C-Reactive Protein And Cognitive Deficits In Elderly Men And Women: A Meta-Analysis, Bruce L. Brown, Dawson W. Hedges, Thomas J. Farrer

Abstract
Background: Certain risk factors for cognitive decline appear modifiable. A potentially modifiable marker of inflammation, C-reactive protein may be associated with cognitive deficits, although not all studies have found a relationship between C-reactive protein and cognitive ability. Further, few research papers have examined whether gender may affect any association between C-reactive protein and cognitive deficit.
Methods: To better understand the association between C-reactive protein, cognitive deficit, and gender in elderly people, we meta-analyzed cross-sectional studies that reported cognitive ability assessed by the Mini-Mental State Examination or an equivalent measure, C-reactive protein concentrations, and gender.
Results: While we identified no …

Global Representation In Psychiatric Research, Bruce L. Brown, Michael Zhang, Dawson W. Hedges
Faculty Publications
To monitor global representation in the psychiatric literature, we compared publication rates in the ten psychiatric journals with the highest impact factors in 1998 and 2008 by world regions. In both 1998 and 2008, North America, Northern Europe, Western Europe and Oceania produced the majority of psychiatric research papers published in these journals, despite representing only a small fraction of the world’s population. This suggests that much of the world’s population continues to be underrepresented in highly influential psychiatric journals.

Alcohol misuse increases risk of suicidal behavior in older adults. TheDepressive Symptom Inventory-Suicidality Subscale (DSI-SS; Metalsky & Joiner,1997) and its relation to suicide attempt history was examined to see if it differedfor older adults as a function of their alcohol use. Structural equation modelingwas used in a sample (N= 1,061) of older adult outpatients to examine the scale’smeasurement invariance and population heterogeneity and its relation to suicideattempt history. Analyses supported the equivalence of the DSI-SS in risky andnonrisky drinkers. The DSI-SS significantly predicted past suicide attempts. Find-ings support the viability of the DSI-SS as suicide screening tool for older adults.
