Bridging The Great Divide: A Response To Linda Greenhouse And Reva B. Siegel's Before (And After) Roe V. Wade: New Questions About Backlash, Lolita Buckner Inniss

Faculty Journal Articles and Book Chapters

This essay discusses the history of Roe v. Wade as recently addressed by Linda Greenhouse and Reva B. Siegel. Going beyond their assertions, I suggest that an additional, more encompassing inquiry focuses on what factors are implicated in the politics of abortion and how these factors relate to larger social, political, and cultural conflicts both before and after Roe. By naming party politics and the Catholic Church, Greenhouse and Siegel posit two crucial elements that shaped the abortion debate. I assert, however, that what is not discussed in their Article is the way numerous other factors have figured into the …

Introductory Note To The European Court Of Human Rights (Gc): Şahin V. Turkey, Chris Jenks Jan 2012

Introductory Note To The European Court Of Human Rights (Gc): Şahin V. Turkey, Chris Jenks

Faculty Journal Articles and Book Chapters

This note introduces a Grand Chamber of the European Court of Human Rights decision which considered whether disparate outcomes from different court systems of the same state evaluating the same set of facts constituted a violation of the European Convention’s right to a fair hearing. While discussion of micro level Turkish procedural issues is required, the Şahin case also provides broader, macro lessons on the legitimacy of military court decisions.

Good News In A Bad Economy: Service Acquiesces On Pro-Taxpayer Application Of Passive Activity Loss Rules To Limited Liability Companies, Orly Mazur Jan 2012

Good News In A Bad Economy: Service Acquiesces On Pro-Taxpayer Application Of Passive Activity Loss Rules To Limited Liability Companies, Orly Mazur

Faculty Journal Articles and Book Chapters

After nearly two decades with no guidance addressing the correct characterization of a limited liability company’s activities under the passive activity loss rules, investors are finally receiving the answer they have patiently sought. Several courts, the Service’s acquiescence and newly issued proposed regulations have recently clarified that ownership interests in limited liability companies are not all treated as presumptively passive limited partnership interests. Instead, the more lenient general passive activity loss rules set forth in the temporary regulations are used to determine the active or passive nature of many activities. These decisions have been accurately hailed as a significant taxpayer …

Defense Of Marriage Act, Will You Please Go Now!, Joanna L. Grossman

Faculty Journal Articles and Book Chapters

The time has come.

The time has come.

The time is now.

Just go.

Go.

GO!

I don’t care how.

You can go by foot.

You can go by cow.

Marvin K. Mooney, will you please go now!

These are the opening lines of Marvin K. Mooney Will You Please Go Now!, a Dr. Seuss book that my three sons and I have read literally hundreds of times. It has all the usual appeal of a Dr. Seuss book -- euphonious rhymes, made-up words and objects, fantastical creatures. But it has something else, too. An air of mystery. The …

From Representation To Research And Back Again: Reflections On Developing An Empirical Project, Mary B. Spector Jan 2012

From Representation To Research And Back Again: Reflections On Developing An Empirical Project, Mary B. Spector

Faculty Journal Articles and Book Chapters

This article presents the story of Doreen, a client represented by the SMU Civil Clinic in a suit against her to collect a consumer debt. My goal in sharing Doreen's story here is two-fold. First, it is to provide an example of how our work with students and our clients can shift from representation to research to advocacy and back again. My second goal is to encourage others-students, clinic supervisors, fellows and faculty-to consider the work they do and its potential to improve the quality of justice in communities, to enhance the delivery of legal services, and to promote economic …

Exporting Waste: Regulation Of The Export Of Hazardous Wastes From The United States, Jeffrey M. Gaba Jan 2012

Exporting Waste: Regulation Of The Export Of Hazardous Wastes From The United States, Jeffrey M. Gaba

Faculty Journal Articles and Book Chapters

The international trade in hazardous wastes has been a subject of controversy for decades. Notorious examples of hazardous wastes being improperly disposed of in Africa have created concern about the legitimacy of developed western countries “dumping” the hazardous byproducts of their industrial development on less-developed countries.

This article examines the legal bases for EPA’s regulation of the exports of hazardous waste under the Resource Conservation and Recovery Act. It contains a detailed examination of EPA’s complex sets of export regulations and provides data on the actual scope of exports reported to EPA. It examines a series of questions regarding EPA’s …

The Influence Of Seawater And Sulfate Reduction On Phosphate Release From Tidal Wetland Soils In The St. John’S River, Florida, Asher Williams Jan 2012

The Influence Of Seawater And Sulfate Reduction On Phosphate Release From Tidal Wetland Soils In The St. John’S River, Florida, Asher Williams

UNF Graduate Theses and Dissertations

Climate change and increasing sea level elevation are predicted to increase salinity in estuarine tidal wetlands in the Southeastern United States. Since much of the ecosystem function in these areas is predicated upon salinity regimes, many fundamental changes are likely to occur as a result. The influence of salinity and SO4 2- reduction on PO4 3- release from tidal wetland soils was evaluated along a salinity gradient at three sites in The St. John’s River, Florida using both field and laboratorybased methods. Porewater was sampled over the course of 10 months to determine ambient levels of SO4 2- and PO4 …

Implementation Of A Beta Blocker Protocol, Jody L. Heriot Jan 2012

Implementation Of A Beta Blocker Protocol, Jody L. Heriot

UNF Graduate Theses and Dissertations

Background: Beta blockers are recommended by the American College of Cardiology/American Heart Association Guidelines for high and intermediate-risk cardiac patients undergoing non-cardiac surgery. Beta blockers are a class of drugs that moderate the effects of increased catecholamine levels on the heart by selectively blocking beta receptors in the heart and blood vessels, resulting in a lower heart rate and blood pressure. Beta blocker use perioperatively has been shown to reduce the risk of ischemia and infarction.

Purpose: The purpose of this project is to address beta blocker use in a group of anesthesia providers who routinely attend to high-risk and …

Nutrient Transport By Shrimp Hepatopancreas, Tamla A. Simmons Jan 2012

Nutrient Transport By Shrimp Hepatopancreas, Tamla A. Simmons

UNF Graduate Theses and Dissertations

Purified brush border membrane vesicles (BBMV) were isolated to characterize primary cellular transport mechanisms for white shrimp. The ultimate goal is to determine the effective components of a shrimp’s diet, thereby enhancing growth, as well as nutrient content. Juvenile shrimp are dependent on plant material as a food source. Potassium is a key component of plants, thus it may play a role in nutrient transport. In addition, divalent metals have been shown to act as co-transporters in several other organisms, thus they may serve as a transport mechanism for shrimp.

Fresh, live, white or brown shrimp were obtained, and from …

Social Connectedness And The Impact On Chronic Illness, Tara L. Hatchcock Jan 2012

Social Connectedness And The Impact On Chronic Illness, Tara L. Hatchcock

UNF Graduate Theses and Dissertations

Having a chronic illness may feel alienating, yet examination of the literature shows limited research on social connectedness and health. In order to contribute to the understanding of this impact of illness, I examined perceived levels of social connectedness in persons with chronic diseases (CD), functional somatic syndromes (FSS) and medically unexplained symptoms (MUS). A major focus of this study was to investigate the association of social connectedness with depression, anxiety, and general health in patients with ongoing symptoms of illness. Data collection was obtained through the use of four online surveys collectively known as VOICE (Verification of Coping, Illness …

Psychometric Re-Evaluation Of The Spiritual Support Scale, Angela M. Bowman Jan 2012

Psychometric Re-Evaluation Of The Spiritual Support Scale, Angela M. Bowman

LSU Master's Theses

Informal caregivers provide a substantial amount of emotional, financial, physical, and social support to their loved ones with Alzheimer’s disease. Alzheimer’s caregivers often report immense levels of burden, which are associated with the demands of their caregiving duties. Caregivers mediate this burden through various means of coping, including spiritual support. Individuals who successfully manage the negative stressors related to Alzheimer’s caregiving are often highly resilient. The purpose of this study was to re-evaluate the psychometric properties of the Spiritual Support Scale among a sample of Alzheimer’s caregivers. The Spiritual Support Scale was initially utilized to measure spiritual coping among a …

Climate Policy Outcomes In Germany: Environmental Performance And Environmental Damage In Eleven Policy Areas, Roger Karapin Jan 2012

Climate Policy Outcomes In Germany: Environmental Performance And Environmental Damage In Eleven Policy Areas, Roger Karapin

Publications and Research

Germany has reduced its emissions of greenhouse gases more than almost any other industrialized democracy and is exceeding its ambitious Kyoto commitment of a 21% reduction since 1990. Hence, it is commonly portrayed as a climate-policy success story, but the situation is much more complex. Generalizing Germany's per-capita emissions to all countries or its emissions reductions to all industrialized democracies would still very likely produce more than a two-degree rise in global temperature. Moreover, analyzing the German country-case into eleven subcases shows that it is a mixture of relative successes and failures.

This illustrates several major problems with the literature …

Pilot-Scale Evaluation Of Advanced Solvents For Co2 Capture From Coal-Fired Utilities, Brandon Michael Pavlish Jan 2012

Pilot-Scale Evaluation Of Advanced Solvents For Co2 Capture From Coal-Fired Utilities, Brandon Michael Pavlish

Theses and Dissertations

In 1992, international concern about climate change (a change to Earth's climate, especially those produced by global warming) led to the United Nations Framework Convention on Climate Change (UNFCCC). The ultimate objective of that convention was the "stabilization of greenhouse gas concentrations in the atmosphere at a level that mitigates anthropogenic interference with the climate system" (1). There has been a growing concern about global climate change which scientists believe is (arguably) caused mainly by anthropogenic emission of greenhouse gases (GHGs) into the atmosphere. The overall goal of this work was to evaluate next generation solvents at a pilot scale …

Neuroglial Mechanisms Involved In The Anti-Inflammatory Effect Of Acetate Supplementation, Mahmoud Lotfy Soliman Jan 2012

Neuroglial Mechanisms Involved In The Anti-Inflammatory Effect Of Acetate Supplementation, Mahmoud Lotfy Soliman

Theses and Dissertations

Acetate supplementation increases brain acetyl-CoA and attenuates lipopolysaccharide (LPS)-induced neuroinflammation in vivo. To explain the anti-inflammatory effect of acetate treatment, we proposed that acetate treatment disrupts inflammatory signaling in microglia and astrocytes, and induces histone hyperacetylation known to be correlated with anti-inflammatory properties. To test this hypothesis, we measured the effects that LPS and acetate treatment had on histone acetylation, mitogen-activated protein kinase (MAPK), nuclear factor-kappa B (NF-κB), and eicosanoid signaling. A single oral dose of acetate treatment (6 g/kg) in normal animals induced a time- and site-specific pattern of histone hyperacetylation, associated with reduction of histone deacetylase (HDAC) activity …

The Effects Of Static Stretching Warm-Up Versus Dynamic Warm-Up On Sprint Swim Performance, Michael Patrick Moran Jan 2012

The Effects Of Static Stretching Warm-Up Versus Dynamic Warm-Up On Sprint Swim Performance, Michael Patrick Moran

Theses and Dissertations

Recent research has revealed that static stretching (SS) warm-ups may attenuate power performance compared to other warm-up protocols, but most studies have focused on dry land modalities. PURPOSE: To examine the effects of an SS warm-up versus a dynamic warm-up (DW) on sprint performance in competitive swimmers. Specifically, it was hypothesized that SS prior to a 50-meter sprint would attenuate results compared to DW. METHOD: Sixteen NCAA Division 1 swimmers (5 female, 11 male) participated. These swimmers had recently completed their collegiate season. In a randomized order crossover design, the participants swam a 50-meter freestyle sprint after two different warm-up …

A Geographic Study Of The Laotian Hydropower Sector, Patrick Neal Bright

Theses and Dissertations

The country of Laos is a developing nation that is geographically endowed with significant hydropower assets. Hydropower represents one of very few quick and profitable, exportable resources for Laos as a least developed country, and is seen as the avenue of escape from poverty for the nation. In the past two decades, Laos has seen both booms and busts in hydropower development, which has raised questions to hydropower's actual contributions to economic growth, and the consequences of large scale hydropower development.

This research examines trends and patterns in Laotian hydropower development in the past two decades. The study analyzes contributing …

Intimate Partner Violence: Implications For Northern Plains And Upper Midwest American Indian Mother-Daughter Dyads' Attachment Relationships, Julii Monette Green

Theses and Dissertations

An established body of research focused on family violence captures the experiences of women impacted by intimate partner violence (IPV), the implications for child witnesses of IPV, and the predictive risk factors of violence toward women. In an attempt to understand the unique experiences of American Indian women and children this study examined the intersection of American Indian identity, attachment relationships, and traumatic experiences to comprehend the short and long-term impact of IPV.

The current research study included 30 American Indian mother-daughter dyads who had a history of IPV. The findings suggested that participants' substance use during IPV episodes was …

Emerging Adults In College: Assessing Expectations And Perceptions, Diane J. Wolter Jan 2012

Emerging Adults In College: Assessing Expectations And Perceptions, Diane J. Wolter

Theses and Dissertations

This study uses qualitative methods to investigate the expectations and perceptions of freshmen at a regional university. Research suggests that stratification in American higher education has resulted in differing student populations at different types of institutions, and that regional universities and their students are underrepresented in the literature. The study examines the utility of Arnett's emerging adults model to describe how freshmen at a regional university perceive the role of college in their lives. Application of metaphor theory reveals that students view college as either a commodity to be exchanged for a desired future outcome, or as one of a …

This study tested an intervention based upon motivational signage placed in the stairwells of a University administrative building, as well as daily emails sent to the employees in the building. Key concepts from Self-Determination Theory (SDT) and a sub-theory of SDT, Organismic Integration Theory (OIT) were integrated into the messages of the posters …

Narratives Of Nigerian Educated Women Pursuing Higher Education Degrees In Western Universities, Vincent Hassan Bulus Jan 2012

Narratives Of Nigerian Educated Women Pursuing Higher Education Degrees In Western Universities, Vincent Hassan Bulus

Theses and Dissertations

The impetus for conducting this research is near and dear to my heart along with desiring to make a change for the better. In conducting interviews of Nigerian women's experiences, struggles and accessibility to secondary education, the research shows significant barriers to secondary education in their narrative experiences that their male counterparts do not experience. Specifically, the experiences of these selected Nigerian women who have shared their aspirations, goals and accomplishments through narrative form can be generalized to the women of Nigeria as a whole. The cultural background is an overwhelming obstacle which, although seems to be slowly eroding, the …

New Media And Ethno-Politics In The Guinean Diaspora, Mohamed S. Camara Jan 2012

New Media And Ethno-Politics In The Guinean Diaspora, Mohamed S. Camara

Security Studies & International Affairs - Daytona Beach

This paper discusses the resurgence of ethno-politics in Guinea in conjunction with the reintroduction of multiparty politics after three decades of single-party and military rule, and the trend’s multilayered repercussion into the Guinean Diaspora of North America. It further examines the principal ways in which ethno-regionalist organisations populating that Diaspora use and misuse new media outlets (web sites, web radio stations, and blogs) in order to promote the political agenda of their respective ethno-political elites. The article scrutinises the deficit of professionalism that characterises the performance of most of those publishing on such web sites and broadcasting on such stations and …
