Beneficiaries Of Misconduct: A Direct Approach To It Theft, Andrew Popper Jan 2012

Beneficiaries Of Misconduct: A Direct Approach To It Theft, Andrew Popper

Scholarly Articles in Law Reviews & Journals

Stolen information technology (IT) is a domestic and global problem. Theft of IT by upstream producers has a pernicious effect on the competitive market and violates fundamental policies designed to protect those who create and invent such assets. Companies profiting from stolen IT are not just free-riding on the successes of those who design and produce the products and ideas that are a driving force in the U.S. economy – they are destabilizing rational pricing and distorting lawful competition by virtue of outright theft. Current legal recourse is insufficient to address such misconduct; new approaches are needed at the state …

Debt And Discipline: Neoliberal Political Economy And The Working Classes, Tayyab Mahmud Jan 2012

Debt And Discipline: Neoliberal Political Economy And The Working Classes, Tayyab Mahmud

Kentucky Law Journal

Over the last three decades, neoliberal restructuring of the economy created a symbiosis of debt and discipline. New legal regimes and strategic use of monetary policy displaced Keynesian welfare, facilitated financialization of the economy, broke the power of organized labor, and expanded debt to sustain aggregate demand. Public laws and policies created afield of possibility within which financial markets extended their reach and brought ever-increasing sections of the working classes and the marginalized within the ambit of the credit economy. Reordered public policies and new norms of personal responsibility demarcated the horizon within which the economically vulnerable pursued strategies of …

Smooth Transitions : Increasing Support For Students With Disabilities And Special Needs To Meet Their Post-Secondary Goals, Traci Lynn Alger Jan 2012

Smooth Transitions : Increasing Support For Students With Disabilities And Special Needs To Meet Their Post-Secondary Goals, Traci Lynn Alger

Capstone Projects and Master's Theses

Transitioning from high school into their adult lives can be tumultuous for students with disabilities and special needs. Graduation causes a loss of some services where necessary adult programs may be inaccessible. Through written survey and personal communication with valid local stakeholders, opinions revealed a need for better connections to local educational resources to help students and their caregivers create realistic post-secondary educational goals. The action of this project is important because there are students with disabilities unable to access services for themselves as they are required to function more independently. Each student has different needs and unique goals, requiring …

Power Lunch : Optimizing Extra-Curricular Reading Groups At Oakside High, Sarah M. Figueroa Jan 2012

Power Lunch : Optimizing Extra-Curricular Reading Groups At Oakside High, Sarah M. Figueroa

Capstone Projects and Master's Theses

There is a major problem when ninth- and tenth-graders are reading at a fifth grade level. It is more than just an indicator of students’ unwillingness to participate in school – it is a reflection of student disengagement; disengagement being more that just typical teenage rebellion. Teenagers become disengaged for a multitude of reason, but a key feature of engagement is close, trusting, caring relationships with teachers. Within the context of an extra-curricular reading group which met twice a week during student’s lunchtime, culturally relevant literature was used to create teacher-student relationships and boost overall engagement with scholastic material.

Through The Looking Glass : A Trans Students' Internal And External Exploration Of Csumb Campus Climate, Amanda Mcmillan

Capstone Projects and Master's Theses

With transgender people coming out at younger and younger ages, and transphobia being strongly present in our society, it is important to give these individuals safe and welcoming places to learn. To find out how much of a safe, welcoming, and supportive place California State University, Monterey Bay (CSUMB) is I interviewed several departments on campus and sent out surveys to students as well as documenting my own experience on my campus as a trans person. I used several theorists to analyze my findings and, by the end, I discovered that it was relatively safe compared to what I found …

Danger In Familiarities : Sex Education And Adolescent Sexuality In The Early 20th Century, Sadie Johnson Jan 2012

Danger In Familiarities : Sex Education And Adolescent Sexuality In The Early 20th Century, Sadie Johnson

Capstone Projects and Master's Theses

In this paper I focus on the affects of sex education on adolescent sexuality from 1910 until 1940. Using Bronfenbrenner’s Ecological Model of Human Development, I examine how different levels of society changed sex education and the adolescent experience. I analyze texts, movies, and theories of the early 20th century to find that sex education’s had no specific affect on the adolescent experience from 1910 until 1940.

Positive Emotions And Immune Respose To Influenza In Medically Stable Older Adults, Maryann J. Gierloff Jan 2012

Positive Emotions And Immune Respose To Influenza In Medically Stable Older Adults, Maryann J. Gierloff

Dissertations

Influenza results in substantial human suffering and health care costs. Evidence from psychoneuroimmunology suggests that emotions influence the immune system and may alter susceptibility to infectious diseases, like influenza. The purpose of this investigation was to evaluate the influence of psychological factors, health behaviors, circulating levels of proinflammatory cytokines and the development of influenza-like illness in older adults. Medically stable participants, 55 years of age and over, were enrolled from the general community and an elderly community. Psychological factors (emotions and perceived stress), health behaviors (sleep and physical activity) and plasma cytokine levels (IL-6 and IL-1B) were evaluated with respect …

The Locus Of Preparation And Privilege: College Choice And Social Reproduction, Daniel Allen Jan 2012

The Locus Of Preparation And Privilege: College Choice And Social Reproduction, Daniel Allen

Dissertations

Despite the ostensible proposition of American higher education to create a level playing field and advance an individual's life opportunities, the history of access to higher education in the United States has demonstrated a lack of equality in enrollment patterns. This enrollment inequality appears most pronounced when considering family income and socioeconomic status. These differences are particularly notable when considering enrollment patterns of students who are academically qualified to succeed at a highly selective college or university, but who come from low income families. Such variations in enrollment at highly selective colleges and universities aligned with family income and not …

Nietzsche's Theory Of Cognition: An Interpretation And Defense Of Perspectivism, Justin R. Marquis Jan 2012

Nietzsche's Theory Of Cognition: An Interpretation And Defense Of Perspectivism, Justin R. Marquis

Dissertations

Friedrich Nietzsche has long been recognized as a pivotal thinker in the history of moral philosophy, but until the last quarter century his importance for our understanding of the concepts of truth and knowledge had been largely ignored in English-language scholarship. In my dissertation, I add to the growing discussion on Nietzsche's theory of human cognition. While more attention has recently been given to this dimension of Nietzsche's thought, several key aspects have been largely ignored or insufficiently treated including the effects that the ethical or evaluative domain have on the way we cognize the world, the role that radical …

Permanence And Stability Of Placement : An Assessment Of The Effectiveness Of Foster And Adoptive Parent Training, Alexis Boerlage

Capstone Projects and Master's Theses

Achieving permanence and stability, both emotionally and physically, is a major goal for most people. This goal begins to surface early in life within the family setting. Unfortunately, children who have been subjected to abuse and/or neglect at the hands of their caregivers may face the grave consequence of lack of permanency and instability within their family systems. This grave consequence is one that can have a negative effect on a person’s future. In order to prevent this from occurring, the Monterey County Department of Social and Employment Services (DSES), Family and Children Services works to provide children, who have …

Stamp Out Stigma : Putting A Face To Mental Illness : Increasing Mental Health Knowledge For Local High School Students, Danielle Pacheco Jan 2012

Stamp Out Stigma : Putting A Face To Mental Illness : Increasing Mental Health Knowledge For Local High School Students, Danielle Pacheco

Capstone Projects and Master's Theses

Adolescence is a critical time for mental, social, and emotional development. Untreated mental health problems among adolescents often result in negative outcomes. Mental illness can decrease an individual’s ability to function in the community, with consequences such as suicide, delinquency, truancy, and substance abuse. Adolescents face these determinate costs when they do not receive treatment; consequently, they may increase as the problem of untreated illnesses expands. The lack of resources, deficiency of mental health education, and fear of stigma discourages individuals and their families from seeking the help they need. The Stamp Out Stigma workshop provides information and education about …
