Computational Fluid Dynamics (Cfd) Modeling Of Mixed Convection Flows In Building Enclosures, Alexander Kayne Jan 2012

Computational Fluid Dynamics (Cfd) Modeling Of Mixed Convection Flows In Building Enclosures, Alexander Kayne

All Theses and Dissertations (ETDs)

In recent years Computational Fluid Dynamics: CFD) simulations are increasingly used to model the air circulation and temperature environment inside the rooms of residential and office buildings to gain insight into the relative energy consumptions of various HVAC systems for cooling/heating for climate control and thermal comfort. This requires accurate simulation of turbulent flow and heat transfer for various types of ventilation systems using the Reynolds-Averaged Navier-Stokes: RANS) equations of fluid dynamics. Large Eddy Simulation: LES) or Direct Numerical Simulation: DNS) of Navier-Stokes equations is computationally intensive and expensive for simulations of this kind. As a result, vast majority of …

Paved With Good Intentions: The Fate Of Strict Liability Under The Migratory Bird Treaty Act, Kalyani Robbins Jan 2012

Paved With Good Intentions: The Fate Of Strict Liability Under The Migratory Bird Treaty Act, Kalyani Robbins

Akron Law Faculty Publications

The Migratory Bird Treaty Act (MBTA) contains a very broad ban on harming migratory birds, as well as a strict liability standard for misdemeanor violations. Without further limitation, the MBTA would theoretically apply to countless ordinary life activities, such as driving a car or having windows on one’s home. Naturally, there are due process concerns with such a scenario, so Congress expressly left it to the Department of the Interior to draft more detailed implementing regulations. Unfortunately, the existing regulations fail to adequately address the potential overbreadth of the MBTA’s misdemeanor application, forcing the courts to do so on an …

Defining The Intangible Skillset Of Advanced Practice Nurses: A Psychophenonemological Study Of Aprnand Graduate Nursing Student Narratives, Kathryn Perticone

Yale School of Nursing Digital Theses

The purpose of this pilot qualitative study was to generate a definition of advanced practice nurses that delineates their intangible skillset. The definition was derived from narratives of eleven experienced advanced practice nurses and 18 graduate nursing students who responded to individualized questionnaires. Results were analyzed using van Kaam's, 12-step psychophenomenological method. Four necessary and essential qualities of the intangible skillset of advanced practice nurses were identified as: Development of a patient-centered relationship; provision of care that is holistic and promotes health and wellness; use of practical critical thinking and judgment; and, engagement in "tri-lingual communication" or the ability to …

Aesthetization, Artification, And Aquariums, Thomas Leddy Jan 2012

Aesthetization, Artification, And Aquariums, Thomas Leddy

Contemporary Aesthetics (Journal Archive)

‘Artification’ is a term recently coined and developed in Finnish aesthetic theory and proposed by Ossi Naukkarinen in this volume as the process of treating non-art objects as art. In this paper, I distinguish between a superficial sort of artification and a deep sort. The superficial sort is the one we need to worry about. In Part I, I consider various issues surrounding the definition of artification. In the process, I situate artification within the larger question of aestheticization. I understand aestheticization in terms of recent psychological work on supernormal stimuli and Virginia Postrel’s defense of style and surface in …

Pending On Art, Pauline Von Bonsdorff Jan 2012

Pending On Art, Pauline Von Bonsdorff

Contemporary Aesthetics (Journal Archive)

Artification is mostly approached from a contextualist perspective where “art” refers to objects that are presented and appreciated within socially recognized art institutions. Artification then means that the notion of art is extended to non-art areas. Yet it can be argued that contextualism is circular, since it starts with an unquestioned assumption about what art is. Another weakness of contextualism is that by privileging theory it tends to downplay the role of creative and appreciative practices. Alternative approaches are possible, and this article explores in a preliminary way what a naturalist approach could mean for how we see art and …

When Is Artification?, Roberta Shapiro, Nathalie Heinich Jan 2012

When Is Artification?, Roberta Shapiro, Nathalie Heinich

Contemporary Aesthetics (Journal Archive)

How do people do or make things that come to be seen as works of art? In other words, when is there artification? The answer to this question is simultaneously symbolic, material, and contextual. It has to do with meanings, objects, interaction, and institutions. We seek to define not what art is nor how it should be considered, but how and under what circumstances it comes about by way of methodical observation and inquiry in a variety of fields. Circus acrobats, break-dancers, fashion designers, chefs, graffiti artists, printers, photographers, and jazz musicians are some of the examples we explore. This …

Artification Of Sport: The Case Of Distance Running, Matti Tainio Jan 2012

Artification Of Sport: The Case Of Distance Running, Matti Tainio

Contemporary Aesthetics (Journal Archive)

This article deals with the possibilities of artification in sport, using distance running as an example. Sport is viewed as one phenomenon in the history of physical cultures, with both predecessors and also the possibility of developing into something new. Sport was first defined primarily as a competitive activity but, by the end of the twentieth century, it had developed as part of the athletic trend towards exploring experience-seeking fitness sports. Through the developments of contemporary visual art, sport has also become a possible medium of art. These developments, both in sport and art, provide an opportunity to look for …

Grant was an underage Union soldier in the Civil War who participated in the capture of New Orleans and whose service was recognized by the U.S. Congress. At a time when less than one percent of the people in the nation had a college degree, he graduated from Western Reserve College (then in …

Arbitrability And Vulnerability, Carolyn L. Dessin Jan 2012

Arbitrability And Vulnerability, Carolyn L. Dessin

Akron Law Faculty Publications

Arbitration is cool. Everybody‟s doing it. In the eighty-five years since the passage of the Federal Arbitration Act, that seems to be the prevailing sentiment. Recent decades have seen the meteoric rise of arbitration as a form of alternative dispute resolution. Arbitration is widely regarded as a less expensive, more expeditious alternative to litigation.

Courts frequently note that federal policy clearly favors arbitration. No judicial enthusiasm for arbitration seems more complete than that evidenced in the jurisprudence of the United States Supreme Court.

Along with the rise of arbitration, however, there has also been a rise in the amount of …

Switching To Prophylactic Injunctions, Tracy A. Thomas Jan 2012

Switching To Prophylactic Injunctions, Tracy A. Thomas

Akron Law Faculty Publications

This essay highlights the significance of John Golden’s work on patents to the field of Remedies more generally. In his important new article, Injunctions as More (or Less) Than ‘Off Switches’: Patent-Infringement Injunctions’ Scope (Texas Law Review), Golden proves my thesis: prophylactic injunctions are, and should be, common, normal types of equitable relief. His careful and detailed analysis of the type and frequency of injunctions issued in patent infringement cases exposes the myth that prophylaxis is illegitimate. Steeped in details of patent law, Golden’s work nevertheless contributes significantly to the broader transsubstantive questions of the metes and bounds of equitable …

The Growing Acceptance And Legal Recognition Of Same-Sex Marriage In America Constitutes A Victory For Reality-Based Thinking, Wilson Huhn Jan 2012

The Growing Acceptance And Legal Recognition Of Same-Sex Marriage In America Constitutes A Victory For Reality-Based Thinking, Wilson Huhn

Akron Law Faculty Publications

During the 20th century “pragmatism” emerged as the leading American philosophy and policy analysis – also called “legal realism” – became the dominant method of interpreting American law. The lightning speed with which same-sex marriage is gaining acceptance in the United States is due to the fact that Americans embrace realistic rather than ideological forms of thinking, and the growing recognition of same-sex marriage in the law is due to the fact that we interpret our Constitution in accordance with realistic analysis.

Misappropriating Women's History In The Law And Politics Of Abortion, Tracy A. Thomas Jan 2012

Misappropriating Women's History In The Law And Politics Of Abortion, Tracy A. Thomas

Akron Law Faculty Publications

“Without known exception, the early American feminists condemned abortion in the strongest possible terms.” This claim about women’s history has been used by pro-life advocates for twenty years to control the political narrative of abortion. Conservatives, led by the group Feminists for Life, have used feminist icons from history to support their anti-abortion advocacy. Federal anti-abortion legislation has been named after feminist heroines, like the Elizabeth Cady Stanton Pregnancy and Parenting Students Act (co-sponsored by Rick Santorum) and the Susan B. Anthony and Frederick Douglass Act of 2011. Amicus briefs to the U.S. Supreme Court quote women’s rights leaders in …

U.S. Trafficking Policy And The J-1 Visa Program : The State Department's Challenge From Within, Patricia Medige, Catherine G Bowman

Intercultural Human Rights Law Review

This article will review two key J-1 categories of the Exchange Visitor Program-the Au Pair and Summer Work Travel (SWT) programs-and compare the legal protections afforded by them to those provided under the H-2A and H-2B visas, two temporary worker visa programs regulated by the U.S. Department of Labor (USDOL).7 The article will then discuss the J-1 program within the context of the U.S. Trafficking Victims Protection Act (TVPA),8 a federal law passed in 2000, which significantly altered the legal definitions and penalties associated with human trafficking and conferred additional responsibilities to the State Department to coordinate anti-trafficking efforts. Equality, Procedural Justice, And The World Trade Organization, Adam S. Chilton, Ryan W. Davis Jan 2012

Equality, Procedural Justice, And The World Trade Organization, Adam S. Chilton, Ryan W. Davis

Intercultural Human Rights Law Review

First, in Part II we describe equality as a norm of distributive justice within domestic political contexts. We consider and reject the possibility of exporting domestic egalitarian principles to international legal institutions. Second, in Part III we assemble materials for a theory of international egalitarian justice. We hold that the variety of international contexts favors a procedural rather than substantive approach. Third, in Part IV we develop a set of procedural egalitarian norms for satisfying justice within the WTO. Finally, in Part V we consider three policy level reforms that would help to secure the procedural protections required by justice. …

The Special Care Nursery, Linda Kahn-D’Angelo, Yvette Blanchard, Beth Mcmanus

Physical Therapy Faculty Publications

Providing services to high-risk infants and their families in the neonatal intensive care unit is a complex subspecialty of pediatric physical therapy requiring knowledge and skills beyond the competencies for entry into practice. The newborns in the neonatal intensive care unit (NICU) are among the most fragile patients that physical therapists will treat, and detrimental effects can occur as the result of routine caregiving procedures. Pediatric physical therapists (PTs) need advanced education in areas such as early fetal and infant development; infant neurobehavior; family responses to having a sick newborn; the environment of the NICU, physiologic assessment and monitoring; newborn …

Impact Of A Conflict Resolution/Peer Mediation Program On Middle School Students, Robert W. Carrillo

Abraham S. Fischler College of Education ETD Archive

This applied dissertation was designed to provide current information and research regarding a yearlong conflict resolution peer mediation program offered as a separate course in a middle school. Discipline and safety are major concerns due to the recent incidents of violence, aggression, bullying and even suicides infiltrating our schools. The need for peaceful methods of resolving conflict has become a necessity in order to keep our children safe. This study looked at the coercive nature that schools use to maintain discipline and how students can empower themselves by learning how to resolve conflicts peacefully and without the need of adult …

An Ethnographic Case Study Of Elementary Principal Leadership Strategies And The No Child Left Behind Act, Cassandra J. Poole

Abraham S. Fischler College of Education ETD Archive

Leadership is regarded as the key to comprehensive school improvement efforts and the principal is expected to lead the charge/change. Book knowledge is good, but the difference between effective and less effective principals is not what they know but what they actually do. What do principals do to meet AYP? Young (2004) pointed out that some principals recognize they can gain the edge and survive by learning from other effective practitioners. NCLB and AYP demand change to meet the mandates that will bring about improvement in student achievement. NCLB has changed the educational landscape. Numerous articles and literature exists on …

Effects Of A Counselor-Led Intervention On Student Attendance, Mary Harris Watlington

Abraham S. Fischler College of Education ETD Archive

This applied dissertation investigated the impact of a counselor-led intervention on student attendance. The intervention used in this study applied the guidance-curriculum component from the Gysbers and Henderson (2006) comprehensive guidance and counseling model, which was designed to help students develop and learn the academic, personal, and social skills needed to be successful in kindergarten through Grade 12 and postsecondary education. The 9-week counselor-led intervention was intense and incorporated small-group and large-group sessions, along with individual counseling sessions, which required participants to interact with peers and work in teams.

To evaluate the impact of the counselor-led intervention program, a quasi-experimental …

Pleading As Information-Forcing, Alexander Reinert Jan 2012

Pleading As Information-Forcing, Alexander Reinert

Articles

Academics, judges, and practitioners have devoted much attention to the potential impact of the federal pleading standards announced in Ashcroft v. Iqbal, 556 U.S. 662 (2009), and Bell Atlantic Corp. v. Twombly, 550 U.S. 544 (2007). Many have criticized Iqbal and Twombly on procedural, substantive, and policy grounds. And although most everyone agrees that the cases mark a break with past liberal pleading rules and have changed pleading practice, there is little agreement about precisely how the cases have affected ultimate outcomes. Indeed, there is much confusion about what exactly the new rules require of a pleader.

In this Article, …
