Going Rogue: Stop The Beach Renourishment As An Object Of Morbid Fascination, Mary Doyle, Stephen J. Schnably

Scholarly response to the Supreme Court’s decision in Stop the Beach Renourishment, Inc. v. Florida Department of Environmental Protection has focused on the plurality’s strong advocacy of a judicial takings doctrine. We take a different tack. While the concept of judicial takings is worthy of serious attention, it is wrong to treat the plurality opinion as an ordinary object of analysis. It is, instead, the emanation of a Court going rogue. Three basic symptoms of the pathology stand out. First, sleight of hand: The plurality opinion purports to be about an institutional issue—can a state court commit a taking?—while slipping …

Information posted to the Internet is never truly forgotten. While permanently available data offers significant social benefits, it also carries substantial risks to a data subject if personal information is used out of context or in ways that are harmful to the subject’s reputation. The potential for harm is especially dire when personal information is disclosed without a subject’s consent. In response to these risks, European policymakers have proposed legislation recognizing a “right to be forgotten.” This right would provide persons in European Union countries with a legal mechanism to compel the removal of their personal data from online databases. …

Video games have a history of being exploited for education. However, all too fre- quently, the resulting educational video game is either transparent in its hijacking of video game media, or the educational content is not intelligently placed within the context of the game. In this paper we analyze existing educational video games and observe popular commercial video game mechanics to form a more player oriented development mindset. Our approach involves mingling game mechanics that are not commonly used together to create a genre hybrid educational video game with a seamlessly integrated introductory programming curriculum. Production of nuclear fuels for weapons and electric energy has resulted in groundwater uranium contamination at Department of Energy (DOE) sites. Reduction of uranium by dissimilatory metal-reducing bacteria (DMRB) is an effective approach for in-situ bioremediation of these sites. In this process, an organic electron donor is typically delivered through a well into groundwater in order to promote the biological reduction of soluble and toxic U(VI) to insoluble and less toxic U(IV). A numerical model is presented that defines a sustainability criterion as no net loss of shell, and calculates a sustainable harvest of seed (<75 >mm) and sack or market oysters (≥75 mm). Stock assessments of the Primary State Seed Grounds conducted east of the Mississippi from 2009 to 2011 show a general trend toward decreasing abundance of sack and seed oysters. Retrospective simulations provide estimates of annual sustainable harvests. Comparisons of simulated sustainable harvests with actual harvests show a trend toward unsustainable harvests toward the end of the time series. One of the myriad of issues affecting the administration of the vocational rehabilitation (VR) program by State VR agencies under Title I of the Rehabilitation Act is how to maximize access to and use of all available funding sources to pay for VR services and supports for VR applicants and clients. Assessing The Impacts Of Dams On Nutrient And Sediment Loading In The Kalamazoo River Using The Soil And Water Assessment Tool (Swat), Daniel Henry Serfas

The Soil and Water Assessment Tool (SWAT) was applied to the Kalamazoo River Watershed in order to evaluate the impacts that several dams within a superfund site "Area of Concern" have on the sediment, nutrients, and streamflow of the system. It was hypothesized that the SWAT model could be used to recreate the watershed in hopes of estimating the amounts of nitrogen, phosphorus, and sediment that would result from the removal of the dams. The model would then be used to evaluate dam removal scenarios to come up with a best management practice (BMP).

Rates of suicidal behaviors vary over the lifespan, but little research has focused on developmental aspects of suicidal behaviors and associated risk factors. Previous studies suggest that young people who attempt or die by suicide are likely to be generally impulsive. 108 community-dwelling older adults age 60 and older and 498 undergraduate students ages 18-30 completed the Center for Epidemiological Studies -- Depression Scale, the Barratt Impulsivity Scale, and the Suicidal Behaviors Scale -- Revised. The Influence Of Self-Reported Family Functioning On Depression Symptom Severity And Psychological Well-Being In Treatment-Seeking Older Adults, Patricia M. Bamonti

Among treatment-seeking older adults, positive social ties are related to depression outcomes prospectively. Less is known regarding the role of negative social ties in relation to depression and well-being outcomes among patients in treatment. The current study adds to this literature through the cross-sectional and prospective examination of patients' appraisal of family members perceived criticism in relation to self-reported depressive symptom severity and psychological well-being In addition, potential moderators of these relations were examined, including personality variables (Neuroticism and Conscientiousness), cognitive functioning, and living status. adults 60 years of age and older newly (< 1 month after intake session) receiving treatment for depressive or anxious symptomatology at a university-affiliated outpatient clinic as part of an on-going study that assessed depression and decision-making in late life. Results demonstrated that individuals with increased perceived criticism also had greater depressive symptom severity, at least measured at one point in time. Perceived criticism failed to predict change in depression symptom severity in the prospective analyses. Similarly, perceived criticism was associated with lower psychological well-being in the cross-sectional analyses; however, perceived criticism failed to predict change in psychological well-being in prospective analyses. No significant interactions were found with perceived criticism, suggesting at least in the current study, personality variables, cognitive functioning, and living status did not qualify the relation between perceived criticism and depression symptom severity or change in depression symptom severity over time. EI was not significantly associated with depression symptom severity and psychological well-being cross-sectionally and prospectively, after controlling for perceived criticism and perceived social support from family. Implications, limitations, and future directions are discussed.

Axillary Lymph Node involvement is the most important prognostic factor in the assessment of Estrogen Receptor positive (ER+) breast cancer (BCa) patients. Patients with evidence of metastatic disease in axillary lymph nodes positive (LN+) patients have poorer survival prospects and higher likelihood of metastasis. Standard clinical treatment for LN+ patients includes adjuvant chemotherapy, though not all LN+ patients will benefit from it. Although the absence of axillary lymph node involvement at initial diagnosis typically indicates lower risk, 30% of these LN-, ER+ BCa patients will ultimately die from breast cancer metastasis, even with optimal treatment. This Article surveys cases from the Georgia Supreme Court and the Georgia Court of Appeals from June 1, 2011 through May 31, 2012, during which principles of administrative law were either illuminated or formed an important piece of the decision making. Beef cattle longevity is related to reproductive success, which can be influenced by development system and maternal environment. Three experiments were conducted to determine the impact of development system, maternal protein supplementation, and ovarian steroidogenic environment on beef cattle reproduction. Experiment 1 evaluated the effect of heifer development system on heifer performance and reproduction. Heifers developed on corn residue (CR) had reduced BW from prebreeding through pregnancy diagnosis compared with drylot (DL) developed heifers, but there was no difference in reproductive performance. PURPOSE: The overall aim of this study was to examine the effects of a high-fructose diet on postprandial lipemia and hormones associated with glucose control during periods of altered physical activity. METHODS: Twenty-two recreationally active males and females participated in this randomized, cross-over design study (age: 21.2 ± 0.6 years; BMI: 22.6 ± 0.6 kg/m2). Subjects ingested 75 g of fructose for 14 days during a period of high physical activity (FR+Active) (>12,500 steps/day) and a period of low physical activity (FR+Inactive) (<4500 steps/day). Prior to and following the 2 wk loading period, a fructose-rich meal challenge was administered (45% carbohydrate [25% fructose], 40% fat, and 15% protein). Blood was sampled at baseline and for 6 h after the meal and analyzed for triglycerides (TG), very-low density lipoproteins (VLDL), c-reactive protein (CRP), tumor necrosis factor-a (TNF-a), interleukin-6 (IL-6), glucagon-like peptide 1 (GLP-1), glucose-dependent insulinotropic peptide (GIP), …
