American Natures: The Shape Of Conflict In Environmental Law, Jedediah S. Purdy Jan 2012

American Natures: The Shape Of Conflict In Environmental Law, Jedediah S. Purdy

Faculty Scholarship

There is a firestorm of political and cultural conflict around environmental issues, including, but running well beyond, climate change. Legal scholarship is in a bad position to make sense of this conflict because the field has concentrated on making sound policy recommendations to an idealized lawmaker, neglecting the deeply held and sharply clashing values that drive, or block, environmental lawmaking. This Article sets out a framework for understanding and engaging the clash of values in environmental law and, by extension, approaching the field more generally. Americans have held, and legislated based upon, four distinct ideas about why the natural world …

The Rhetoric Hits The Road: State Resistance To Affordable Care Act Implementation, Elizabeth Weeks Leonard Jan 2012

The Rhetoric Hits The Road: State Resistance To Affordable Care Act Implementation, Elizabeth Weeks Leonard

Scholarly Works

This paper provides an update and reanalysis of my previously published article, Rhetorical Federalism: The Value of State-Based Dissent to Federal Health Reform, 93 Hofstra Law Review 111 (2010). In Rhetorical Federalism, I made an affirmative case for the widespread trend of state resistance to the then-recently enacted Patient Protection and Affordable Care Act of 2010 (ACA). Before and immediately after ACA’s enactment, a significant number of states engaged in various forms of objection to the new federal Act, including but not limited to lawsuits challenging the constitutionality of the individual insurance mandate. My article focused on five targets of …

After The Great Recession: Regulating Financial Services For Low- And Middle-Income Communities, Ronald J. Mann Jan 2012

After The Great Recession: Regulating Financial Services For Low- And Middle-Income Communities, Ronald J. Mann

Faculty Scholarship

This paper, prepared as a speech at Washington and Lee Law School, discusses regulatory strategies for lending to LMI households after the Great Recession. It argues that the CFPB's emphasis on behavioral economics is likely to lead it astray, especially if it relies on assumptions drawn from experience with middle-class behavior to interfere with the choices made by LMI households that face a different set of opportunities than the middle-class households more familiar to regulators. More generally, the paper suggests that most of the financial distress faced by LMI households is a result of broader social and institutional problems, and …

The purpose of this study was to explore primary grade teachers' stages of concern and their implementation of an educational reform initiative called Integrated Thematic Instruction (ITI) in Indonesia. The Indonesian minister of education mandated primary grade teachers to implement ITI in 2006. Using a convenience sampling method, 150 Kanisius primary grade teachers participated in the study. The data collection method used was a questionnaire that consisted of three parts: The Stages of Concern Questionnaire (SoCQ), the Integrated Curriculum Implementation Scale, and demographic questions. The data analysis employed in this research were descriptive, a one way ANOVA test and multiple …

Ethnographic Methods, Kathleen M. Adams Jan 2012

Ethnographic Methods, Kathleen M. Adams

Anthropology: Faculty Publications and Other Works

Although ethnographic methods derive from the discipline of sociocultural anthropology, because of their potential for producing insights into human actions and behaviors they have come to be embraced by sociologists, psychologists, and other social scientists interested in gaining insights into human behavior. Ethnographic methods fall into the broader category of qualitative methodologies and are aimed at nnderstanding cultural practices, human beliefs and behaviors, and sociocultural changes over time. As such, ethnographic methods are particularly apt for tourism-related research and for tourism policy planning, as noted by a number of recent tourism scholars (Cole, 2005; Grabum, 2002; Nash, 2000; Palmer, 2001, …

Development Of Mineral Particle Surfaces For The Adsorption Of Pitch From Wood Processing And Recycling Of Paper, Daniel Gantenbein Jan 2012

Development Of Mineral Particle Surfaces For The Adsorption Of Pitch From Wood Processing And Recycling Of Paper, Daniel Gantenbein

School of Geography, Earth and Environmental Sciences Theses

During the production of paper in paper mills, detrimental wood resin is released into the water circuit of the mill during the pulping process of the wood into fibres. This wood resin, termed pitch, can detrimentally deposit on the paper and on the paper machine equipment. The deposits mark the paper or can lead to a tear of the paper web involving a loss of output and a reduction in paper quality. Furthermore, the wood resinous compounds in paper mill effluents need to be reduced in order to minimise their toxic effects on water organisms. Talc has been the benchmark …

Sustainable Management Of The Historic Environment Resource In Upland Peat: A Study From Exmoor, Heather Joy Davies Jan 2012

Sustainable Management Of The Historic Environment Resource In Upland Peat: A Study From Exmoor, Heather Joy Davies

School of Geography, Earth and Environmental Sciences Theses

UK uplands preserve a rich history of human inhabitation and environmental change through standing monuments, archaeological sites, and within peat deposits. Palaeoenvironmental remains within peat can be used to reconstruct environmental histories throughout the Holocene. Small mires in varied topographic locations can allow detailed local landscape reconstruction, setting archaeological sites in environmental context, or building up a picture of the mosaic of changing landscapes through time. Recent moves towards assessing the ecosystem services provided by different landscapes mean that, to make a case for preserving upland peatlands for the palaeoenvironmental remains they preserve, we must be able to demonstrate their …

Early Mesozoic Stratigraphy, Sedimentology And Structure Of The, Emhemed Alfandi Jan 2012

Early Mesozoic Stratigraphy, Sedimentology And Structure Of The, Emhemed Alfandi

School of Geography, Earth and Environmental Sciences Theses

The Gharian area is used as a case study to examine the sedimentary succession, structural evolution and timing of sedimentary and structural events during basin development in the Early Mesozoic. These sediments (Kurrush, Al Aziza and Abu Shaybah Formations) are examined in order to provide palaeonvironmental and palaeogeographic reconstructions for the study area. The formations are described using facies analysis. The Kurrush is probably deposited in delta plain environment. A complete section (140 m) has been logged and seven facies from the Al Aziza Formation represent a shallow shelf platform area (inner ramp: an intertidal-subtidal carbonate flat to shelf lagoonal …

The Effect Of Sea Level Rise On Radionuclide Mobility At Contaminated Nuclear Sites, Jane Eagling Jan 2012

The Effect Of Sea Level Rise On Radionuclide Mobility At Contaminated Nuclear Sites, Jane Eagling

School of Geography, Earth and Environmental Sciences Theses

Global sea levels are expected to rise as a result of climate change, which will lead to the inundation and erosion of low lying coastal areas and accelerate the intrusion of seawater into sub-surface sediments. Many of the UK’s legacy nuclear facilities are located in close proximity to the shore, raising questions regarding the potential mobilisation of radionuclides during sea level rise. Here batch and column experiments were used to simulate and investigate the effect of these processes on the mobilisation of key radionuclides Tc, 90Sr and U from oxic and reduced sediments under sea level rise scenarios. Strontium-90 was …

Policy Learning And The Development Of Renewable Energy Policy In The United Kingdom, Sally Murrall-Smith Jan 2012

Policy Learning And The Development Of Renewable Energy Policy In The United Kingdom, Sally Murrall-Smith

School of Geography, Earth and Environmental Sciences Theses

Despite the UK’s abundance of renewable energy sources and the imperative for renewable energy to make a significant contribution to addressing the problems of climate change and fossil-fuel dependency, renewable energy capacity in the UK has developed slowly compared with some other EU states. The UK has introduced a succession of policies to promote renewable energy, but so far these have failed to meet national and EU targets. This signals the need for detailed examination of the reasons for these ‘failures’ and, in particular, the extent, nature and constraints on ‘policy learning’ within UK renewable energy policy. Policy learning has …

Extinction And Recovery Dynamics Of Triassic-Jurassic Macro-Invertebrate Communities, Luis Felipe Opazo Mella Jan 2012

Extinction And Recovery Dynamics Of Triassic-Jurassic Macro-Invertebrate Communities, Luis Felipe Opazo Mella

School of Geography, Earth and Environmental Sciences Theses

This work is focused on characterising and evaluating the intensity and selectivity of the marine fauna during the Tr/J mass extinction and recovery of the ecosystem in different localities throughout Pangaea. To address this, four localities were studied: St. Audrie’s Bay, Larne and Pinhay Bay in the UK, and Portezuelo Providencia in Chile. From each locality, samples were taken at approximately 1m intervals throughout the Tr/J sections. Species abundance per sample was estimated and each species was classified according to autoecological information derived from the literature. In order to assess changes in the structure and composition of the assemblages, NMDS …

The Impact Of Future Sea-Level Rise On The London-Penzance Railway Line, David Dawson Jan 2012

The Impact Of Future Sea-Level Rise On The London-Penzance Railway Line, David Dawson

School of Geography, Earth and Environmental Sciences Theses

The coastal section of the London to Penzance railway line (Dawlish-Teignmouth) lies very close to sea level and has been susceptible to frequent closure during high seas and storm events. As the main railway connection for the southwest of England to the rest of Great Britain, it is a vital transport link for the Devon and Cornwall economy. Current understanding of future sea-level rise in the region is compromised by a lack of reliable geological data on which to establish accurate future sea-level projections. Furthermore, the impacts – in engineering and economic terms – of potential sea-level change on the …

Carbon Management And Scenario Planning At The Landscape Scale With Gis, Shabnam Delfan Azari Jan 2012

Carbon Management And Scenario Planning At The Landscape Scale With Gis, Shabnam Delfan Azari

School of Geography, Earth and Environmental Sciences Theses

Carbon Management and Scenario Planning at the Landscape Scale with GIS By: Shabnam Delfan Azari It is now widely believed that globally averaged temperatures will rise significantly over the next 100 years as a result of increasing atmospheric concentrations of greenhouse gases (GHG) such as carbon dioxide. Responses to the threat of future climate change are both adaptations to new climate conditions, and mitigation of the magnitude of change. Mitigation can be achieved both through reducing emissions of greenhouse gases and by increasing storage of carbon in the earth system. In particular it is thought that there is potential for …

The Governance Of Security In The Revanchist City- The Case Of Cape Town, South Africa, Till Frederik Paasche Jan 2012

The Governance Of Security In The Revanchist City- The Case Of Cape Town, South Africa, Till Frederik Paasche

School of Geography, Earth and Environmental Sciences Theses

The governance of security in the revanchist city- The case of Cape Town, South Africa Much has been written on the revanchist city (for example Smith, 1996; MacLeod, 2002; Belina and Helms, 2003) and the reclaiming of space from so-called ‘undesirables‘ through the means of the police. Here, the guiding ideas are policing strategies such as the ‘broken windows syndrome‘ (Kelling and Wilson, 1982) and ‘zero tolerance policing‘ (Giuliani and Bratton, 1994; Beckett and Herbert, 2008; Herbert and Beckett, 2010). However, the role of private security companies in the reclaiming of public space remains under-researched. Using a case study in …

Don't Forget Dad: Addressing Women's Poverty By Rethinking Forced And Outdated Child Support Policies, Daniel L. Hatcher Jan 2012

Don't Forget Dad: Addressing Women's Poverty By Rethinking Forced And Outdated Child Support Policies, Daniel L. Hatcher

All Faculty Scholarship

In the dialogues regarding reducing poverty among women, especially mothers, the inextricably linked issues surrounding low-income men must be simultaneously considered. In social policy addressing women’s poverty, poor fathers have too often been considered primarily as an enemy to be pursued rather than a fellow victim of poverty’s wrath, and potential partner towards the cure. We want someone to blame, and many assume that poor single mothers are best served by always being encouraged — and even forced — to pursue the noncustodial fathers for financial support through adversarial means. Mothers applying for public assistance are forced to sue the …

Epidemiology And Public Health Significance Of Bovine Tuberculosis In Cattle In The Highlands Of Cameroon, Julius Awah Ndukum Jan 2012

Epidemiology And Public Health Significance Of Bovine Tuberculosis In Cattle In The Highlands Of Cameroon, Julius Awah Ndukum

Other Faculty of Science and Engineering Theses

Bovine tuberculosis (TB) is a contagious neglected zoonosis of cattle that is prevalent but under-investigated in Cameroon, hence this study was designed to assess the epidemiology of bovine TB in cattle, risks for M. bovis infection in cattle and humans; and public health implications of zoonotic bovine TB in the highlands of Cameroon. A retrospective study of meat inspection records (1994 – 2010) was done to estimate the prevalence of TB lesions in slaughtered cattle in the North West region. The prevalence of bovine TB and anti-bovine TB antibodies in live cattle based on tuberculin skin tests (2 surveys) and …

Hidden Histories And Multiple Meanings: The Richard Dennett Collection At The Royal Albert Memorial Museum, Exeter., Sara Craig Ayres Jan 2012

Hidden Histories And Multiple Meanings: The Richard Dennett Collection At The Royal Albert Memorial Museum, Exeter., Sara Craig Ayres

Other Faculty of Arts, Humanities and Business Theses

Ethnographic collections in western museums such as the Royal Albert Memorial Museum (RAMM) carry many meanings, but by definition, they represent an intercultural encounter. This history of this encounter is often lost, overlooked, or obscured, and yet it has bearing on how the objects in the collection have been interpreted and understood. This thesis uncovers the hidden history of one particular collection in the RAMM and examines the multiple meanings that have been attributed to the objects in the collection over time. The Richard Dennett Collection was made in Africa in the years when European powers began to colonise the …

Creative Tourism In Saint Petersburg: The State Of The Art, Valery Gordin, Marina Matetskaya Jan 2012

Creative Tourism In Saint Petersburg: The State Of The Art, Valery Gordin, Marina Matetskaya

Journal of Tourism Consumption and Practice

Tourism development in St. Petersburg, which is a major cultural centre, has improved in terms of tourist flows; both tourism demand and tourist products have become more diverse. These improvements give grounds for a fairly optimistic prognosis for the tourist industry in St. Petersburg. At the same time, there are a number of factors which may endanger sustainable development of tourism in St. Petersburg. The current situation calls for a more flexible and innovative approach to industry development. Among these factors are the pronounced seasonal character of tourism, the short-term visits of most of the tourists, and the rather conservative, …

Boosting Potential Creative Tourism Resources: The Case Of Siby (Mali), Lénia Marques Jan 2012

Boosting Potential Creative Tourism Resources: The Case Of Siby (Mali), Lénia Marques

Journal of Tourism Consumption and Practice

This paper further develops the conceptual framework for creative tourism, discussing the co-creation of experiences and the identification of potential resources for creative tourism development. The case of the village of Siby, in Mali, West Africa, illustrates the development of tourism and creativity in a non-western, rural environment, where creative tourism experiences can emerge spontaneously. The impacts of creative tourism are analysed and the need for more specific policies is highlighted, particularly in view of the inherent risks in creative tourism development.

A Gis Based Spatial Decision Support System For Landscape Character Assessment, Faye Elanor Davey Jan 2012

A Gis Based Spatial Decision Support System For Landscape Character Assessment, Faye Elanor Davey

Other Faculty of Science and Engineering Theses

Landscape Character Assessment (LCA) provides a structured approach to identifying the character and distinctiveness about the landscape. It is a tool used to identify what makes a location unique, a set of techniques and procedures used to map differences between landscapes based on their physical, cultural and historical characteristics. Although the UK has committed to assessing all of its landscapes by signing the European Landscape Convention in 2006, only 60% of coverage has been achieved. The majority of LCAs are carried out by professional environment or landscape consultancies rather than ‘in-house’. Geographical Information Systems are increasingly being used to collate …
