Zoning Barriers To The Implementation Of New Urbanist Land Use Principles In Lincoln, Nebraska, Rachel K. Jones Aug 2012

Zoning Barriers To The Implementation Of New Urbanist Land Use Principles In Lincoln, Nebraska, Rachel K. Jones

Community and Regional Planning Program: Theses

Euclidean land use regulations that segregate different kinds of uses from one another can present significant barriers to achieving the land use-related principles of New Urbanism on a foundational level. This research evaluated the zoning ordinance of the city of Lincoln, Nebraska, with a special focus on the Community Unit Plan and Planned Unit Development processes, in order to determine its openness to mixed housing and mixed uses, using a combination of policy analysis and Geographic Information System (GIS). It was found that a number of Lincoln’s zoning districts as well as a significant amount of land are restricted in …

Deepwater, Deep Ties, Deep Trouble: A State-Corporate Environmental Crime Analysis Of The 2010 Gulf Of Mexico Oil Spill, Elizabeth A. Bradshaw

Dissertations

The 2010 Gulf of Mexico oil spill was one of the worst environmental disasters of all time. Using the concept of state-corporate environmental crime, this project applies a case study analysis of secondary data sources including publicly available government reports, corporate documents, academic sources and journalistic accounts to examine the causes of the blowout and the response to the spill. Building on Michalowski and Kramer’s Integrated Theoretical Model of State-Corporate Crime, this study introduces an additional level of analysis- that of the industry- between the organizational and institutional levels.

The causes of the Deepwater Horizon explosion are rooted both in …

Political Cooperation And International Environmental Governance In The Baltic Sea Region After World War Ii, Taavi Kelder

Graduate Theses, Dissertations, and Problem Reports (ETD)

Today, global environmental problems have become one of the most important international issues. This Master's thesis is about international environmental and political cooperation in the Baltic Sea Region after World War II. The Baltic Sea is surrounded by nine states and the degradation of the marine environment of the Baltic Sea has become a common problem. However, international environmental cooperation depends on many political factors: financial support, international organizations, the attitude of states, international law and the status of environmental issues in the international arena. This thesis focuses on different forms of political cooperation which have influenced international environmental governance …

The Effects Of Symbolic And Realistic Threats On Moral Exclusion From The Scope Of Justice, Dana Charles Leighton Aug 2012

The Effects Of Symbolic And Realistic Threats On Moral Exclusion From The Scope Of Justice, Dana Charles Leighton

Graduate Theses and Dissertations

Moral exclusion refers to a psychological process that removes others from our moral community--those whom we treat with fairness and concern for their welfare. The present research is concerned with how perceived symbolic threats (threats to the ingroup's values, morals, and worldview) and realistic threats (threats to the ingroup's well-being and resources) are related to moral exclusion. Perceived symbolic and realistic threats from an outgroup (Mexican immigrants) were measured (Study 1) and manipulated (Study 2) to discover their predictive and causal relationships with moral exclusion. It was found that both symbolic and realistic threats predicted moral exclusion and did so …

Fairness In The Bay: Environmental Justice And Nutrient Trading, Rena I. Steinzor, Robert R.M. Verchick, Nicholas W. Vidargas, Yee Huang Aug 2012

Fairness In The Bay: Environmental Justice And Nutrient Trading, Rena I. Steinzor, Robert R.M. Verchick, Nicholas W. Vidargas, Yee Huang

Faculty Scholarship

Maryland, Virginia, Pennsylvania and other states in the Chesapeake Bay region, with support from the Environmental Protection Agency, are working toward developing water quality trading programs intended to help meet federal pollution limits for the Bay. This white paper from the Center for Progressive Reform warns that even if a trading system succeeds in reducing overall pollution in the Bay, it might still have a dire effect on low-income and minority communities in the Bay region.

If trading programs are not carefully designed and monitored, trading can cause localized concentrations of nutrients and accompanying contaminants in local waters, posing a …

An Analysis Of The Los Padillas Wildlife Sanctuary : A Place-Based Environmental Education Model, Mariana Padilla

Water Resources Professional Project Reports

The purpose of this professional project is to examine the history of the Los Padillas Wildlife Sanctuary (LPWS) program in order to formulate recommendations that will assist the school in making it more sustainable while ensuring that it is integrated into its curriculum and educational philosophy in a meaningful way. Despite the value this program brings to the school it has continued to struggle; it lacks necessary funding for staffing and administration and also suffers from low participation and involvement by school staff, students and community. The project approach includes a detailed description of the development of the LPWS based …

Co-Management Of Natural Resources By Indigenous People And States: A Method To Promote Environmental Justice And Sustainability, Bradford Morse Jul 2012

Co-Management Of Natural Resources By Indigenous People And States: A Method To Promote Environmental Justice And Sustainability, Bradford Morse

Global Environmental Law at a Crossroads

This paper will explore the potential contributions that could be made to achieving environmental justice, as well as local, regional and global efforts toward environmental sustainability, through embracing the concept of co-management of nature in which the natural world is a participant represented by those humans retaining traditional knowledge of sustainable co-existence. In particular, my focus will be on the potential of partnerships between settler governments with access to ‘modern’ scientific knowledge combining with Indigenous peoples relying on their ‘traditional’ ecological knowledge. I will examine how recent reinterpretation of longstanding international human rights, along with the development of international environmental …

Using Law To Advance Sustainability: The Law Of Sustainable Development, Carla D. Aceves-Avila Jul 2012

Using Law To Advance Sustainability: The Law Of Sustainable Development, Carla D. Aceves-Avila

Global Environmental Law at a Crossroads

Sustainability and law as a social tool behold linkages that strengthen one another, although this conjunction is frail when analyzed under the typical standards and paradigm of most contemporary legal systems.

The role of law under sustainability must be carefully profiled and differentiated as compared to the rest of legal rules. Even though it is true that all legal rules are created and implemented with the main purpose of improving human interaction, the role of law oriented towards sustainability should be the protection and preservation of natural resources, elements, as well as the conditions associated to these in order to …

Environmental Justice And The Green Economy- Risks And Opportunities, Nathalie Chalifour Jul 2012

Environmental Justice And The Green Economy- Risks And Opportunities, Nathalie Chalifour

Global Environmental Law at a Crossroads

The last decade of environmental advocacy has been characterized by the application of economic principles to environmental challenges, resulting in an interest in using economic instruments to internalize environmental costs in decision-making and reflected in the growing use of concepts such as environmental valuation and resource productivity in policy choices. While many view this greater connection between economic principles and environmental decision-making as key to achieving sustainable development (eg. Keohane & Olmstead, 2007), others fear that the focus on the green economy may undermine goals of social equity and environmental justice (eg. Dobson, 1998; Langhelle, 2000; Hoedeman, 2012). This paper …

Environmental Justice In Nigeria's Oil Industry: Recognizing And Embracing Contemporary Legal Developments, Rhuks Ako Jul 2012

Environmental Justice In Nigeria's Oil Industry: Recognizing And Embracing Contemporary Legal Developments, Rhuks Ako

Global Environmental Law at a Crossroads

The legal framework regulating Nigeria’s oil industry is one of the major drivers of disputes and the consequent violent conflicts in the oil-rich Niger Delta region. The region has gone through different phases of peaceful and violent struggles as the indigenes of the region aim to achieve environmental justice. The amnesty initiative; the latest attempt to curb the militancy in the region that escalated the violence to new heights, is showing signs of systemic failure after a brief period of relative peace. Militancy in the region has begun to increase as attacks on oil facilities and installations are once again …

Governance And Environmental Democracy: A Global Policy, Carla Aceves-Avila Jul 2012

Governance And Environmental Democracy: A Global Policy, Carla Aceves-Avila

Global Environmental Law at a Crossroads

In legal terms, and through the late decades sustainable development has transformed from an economic development theory to a public policy obligation that in turn has also translated in practice into concrete rights and obligations in legal systems throughout the world. These rights and obligations apply both to individuals and governments through constitutional, civil, administrative, commercial and even criminal legal rules.

Environmental law has become an essential tool for governance and administration of sustainable development while environmental democracy and its elements are becoming essential for a safe and sound planetary cohabitation. Environmental democracy provides the basis for the policies and …

A River Of Voices: Confluences And Cross-Currents In The Discourse Of The Colorado River, Paul Formisano Jul 2012

A River Of Voices: Confluences And Cross-Currents In The Discourse Of The Colorado River, Paul Formisano

English Language and Literature ETDs

This dissertation argues that the Colorado River and its watershed face a crisis of representation as privileged nineteenth-century myths portraying the American West as a frontier, garden, and wilderness have limited an understanding of what and whom the river is for. It examines the contribution of tributary voices' or the lesser known perspectives from the region to reveal new lines of thinking about this river and its surroundings as they engage the traditional views of the river shaped by these myths. The voices examined at length in this study include contemporary nature writer Craig Childs, recent female boating narratives by …

Sustainable Management: A Sustainable Ethic?, Trevor Daya-Winterbottom Jul 2012

Sustainable Management: A Sustainable Ethic?, Trevor Daya-Winterbottom

Global Environmental Law at a Crossroads

New Zealand is a country rich in biodiversity and natural resources, steeped in Maori culture and indigenous values, that legislated for sustainable management under the Resource Management Act 1991. Despite the rhetoric of sustainable management, environmental law and governance in New Zealand continue to grapple with persistent challenges:

· New Zealand is a significant contributor to global biodiversity but has one of the highest species extinction rates due to continued habitat loss and invasion by pest species.

· While New Zealand has a plentiful supply of clean freshwater, water demand from agriculture and urban growth is increasing and water quality …

The Main Track Of The Development Of Environmental Framework Law: From The Conference On The Human Environment To The Conference On Environment And Development, Li Zhi Ping Jul 2012

The Main Track Of The Development Of Environmental Framework Law: From The Conference On The Human Environment To The Conference On Environment And Development, Li Zhi Ping

Global Environmental Law at a Crossroads

The United Nations' Conference on Human Environment launched a new era of global environmental protection; one of its significant impacts on the world is driving the emergence and promoting the development of the environment framework law. Look back to the history, two peaks appeared in the development process of national environmental framework law, the first one arises after the 1972 United Nations Conference on the Human Environment, the second one arises after the 1992 United Nations Conference on Environment and Development. These two conferences have been able to play such an important role, because they brought together the human intelligence, …

A Comparative Analysis Of California And German Renewable Energy Policy: Actors And Outcomes, Jesse M. Keppley Jul 2012

A Comparative Analysis Of California And German Renewable Energy Policy: Actors And Outcomes, Jesse M. Keppley

Josef Korbel Journal of Advanced International Studies

Policymakers have long been interested in promoting renewable energy development. Yet it is only over the last two decades that interest has fully bloomed, leading to new policy instruments designed to promote increased generation in an economically efficient manner. Two environmental leaders, California and Germany, are identified as models in this field. Both have shown remarkable growth in generating capacity. Yet a closer examination of policy developments reveals marked differences in the way actors have pursued their interests to shape policy outcomes. This paper discusses both models in detail, exploring the ways political interests became involved in the policymaking process. …

Fostering Ecological Citizenship: The Case Of Environmental Service-Learning In Costa Rica, Jennifer Rebecca Kelly, Troy D. Abel Jul 2012

Fostering Ecological Citizenship: The Case Of Environmental Service-Learning In Costa Rica, Jennifer Rebecca Kelly, Troy D. Abel

International Journal for the Scholarship of Teaching & Learning

The intent of this study was to explore how experiential education fosters ecological or environmental citizenship. In this context, we investigated the impact of international environmental service-learning in a college course. Specifically our research question was does environmental service-learning have an effect on ecological citizenship? Using a multimethod approach of both qualitative and quantitative instruments our study drew on 13 participant interviews, 19 student journals and 10 survey responses. Employing variables from the Value-Belief-Norm Theory our findings suggest that environmental service-learning experiences impact both awareness of environmental consequences and personal normative beliefs. We conclude that ecological citizenship was indirectly impacted …

Environmental Damages After The Federal Environmental Enforcement Act: Bringing Ecosystem Services To Canadian Environmental Law?, Martin Z. P. Olsynski Jul 2012

Environmental Damages After The Federal Environmental Enforcement Act: Bringing Ecosystem Services To Canadian Environmental Law?, Martin Z. P. Olsynski

Osgoode Hall Law Journal

The Canadian Environmental Enforcement Act [EEA] directs judges to consider actual environmental damage, or risk thereof, when setting fines for environmental offences. The EEA defi nes damage as including the loss of use and non-use values. While these terms are not unprecedented in Canadian environmental law, their use in environmental damage assessment is. Bearing in mind recent developments in environmental valuation in the United States and internationally, and considering the emergence of the “ecosystem services” paradigm in particular, this article explores the opportunities and challenges for ecosystem services based environmental damages assessment in the Canadian environmental sentencing context. The ecosystem …

Forests, Protected Areas And The Payment For Ecosystem Services: Reserva Do Juma (State Of Amazonas- Brazil), Solange Teles Da Silva, Danielle De Ouro Mamed

Global Environmental Law at a Crossroads

In the State of Amazonas, the Climate Change, Environmental Conservation and Sustainable Development Policy Act adopted by State Law n. º 3.135/2007 has created a Program called “Bolsa Floresta”. In a pioneering way, this program was established with the aim of starting the payment for environmental services and products to traditional communities for the sustainable use of natural resources, conservation, environmental protection and encouragement of voluntary policies to reduce deforestation. This Program of “compensation” - “Bolsa Floresta” - is divided into four types: a) “Bolsa Floresta” Family b) “Bolsa Floresta” Association c) “Bolsa Floresta” Social and, d) “Bolsa Floresta” Income. …
