A Therapeutic Jurisprudential Framework Of Estate Planning, Mark Glover
A Therapeutic Jurisprudential Framework Of Estate Planning, Mark Glover
Faculty Articles
The psychological consequences of the law of succession largely have been overlooked This oversight is confounding given that the estate planning and probate processes are emotionally charged and raise a number of psychological issues Filling this analytical void this article examines the estate planning process from a therapeutic jurisprudential perspective and makes two primary contributions to the study of the law of succession First the article identifies the psychological consequences of the estate planning process Although the analysis suggests that certain aspects of preparing and implementing an estate plan can negatively affect one's psychological wellbeing the analysis also reveals that …

“Offsetting” Crisis? - Climate Change Cap-And-Trade Need Not Contribute To Another Financial Meltdown , Victor B, Flatt
“Offsetting” Crisis? - Climate Change Cap-And-Trade Need Not Contribute To Another Financial Meltdown , Victor B, Flatt
Pepperdine Law Review
In 2009, the promise of a comprehensive federal cap and trade bill to address climate change fell apart. At least in part, this was due to the fears that exotic 'carbon' financial instruments might cause more financial crises. As California launches it economy wide carbon trading system, and other regional systems and the even possibly the EPA consider cap and trade, it is important to revisit what, if anything, about carbon denominated financial instruments might lead to financial market problems. The most problematic of the instruments, offsets, can be designed to lessen financial risk from underlying asset failure.

Restructuring Science, Reengaging Society, Danielle L. Lake
Restructuring Science, Reengaging Society, Danielle L. Lake
Faculty Peer Reviewed Articles
Much of Paul Rabinow’s work is centered on the need for restructuring science, but does not argue for the means by which we should do so. The following paper suggests various ways in which the sciences can be restructured so as to reengage society. Bryan Norton’s bridge concepts are suggested as a means to work past the narrow thinking which accompanies hyper-specialization and a lack of integration. Secondly, the need to acknowledge and examine the role of values in knowledge construction is highlighted. Next, I suggest the restructuring of our social systems needs to be accompanied by a restructuring of …

Homeless Encampments On Public Right-Of-Way: A Planning And Best Practices Guide, Ellen M. Bassett, Andrée Tremoulet, Allison Moe
Urban Studies and Planning Faculty Publications and Presentations
Homelessness is a societal problem. Its causes are complex, and its effects have implications for many public agencies, including those not directly responsible for providing assistance to homeless individuals. Because homeless people constantly seek safe shelter and refuges, agencies that own public land and buildings sometimes find themselves in contact with this population. Nationally, the impact of homelessness appears to represent a substantial operational challenge for state transportation agencies and Departments of Transportation (DOTs). Two online surveys?one of state DOT managers and supervisors and the other of public sector managers of highway rest areas (DOT and other state agency staff)?conducted …

Journal of Rural Social Sciences
The development of an environmental identity is viewed by many as essential if we are to reorganize our societies toward ecological sustainability (Bell 2009; Clayton and Opotow 2003; Thomashow 2002). That, along with an eye toward environmental justice, was the major impetus for our graduate seminar in applied environmental sociology to partner with an elementary school in our small city of Hammond, LA, during the spring semester of 2010. After conducting focus groups with a group of fourth to sixth grade students and holding decision-making discussions with them for this community-based research (CBR) project, we went about two projects – …
Property Rights For Natural Resources Management In Indonesia: Have They Been Ruled Unconstitutional?, Sarah Waddell
Property Rights For Natural Resources Management In Indonesia: Have They Been Ruled Unconstitutional?, Sarah Waddell
Indonesia Law Review
A new property right known as the coastal waters commercial use right (Hak Pengusahaan Pengairan Pesisir (HP-3)) introduced by Law No. 27 of 2007 regarding the Management of Coastal and Small Island Areas has been ruled inoperative by the Constitutional Court. The decision raises a question as to whether the door has been closed to marketbased instruments that rely on property rights as a policy tool in natural resources management. This concern is relevant as legal developments in natural resources law internationally have moved away from traditional forms of regulation to focus on the creation of new statutory property rights …
Food Stamps Grow Urban Gardens, Daniel Bowman Simon
Food Stamps Grow Urban Gardens, Daniel Bowman Simon
Cities and the Environment (CATE)
Plants and seeds can be purchased with SNAP (formerly Food Stamps, renamed Supplemental Nutrition Assistance Program, or SNAP in 2008,) but most current SNAP participants are unaware. Nearly four decades ago, in 1973, Alabama Senator James Allen championed an amendment to allow the purchase of food-producing plants and seeds with Food Stamps. The Senate passed the amendment after less than ten minutes of floor debate. However, in the ensuing decades, there has not been a focused national effort to make SNAP participants raise awareness of this choice that is available to SNAP participants, nor to connect SNAP participants to resources …

Waterfront Redevelopment At South Street Seaport: Where Water And Land, Collaboration And Planning Converge, Kathryn Anne Lorico Tipora
Urban Studies Masters Theses
With a new analytic approach to waterfront space and the incorporation of community-based planning in the process, urban planning can be used as a tool in the social and environmental justice movement for a more livable and accessible city. I will identify the benefits and challenges of an interdisciplinary approach to planning and developing waterfronts by 1) analyzing the history and past redevelopments of South Street Seaport, an essential step to understanding any urban space; 2) identifying the benefits and challenges of an interdisciplinary and collaborative approach to planning and developing urban waterfronts; and 3) providing a possible explanation for …

Links And Distinctions Among Citizenship, Science, And Citizen Science. A Reponse To "The Future Of Citizen Science.", Caren B. Cooper
Democracy & Education
Mueller, Tippins, and Bryan (2012) presented a new conceptualization of citizen science that is meant to facilitate emerging trends in the democratization of science and science education to produce civically engaged students. I review some relevant trends in the field of citizen science, for clarity here referred to as public participation in scientific research (PPSR), and present overlooked styles and outcomes of PPSR. Education efforts should seize the opportunity to emphasize the key and distinct roles students can play in both the science and the values elements that inform decision-making processes.

Debating Sustainable Development In Global Climate Change Policy: The “Cancún Agreements” V. The “People’S Agreement Of Cochabamba”, Andrew J. Riplinger
College of Liberal Arts & Social Sciences Theses and Dissertations
The climate is in crisis, and the policies put in place now will have a dramatic impact on international development, international relations, and social movements for generations to come. In recent years there have been two major conferences bringing together international policy makers to craft a treaty to address climate change that would take the place of the Kyoto Protocol when it expires at the end of 2012: the United Nations Framework Convention in Climate Change (UNFCCC; resulting in the 2009 “Copenhagen Accord” and the 2010 “Cancún Agreements”) and the World Peoples’ Conference on Climate Change (WPCCC; resulting in the …

Pine Springs Hazardous Fuel Reduction Phase Ii, United States Department Of The Interior, Bureau Of Land Management
Environmental Assessments (UT)
The purpose of the Pine Springs Hazardous Fuel Reduction Phase II project is to reduce the buildup of hazardous fuels that have accumulated over the last several decades in order to prevent the potential for large catastrophic fire events. In addition, the proposed action is needed to maintain important sage-steppe habitat for a variety of wildlife species in the project area.
