In-House Counsel Beware!, Katrice Bridges Copeland Jan 2012

In-House Counsel Beware!, Katrice Bridges Copeland

Faculty Scholarship

This Article argues that the prosecution of Lauren Stevens for covering up the alleged crimes of GSK was misguided both as a matter of law and a matter of policy. In particular, this Article contends that the government should not prosecute attorneys for obstruction of justice or other cover-up crimes for actions taken in good faith during a government investigation into a client's conduct. Part I provides background on the Lauren Stevens case and the convergence of the four prosecution trends that led the government to indict her. Part II argues that Lauren Stevens did not obstruct the government's investigation …

Perceptions Of Secondary Teachers And Administrators About Coteaching, Brenda Brie Cederna Jan 2012

Perceptions Of Secondary Teachers And Administrators About Coteaching, Brenda Brie Cederna

Abraham S. Fischler College of Education ETD Archive

Educating students with disabilities in the general education classroom continues to increase as districts are mandated to meet federal requirements. The use of coteaching to support students in the general education classroom is on the rise. By having a content area teacher and a special education teacher share classroom responsibilities, students gain access to the general education curriculum while continuing to receive services and supports to meet their individual needs. This qualitative study allowed the researcher to gather information directly from the teachers and administrators who were responsible for the implementation of the coteaching model at one high school in …

Strategic Communication Games: Theory And Applications, Shintaro Miura Jan 2012

Strategic Communication Games: Theory And Applications, Shintaro Miura

All Theses and Dissertations (ETDs)

The dissertation consists of the three essays about strategic communication games. Strategic communication games are costless sender-receiver games, and address the question of how much information can be credibly transmitted in equilibrium, and what kind of communication environments facilitate information transmission. Ch. 2, “Multidimensional Cheap Talk with Sequential Messages,” considers a multidimensional cheap talk game where there are two senders who share the private information, and send a message to the receiver sequentially. We suggest a notion of extended self-serving belief, and show that there exists a fully revealing equilibrium if and only if the senders have opposing-biased preferences. Ch. …

A Study Of The Processes Involved In Sexual Battery Investigations, Kelly S. Boone Jan 2012

A Study Of The Processes Involved In Sexual Battery Investigations, Kelly S. Boone

Abraham S. Fischler College of Education ETD Archive

This applied dissertation was designed to identify the common and unique processes employed during investigations of sexual battery. While departmental policies and state statutes provide guidance on the processes to be used in sexual battery investigations, there is a great deal of variability in the combination of processes that can be employed to investigate these cases. There is also some degree of variability in the outcomes associated with these investigations. This study examined the processes employed during sexual battery investigations in an effort to identify common themes. Importantly, the study identified the variation in cases that are genuine versus unfounded, …

How To Choose The Least Unconstitutional Option: Lessons For The President (And Others) From The 2011 Debt Ceiling Standoff, Neil H. Buchanan, Michael C. Dorf Jan 2012

How To Choose The Least Unconstitutional Option: Lessons For The President (And Others) From The 2011 Debt Ceiling Standoff, Neil H. Buchanan, Michael C. Dorf

GW Law Faculty Publications & Other Works

The current successor to a federal statute first enacted in 1917, and widely known as the “debt ceiling,” limits the face value of money that the United States may borrow. Congress has repeatedly raised the debt ceiling to authorize borrowing to fill the gap between revenue and spending, but in the summer of 2011, a political standoff nearly left the government unable to borrow funds to meet obligations that Congress had affirmed earlier that very year. Some commentators urged President Obama to ignore the debt ceiling and issue new bonds, in order to comply with Section 4 of the Fourteenth …

Nullifying The Debt Ceiling Threat Once And For All: Why The President Should Embrace The Least Unconstitutional Option, Neil H. Buchanan, Michael C. Dorf Jan 2012

Nullifying The Debt Ceiling Threat Once And For All: Why The President Should Embrace The Least Unconstitutional Option, Neil H. Buchanan, Michael C. Dorf

GW Law Faculty Publications & Other Works

In August 2011, Congress and the President narrowly averted economic and political catastrophe, agreeing at the last possible moment to authorize a series of increases in the national debt ceiling. This respite, unfortunately, was merely temporary. The amounts of the increases in the debt ceiling that Congress authorized in 2011 were only sufficient to accommodate the additional borrowing that would be necessary through the end of 2012. In an economy that continued to show chronic weakness -- weakness that continues to this day -- the federal government would pre-dictably continue to collect lower-than-normal tax revenues and to make higher-than-normal expenditures, …

The article traces the history of the most powerful body in amateur sports, the NCAA, discussing the regulation of amateur sports before it arose, the factors that led to its creation, early definitions of amateurism, key issues facing the early body, its promotion of University amateur sports as a training ground for soldiers during World War I, emerging conflicts among members, its treatment of collegiate segregation policies and campus neglect of women's sports opportunities, and how past problems in amateur sports regulation were prologue for the issues facing intercollegiate athletics regulators and participants today.

An Addendum To Cox And Posner: A Visa To 'Snitch', Eleanor Marie Brown Jan 2012

An Addendum To Cox And Posner: A Visa To 'Snitch', Eleanor Marie Brown

GW Law Faculty Publications & Other Works

Cox and Posner’s landmark contribution is the first article to have highlighted the challenges of information asymmetry in immigration screening. While Cox and Posner have undoubtedly made a significant contribution, there is a critical oversight in their framework: they do not discuss the importance of targeted ex post mechanisms of screening educational elites. This Essay is an attempt to remedy Cox and Posner’s omission. Why is this oversight so problematic? In the post-9/11 world, U.S. immigration policy currently finds itself on the horns of a dilemma. While immigrant educational elites are critical to U.S. economic growth, terrorist networks have stepped …

Hydrodynamics, Mixing, And Mass Transfer In Bubble Columns With Internals, Mohamed Hamed Jan 2012

Hydrodynamics, Mixing, And Mass Transfer In Bubble Columns With Internals, Mohamed Hamed

All Theses and Dissertations (ETDs)

Bubble columns and slurry bubble columns are considered reactors of choice for a wide range of applications in the chemical, biochemical, and petrochemical industries. Most of the chemical applications of bubble columns include exothermic processes and hence they require some means of heat removal to maintain a steady process. The most practical means for heat removal in these reactors is the utilization of vertical cooling internals since they provide high heat transfer area per reactor volume. However, the effects of these internals on the reactor performance are poorly understood in the open literature. This causes the design of the internals …

Représentations De La Violence Révolutionnaire Dans La Littérature Et Le Cinéma Français (1928-1986), Antoine Krieger

All Theses and Dissertations (ETDs)

In my dissertation, I study the constants and the variables of the representation of: mostly left-wing) militants in 20th century French literature and film. I demonstrate that they are young idealists seeking personal rejuvenation through political violence. Moreover, I show how those works are a reflection of major trends in French cultural and political history during specific time-periods such as the inter-war period, the occupation of France by Nazi Germany or the Algerian War of Independence. My theoretical approach is a "sociology of literature" influenced by the theories of Lucien Goldmann and Marc Angenot. However, I also occasionally use postcolonial …

Applying Peer Modeling In Inclusion Classrooms: A Study On Educators’ Perception, Rossana I. Chiarella Jan 2012

Applying Peer Modeling In Inclusion Classrooms: A Study On Educators’ Perception, Rossana I. Chiarella

Abraham S. Fischler College of Education ETD Archive

This study evaluated the effects of educators’ perception on the application of peer modeling strategies in the classrooms. Without teachers’ positive attitude towards peer modeling, it was difficult to apply these strategies effectively. Teachers’ attitudes were determined by their existing perceptions, whereas different perceptions resulted in different dispositions to act and different outcomes. The purpose was to determine how teachers in a school located in south Florida applied peer modeling, and how their perceptions over it played an important role. The researcher attempted to evaluate the importance of peer-model strategies and to demonstrate the true benefit of their proper application …

Epistemic Vigilance: The Error Management Of Source Memory And Belief, Brian Bergstrom Jan 2012

Epistemic Vigilance: The Error Management Of Source Memory And Belief, Brian Bergstrom

All Theses and Dissertations (ETDs)

The studies reported here explore some of the cognitive contours of epistemic vigilance--that is, how the mind adaptively tracks and monitors information. These studies ask how the mind considers the source of new information when making epistemic judgments. Four experiments investigate the role of source information in modulating the "truth bias": an automatic tendency to presume new information is true). An evolutionary hypothesis is advanced: that a "support bias" exists for sources with special coalitional relevance: e.g., a best friend) that interacts with the truth bias to produce supportive patterns of recall that are unique to that source. Results partially …

The Rise Of Institutional Law Practice, Thomas D. Morgan Jan 2012

The Rise Of Institutional Law Practice, Thomas D. Morgan

GW Law Faculty Publications & Other Works

For generations, the legal profession has assumed that only individual lawyers practice law. Ethical standards have been largely, if not exclusively, directed at individuals, and practice organizations have been regulated to prevent limiting individual lawyer professional judgment. The world in which lawyers now practice makes the individualized model obsolete. The complexity of modern law narrows the breadth of any individual lawyer's practice and makes law firms and other practice organizations inevitable. Firms, in turn, must maintain both ethical compliance and a high level of service quality that is inconsistent with lawyers behaving idiosyncratically. The article explores these developments and suggests …

Enforcing The Nuclear Nonproliferation Regime: The Legality Of Preventive Measures, Cristian Defrancia Jan 2012

Enforcing The Nuclear Nonproliferation Regime: The Legality Of Preventive Measures, Cristian Defrancia

Vanderbilt Journal of Transnational Law

Efforts to limit the proliferation of nuclear weapons and nuclear-weapons-related technology have increasingly involved economic, technological, and military forms of coercion implemented in an environment of low-level conflict. Coercive counterproliferation measures have included a range of actions, including targeted economic sanctions, industrial sabotage, cyber attacks, targeted killings, and military strikes. While the nonproliferation obligations of states are well-established under relevant treaties, state practice, and the international monitoring system of the International Atomic Energy Agency (IAEA), norms relating to the enforcement of those obligations are not clearly defined in legal instruments. This Article reviews the legality of prevention and enforcement measures …

Secular Crosses And The Neutrality Of Secularism, Marie E. Roper Jan 2012

Secular Crosses And The Neutrality Of Secularism, Marie E. Roper

Vanderbilt Journal of Transnational Law

This Note discusses analogous themes in two religious public display cases, Lautsi v. Italy, recently decided by the Grand Chamber of the European Court of Human Rights (ECHR), and Salazar v. Buono, recently handed down by the U.S. Supreme Court. Broader critiques of ECHR religious jurisprudence are addressed in the context of the interpretation and application of the principle of neutrality and the argument that secularism is not a necessary postulate of this demand. It is this theme of the relationship between neutrality and secularism that is also prominent in the American discussion about the relationship between government and religion. …

Characterization Of Surface Microtopography And Determination Of Hydrotopographic Properties, Yaping Chi Jan 2012

Characterization Of Surface Microtopography And Determination Of Hydrotopographic Properties, Yaping Chi

Civil and Environmental Engineering

Spatial characterization of surface microtopography is important in understanding the overland flow generation and the spatial distribution of surface runoff. In this study, fractal parameters (i.e., fractal dimension D and crossover length l) and three hydrotopographic parameters, random roughness (RR) index, maximum depression storage (MDS), and the number of connected areas (NCA), have been applied to characterize the spatial complexity of microtopography. Clear and meaningful relationships have been established between these parameters. The RR was calculated as the standard deviation of the processed elevation, and the fractal parameters were calculated with the semivariogram method. The puddle delineation program was applied …

Initial Swelling Mechanism Of Expansive Clays: A Molecular Dynamics Study, Lakshmikanth Srinivasamurthy Jan 2012

Initial Swelling Mechanism Of Expansive Clays: A Molecular Dynamics Study, Lakshmikanth Srinivasamurthy

Civil and Environmental Engineering

Expansive soils are widely found in many parts of the world. Highly active smectite clay mineral Montmorillonite is the major constituent in these clays and can expand or contract up to 15 times of their original volume. Constrained swelling exert large amount of stress causing damage to structures, pavements etc. These clays are also used as barrier materials, Nano-materials in polymer clay Nano composites and drug delivery systems. Several factors influence the swelling potential such as water content, density, voids, electrolyte content and cation exchange capacity. However, molecular scale mechanisms that control swelling behavior in these clays need to be …

Child Welfare And Delinquency: Examining Differences In First-Time Referrals Of Crossover Youth Within The Juvenile Justice System, Courtney Nicole Shrifter Jan 2012

Child Welfare And Delinquency: Examining Differences In First-Time Referrals Of Crossover Youth Within The Juvenile Justice System, Courtney Nicole Shrifter

Dissertations and Theses

The link between child welfare and juvenile justice is well established, with over forty years of research that focuses on the increased risk of delinquency associated with child maltreatment. However, with over 700,000 children in the United States being victims of abuse and/or neglect in 2010 (DHHS, 2011), it is important to continue investigating this connection. Few studies are able to identify the same youth in both systems, therefore this study provides the unique opportunity using child welfare and juvenile justice administrative data from Oregon, to compare juvenile offenders that have been in the child welfare system, otherwise known as …

The Balkinization Of Originalism, James E. Fleming Jan 2012

The Balkinization Of Originalism, James E. Fleming

Faculty Scholarship

This Article suggests that, with the publication of Jack Balkin's Living Originalism, we are witnessing the "Balkanization" of originalism (when originalism splits into warring camps) along with the "Balkinization" of originalism (when even Balkin, hitherto a pragmatic living constitutionalist, becomes an originalist). It goes on to argue that Balkin's living originalism is what Ronald Dworkin has called a "moral reading" of the Constitution, for it conceives the Constitution as embodying abstract moral and political principles, not codifying concrete historical rules or practices. Furthermore, despite important differences, there are unmistakable affinities between Balkin's commitment to interpret the Constitution so as to …

Chain-Link Confidentiality, Woodrow Hartzog Jan 2012

Chain-Link Confidentiality, Woodrow Hartzog

Faculty Scholarship

Disclosing personal information online often feels like losing control over one’s data forever; but this loss is not inevitable. This essay proposes a “chain-link confidentiality” approach to protecting online privacy. One of the most difficult challenges to guarding privacy in the digital age is the protection of information once it is exposed to other people. A chain-link confidentiality regime would contractually link the disclosure of personal information to obligations to protect that information as the information moves downstream. The system would focus on the relationships not only between the discloser of information and the initial recipient, but also between the …
