Reading The Talmud: Developing Independence In Gemara Learning, Henry M. Abramson
Reading The Talmud: Developing Independence In Gemara Learning, Henry M. Abramson
Lander College of Arts and Sciences Books
Reading the Talmud is a textbook designed for students who want to move beyond translations to learning the Talmud on their own. This book presents a proven, “no shortcuts” approach based on the traditional Yeshiva model. If you have enough Hebrew skills to work out a Biblical verse, and a healthy determination to toil in the Talmud, this book will help you develop independence in Gemara learning.
This is the second edition of this book.
The Word Commons And Foreign Laws, Thomas O. Main
The Word Commons And Foreign Laws, Thomas O. Main
Scholarly Works
Dual trends are colliding in U.S. courts. The first trend is a tidal wave of cases requiring courts to engage the domestic laws of foreign legal systems; globalization is the principal driver of this escalation. The second trend is a profound and ever-increasing skepticism of our ability to understand foreign law; the literature of pluralism and postmodernism has illuminated the uniquely local, language-dependent, and culturally embedded nature of law. Courts cope with this dissonance by finding some way to avoid the application of foreign law. But these outcomes are problematic because parties are denied access to court or have their …

Bio-Cultural Knowledge And The Challenges Of Intellectual Property Rights Regimes For African Development, Ikechi Mgbeoji
Bio-Cultural Knowledge And The Challenges Of Intellectual Property Rights Regimes For African Development, Ikechi Mgbeoji
Articles & Book Chapters
African states have, since the colonial encounter, been part of the international regimes on intellectual property rights. Formal accession to various treaties and conventions on intellectual property rights instruments should not be mistaken for actual internalization of the policies, structures and norms required for reaping the promised benefits of participation in such regimes. There is ample evidence showing that most African states do not have the requisite structures for fruitful engagement with international intellectual property rights regimes. Until this anomaly is rectified, African states' engagement with international intellectual property regimes will remain structurally flawed and inimical to the human development …
Anticipating Change: Missions And Paradigm Shifts In Emergence, Sam Law
Anticipating Change: Missions And Paradigm Shifts In Emergence, Sam Law
The Asbury Journal
As our global community is in an unprecedented period of rapid change, missiology, being a study of crossing boundaries, plays a critical pathfinder role in anticipating, participating and mediating the change process, for change itself is a temporal boundary. Failure to do so in the past has left the Church and other groups in a position in which they lag change, and have been marginalized and considered irrelevant. Emergence theory is introduced as a new model, in place of Kuhn's pyramid of causality, to describe how change itself has changed, as networks are now the opinion leaders. As well, Emergence …

Conducting Research With Tribal Communities: Sovereignty, Ethics, And Data-Sharing Issues, Catherine O’Neill, Anna Harding, Barbara Harper, Dave Stone, Patricia Berger, Stuart Harris, Jamie Donatuto

When conducting research with American Indian tribes, informed consent beyond conventional Institutional Review Board (IRB) review is needed because there may be potential for adverse consequences at a community or governmental level that are unrecognized by academic researchers. This paper reviews sovereignty, research ethics, and data-sharing considerations when doing community-based participatory health-related or natural resource-related research with American Indian nations and presents a model material and data-sharing agreement that meets tribal and university requirements. Only tribal nations themselves can identify potential adverse outcomes, and they can do this only if they understand the assumptions and methods of the proposed research. …
Forgiveness In Islamic Ethics And Jurisprudence, Russell Powell
Forgiveness In Islamic Ethics And Jurisprudence, Russell Powell
Faculty Articles
Some commentators characterize the relationship between Islam and other religions as a clash of cultures. Deep seated senses of harm, whether arising from the Crusades or 9/11, make the process of intercommunal engagement particularly challenging. However, some contemporary Muslim scholars propose a new paradigm for constructive interaction with non-Muslim communities that is authentically rooted in Islamic jurisprudential and textual traditions. The paper explores a number of potential starting points for intercommunal toleration, forgiveness, and reconciliation within Islamic tradition. Islamic jurisprudence contains deep commitments to forgiveness and reconciliation in its textual traditions (the Quran and Sunna), in its classical jurisprudence (particularly …

Leadership And Management In Second Generation Medium-Size Family Businesses: A Comparative Study, Gonzalo Gonzalez-Serna
Theses and Dissertations
A research study was conducted among 10 second generation owners of medium-size family businesses in Mexico to gain a better understanding of how their firms were founded and of how these business owners have succeeded in growing their companies and keeping their business alive for more than 40 years. Literature from leadership, management, and family business was reviewed to analyze the existing research on the topic. The literature review revealed that many authors have addressed similar issues, but from different perspectives. This study presents the experiences of a group of second generation business owners in great detail, focusing on their …

Public Leadership: A Study Of The Leadership Practices Of Elected Public Officials In Guam And The Commonwealth Of The Northern Mariana Islands, Florie Nadine Manglona Mendiola
Theses and Dissertations
Elected public officials hold one of the highest levels of leadership. They are voted into office with the belief that they embody the ideals of a good leader and are charged with the all-encompassing task of making crucial decisions that affect all sectors of society and its constituents. There is pressure to produce results, maintain credibility in their performance, and build trust with constituents. It is essential that an assessment tool be used to help leaders gain perspective and understanding in determining the effectiveness of their leadership practices. The opportunities to self-evaluate allow leaders to continuously refine their craft to …
A Good Story Changes Everything, Daraunda Bryant
A Good Story Changes Everything, Daraunda Bryant
Theses and Dissertations
Although applied in organizational settings, storytelling is not commonly used or understood in change efforts. Furthermore, storytelling's impact on changing organizational culture has not been widely examined. This study therefore sought to answer the question: What is the effect of stories on culture change? Twenty-five participants (4 managers and 21 associates) completed one-on-one, in-person interviews prior to a storytelling workshop. All associates attended the storytelling workshop, followed by interviews of all four managers and four randomly selected associates regarding culture change. This study found that storytelling, in particular the storytelling workshop, influenced the behaviors and attitudes of organizational members and, …
The Catholic Church, Human Rights, And Democracy: Convergence And Conflict With The Modern State, Paolo G. Carozza, Daniel Philpott
The Catholic Church, Human Rights, And Democracy: Convergence And Conflict With The Modern State, Paolo G. Carozza, Daniel Philpott
Journal Articles
The author traces the history of the Catholic Church's relationship to the modern state, focusing on the idea of sovereignty and the development of human rights and democracy. It argues that the Catholic Church's relationship to human rights and democracy in the modern world can only be understood as reflective of both a historical convergence and a persistent tension and ambivalence. The first part argues for this dual theme in the development of Catholic doctrine, where today, as over the past several centuries, the Church's conception of the common good yields both an embrace of human rights and democracy and …
Praesentia Ex Machina: The Millennial Technoculture, Liveness And Theatre, Reid J. Reimers
Praesentia Ex Machina: The Millennial Technoculture, Liveness And Theatre, Reid J. Reimers
Graduate Student Theses, Dissertations, & Professional Papers
This work examines the modern technoculture, its component parts and the changing role of theatre in Anglo-American culture. Our contemporary society is marked by the ubiquity of digital technologies and has become reliant on their commodities. The emerging Millennial Generation has matured with many of these devices and has embraced the modern technoculture. Many changes in daily life brought on by new technologies are obvious, but fundamental shifts remain obscured by the nature of technology itself. These subtle transformations are cumulative and have caused a technological disorientation with broad reaching implications. Liveness, initially defined as that which is unrecorded, has …
Floklore 2.0: Preservation Through Innovation, Sean A. Pager
Floklore 2.0: Preservation Through Innovation, Sean A. Pager
Utah Law Review
The WIPO draft treaty on TCE/folklore is intended to be legally binding. Yet, the exclusive rights it would establish are largely untested. They risk unintended consequences that may cause far more harm than good. This Article has argued that by placing undue restrictions on adaptation and commercialization, a strong property rights model of TCE protection would inhibit the creative renewal on which the long-term survival of traditional culture depends. Placing a “no trespassing sign” on intangible heritage may preserve folkloric traditions in their “authentic” state, but to do so is to adopt the preservationism of a taxidermist.

Up Like Weeds, Danielle Burns
Up Like Weeds, Danielle Burns
LSU Master's Theses
A child playing with matches is forgivable. Kids are curious. They want to explore adult activities through play. Does it stay innocent when that child experiments with the effects of firecrackers in frogs and gasoline on animals? What happens when they light the match? The grey area between childhood innocence and realization of wrong intrigues me and I find it fascinating how adult perspectives of such malicious deeds often vary. Up Like Weeds questions these responses using a collection of narrative prints and freestanding woodcut figures. They visually tell five tales of children in a rural environment acting out in …

Designing Pots: Determining Orange Incised Design Variation And Distribution At The Rollins Shell Ring Site And The Guana Shell Ring Site In Florida, Margaret Kathryn Wrenn
LSU Master's Theses
Orange pottery is a Late Archaic (5000-3000 B.P.) fiber-tempered pottery found throughout northern and central Florida, though the heartland of the ware is considered to be in the northeastern part of Florida. Orange pottery is most commonly plain, but incised Orange pottery is frequently found at shell ring sites on the eastern Florida coast. Prior examinations of Orange Incised pottery have indicated design considerable homogeneity in design at Orange Period sites. The highest percentage of decorated pottery is found at shell ring sites. For this thesis, I conducted an analysis and comparison of Orange Incised pottery collections from two contemporaneous …
Drought In Georgia: Water Scarcity Issues And Implications, Samantha Kay Chaisson
Drought In Georgia: Water Scarcity Issues And Implications, Samantha Kay Chaisson
LSU Master's Theses
Population growth and hydrological drought threaten the water supply of Atlanta, Georgia. In Georgia, water policy changed rapidly due to stress on the resource, regulation increased, and the state promoted a “culture of conservation” to combat water scarcity. This study examines how regulatory measures, including legislative acts and Governor’s executive orders, have impacted the population’s attitudes and behaviors towards water consumption. Furthermore, public spaces are used to measure public perception of water policy, and serve as a physical representation of the culture shift.

Mapping A Historic Bitterroot Valley, Montana Landscape Using General Land Office Surveyors' Field Notes, Karen M. Shelly
Graduate Student Theses, Dissertations, & Professional Papers
The late 1800s Bitterroot Valley, Montana, landscape and settlement patterns were summarized and mapped using the General Land Office (GLO) surveyors' field notes. Surveyors' observations of six townships from Hamilton to the Stevensville vicinity were examined in several ways. A total of 3321 points of ecological and geographic information and 422 miles of vegetation were mapped from the field notes. Surveyor information, vegetation composition, tree abundance, vegetation spatial structure and distribution of vegetation types were characterized in a multi-part historic vegetation data assemblage of point, line and polygon feature classes. Aquatic, topographic and cultural aspects of the area contributed to …
The Distinctiveness Of Appellate Adjudication, Heidi Li Feldman
The Distinctiveness Of Appellate Adjudication, Heidi Li Feldman
Georgetown Law Faculty Publications and Other Works
This paper concerns two topics which, I hope to show, are vitally connected. One is the distinctive importance of appellate adjudication in the legal system of United States. The other is the workings of entangled concepts in the law. That appellate adjudication is important in some sense may seem obvious to everybody (to a few it will seem obvious that appellate adjudication is unimportant). My point will be that via appellate adjudication courts engineer entangled legal concepts, and it is this aspect of appellate adjudication that is both crucial and unique to it, at least in the U.S. legal system. …

Framing In Cognitive Clinical Interviews About Intuitive Science Knowledge: Dynamic Student Understandings Of The Discourse Interaction, Rosemary S. Russ, Victor R. Lee, Bruce L. Sherin
Instructional Technology and Learning Sciences Faculty Publications
Researchers in the science education community make extensive use of cognitive clinical interviews as windows into student knowledge and thinking. Despite our familiarity with the interviews, there has been very limited research addressing the ways that students understand these interactions. In this work we examine students’ behaviors and speech patterns in a set of clinical interviews about chemistry for evidence of their tacit understandings and underlying expectations about the activity in which they are engaged. We draw on the construct of framing from anthropology and sociolinguistics and identify clusters of behaviors that indicate that students may alternatively frame the interview …
Reflections On Intellectual Hybridity, Kimala Price
Reflections On Intellectual Hybridity, Kimala Price
Journal of Feminist Scholarship
Drawing from the growing literature on interdisciplinarity and my own experiences as an intellectual hybrid, I discuss the personal and institutional challenges inherent in crossing disciplinary boundaries in the academy. I argue that boundary crossing is a natural occurrence and that the issue of (inter)disciplinarity is a matter of degree and of determining who gets to define the boundaries. Defining boundaries is not merely an intellectual enterprise, but also a political act that delineates what is, or is not, legitimate scholarship. This issue is especially salient to women's and gender studies during times of economic distress and educational budget cuts.
Novas Cartas Portuguesas: The Making Of A Reputation, Ana Margarida Dias Martins
Novas Cartas Portuguesas: The Making Of A Reputation, Ana Margarida Dias Martins
Journal of Feminist Scholarship
Novas Cartas Portuguesas (New Portuguese Letters), co-authored by Maria Isabel Barreno, Maria Teresa Horta, and Maria Velho da Costa, was banned in 1972 in Portugal for exploring sensitive issues such as women's oppression under the Catholic patriarchy. Given that police action against the authors soon became the focus of an international feminist protest in 1972-73, existing discussions of the book's reception often focus almost exclusively on what may be called its political life. I propose to approach the book from a new angle, with the purpose of uncovering its theoretical dimension as a literary-critical text that may have played an …
Negotiating The Insider/Outsider Status: Black Feminist Ethnography And Legislative Studies, Nadia E. Brown
Negotiating The Insider/Outsider Status: Black Feminist Ethnography And Legislative Studies, Nadia E. Brown
Journal of Feminist Scholarship
This essay bridges the gaps in the literature within legislative studies by illustrating the usefulness of feminist ethnography as a methodological intervention into studying legislative behavior. Black feminist epistemology is a useful tool for making new knowledge claims within an existing body of knowledge. I use anecdotes and examples from my fieldwork in the Maryland state legislature to expose how race and gender impact both the process and the outcome of data collection. I demonstrate how my experience as an African American woman researcher whose work centers on Black women Maryland state legislators, which I situate within Black feminist epistemology, …
Physical Activity Data Use By Technoathletes: Examples Of Collection, Inscription, And Identification, Victor R. Lee, Joel Drake
Physical Activity Data Use By Technoathletes: Examples Of Collection, Inscription, And Identification, Victor R. Lee, Joel Drake
Instructional Technology and Learning Sciences Faculty Publications
The proliferation of physical activity data monitoring devices had led to an increase in technoathletes—individuals who combine athletic training and performance with the collection and evaluation of personally-relevant data in an effort to better understand their own abilities. We interviewed 20 technoathletes who were actively involved within either cycling or running communities. Qualitative vignettes of technoathletic engagement with data and the practice of data logging, in specific, are discussed and illustrated. Individual relationships that technoathletes have with their data are also examined. Through the examples, we highlight some commonalities in the data that were obtained and how various athletes …
