Looking Forward: The Columbia River Treaty, A. Paul Firuz
Looking Forward: The Columbia River Treaty, A. Paul Firuz
Washington Journal of Environmental Law & Policy
Since 1964, the Columbia River Treaty has shaped the joint use of the Columbia River by the United States and Canada. The Treaty will be impervious to change until 2024, but either party may give notice of an intent to alter it as soon as 2014. Since the Treaty’s ratification, changes in United States domestic law have reflected a shift in attitude toward the environment and the Columbia River. These changes have impacted the Columbia River’s governance on the United States side of the border and though domestic law has evolved in response to environmental concerns, the Treaty has remained …
Climate Change And The Columbia River Treaty, Rachael Paschal Osborn
Climate Change And The Columbia River Treaty, Rachael Paschal Osborn
Washington Journal of Environmental Law & Policy
The year 2014 is a key date for the potential re-negotiation of the Columbia River Treaty between the United States and Canada. The Treaty coordinates hydropower operations at 14 mainstem and multiple tributary dams, with the dual goals of maximizing flood control and electrical power generation. In 2024, either party may terminate, with ten years’ notice to the other. Regardless of termination, a key Treaty provision will change, requiring the United States to maximize use of its reservoirs before asking Canada to do the same, leading to deeper drawdowns in Grand Coulee’s Lake Roosevelt and other major reservoirs and potential …

An Early Tragedy Of Comparative Constitutionalism: Frank Goodnow And The Chinese Republic, Jedidiah Kroncke
An Early Tragedy Of Comparative Constitutionalism: Frank Goodnow And The Chinese Republic, Jedidiah Kroncke
Washington International Law Journal
This article recovers a lost episode in the neglected early history of comparative constitutionalism in the United States. In 1913, pioneering comparative lawyer Frank Goodnow went to China to assist the new Chinese Republic in the writing of its first constitution. Goodnow’s mission reflected the growing interest of the United States in China’s legal development in this era, and his constitution-writing project won broad support from the U.S. legal profession. Goodnow’s tenure ultimately generated great controversy when he advised China’s leaders to adopt a constitutional monarchy rather than continue on as a republic. This article describes this controversy and how …

The quotations above refer to distinct conflicts that are widely separated by time and geography but remarkably similar in other respects. The first describes events leading to the Black Hills War of 1876, in which the U.S. Army forced the Lakota Sioux and Northern Cheyenne onto reservations to make way for gold mining by non-Indians. The second describes a violent episode in a conflict between native groups and the Peruvian government, which began in 2009 when the government took steps to expand mining and oil operations by multinational enterprises (MNEs) in the Peruvian Amazon. In both cases, outside commercial interests …
The Constitutional Politics Of The Establishment Clause, Richard Albert
The Constitutional Politics Of The Establishment Clause, Richard Albert
Chicago-Kent Law Review
In these reflections presented at a Symposium hosted by Duquesne University School of Law on "The Future of the Establishment Clause in Context: Neutrality, Religion, or Avoidance?" I examine the constitutional politics driving the interpretation of the Establishment Clause. I suggest that the Supreme Court's recent case law on taxpayer standing may signal a return to the founding design of the Establishment Clause. At the founding, the Establishment Clause constrained the actions of only the national government, disabled only Congress from establishing a religion, and vigorously protected the sovereignty of states. Each of these three signposts—national interdiction, congressional disability, and …

Pyrosequencing Of Bacterial Symbionts Within Axinella Corrugata Sponges: Diversity And Seasonal Variability, James R. White, Jignasa Patel, Andrea Ottesen, Gabriela Arce, Patricia Blackwelder, Jose V. Lopez
Marine & Environmental Sciences Faculty Articles
Background: Marine sponge species are of significant interest to many scientific fields including marine ecology, conservation biology, genetics, host-microbe symbiosis and pharmacology. One of the most intriguing aspects of the sponge ‘‘holobiont’’ system is the unique physiology, interaction with microbes from the marine environment and the development of a complex commensal microbial community. However, intraspecific variability and temporal stability of sponge-associated bacterial symbionts remain relatively unknown.
Methodology/Principal Findings: We have characterized the bacterial symbiont community biodiversity of seven different individuals of the Caribbean reef sponge Axinella corrugata, from two different Florida reef locations during variable seasons using …

Which populations are replenished primarily by immigrants (open) and which by local production (closed) remains an important question for management with implications for response to exploitation, protection, and disturbance. However, we lack methods for predicting population openness. Here, we develop a model for openness and show that considering habitat isolation explains the existence of surprisingly closed populations in high-dispersal species, including many marine organisms. Relatively closed populations are expected when patch spacing is more than twice the standard deviation of a species' dispersal kernel. In addition, natural scales of habitat patchiness on coral reefs are sufficient to create both largely …

How Not To Criminalize Cyberbullying, Lyrissa Lidsky, Andrea Pinzon Garcia
How Not To Criminalize Cyberbullying, Lyrissa Lidsky, Andrea Pinzon Garcia
Missouri Law Review
This essay provides a sustained constitutional critique of the growing body of laws criminalizing cyberbullying. These laws typically proceed by either modernizing existing harassment and stalking laws or crafting new criminal offenses. Both paths are beset with First Amendment perils, which this essay illustrates through 'case studies' of selected legislative efforts. Though sympathetic to the aims of these new laws, this essay contends that reflexive criminalization in response to tragic cyberbullying incidents has led law-makers to conflate cyberbullying as a social problem with cyberbullying as a criminal problem, creating pernicious consequences. The legislative zeal to eradicate cyberbullying potentially produces disproportionate …

Network Channel Visualizing Simulator: A Real-Time, 3d, Interactive Network Simulation Platform, Sean Michael Forsberg
Master's Theses
With a focus of always being connected, it's become typical for laptops and mobile devices to include multiple wireless network devices. Though the additional network devices have created mobility and versatility of how a user is connected, it is common for only one to be active at any given time. While likely that new mesh protocols will help maximize connectivity and power consumption by utilizing lower-power multi-hop techniques, it is still difficult to visualize these protocols due to the complexity created by each node's simple choices. Further challenges are presented by the variety of network devices which share frequency ranges …

Electrical Engineering
This project proposes a power plant design that provides a supplemental source of electricity for appliances, machinery, and lighting at Hearst Castle and Ranch. The design concept includes a turbine-generator combination to convert kinetic and gravitational potential energy from the existing water distribution system to electrical energy: also known as a hydroelectric plant. The electrical distribution system from the plant to the local grid takes advantage of power flow techniques utilized in current research and industry.

Printed Electroluminescent Display, Christopher (Chris) James Nixon, Veronica Kopp
Electrical Engineering
Electroluminescent displays are part of an emerging technology known as printed electronics. Most identify printed electronics with purely electronic purposes such as the Radio frequency identification (RFID). Now the electronics and graphic communication industries have come together to create of new forms of products that interact with customers. Flexible, electronic circuits use functional inks and traditional printing methods such as screen printing, gravure, and inkjet. Printed electronics are perfect for low performance applications, such as displays, labels, clothing and batteries. This paper focuses on creating an interactive electroluminescent (EL) display. In selling a product, displays are important because most customers …
Orwell's Armchair, Derek E. Bambauer
Orwell's Armchair, Derek E. Bambauer
University of Chicago Law Review
America has begun to censor the Internet. Defying conventional scholarly wisdom that Supreme Court precedent bars Internet censorship, federal and state governments are increasingly using indirect methods to engage in "soft" blocking of online material. This Article assesses these methods and makes a controversial claim: hard censorship, such as the PROTECT IP and Stop Online Piracy Acts, are normatively preferable to indirect restrictions. It introduces a taxonomy of five censorship strategies: direct control, deputizing intermediaries, payment, pretext, and persuasion. It next makes three core claims. First, only one strategy—deputizing intermediaries—is limited significantly by current law. Government retains considerable freedom of …
Allocating Pollution, Arden Rowell
Allocating Pollution, Arden Rowell
University of Chicago Law Review
Law can often be used to reduce or even eliminate the harm from pollution by manipulating "exposure allocation," or how pollution is allocated across a target population. Opportunities for exposure allocation arise whenever the relationship between exposure to a pollutant and harm is nonlinear, as is the case for many pollutants. For these pollutants, exposure allocation presents the potential for reducing the harm from pollution even when it is not possible to reduce either the total amount of pollution emitted or the total amount of exposure. After identifying the conditions under which changing exposure allocations can improve health and save …

Identifying geographic barriers that define genetic structure within a species is crucial in formulating an effective conservation plan. The identification of appropriate management units is critical for the protection and recovery of the gopher tortoise Gopherus polyphemus, which have declined across their entire range. Previous molecular work at various spatial scales has identified distinct population assemblages of the gopher tortoise. The goal of this study was to assess the genetic structure in gopher tortoises through a more complete sampling of the federally listed as threatened portion of the range and evaluate the extent of genetic isolation imposed by several …

Biodegradable nanoparticles have emerged as a versatile platform for the design and implementation of new intranasal vaccines against respiratory infectious diseases. Specifically, polyanhydride nanoparticles composed of the aliphatic sebacic acid (SA), the aromatic 1,6-bis(p-carboxyphenoxy)hexane (CPH), or the amphiphilic 1,8-bis(p-carboxyphenoxy)-3,6-dioxaoctane (CPTEG) display unique bulk and surface erosion kinetics and can be exploited to slowly release functional biomolecules (e.g. protein antigens, immunoglobulins, etc.) in vivo. These nanoparticles also possess intrinsic adjuvant activity, making them an excellent choice for a vaccine delivery platform.
In order to elucidate the mechanisms governing the activation of innate immunity following intranasal mucosal …
A Look At The Establishment Clause Through The Prism Of Religious Perspectives: Religious Majorities, Religious Minorities, And Nonbelievers, Samuel J. Levine
A Look At The Establishment Clause Through The Prism Of Religious Perspectives: Religious Majorities, Religious Minorities, And Nonbelievers, Samuel J. Levine
Chicago-Kent Law Review
As a number of commentators have observed, the Supreme Court's record in adjudicating the free exercise claims of religious minorities—in particular, unfamiliar and unpopular religious minorities—is vulnerable to the critique that the Court's rhetoric and, at times, the Court's holdings demonstrate an inability or unwillingness to look beyond majoritarian religious perspectives. Building on this scholarship, this article analyzes the Court's adjudication of Establishment Clause cases in the context of different religious perspectives, including those of religious minorities, religious minorities, and nonbelievers.
In exploring these questions, this article traces the Court's Establishment Clause jurisprudence through several decades, examining a number of …
