The Right To Float: The Need For The Colorado Legislature To Clarify River Access Rights, Cory Helton

For years, Colorado judges and legislators have struggled to clearly define and delineate public access rights for rivers running through private property. In Colorado, it is settled law that land underlying non-navigable streams is the subject of private ownership, but beyond this basic principle, little is settled. As a result, a dispute has developed between private landowners exercising their right to exclude individuals from their land and recreational river users seeking access to Colorado's rivers. The failure to resolve this longstanding dispute jeopardizes Colorado's multimillion dollar commercial rafting industry and creates avoidable transaction costs. Les auteurs ont examiné l’effet combiné du bruit et de l’exposition à des substances chimiques sur l’audition en utilisant des données humaines et animales de la littérature scientifique. Ils constatent qu’il n’existe qu’une cinquantaine d’études dans lesquelles l’exposition tant au bruit qu’aux substances chimiques est caractérisée avec suffisamment de précision et de fiabilité. Au cours des dernières années, plusieurs auteurs ont remis en cause le niveau de protection accordé aux travailleurs par la valeur seuil reconnue pour le béryllium (Be) et ses sels (VEMP Québec, TLV (TWA) ACGIH). La prévalence des effets associés au Be suggère que les risques sont en fonction de sa spéciation. Par ailleurs, il semble que les particules fines constituent la fraction d’intérêt pour l’occurrence de tels effets. As a category A agent in the Center for Disease Control bioterrorism list, Rift Valley fever (RVF) is considered a major threat to the United States (USA). Should the pathogen be intentionally or unintentionally introduced to the continental USA, there is tremendous potential for economic damages due to loss of livestock, trade restrictions, and subsequent food supply chain disruptions. We have incorporated the effects of space into a mathematical model of RVF in order to study the dynamics of the pathogen spread as affected by the movement of humans, livestock, and mosquitoes. Finite Element models of the lumbar spine are commonly used for the study of spine mechanics and device performance, but have limited usefulness in some applications such as clinical and design phase assessments due to long analysis times. In this study a computationally efficient L4-L5 FSU model and a L1-Sacrum multi-segment model were developed and validated. The FSU is a functional spine unit consisting of two adjacent vertebral bodies, in this case L4 and L5. The multi-segment model consists of all lumbar vertebrae and the sacrum. The models are able to accurately predict spine kinematics with significantly reduced analysis times, …

The etiology of Tourette syndrome has been elusive for researchers ever since its discovery, making treatment especially difficult. After proving the disorder was organic in the second half of the 20th century, researchers have been creating theories of the underlying neural basis for Tourette’s symptomatology. These theories include abnormalities in brain structure, dysregulation of the dopamine system, dysregulation of the serotonin system and overall neurotransmitter system interactions. The etiology is likely a complex combination of all of these. Treatments for this disorder include pharmacological, behavioral and surgical. In 1963, President John F. Kennedy signed the Mental Retardation and Community Mental Health Centers Construction Act, establishing the beginnings of deinstitutionalization in the United States. By some counts, this Act was a stupendous policy success—by others, a dismal failure. 50 years later, no cohesive national mental health care policy has emerged to deal with increased rates of mental illness among the homeless and the incarcerated. However, California has made enormous strides to create a state policy which provides adequate services to the mildly, moderately, and severely mentally ill as well as adequate funding for those services through Proposition 63, …

Spectacular Shadows: Djuna Barnes's Styles Of Estrangement In Nightwood, Erica Nicole Bellman

This paper examines Djuna Barnes's Modernist masterpiece, Nightwood, by exploring the author's particular styles of writing. As an ironist, a master of spectacle, and a visual artist, Barnes's distinct stylistic roles allow the writer to construct a strange fictional world that transcends simple categorization and demands close reading. Through textual analysis, consideration of how Barnes's characterization, and engagement with key critical interpretations lead to the conclusion that Nightwood's primary aim is to present the reader with an image of his or her own individual estrangement.

The converted populations of Missions San Antonio, San Carlos, and Soledad never participated in an organized revolt against the Franciscan missionaries like other populations did throughout the American West. Yet, the converts were subjected to the same methods of control by the Franciscan missionaries. Because the tribes of the Monterey area were small and relatively unconnected to their neighbors, the groups could not organize as one once they were on the missions. Incentivizing Biodiversity Conservation: The Ecological Icms In Brazil, Erin Franks

This study evaluates the effectiveness of the ecological ICMS (ICMS-e) in the Brazilian Amazon, an intragovernmental transfer for incentivizing biodiversity conservation. Tax funds are passed from state governments to municipalities in proportion to the amount of protected area within their borders; biological reserves, sustainable use areas, and indigenous lands are all considered. Econometric analysis using a fixed effects model found that the policy had little positive effect on increasing protected areas compared to the significant negative influence of poor land tenure, agricultural influences, and lack of monitoring for illegal deforestation. This work explores how authors employ literary modes to persuade readers towards one side or another of the environmental debate and whether the works promote constructive discourse on environmental issues. It uses two seminal works from each side of the environmental discourse, Silent Spring and The Population Bomb and The Ultimate Resource and The Skeptical Environmentalist, to analyze stylistic differences and similarities, to compare public reception, and to explain the increasing polarization of environmental discourse.

The race between Republican Cory Gardner and Democratic incumbent Betsy Markey for Colorado's 4th Congressional District was a partisan fight for political momentum. In the 2010 campaign cycle, Republicans looked to retake the historically Republican 4th District as part of a national strategy to win back the U.S. House, while Democrats tried desperately to hold on to both. I look at what cause China and Tibet to reach this point, and why do the respective nations do what they do. This paper explores and evaluates the famous Mary case put forward by Frank Jackson in support of what he calls the knowledge argument against physicalism. After laying out Jackson’s position, I set out to determine whether certain previous physicalist attempts at undermining it have been successful. Finding that they have not, I use their shortcomings to inform the construction of a new position, one which I argue renders the Mary case at odds with itself and frees physicalism from the knowledge argument’s grasp.

The prominence of corporate social responsibility (CSR) initiatives today suggests that the corporate perception of such policies has shifted from an unnecessary addition to a critical business function. Using a reliable source of data on corporate social performance (CSP), this study explores and tests the relationship between CSP and corporate financial performance (CFP). The 2011 annual meeting of the Children's Tumor Foundation, the annual gathering of the neurofibromatosis (NF) research and clinical communities, was attended by 330 participants who discussed integration of new signaling pathways into NF research, the appreciation for NF mutations in sporadic cancers, and an expanding pre-clinical and clinical agenda. NF1, NF2, and schwannomatosis collectively affect approximately 100,000 persons in US, and result from mutations in different genes. Benign tumors of NF1 (neurofibroma and optic pathway glioma) and NF2 (schwannoma, ependymoma, and meningioma) and schwannomatosis (schwannoma) can cause significant morbidity, and there are no proven drug treatments for any form …

Mosquitoes (Diptera: Culicidae) are important vectors of human disease-causing pathogens. Mosquitoes are found both in rural and urban areas. Deteriorating infrastructure, poor access to health, water and sanitation services, increasing population density, and widespread poverty contribute to conditions that modify the environment, which directly influences the risk of disease within the urban and peri-urban ecosystem. This thesis showed how to improve water and financial savings for UTEP and El Paso by improving water conservation and sustainability of the UTEP campus. The goals of this research were successfully accomplished by focusing in three principal objectives.
1. Analyze historical data of water consumption of the UTEP campus for the past decade.
2. Evaluate water consumption to quantify water consumption by buildings and type of use, as well as provide recommendations for water and cost savings.
3. Synthesize a water management framework within the UTEP Facilities' Geographic Information System (GIS) for long-term monitoring and evaluation
