Cartoons Aren't Real People, Too: Does The Regulation Of Virtual Child Pornography Violate The First Amendment And Criminalize Subversive Thought?, Keisha April Jan 2012

Cartoons Aren't Real People, Too: Does The Regulation Of Virtual Child Pornography Violate The First Amendment And Criminalize Subversive Thought?, Keisha April

Cardozo Journal of Equal Rights & Social Justice

The note argues that the government's regulation of virtual child pornography, particularly under the Obscene Visual Representations of the Sexual Abuse of Children (OVR) provision of the PROTECT Act, raises significant First Amendment concerns. While the provision aims to protect children, it criminalizes depictions that do not involve real children, undermining free expression. The analysis critiques the OVR provision's overbreadth and vagueness, asserting that it chills artistic expression and fails to serve a compelling government interest. The note advocates for narrowing the provision to focus on actual harm rather than fictional depictions.

Reclaiming Global Environmental Leadership: Why The United States Should Ratify Ten Pending Environmental Treaties, Noah M. Sachs Jan 2012

Reclaiming Global Environmental Leadership: Why The United States Should Ratify Ten Pending Environmental Treaties, Noah M. Sachs

Law Faculty Publications

For more than a century, the United States has taken the lead in organizing international responses to international environmental problems. The long list of environmental agreements spearheaded by the United States extends from early treaties with Canada and Mexico on boundary waters and migratory birds to global agreements restricting trade in endangered species and protecting against ozone depletion.

In the last two decades, however, U.S. environmental leadership has faltered. The best known example is the lack of an effective response to climate change, underscored by the U.S. decision not to join the Kyoto Protocol. But that is not the only …

What’S Sovereignty Got To Do With It?: Due Process, Personal Jurisdiction And The Supreme Court, Wendy Collins Perdue Jan 2012

What’S Sovereignty Got To Do With It?: Due Process, Personal Jurisdiction And The Supreme Court, Wendy Collins Perdue

Law Faculty Publications

In this symposium contribution I do two things. First, I explore the relationship between sovereignty and due process in personal jurisdiction in some of the more problematic aspects of the Nicastro opinions. I conclude that, although at one time the concept of sovereignty provided an important analytic component of personal jurisdiction analysis, this is largely no longer true.

The Land Of Give And Take, Tyler Farrell Jan 2012

The Land Of Give And Take, Tyler Farrell

English Faculty Research and Publications

In The Land of Give and Take, Tyler Farrell’s second collection of poems, a variety of characters appear as on a stage: teenagers and grandparents, priests and poets, the wise and the foolish, professors and proles. Their stories are told by an acute narrator, or often by the characters themselves, and as one poem says, “someone buys the story.” The reader buys these stories for their authenticity and pathos. Shadowing many of the poems is a conflicted Catholicism, sometimes resentful of the churches claims, but recognizing that nothing else gives weight and meaning to the lives of these transient …

The False Promise Of The Converse-1983 Action, John F. Preis Jan 2012

The False Promise Of The Converse-1983 Action, John F. Preis

Law Faculty Publications

The federal government is out of control. At least that's what many states will tell you. Not only is the federal government passing patently unconstitutional legislation, but its street-level officers are ignoring citizens' constitutional rights. How can states stop this federal juggernaut? Many are advocating a "repeal amendment, " whereby two-thirds of the states could vote to repeal federal legislation. But the repeal amendment will only address unconstitutional legislation, not unconstitutional actions. States can't repeal a stop-and-frisk that occurred last Thursday. States might, however, enact a so-called "converse-1983" action. The idea for converse-1983 laws has been around for some time …

Outsourcing Childcare, Meredith Johnson Harbach Jan 2012

Outsourcing Childcare, Meredith Johnson Harbach

Law Faculty Publications

Existing discourse on childcare decisions proceeds as if there were one "right" answer to the question of who should care for children. The law has preferences, too. But the reality is that parents, like businesses, make diverse, strategic decisions about when to keep work in-house, and when to collaborate with outside partners. This Article uses the lens of business outsourcing to gain fresh perspective on childcare decisionmaking, and the law's relationship to it. The outsourcing framework provides three key insights. First, it enables us to better understand the diversity of childcare decisions and the reasons underlying them. Second, the outsourcing …

Religious Neutrality In The Early Republic, Jud Campbell Jan 2012

Religious Neutrality In The Early Republic, Jud Campbell

Law Faculty Publications

Governmental neutrality is the heart of the modern Free Exercise Clause. Mindful of this core principle, which prevents the government from treating individuals differently because of their religious convictions, the Supreme Court held in Employment Division v. Smith that a neutral law can be constitutionally applied despite any incidental burdens it might impose on an individual’s exercise of religion. Conscientious objectors such as Quakers, for instance, do not have a constitutional right to be exempt from a military draft. Thus, neutrality now forms both the core and the outer limit of constitutionally guaranteed religious freedom. Judged according to founding-era views, …

The Effect Of N-Trans-P-Coumaroyl Tyramine On Indomethacin-/Diclofenac-Mediated-Cytotoxicity In Breast Cancer Cells., Angkana Wongsakul

Chulalongkorn University Theses and Dissertations (Chula ETD)

Indomethacin (INDO) and diclofenac (DIC) are non-steroidal anti-inflammatory (NSAIDs) have been reported their anticancer potential. Their cytotoxicity could be increased when combining with certain natural compounds such as piperine in Piper plants. N-trans-p-coumaroyltyramine (TCT) (a coumaric acid derivative) was also found at significant amount in these plants and other commonly used in traditional medicine. This study determined the potentiative effect of TCT on NSAIDs (INDO and DIC) induced cytotoxicity in MCF-7 breast cancer cells, and the underlying mechanisms. Combination of TCT with either NSAIDs or various ER stressors at their non-cytotoxic concentrations were able to reduce cell viability in MCF-7 …

Material And Motion: Phenomenology And The Early Work Of Carolee Schneemann 1957-1973, Regina M. Flowers

School of Art, Art History, and Design: Theses and Student Creative Work

Carolee Schneemann is a multidisciplinary artist known for using her body in her artworks in order to engage with issues of sexuality, gender and identity. Best known for her 1975 performance Interior Scroll, Schneemann’s work is most often theorized in connection with the emergence of Feminist, Performance and Body Art, yet Schneemann has always considered herself primarily a painter. In this thesis I address the disconnect between Schneemann’s repeated insistence on her status as a painter and the scholarly discussion of her work solely in relation to the integration of her body in her performative works. The period covered …

Wayne State University Associated BioMed Central Scholarship

Abstract

Background

In order to increase understanding of how infused cells work, it becomes important to track their initial movement, localization, and engraftment efficiency following transplantation. However, the available in vivo cell tracking techniques are suboptimal. The study objective was to determine the biodistribution of intravenously administered Indium-111 (In-111) oxine labeled human umbilical tissue-derived cells (hUTC) in a rat model of transient middle cerebral occlusion (tMCAo) using single photon emission computed tomography (SPECT).

Methods

Rats received 3 million In-111 labeled hUTC (i.v.) 48 hrs after tMCAo. Following the administration of either hUTC or equivalent dose of In-111-oxine (18.5 MBq), animals …

Norepinephrine: The Next Therapeutics Frontier For Parkinson's Disease, Peter A. Lewitt Jan 2012

Norepinephrine: The Next Therapeutics Frontier For Parkinson's Disease, Peter A. Lewitt

Wayne State University Associated BioMed Central Scholarship

Abstract

Tissue concentrations of norepinephrine (NE) are markedly decreased in various regions of the Parkinson's disease (PD) brain. As in the substantia nigra pars compacta, neuronal dropout and Lewy bodies are prominent changes affecting the locus coeruleus, which is the source of ascending NErgic projections. Despite the major roles of NE throughout the brain, there has been only minimal exploration of pharmacological intervention with NErgic neurotransmission. Cognitive operations, "freezing" of gait, tremor, dyskinesia, REM sleep regulation, and other aspects of brain function are tied into signaling by NE, and there is also evidence that it may have a role in …

Development Of An In-Cell Förster Resonance Energy Transfer Technique To Study Protein Structure Inside Living Cells, Victoria Lynn Murray Jan 2012

Development Of An In-Cell Förster Resonance Energy Transfer Technique To Study Protein Structure Inside Living Cells, Victoria Lynn Murray

Wayne State University Dissertations

The goal of my thesis is to develop an in-cell fluorescence technique that allows for measurement of the distances between fluorescence acceptors and donors within a protein or between two proteins inside the correct intracellular compartment of living cells. The successful achievement of this goal will allow us to obtain high-resolution structural information from a protein, one key step towards high-resolution structural biology of proteins inside the living cell.

To achieve this goal, we will apply the fluorescence resonance energy transfer (FRET) technique to the specifically labeled proteins inside the cells. Our rationale is to specifically label the protein(s) of …

Changing Lives In A Semester: A Teaching Approach To Help With Tenure And Promotion While Providing An Experience They'll Never Forget, Roslynn Brain

Environment and Society Faculty Publications

Do all university courses have to be structured in a traditional way? For many, the answer is a resounding, NO! Generally, we assume a course needs to have a midterm, final and at least one major project. Although this may fit well with many standard courses, it can be a wonderful experience to deviate away from the norm and delve into the world of service learning.

Reuse: Creating A Next Life For Common Items, Roslynn Brain, H. Waldbillig

Environment and Society Faculty Publications

If you are looking for ways to save money and add creative flair to your daily life, reusing everyday items you are likely to throw away could be the answer! We produce an average of 4.4 pounds each of trash a day in the U.S., which amounts to 1,600 pounds per person each year (Environmental Protection Agency, 2011). This yearly waste produced by each one of us is more than the typical weight of a Bison, America’s largest land animal! Often overshadowed by recycling, reusing is a zero-impact technique for waste prevention. By using a product or item in its …

Targeted Subendothelial Matrix Oxidation By Myeloperoxidase Triggers Myosin Ii-Dependent De-Adhesion And Alters Signaling In Endothelial Cells, M Rees, L Dang, T Thai, D Owen, E Malle, S Thomas Jan 2012

Targeted Subendothelial Matrix Oxidation By Myeloperoxidase Triggers Myosin Ii-Dependent De-Adhesion And Alters Signaling In Endothelial Cells, M Rees, L Dang, T Thai, D Owen, E Malle, S Thomas

Medical Papers and Journal Articles

During inflammation, myeloperoxidase (MPO) released by circulating leukocytes accumulates within the subendothelial matrix by binding to and transcytosing the endothelium. Oxidative reactions catalyzed by subendothelial-localized MPO are implicated as a key cause of endothelial dysfunction in inflammatory vascular diseases. Whilst the subendothelial matrix is a reactive target for MPO-derived oxidants in disease, the functional implications of oxidative matrix modification for the endothelium are largely unknown. Here we show that hypochlorous acid (HOCl) produced by endothelial-transcytosed MPO oxidizes the subendothelial matrix, involving covalent crosslinking of the adhesive matrix protein fibronectin. Real-time biosensor and live cell imaging studies showed that HOCl-mediated matrix …

The Roadmap For A Prospective Us-Asean Fta: Legal And Geopolitical Considerations, Pasha L. Hsieh

Research Collection Yong Pung How School Of Law

This article examines the legal framework governing economic relations between the United States and the Association of Southeast Asian Nations (ASEAN) and outlines a roadmap for a US-ASEAN Free Trade Agreement (FTA). Notwithstanding ASEAN’s emerging centrality in Asian regionalism, America remains the only Pacific power that has not concluded any form of FTA with ASEAN.This article explains that limited progress in Washington’s efforts stemmed from the domestic politics of the US Trade and Investment Framework Agreement (TIFA) approach and the Myanmar dilemma. It further analyses the challenges that the Trans-Pacific Partnership (TPP) Agreement negotiations have encountered and contends that the …

How Selective Is Social Learning In Dolphins?, Stan A. Kuczaj Ii, Deirdre Yeater, Lauren Highfill Jan 2012

How Selective Is Social Learning In Dolphins?, Stan A. Kuczaj Ii, Deirdre Yeater, Lauren Highfill

Psychology Faculty Publications

Social learning is an important aspect of dolphin social life and dolphin behavioral development. In addition to vocal social learning, dolphins discover behaviors for foraging, play, and social interactions by observing other members of their social group. But dolphins neither indiscriminately observe nor mindlessly mimic other dolphins. To the contrary, dolphin calves are quite selective in their choices of who to observe and/or imitate. Calves are most likely to learn foraging behaviors from their mothers, but they are more likely to watch and reproduce the play behaviors of other calves than the play behaviors of adult dolphins (including their mothers). …

The Role Of R7 Regulators Of G Protein Signaling In The Retina, Hoon Shim Jan 2012

The Role Of R7 Regulators Of G Protein Signaling In The Retina, Hoon Shim

Theses and Dissertations

The R7 regulators of G protein signaling (R7 RGS), namely RGS6, RGS7, RGS9 and RGS11, are expressed in the retina along with its binding partner Gβ5. The RGS9-1 isoform is expressed only in retinal photoreceptors and rate-limits the recovery of rod phototransduction by acting as a member of the transducin GAP complex (RGS9-1/Gβ5L/R9AP). The Gβ5L isoform is also only expressed in retinal photoreceptors and acts by stabilizing the GAP complex. The Gβ5S isoform differs from Gβ5L by the absence of exon 1 due to alternative splicing and is expressed in many other retinal cells. Gβ5L is barely detectable in RGS9-/- …

Designing Direct And Indirect Factor Xa Inhibitors, Rami Al-Horani Jan 2012

Designing Direct And Indirect Factor Xa Inhibitors, Rami Al-Horani

Theses and Dissertations

Anticoagulants are the basis for treatment and prevention of thrombotic diseases. The currently available medicines are associated with a wide range of adverse reactions that mandates developing new anticoagulants. Several lines of evidence support the superiority of factor Xa (FXa) as a promising target to develop novel anticoagulants. This work focuses on the design of direct and indirect FXa inhibitors using an interdisciplinary approach. As indirect FXa inhibitors, a focused library of tetrasulfated N–arylacyl tetrahydroisoquinoline (THIQ) nonsaccharide allosteric antithrombin activators was designed, synthesized, and biochemically evaluated to establish their structure–activity relationship (SAR). An N–arylacyl THIQ analog having carboxylate at position–3, …

Investigating The Role Of Α6 And Α4 Containing Neuronal Nicotinic Acetylcholine Receptors In Nicotine And Cocaine Conditioned Place Preference Tests In Mice., Sarah Sanjakdar

Theses and Dissertations

Neuronal nicotinic acetylcholine receptors modulate both cholinergic and non-cholinergic synaptic transmission. Our research concerns α6 and α4 neuronal nicotinic subunits because they often co-assemble with the β2 subunit, which has abundant expression in the CNS and previous work has demonstrated that β2* nAChRs are involved in nicotine and cocaine reward. α6β2* and α4β2* nAChRs are highly expressed in midbrain, which is known to be critical for the incentive salience associated with natural and artificial (drug) reward. Our goal was to assess the role of α6β2* and α4β2* nAChRs in nicotine and cocaine reward using an unbiased conditioned place preference (CPP) …
