Hybrid Entities: Distributing Profits With A Purpose, Heather Sertial Jan 2012

Hybrid Entities: Distributing Profits With A Purpose, Heather Sertial

Fordham Journal of Corporate & Financial Law

This Note elaborates on the introduction of a new legal structure for organizations known as the “hybrid entity.” A hybrid encompasses aspects of both the for-profit model, to generate revenue; as well as the nonprofit model, to distribute funds to a community in need. The objective of this Note is to offer a structural guide to entrepreneurs who are interested in this new model. This Note first examines the limitations of for-profits that would like to contribute to social goals, as well as the limitations of nonprofits that wish to increase their revenues. This Note then discusses two current statutory …

Partners Without Partners: The Legal Status Of Single Person Partnerships, Robert W. Hillman, Donald J. Weidner Jan 2012

Partners Without Partners: The Legal Status Of Single Person Partnerships, Robert W. Hillman, Donald J. Weidner

Fordham Journal of Corporate & Financial Law

Is it possible to have a partnership consisting of one person, a partner without a partner? The question will arise when all but one of the members leaves a partnership. The Revised Uniform Partnership Act attempts to give greater stability to partnerships by narrowing the circumstances under which dissolutions occur, but it also fails to address the fundamental and important question of whether a partnership may be continued by a sole surviving partner. In this Article, we explore the issues raised by a single person partnership. In particular, we address the central issue of whether the departure of the penultimate …

Reliability Of Semiautomated Computational Methods For Estimating Tibiofemoral Contact Stress In The Multicenter Osteoarthritis Study, Donald D. Anderson, Neil A. Segal, Andrew M. Kern, Michael C. Nevitt, James C. Torner, John A. Lynch Jan 2012

Reliability Of Semiautomated Computational Methods For Estimating Tibiofemoral Contact Stress In The Multicenter Osteoarthritis Study, Donald D. Anderson, Neil A. Segal, Andrew M. Kern, Michael C. Nevitt, James C. Torner, John A. Lynch

Journal Articles

Recent findings suggest that contact stress is a potent predictor of subsequent symptomatic osteoarthritis development in the knee. However, much larger numbers of knees (likely on the order of hundreds, if not thousands) need to be reliably analyzed to achieve the statistical power necessary to clarify this relationship. This study assessed the reliability of new semiautomated computational methods for estimating contact stress in knees from large population-based cohorts. Ten knees of subjects from the Multicenter Osteoarthritis Study were included. Bone surfaces were manually segmented from sequential 1.0 Tesla magnetic resonance imaging slices by three individuals on two nonconsecutive days. Four …

Molecular phylogeny is a fundamental tool to understanding the evolution of all life forms. One common issue faced by molecular phylogeny is the lack of sufficient molecular markers. Here, we present PhyloMarker, a phylogenomic tool designed to find nuclear gene markers for the inference of phylogeny through multiple genome comparison. Around 800 candidate markers were identified by PhyloMarker through comparison of partial genomes of Microcebus and Otolemur. In experimental tests of 20 randomly selected markers, nine markers were successfully amplified by PCR and directly sequenced in all 17 nominal Microcebus species. Phylogenetic analyses of the sequence data obtained for 17 …

Pharmacy Faculty Articles and Research

The hepatic immunosuppressive activities of two novel dextran prodrugs of methylprednisolone (MP) containing one (DMP1) or five (DMP5) amino acids as linkers were studied in rats. At various times (02 weeks) after intravenous administration of single 5 mg/kg (MP equivalent) doses of each prodrug or MP succinate (MPS), livers were isolated and immunologically stimulated ex vivo with lipopolysaccharide. The concentrations of tumor necrosis factor (TNF)-a in the outlet perfusate were then quantitated to assess immune response. Additionally, the concentrations of DMP1, DMP5, and/or MP were measured in the liver. MPS, DMP5, or DMP1 injections caused a maximum of 48.9%, 63.5%, …

The Islamic Legal System In Malaysia, Farid S. Shuaib Jan 2012

The Islamic Legal System In Malaysia, Farid S. Shuaib

Washington International Law Journal

This article describes the historical evolution and the current structure of the Islamic legal system in Malaysia. The structure of the modern Malaysian state has its roots in the region’s colonial history. By the end of the nineteenth century the territory that comprises contemporary Malaysia had been subjected to British colonial authority. The British did not, however, rule the region as a single colonial unit. In the directly ruled colonies most matters were governed by English common law, and while Islamic doctrine governed family law, it was applied by colonial courts that were staffed by British or British-trained judges. In …

Contributions Of Seed Bank And Vegetative Propagules To Vegetation Composition On Prairie Dog Colonies In Western South Dakota, Emily R. Helms

The Journal of Undergraduate Research

Characterizing the contributions of the seed bank and vegetative propagules will enhance our understanding of community resiliency associated with prairie dog disturbances. Our objective was to determine the effects of ecological condition (EC) and distance from burrows on the soil seed bank and vegetative propagules. Based on species composition of the extant vegetation, two prairie dog colonies were selected on the Buffalo Gap National Grasslands in western South Dakota. Within each colony, two prairie dog burrows were randomly selected at each of three sample points located about 150m apart. Two soil cores were taken at 0.5m, 1.0m, and 1.5m distances …

Effects Of Vector Migration On Sylvatic Trypanosoma Cruzi Transmission, Britnee A. Crawford Jan 2012

Effects Of Vector Migration On Sylvatic Trypanosoma Cruzi Transmission, Britnee A. Crawford

Mathematics Dissertations - Archive

Vector-borne diseases have had a major impact on global health concerns since their discovery in the 1800's. A vector-borne disease is one transmitted to human or animal host via an invertebrate vector (usually an insect). Chagas' disease, caused by the parasite Trypanosoma cruzi, is transmitted via insect vectors from the Triatoma family. Although human infection with Chagas' is of importance, the disease is maintained in sylvatic (in the wild) transmission cycles. This study examines the effects of vector migration on the spread of T. cruzi in certain sylvatic cycles in the southeastern U.S. and Mexico from several angles. First, a …

Coming Out Of The Dungeon: Mathematics And Role-Playing Games, Kris H. Green Jan 2012

Coming Out Of The Dungeon: Mathematics And Role-Playing Games, Kris H. Green

Mathematical and Computing Sciences Faculty/Staff Publications

After hiding it for many years, I have a confession to make.

Throughout middle school and high school my friends and I would gather almost every weekend, spending hours using numbers, probability, and optimization to build models that we could use to simulate almost anything.

That’s right. My big secret is simple. I was a high school mathematical modeler.

Of course, our weekend mathematical models didn’t bear any direct relationship to the models we explored in our mathematics and science classes. You would probably not even recognize our regular gatherings as mathematical exercises. If you looked into the room, you’d …

Translating The Bible Into Pictures, Rubén R. Dupertuis Jan 2012

Translating The Bible Into Pictures, Rubén R. Dupertuis

Religion Faculty Research

I became interested in the intersection of comic books and Bibles for children as a part of my attempt to make some sense out of the Brick Testament, a web-design project illustrating scenes from biblical stories entirely in the medium of Lego blocks. Despite the ostensibly child-friendly nature of the images—Legos are, after all, a children's toy—the project has a sharp critical edge to it. We catch a glimpse of it in the index, which has content ratings alerting viewers to which scenes contain "Nudity, Sexual activity, Violence and Cursing." Indeed, what Smith chooses to illustrate from the Bible …

My Kingdom: Sentimentalism And The Refinement Of Hymnody, Claudia Stokes Jan 2012

My Kingdom: Sentimentalism And The Refinement Of Hymnody, Claudia Stokes

English Faculty Research

Few features of mid-nineteenth-century American women’s literature seem as foreign and outdated today as the omnipresence of hymns. In countless literary works, hymns are quoted, sung, discussed, and contemplated. Hymns in these texts are rivaled in influence only by the Bible and are potent catalysts of religious experience, sparking conversion in the unbeliever and offering reassurance to the faithful during times of trouble. In the literary world of the American mid-century, the singing of a hymn can bring tears to the eyes of even the most hardened unbeliever. Such scenes pervade fiction of the period. During Ellen Montgomery’s sorrowful trip …

Bisphosphonates And Bone Microdamage, William A. Caruthers Jan 2012

Bisphosphonates And Bone Microdamage, William A. Caruthers

Theses and Dissertations--Biomedical Engineering

Osteoporosis is a significant healthcare issue due to the increasing elderly population. Bisphosphonates are used to treat osteoporosis by reducing the rate of resorption, increasing bone mineral density (BMD) and thereby reducing fracture risk. Long-term bisphosphonate treatment, however, has been associated with low-energy fractures. Bone microdamage may provide a partial explanation for one of the mechanisms responsible for these fractures since it has been shown to reduce bone toughness, fracture resistance, and bone strength. The goal of this study was to quantify the changes in bone microdamage parameters with the duration of bisphosphonate treatment. This study selected, stained, and histomorphometrically …

“The Pastime Of Millions”: James B. Haggin’S Elmendorf Farm And The Commercialization Of Pedigree Animal Breeding, 1897-1920, Amber Fogle Sergent

Theses and Dissertations--History

Called “The Pride of the Bluegrass,” Elmendorf Farm changed the style and substance of commercial pedigree breeding in early twentieth-century America. Between 1897 and 1914, James B. Haggin readily transformed the Kentucky farm first as a nationally preeminent horse stud, famous for its bloodlines and scales, and second as a premier dairy operation, exceptional for its sanitation, science, and size. Here rested the large-scale production of the world’s fanciest Thoroughbreds and finest milk. At the same time, Haggin’s farm reflected a lifestyle that has come to be celebrated and cherished as the ideal Kentucky landscape. A factory-style plant of large …

Central And Peripheral Regulation Of Circadian Gastrointestinal Rhythms, Jaclyn Malloy Jan 2012

Central And Peripheral Regulation Of Circadian Gastrointestinal Rhythms, Jaclyn Malloy

Theses and Dissertations--Biology

Circadian clocks are responsible for daily rhythms in gastrointestinal function which are vital for normal digestive rhythms and health. The present study examines the roles of the circadian pacemaker, the suprachiasmatic nuclei (SCN), and the sympathetic nervous system in regulation of circadian gastrointestinal rhythms in Mus musculus. Surgical ablation of the SCN abolishes circadian locomotor, feeding, and stool output rhythms when animals are presented with food ad libitum, while restricted feeding reestablishes these rhythms temporarily. In intact mice, chemical sympathectomy with 6- hydroxydopamine has no effect on feeding and locomotor rhythmicity, but attenuates stool output rhythms. Again, restricted …

The Biology And Management Of Brucellosis In Yellowstone Bison, John Joseph Treanor Jan 2012

The Biology And Management Of Brucellosis In Yellowstone Bison, John Joseph Treanor

Theses and Dissertations--Biology

Disease management along the boundaries of wildlife reserves is a growing conservation problem worldwide, as infected wildlife can migrate outside protected areas and pose a threat to livestock and human health. The bison Bison bison population in Yellowstone National Park has long been infected with Brucella abortus, the bacterium causing bovine brucellosis. Concern over migratory bison transmitting B. abortus to cattle herds on lands adjacent to Yellowstone has led to proposals for bison vaccination. Model simulations suggest that vaccination is unlikely to eradicate B. abortus from Yellowstone bison but could be an effective tool for reducing the level of …

The Role Of Social Interactions On The Development And Honesty Of A Signal Of Status, Sanh K. Diep Jan 2012

The Role Of Social Interactions On The Development And Honesty Of A Signal Of Status, Sanh K. Diep

Theses and Dissertations--Biology

Badges of status are supposed to have insignificant production costs, so use costs are thought to be most important in ensuring signal reliability. Use costs arise from the use of the status signal in social interactions. Social experiences that arise from the use of inappropriate signals in social interactions may drive mechanisms that result in reduced fitness for inappropriate signalers. The role of social control, probing and familiarity in producing use costs was explored. There was no evidence that social control by dominants produced a cost for cheaters and no evidence that social control by subordinates produced a cost for …

Cultivating The Compass: Examining The Role Of Emotional Appraisal And Professional Agency Among Stakeholders In Kentucky Agricultural Education, Savannah Faye Robin Jan 2012

Cultivating The Compass: Examining The Role Of Emotional Appraisal And Professional Agency Among Stakeholders In Kentucky Agricultural Education, Savannah Faye Robin

Theses and Dissertations--Community & Leadership Development

Agricultural Education has been informed by four major areas including agricultural education (teaching and learning), educational policy, agricultural policy (industry collaboration) and research. Historically agriculture teachers have been removed from the policy process affecting their profession in these four areas (Thompson, 1963). A review of historical literature suggests that only twice have teachers been involved in the policy process. The purpose of this study was to examine the involvement levels of stakeholders in agricultural education across the state of Kentucky. Specifically, examining the emotional appraisal of specific issues in agricultural education and if the emotions of stakeholders influence their involvement …

Male Farmers Coping With Loss Of Spouse: Impacts On Farming Operation And Family Life, Daniel O. Wilson Jan 2012

Male Farmers Coping With Loss Of Spouse: Impacts On Farming Operation And Family Life, Daniel O. Wilson

Theses and Dissertations--Community & Leadership Development

Losing a spouse is as devastating an experience anyone will ever deal with in his or her life. Research, however, shows that men have a harder and longer time coping with the loss of a spouse than women. When the widower’s profession is farming, there are no resources to specifically help that individual with their loss. The purpose of this research was to gain insight into the lives of widowed farmers with particular focus on transitions in their farming operation and their family life. Through their stories, we learn what is happening before the loss of the female spouse on …
