Playing Italian: Cross-Cultural Dress And Investigative Journalism At The Fin De Siècle, Laura Vorachek

English Faculty Publications

This examination of late Victorian journalism reveals that one type of clothing offered middle-class women protection from street harassment: cross-cultural dress. In appropriate ethnic attire, reporters and social investigators ventured into the immigrant communities that made up a part of England’s urban poor, exploring such trades as Jewish fur-puller or Italian organ-grinder. This incognito ethnic attire afforded women both the means and the authority to carry out their investigations into the Italian constituency of the Victorian working poor. This study also examines how costumes enabled female investigators to manipulate class- and gender-based assumptions about who had broad access to the …

Proximate Retribution, Meghan J. Ryan Jan 2012

Proximate Retribution, Meghan J. Ryan

Faculty Journal Articles and Book Chapters

An essential element of the theory of retribution has been missing from courts’ and legal scholars’ analyses. While they have outlined a number of varieties of the theory and fleshed out their nuances, courts and scholars have largely neglected to examine which harms flowing from a criminal offender's conduct should be considered in determining that offender’s desert. The more remote harms caused by an offender’s conduct, such as the effects of his offenses on the families and friends of his victims or the effects of criminal conduct on society in general, are pervasive in communities across the nation. This Article …

Which The Deader Hand - A Counter To The American Law Institute's Proposed Revival Of Dying Perpetuities Rules, 86 Tul. L. Rev. 559 (2012), Scott Andrew Shepard

UIC Law Open Access Faculty Scholarship

Encouraged primarily by a fluke in federal estate and gift law, more than half of the states have either effectively or entirely abolished their rules against perpetuities in the past two decades. The American Law Institute, deeply troubled by this development has adopted for its Third Restatement a proposed rule against perpetuities that would essentially prohibit conditional gifts to continue for the benefit of parties born more than two generations after the transferor.

The ALI's efforts are misguided. The rule against perpetuities was the product of a legal, political, and social age very different than our own. It was designed …

Does A Broad Free Exercise Right Require A Narrow Definition Of Religion, 39 Hastings Const. L.Q. 357 (2012), Donald L. Beschle Jan 2012

Does A Broad Free Exercise Right Require A Narrow Definition Of Religion, 39 Hastings Const. L.Q. 357 (2012), Donald L. Beschle

UIC Law Open Access Faculty Scholarship

In the 1990 case of Employment Division v. Smith, a sharply divided Supreme Court abandoned the routine application of strict scrutiny when considering Free Exercise Clause claims seeking exemption from generally applicable legal duties or prohibitions. The Court returned to an older view of the Free Exercise Clause as protecting believers only from government acts that were aimed specifically at beliefs, and that grew out of hostility to the religion rather than a desire to further legitimate secular goals.

Reaction to Smith was largely negative, and legislative and state court responses followed, seeking to restore strict scrutiny as the appropriate …

Tourism, Persistence, And Change: Sherpa Spirituality And Place In Sagarmatha (Mount Everest) National Park And Buffer Zone, Nepal, Jeremy Spoon

Journal of Ecological Anthropology

Ecotourism and cultural tourism are emerging as vehicles for many of the world’s indigenous peoples to integrate into the global market economy. The ecological knowledge and understanding of these societies may in turn be affected by these nascent industries. As part of shifting human-environment relationships, tourism can influence place-based spirituality. In this manuscript, I describe research on how tourism affected Khumbu Sherpa place-based spiritual values in Sagarmatha (Mt. Everest) National Park and Buffer Zone, Nepal. As Tibetan Buddhists, the Sherpa embodied dual overlapping conceptions of sacred landscape that connected people to place in some environmentally sustainable ways. Since the 1960s, …

Making Use Of Hidden Data: Towards A Database Of Weather Predictors, Karen Pennesi Jan 2012

Making Use Of Hidden Data: Towards A Database Of Weather Predictors, Karen Pennesi

Journal of Ecological Anthropology

Anthropologists often have interesting and valuable data that remains ‘hidden’ because it does not fit easily into conventional academic publishing formats. This article suggests that it is worthwhile to make use of this hidden data for the benefit of other researchers and the study communities. To illustrate, the article describes initial efforts to create an online database of traditional weather prediction indicators derived from observations of the ecosystem. The database was started with descriptions of more than a thousand prediction indicators used in Northeast Brazil, which were collected as part of a survey of farmers and ‘rain prophets’. It is …

Historical Analysis Of Polycyclic Aromatic Hydrocarbon, Pesticide, And Metal Contamination In Clam Bayou, Florida, Renee A. Price Jan 2012

Historical Analysis Of Polycyclic Aromatic Hydrocarbon, Pesticide, And Metal Contamination In Clam Bayou, Florida, Renee A. Price

USF St. Petersburg campus Master's Theses (Graduate)

Polycyclic aromatic hydrocarbon (PAH), pesticide, and metal contamination in estuarine sediments often results from runoff of residential and commercial developments that are adjacent to coastal areas. This study examines contaminants in surface sediments of Clam Bayou, St. Petersburg, Florida. The purpose was to examine the spatial distribution of contaminants, to relate contaminant concentrations to sediment type, to determine potential sources of contamination, and the history of deposition. Contaminant concentrations were compared with those in sediments from Terra Ceia Bay, which is part of the Terra Ceia Aquatic Preserve in Lower Tampa Bay. Terra Ceia Bay, therefore served as a control …

Pharmacy Faculty Publications

Berberine is one of the main alkaloids found in the Chinese herb Huang lian (Rhizoma Coptidis), which has been reported to have multiple pharmacological activities. This study aimed to analyze the molecular targets of berberine based on literature data followed by a pathway analysis using the PANTHER program. PANTHER analysis of berberine targets showed that the most classes of molecular functions include receptor binding, kinase activity, protein binding, transcription activity, DNA binding, and kinase regulator activity. Based on the biological process classification of in vitro berberine targets, those targets related to signal transduction, intracellular signalling cascade, cell surface …

Peripheral Nerve Repair With Cultured Schwann Cells: Getting Closer To The Clinics, Maria Carolina O. Rodrigues, Antonio Antunes Rodrigues, Loren E. Glover, Julio Voltarelli, Cesar V. Borlongan Jan 2012

Peripheral Nerve Repair With Cultured Schwann Cells: Getting Closer To The Clinics, Maria Carolina O. Rodrigues, Antonio Antunes Rodrigues, Loren E. Glover, Julio Voltarelli, Cesar V. Borlongan

Neurosurgery and Brain Repair Faculty Publications

Peripheral nerve injuries are a frequent and disabling condition, which affects 13 to 23 per 100.000 persons each year. Severe cases, with structural disruption of the nerve, are associated with poor functional recovery. The experimental treatment using nerve grafts to replace damaged or shortened axons is limited by technical difficulties, invasiveness, and mediocre results. Other therapeutic choices include the adjunctive application of cultured Schwann cells and nerve conduits to guide axonal growth. The bone marrow is a rich source of mesenchymal cells, which can be differentiated in vitro into Schwann cells and subsequently engrafted into the damaged nerve. Alternatively, undifferentiated …

Development And Characterization Of Anti-Nitr9 Antibodies, Radhika N. Shah, Ivan Rodriguez-Nunez, Donna D. Eason, Robert N. Haire, Julien Y. Bertrand, Valērie Wittamer, David Traver, Shila K. Nordone

Pediatrics Faculty Publications

The novel immune-type receptors (NITRs), which have been described in numerous bony fish species, are encoded by multigene families of inhibitory and activating receptors and are predicted to be functional orthologs to the mammalian natural killer cell receptors (NKRs). Within the zebrafish NITR family, nitr9 is the only gene predicted to encode an activating receptor. However, alternative RNA splicing generates three distinct nitr9 transcripts, each of which encodes a different isoform. Although nitr9 transcripts have been detected in zebrafish lymphocytes, the specific hematopoietic lineage(s) that expresses Nitr9 remains to be determined. In an effort to better understand the role of …

From There To Here: Using Photography To Explore Perspectives Of Resettled Refugee Youth, Jody Lynn Mcbrien, Rebecca Day Jan 2012

From There To Here: Using Photography To Explore Perspectives Of Resettled Refugee Youth, Jody Lynn Mcbrien, Rebecca Day

School of Interdisciplinary Global Studies Sarasota Manatee Campus Faculty Publications

Because refugee numbers are much smaller than those of other immigrant populations in the United States, researchers frequently group refugees with other immigrants in their studies. However, due to the traumatic circumstances that most refugees face prior to their arrival, they require separate consideration. We chose the medium of photography to help newcomer refugee students express themselves beyond their current capacities in English, and we used the students’ photographs as catalysts to interview them about their resettled lives in the United States. Through this process, we discovered themes central to the students’ lives, and ways in which they were working …

Toothbrush Contamination: A Review Of The Literature, Michelle R. Frazelle, Cindy L. Munro Jan 2012

Toothbrush Contamination: A Review Of The Literature, Michelle R. Frazelle, Cindy L. Munro

Nursing Faculty Publications

Toothbrushes are commonly used in hospital settings and may harbor potentially harmful microorganisms. A peer-reviewed literature review was conducted to evaluate the cumulative state of knowledge related to toothbrush contamination and its possible role in disease transmission. A systematic review was conducted on adult human subjects through three distinct searches. The review resulted in seven experimental and three descriptive studies which identified multiple concepts related to toothbrush contamination to include contamination, methods for decontamination, storage, design, and environmental factors. The selected studies found that toothbrushes of healthy and oral diseased adults become contaminated with pathogenic bacteria from the dental plaque, …

Alignment And Composition Of Laminin-Polycaprolactone Nanofiber Blends Enhance Peripheral Nerve Regeneration, Rebekah A. Neal, Sunil S. Tholpady, Patricia L. Foley, Nathan Swami, Roy C. Ogle, Edward A. Botchwey Jan 2012

Alignment And Composition Of Laminin-Polycaprolactone Nanofiber Blends Enhance Peripheral Nerve Regeneration, Rebekah A. Neal, Sunil S. Tholpady, Patricia L. Foley, Nathan Swami, Roy C. Ogle, Edward A. Botchwey

School of Medical Diagnostics & Translational Sciences Publications

Peripheral nerve transection occurs commonly in traumatic injury, causing deficits distal to the injury site. Conduits for repair currently on the market are hollow tubes; however, they often fail due to slow regeneration over long gaps. To facilitate increased regeneration speed and functional recovery, the ideal conduit should provide biochemically relevant signals and physical guidance cues, thus playing an active role in regeneration. To that end, laminin and lamininpolycaprolactone (PCL) blend nanofibers were fabricated to mimic peripheral nerve basement membrane. In vitro assays established 10% (wt) laminin content is sufficient to retain neurite-promoting effects of laminin. In addition, modified collector …

What’S So New About The New Illegitimacy?, Melissa Murray Jan 2012

What’S So New About The New Illegitimacy?, Melissa Murray

Faculty Articles

At common law, children born out of wedlock were legally disfavored — filius nullius, the child of no one. But according to an inherited legal progress narrative, all of this changed in 1968 when the U.S. Supreme Court decided Levy v. Louisiana and Glona v. American Guarantee & Liability Insurance Co., ushering in a new era in which the common law tradition that imposed serious disadvantages on non-marital children gave way to a more liberal era where the sins of the parents would not be visited upon the children. More recently however, illegitimacy seems to be making a comeback. In …

Simone De Beauvoir: Cuisine, Nourriture, Existentialisme, Véronique Olivier

World Languages and Cultures Faculty Articles and Research

The Shamanic Archetype In Robinson Jeffers Poetry, Steven B. Herrmann Jan 2012

The Shamanic Archetype In Robinson Jeffers Poetry, Steven B. Herrmann

Jeffers Studies

This essay pays homage to Robinson Jeffers’s totemic presence as a shaman-poet of Carmel-by-the-Sea, where the essay’s author was born in 1956. It views shamanism as a symbolic process of transformation that takes place at an emotional, instinctive, and spiritual level; as a method of ecstasy found throughout Jeffers’ poetry and prose from beginning to end of his career. The shamanic archetype takes on concrete form through Jeffers’ ritual enactments of his dreams, spirit visitations, visions, and shamanistic voices that sound to him from Native influences. Science gave Jeffers a vision to behold the world’s spiritual traditions from a vista …
