Constitutional Divide: The Transformative Significance Of The School Prayer Decisions, Steven D. Smith
Constitutional Divide: The Transformative Significance Of The School Prayer Decisions, Steven D. Smith
Pepperdine Law Review
This article challenges the standard view in which Everson v. Board of Education was the foundational and most important establishment clause decision and the school prayer decisions of the early 1960s (Engel v. Vitale and Abington School District v. Schempp) were virtually automatic corollaries. In fact, the article argues, it was the school prayer decisions that were foundational, subverting Everson’s “no aid separationism,” and animating not only later establishment clause jurisprudence but much else in constitutional and public discourse besides. Indeed, it is plausible to see the influence of the school prayer decisions and their articulation of secular neutrality as …
Lawyers Judging Experts: Oversimplifying Science And Undervaluing Advocacy To Construct An Ethical Duty?, David S. Caudill
Lawyers Judging Experts: Oversimplifying Science And Undervaluing Advocacy To Construct An Ethical Duty?, David S. Caudill
Pepperdine Law Review
My focus is on an apparent trend at the intersection of the fields of evidentiary standards for expert admissibility and professional responsibility, namely the eagerness to place more ethical responsibilities on lawyers to vet their proffered expertise to ensure its reliability. My reservations about this trend are not only based on its troubling implications for the lawyer’s duty as a zealous advocate, which already has obvious limitations (because of lawyers’ conflicting duties to the court), but are also based on the problematic aspects of many reliability determinations. To expect attorneys - and this is what the proponents of a duty …
Special Interrogation Report: Brigadefuhrer Kurt Meyer Command, 12th Ss Panzer Division (6 June-25 August 1944), Anonymous
Canadian Military History
Brigadefuhrer Kurt Meyer remains a controversial figure in Canadian military history. As a commander of Waffen-SS troops in Normandy, he fought the Canadians in the days and weeks after the Allied landings and allegedly ordered the killing of prisoners of war. A Canadian military court at Aurich in occupied Germany tried and convicted Meyer on charges of war crimes. Although sentenced to death, Meyer received commutation to life imprisonment from the convening authority, Major-General Chris Vokes. Meyer was imprisoned in New Brunswick and West Germany until his release in 1954. Several significant political, legal, public opinion, diplomatic, and military factors …

Harms From Exposure To Toxic Substances: The Limits Of Liability Law, Robert L. Rabin
Harms From Exposure To Toxic Substances: The Limits Of Liability Law, Robert L. Rabin
Pepperdine Law Review
n the early 1980s, there was great optimism about the prospects for a dawning era of toxic harms litigation, arising out of a heightened sensitivity to public health and safety concerns. This new sensitivity had been manifested in the preceding decade through a whirlwind of political activity, highlighted by such landmark Congressional legislation as the Clean Air Act, the Federal Water Pollution Control Act, and the Occupational Safety and Health Act, and by the establishment of the Environmental Protection Agency. Along parallel lines, a singularly proactive judicial framework for strict products liability emerged in the mid-1960s from a series of …
The Impact Of U.S. Tort Law In Canada, Lewis N. Klar
The Impact Of U.S. Tort Law In Canada, Lewis N. Klar
Pepperdine Law Review
This paper briefly summarizes some of the reasons offered by Professor Peter Cane for the minimal impact that U.S. tort law has had on the tort law of Australia and New Zealand. It discusses this matter from the perspective of Canadian tort law. It suggests that, for a variety of reasons, Canada is in a unique position; it shares some of the same characteristics of the Commonwealth countries which discourage the adoption of U.S. tort law, but at the same time is exposed to countervailing factors which tend to bring Canadian and U.S. tort laws closer together. It illustrates this …
French Canadian Participation In The War Of 1812: A Social Study Of The Voltiguers Canadians, Martin F. Auger
French Canadian Participation In The War Of 1812: A Social Study Of The Voltiguers Canadians, Martin F. Auger
Canadian Military History
During the War of 1812, the participation of French Canadians in colonial militia units such as the Voltigeurs Canadiens was of great importance for the defence of Lower Canada. The colony’s lack of regular British toops combined with threats of American invasion rendered crucial to the mobilization of the local populace, most of which was of French descent. Although lacking the discipline and structure of British regular soldiers. Lower-Canadian militiamen were able to neutralize numerous American invasion attempts. Altogether, this impressive participation in the war effort helped redefine the military character of French Canadians. It also dissipated the British authorities’ …

In The Heat Of Battle: Letters From The Normandy Campaign, Harold Macdonald, M.A. Macdonald
Canadian Military History
Harold S. MacDonald was an officer with the North Shore (New Brunswick) Regiment from June 1942 until the end of the Second World War in Europe. Throughout this period he penned a steady stream of letters to his bestfriend, his wife, Marjorie, who was then a newspaper reporter with the Saint John Evening Times-Globe. These letters, totalling 463, were carefully preserved by Marjorie and provide a continuous and absorbing account of the experiences of a front-line Canadian infantry officer in Northwest Europe during the Second World War. They begin in June 1942 with a description of the rowdy voyage …

"The Chinese Encyclopedia" In Foucault'sThe Order Of Things, Jinshan Che
"The Chinese Encyclopedia" In Foucault'sThe Order Of Things, Jinshan Che
Theoretical Studies in Literature and Art
In the preface of The Order of Things, Michel Foucault quotes and analyzes the classification of animals in a "certain Chinese encyclopedia" referred to by Borges, with which he initiates his brand new philosophical thinking. There are many discussions and interpretations by Chinese scholars on this part, but generally they understand Foucault from the perspective of the differences between China and the West, and they tend to blame him for these reasons. For example, they may think Foucault attached too much importance on the particularity of Chinese culture and the differences between Chinese and Western cultures, so he ignores the …

The Anchor: 2012
The Anchor began in 1887 and was first issued weekly in 1914. Covering national and campus news alike, Hope College’s student-run newspaper has grown over the years to encompass over two-dozen editors, reporters, and staff. For much of The Anchor's history, the latest issue was distributed across campus each Wednesday throughout the academic school year (with few exceptions). In recent years The Anchor moved to monthly print issues and a more frequently updated website. The Anchor is now published in print twice per academic semester. Occasionally, the volume and/or issue numbering is irregular.

Biological Sciences Faculty Publications
The astrocyte brain fatty acid binding protein (Fabp7) has previously been shown to have a coordinated diurnal regulation of mRNA and protein throughout mouse brain, and an age-dependent decline in protein expression within synaptoneurosomal fractions. Mechanisms that control time-of-day changes in expression and trafficking Fabp7 to the perisynaptic process are not known. In this study, we confirmed an enrichment of Fabp7 mRNA and protein in the astrocytic perisynaptic compartment, and observed a diurnal change in the intracellular distribution of Fabp7 mRNA in molecular layers of hippocampus. Northern blotting revealed a coordinated time-of-day-dependent oscillation for the Fabp7 mRNA poly(A) tail throughout …

Ecology Of Unique Lentic Populations Of Roundtail Chub, Gila Robusta, Sarah M. Laske, Frank J. Rahel, Wayne A. Hubert, Peter A. Cavalli
Western North American Naturalist
Although roundtail chub (Gila robusta) is generally considered a riverine species, 6 natural lakes in the upper Green River basin, Wyoming, have resident populations of this fish. In 2 of the lakes, Halfmoon and Little Halfmoon, we investigated the ecology of resident roundtail chub, including their habitat use, diet, weight–length relationships, growth, and reproduction. Lentic roundtail chub used littoral and mid-depth benthic habitats most often, with the highest catch rates in littoral habitats. Roundtail chub were rarely caught in pelagic or deep benthic habitats. Opportunistic foraging was observed in both lakes, with roundtail chub consuming terrestrial and aquatic …

Effect Of Density On Growth And Survival Of Young June Sucker, Mark C. Belk, R. Cary Tuckfield
Effect Of Density On Growth And Survival Of Young June Sucker, Mark C. Belk, R. Cary Tuckfield
Western North American Naturalist
One of the fundamental determinants of survival and growth of individuals is population density. Typically, individuals exhibit negative density dependence, but positive density dependence (Allee effect) may occur. Understanding patterns of density dependence is important for conservation and management of species that have low densities as a result of recent population declines. June sucker (Chasmistes liorus) is an endangered species that was formerly abundant but now is found at low densities in Utah Lake. We tested the hypothesis that young June sucker exhibit positive density dependence (i.e., Allee effects) in growth and survival at low densities. In addition, …
