High Resolution Regional Seismic Attenuation Tomography In Eastern Tibetan Plateau And Adjacent Regions, Xueyang Bao, Eric Sandvol, James Ni, Thomas Hearn, Yongshun John Chen, Yang Shen Jan 2011

High Resolution Regional Seismic Attenuation Tomography In Eastern Tibetan Plateau And Adjacent Regions, Xueyang Bao, Eric Sandvol, James Ni, Thomas Hearn, Yongshun John Chen, Yang Shen

Graduate School of Oceanography Faculty Publications

The Q of regional seismic phases Lg and Pg within the crust is assumed as a proxy for crustal Qβ and Qα, which is used as a constraint of crustal rheology. We measure regional‐phase Q of the eastern Tibetan Plateau and adjacent areas. This method eliminates contributions from source and site responses and is an improvement on the Two‐Station Method (TSM). We have generated tomographic images of crustal attenuation anomalies with resolution as high as 1°. In general we observe low Q in the northernmost portions of the Tibetan Plateau and high Q in the more tectonically …

Turbulent Airflow At Young Sea States With Frequent Wave Breaking Events: Large-Eddy Simulation, Nobuhiro Suzuki, Tetsu Hara, Peter P. Sullivan Jan 2011

Turbulent Airflow At Young Sea States With Frequent Wave Breaking Events: Large-Eddy Simulation, Nobuhiro Suzuki, Tetsu Hara, Peter P. Sullivan

Graduate School of Oceanography Faculty Publications

A neutrally stratified turbulent airflow over a very young sea surface at a high-wind condition was investigated using large-eddy simulations. In such a state, the dominant drag at the sea surface occurs over breaking waves, and the relationship between the dominant drag and local instantaneous surface wind is highly stochastic and anisotropic. To model such a relationship, a bottom boundary stress parameterization was proposed for the very young sea surface resolving individual breakers. This parameterization was compared to the commonly used parameterization for isotropic surfaces. Over both the young sea and isotropic surfaces, the main near-surface turbulence structure was wall-attached, …

Tidal Effects On Intermediate Waters: A Case Study In The East/Japan Sea, Ho Jin Lee, Jae-Hun Park, Mark Wimbush, Kyung Tae Jung, Chan Joo Jang, Yang-Ki Cho, Young-Kyo Seo, Jong Ho Nam Jan 2011

Tidal Effects On Intermediate Waters: A Case Study In The East/Japan Sea, Ho Jin Lee, Jae-Hun Park, Mark Wimbush, Kyung Tae Jung, Chan Joo Jang, Yang-Ki Cho, Young-Kyo Seo, Jong Ho Nam

Graduate School of Oceanography Faculty Publications

Although tides are believed to be the most important source for diapycnal mixing in the ocean, few studies have directly simulated open-ocean circulation including tides. Because the East/Japan Sea (EJS) has been considered to be a “miniature ocean,” tidal effects on the intermediate water of the EJS are investigated by using an eddy-resolving ocean general circulation model that can take account of M2 and K1 tides as well as oceanic flows. The simulated temperature and salinity in the intermediate layer are significantly improved by including tides. The improvement results from the combined effect of two internal tides. The …

Simulating The Time-Dependent Diffusion Coefficient In Mixed-Pore-Size Materials, Zhigang Zhang, David L. Johnson, Lawrence M. Schwartz Jan 2011

Simulating The Time-Dependent Diffusion Coefficient In Mixed-Pore-Size Materials, Zhigang Zhang, David L. Johnson, Lawrence M. Schwartz

Graduate School of Oceanography Faculty Publications

Porous media with a wide distribution of pore sizes are quite common. We show that variable-step-size random walk simulations can be used to model the time-dependent diffusion coefficient D(t) in such porous media. The issue to be overcome is that, in variable-step-size walks, each walker carries its own “clock,” and its position is known only at a random set of times. Thus, a direct ensemble-average calculation of ⟨Δr2(t)⟩ (the mean-square distance traveled at time t) is problematic. We introduce a sequence of approximations that overcome this apparent difficulty. Calculations are carried out on periodic systems that contain pores of quite …

Comparing Species And Ecosystem-Based Estimates Of Fisheries Yields, John H. Steele, Dian J. Gifford, Jeremy S. Collie Jan 2011

Comparing Species And Ecosystem-Based Estimates Of Fisheries Yields, John H. Steele, Dian J. Gifford, Jeremy S. Collie

Graduate School of Oceanography Faculty Publications

Three methods are described to estimate potential yields of commercial fish species: (i) single-species calculation of maximum sustainable yields, and two ecosystem-based methods derived from published results for (ii) energy flow and for (iii) community structure. The requirements imposed by food-web fluxes, and by patterns of relative abundance, provide constraints on individual species. These constraints are used to set limits to ecosystem-based yields (EBY); these limits, in turn, provide a comparison with the usual estimates of maximum sustainable yields (MSY). We use data on cod and haddock production from Georges Bank for the decade 1993–2002 to demonstrate these methods. We …

Highway Safety Investigation Manual For The Oregon Department Of Transportation, Karen Dixon, Christopher Monsere Jan 2011

Highway Safety Investigation Manual For The Oregon Department Of Transportation, Karen Dixon, Christopher Monsere

Civil and Environmental Engineering Faculty Publications and Presentations

Across the state, region, and nation highway safety investigators have developed a wide variety of tools and techniques for highway safety investigation procedures. Analysis techniques can range from systematic evaluation approaches such as the Oregon Department of Transportation’s (ODOT’s) Safety Priority Index System (SPIS) down to specific localized safety assessment strategies. It is important to develop consistent methods for safety evaluations across Oregon to ensure that safety investigations are conducted in a similar manner. It is also important to develop a screening process for proper highway safety investigations and document the procedures used for this assessment.

The objective of this …

A Matrix Formulation For The Moment Distribution Method Applied To Continuous Beams, Arlindo Pires Lopes, Adriana Santos, Rogério Coelho Lopes Jan 2011

A Matrix Formulation For The Moment Distribution Method Applied To Continuous Beams, Arlindo Pires Lopes, Adriana Santos, Rogério Coelho Lopes

Civil and Environmental Engineering Faculty Publications and Presentations

The Moment Distribution Method is a quite powerful hand method of structural analysis, in which the solution is obtained iteratively without even formulating the equations for the unknowns. It was formulated by Professor Cross in an era where computer facilities were not available to solve frame problems that normally require the solution of simultaneous algebraic equations. Its relevance today, in the era of personal computers, is in its insight on how a structure reacts to applied loads by rotating its nodes and thus distributing the loads in the form of member-end moments. Such an insight is the foundation of the …

U.S. Defense Contracts During The Tax Expenditure Battles Of The 1980s, Susan J. Guthrie, James R. Hines Jr. Jan 2011

U.S. Defense Contracts During The Tax Expenditure Battles Of The 1980s, Susan J. Guthrie, James R. Hines Jr.

Articles

This paper considers the impact of the tax treatment of military contractors on the cost and timing of U.S. military procurement. Prior to the early 1980s, taxpayers were permitted to defer tax obligations on profits earned from long-term contracts. Legislation passed in 1982, 1986, and 1987 required that at least 70 percent of the profits earned on long-term contracts be taxed as accrued, thereby significantly reducing the tax benefits associated with long term contracting. Comparing contracts that were ineligible for these tax benefits with those that were eligible, it appears that between 1981–1989 the duration of U.S. Department of Defense …

Narrowing The Tax Gap Through Presumptive Taxation, Kyle D. Logue, Gustavo G. Vettori Jan 2011

Narrowing The Tax Gap Through Presumptive Taxation, Kyle D. Logue, Gustavo G. Vettori

Articles

Can the United States government significantly reduce the federal tax gap? This question has attracted a great deal of scholarly attention over the years and has been the focus of numerous government reports. The "tax gap" is the official term for the Treasury Department's estimate of the difference between what American taxpayers should pay to the federal government in a given tax year (that is, the amount of tax they owe, based on a reasonable interpretation of existing tax laws as applied to particular taxpayers' circumstances) and what they actually pay. This estimate is derived from painstaking and detailed audits …

Financial Literacy Or Financial Castigation?, John A. E. Pottow Jan 2011

Financial Literacy Or Financial Castigation?, John A. E. Pottow

Articles

This year, the Canadians- through their government-convened Task Force on Financial Literacy - have proudly produced, "Canadians and their Money: Building a Brighter Financial Future." Armed with 30 recommendations, its most dramatic innovation is to recommend the creation of a Financial Literacy Leader. I have been asked to provide an American perspective on this report specifically and the broader agenda of "financial literacy" more generally as a consumer welfare intervention. Let me start by acknowledging the critiques of the Canadian Task Force. For example, my Canadian colleague, Saul Schwartz, has already drafted a compelling analysis of the political economy behind …

Potential Responses To The Melendez-Diaz Line Of Cases, Richard D. Friedman Jan 2011

Potential Responses To The Melendez-Diaz Line Of Cases, Richard D. Friedman

Articles

Criminal prosecution is increasingly dependent on proof of the results of forensic laboratory tests. They are used, for example, to prove that a given substance contains cocaine; the prove what a driver’s blood alcohol content was; and to demonstrate that the DNA profile of some substance found at the crime scene matches that of the accused.

In Melendez-Diaz v. Massachusetts, 129 S.Ct. 2527 (2009), the United States Supreme Court resolved a question that had divided the lower courts in the wake of Crawford v. Washington, 541 U.S. 36 (2004). The Melendez-Diaz Court held by a 5-4 vote that forensic laboratory …

Conside the following case: The patient is a 44-year-old woman who presents for radiation treatment of an isolated locoregional recurrence of breat cancer in her chest wall, 3 years after undergoing masectomy. At the time of diagnosis, she had T2N2M0 disease, with four of 15 lymph nodes involved with tumor. She received a masectomy with negative margins and appropriate chemotherapy, but none of her physicians talked to her about postmasectomy radiation therapy, which would clearly have been indicated to reduce her risk of locoregional failure and would have been expected to improve her likelihood of survival. She asks the radiation …

Reflections On Class In American Legal Education, Richard O. Lempert Jan 2011

Reflections On Class In American Legal Education, Richard O. Lempert

Articles

Professor Richard Sander's Class in American Legal Education is an almost unique effort to examine empirically the social class origins of American law school students and to relate law student class origins to law school stratification, the class structure of American society and the potential law school applicant pool. His effort, and the special attention he gives to the class composition of elite law schools comes perhaps at a fortuitous time in the history of American legal education. The law degree, like the medical degree, has long been a route for upward mobility in American society. But the access of …

Losing It, William I. Miller Jan 2011

Losing It, William I. Miller

Articles

You are in your sixties, even fifties, and you are walking by a shop window, or in some area in which a security monitor shows a scan of the line you are in. You sneak a look. You see someone in the space where you should be but you do not recognize the interloper. Then, after an unseemly lag of a second or two you are forced to remake your own acquaintance; it seems you no longer know yourself at first sight. The you behind your eyes believes you look like you did twenty years ago, and it assumes that …

Who Must Testify To The Results Of A Forensic Laboratory Test? Bullcoming V. New Mexico, Richard D. Friedman

Articles

Does the Confrontation Clause permit the prosecution to introduce a forensic laboratory report through the in-court testimony of a supervisor or other person who did not perform or observe the reported test?

Toward A Unified Theory Of Exclusionary Vertical Restraints, Daniel A. Crane, Graciela Miralles Jan 2011

Toward A Unified Theory Of Exclusionary Vertical Restraints, Daniel A. Crane, Graciela Miralles

Articles

The law of exclusionary vertical restraints-contractual or other business relationships between vertically related firms-is deeply confused and inconsistent in both the United States and the European Union. A variety of vertical practices, including predatory pricing, tying, exclusive dealing, price discrimination, and bundling, are treated very differently based on formalistic distinctions that bear no relationship to the practices' exclusionary potential. We propose a comprehensive, unified test for all exclusionary vertical restraints that centers on two factors: foreclosure and substantiality. We then assign economic content to these factors. A restraint forecloses if it denies equally efficient rivals a reasonable opportunity to make …

The Price Of Pay To Play In Securities Class Actions, Adam C. Pritchard, Stephen J. Choi, Drew T. Johnson-Skinner Jan 2011

The Price Of Pay To Play In Securities Class Actions, Adam C. Pritchard, Stephen J. Choi, Drew T. Johnson-Skinner

Articles

We study the effect of campaign contributions to lead plaintiffs—“pay to play”—on the level of attorney fees in securities class actions. We find that state pension funds generally pay lower attorney fees when they serve as lead plaintiffs in securities class actions than do individual investors serving in that capacity, and larger funds negotiate for lower fees. This differential disappears, however, when we control for campaign contributions made to offcials with infuence over state pension funds. This effect is most pronounced when we focus on state pension funds that receive the largest campaign contributions and that associate repeatedly as lead …

Ask And What Shall Ye Receive? A Guide For Using And Interpreting What Jurors Tell Us, Barbara O'Brien, Samuel R. Sommers, Phoebe C. Ellsworth Jan 2011

Ask And What Shall Ye Receive? A Guide For Using And Interpreting What Jurors Tell Us, Barbara O'Brien, Samuel R. Sommers, Phoebe C. Ellsworth

Articles

We review the extensive body of studies relying on jurors' self-reports in interviews or questionnaires, with a focus on potential threats to validity for researchers seeking to answer particularly provocative questions such as the influence of race in jury decision-making. We then offer a more focused case study comparison of interview and questionnaire data with behavioral data in the domain of race and juror decision-making. Our review suggests that the utility of data obtained from juror interviews and questionnaire responses varies considerably depending on the question under investigation. We close with an evaluation of the types of empirical questions most …

Java Smell Detector, Nitin Mathur Jan 2011

Java Smell Detector, Nitin Mathur

Master's Projects

“Code Smell” or “Bad Smell”, at the very least, is an indicator of badly written code and is often indicative of deeper problems in software design. In layman terms, it signals flaws in the core foundation or architecture of the software that can cause any number of more serious problems – from usability and runtime performance to supportability and enhancement. These problems can mostly be prevented by the systematic refactoring of the code. Refactoring is the process (and according to some, an ‘art’) of making incremental changes to existing source code to improve its nonfunctional attributes, without modifying its external …

Nevada County’S Assisted Outpatient Treatment Program: A Model For Other California Counties To Adopt?, Ralph J. Murrieta Jr. Jan 2011

Nevada County’S Assisted Outpatient Treatment Program: A Model For Other California Counties To Adopt?, Ralph J. Murrieta Jr.

Master's Projects

In May 2008, Nevada County became the first county in California to fully implement an Assisted Outpatient Treatment (AOT) program under the guidelines established by Assembly Bill 1421 (Keller, 2011). The Assisted Outpatient Treatment Demonstration Project Act of 2002, more commonly known as “Laura’s Law”, established guidelines for the court ordering of treatment for persons incapacitated by a mental disorder (California Department of Mental Health [CA DMH], 2003).

Passed in September 2002, the bill was highly controversial leading up to its passage and remains a very divisive issue today (Fagan, 2010). This paper will focus on the provisions of the …

Isaac Edward Kiev: Early Leader In American Judaica Librarianship, Amy F. Stempler Jan 2011

Publications and Research

Isaac Edward Kiev (1905–1975), former Chief Librarian of New York’s Hebrew Union College-Jewish Institute of Religion, spent a lifetime facilitating Jewish research. This article, based on the author’s Master’s thesis on Kiev, focuses on his contributions to the founding of Jewish book and library organizations during the American post-war era, including the Association of Jewish Libraries, Jewish Book Council of America, Jewish Cultural Reconstruction, Inc., and numerous Jewish book foundations in the United States and Israel. In addition to providing insight into the creation of these associations, the article illustrates the parallel development of the fields of Judaica librarianship and …

Confidentiality Explained: The Dialogue Approach To Discussing Confidentiality With Clients, Elisia M. Klinka, Russell G. Pearce Jan 2011

Confidentiality Explained: The Dialogue Approach To Discussing Confidentiality With Clients, Elisia M. Klinka, Russell G. Pearce

Faculty Scholarship

Many lawyers lie to their clients by saying, “Everything you tell me is confidential” despite the existence of some rules that require lawyers to disclose client confidences and others that permit lawyers to disclose confidences to protect themselves or collect fees. In an effort to encourage clients to speak honestly, a number of commentators urge lawyers to provide either a general or specific notice of the exceptions to confidentiality. This Article offers a different approach. It seeks to promote an honest and open dialogue between lawyer and client that will create a relationship of mutual trust and will make it …

Student Preferences In Library Website Vocabulary, Mark Aaron Polger Jan 2011

Student Preferences In Library Website Vocabulary, Mark Aaron Polger

Publications and Research

This study explores student preferences to library website vocabulary and compares the data with what librarians report on their library's website. Two questionnaires were distributed in the fall of 2009 to students (N=300) and librarians (N=527). Students were asked to identify the terms they prefer from a larger list of library website vocabulary. Librarians were asked to report the terms that were used on their library's website. Twenty-seven terms were selected for both the student and librarian questionnaires. The 27 terms were culled from library literature, library instruction classes, and reference desk interactions. Of the 300 students, 54% were freshmen, …

Work Friends: A Commentary On Laura Rosenbury's Working Relationships, Ethan J. Leib Jan 2011

Work Friends: A Commentary On Laura Rosenbury's Working Relationships, Ethan J. Leib

Faculty Scholarship

Knowing that work is a site of intimacy between coworkers does not tell us--as lawyers and public policy designers--what should change to accommodate this new knowledge. Rosenbury rightly emphasizes that this deeper understanding of intimate networks at work should enrich and modify our pursuit of antidiscrimination norms in the workplace. On the one hand, we might wish to allow friends to prefer one another at work in order to reinforce the social institution of friendship that does so much to sustain us. On the other hand, the dangers of homophily--the robust sociological finding that we tend to sort ourselves into …

Cd-Induced Responses In Plasma Ionic Regulation And Oxidative Stress In Rainbow Trout (O. Mykiss) Or Lake Whitefish (C. Clupeaformis) During Chronic Waterborne Exposure, Amanda Mancini Jan 2011

Cd-Induced Responses In Plasma Ionic Regulation And Oxidative Stress In Rainbow Trout (O. Mykiss) Or Lake Whitefish (C. Clupeaformis) During Chronic Waterborne Exposure, Amanda Mancini

Theses and Dissertations (Comprehensive)

During chronic exposure to Cd or other metals, freshwater fish generally undergo physiological changes that results in acclimation, following a phase of damage and subsequent repair. The mechanisms associated with deleterious cellular effects induced by Cd throughout long-term exposures are less understood than those of acute toxicity, and may relate to an over-production of reactive oxygen species. The objectives of the present study were to examine the changes in, and relationship between, tissue-specific oxidative damage and antioxidant response, as well as plasma ionic regulation and tissue accumulation, in two freshwater salmonids throughout chronic Cd exposure. Rainbow trout (O. mykiss …

A Comparison Of Ancient Mediterranean Metal Structural Fittings, Evan Galen Sharp Jan 2011

A Comparison Of Ancient Mediterranean Metal Structural Fittings, Evan Galen Sharp

Theses and Dissertations (Comprehensive)

The construction of shelter is one of the basic activities that allows humans to survive. It is, moreover, one of the principal means by which we identify the occupation of a place by peoples who came before us. In the world of the ancient Mediterranean, methods and techniques flowed among populations as readily as any other commodity, and their manifestations bear witness to cultural contact as much as any transported religious, commercial, or military object. Moreover, since the construction of shelter is an activity common to all, functional techniques were a universally sharable knowledge. A collection and comparison of the …

Assessing The Stability Of Elite Political Culture: An Empirical Analysis Of The Attitudes Of Elected Officials In Canada, Lydia Summerlee Jan 2011

Assessing The Stability Of Elite Political Culture: An Empirical Analysis Of The Attitudes Of Elected Officials In Canada, Lydia Summerlee

Theses and Dissertations (Comprehensive)

Do attitudes of Members of the 32nd and 40th parliament differ on issues of political ethics? Or have attitudes remained unchanged? Based on interviews of 44 members of the 40th parliament and 107 members of the 32nd parliament, this thesis explores attitude shifts across time. The study reveals that in the areas of conflict of interest and patronage attitudes have hardened. Members of Parliament (MPs) from the 40th parliament are more sensitive to these dimensions of political corruption as opposed to MPs from the 32nd parliament. For ethically charged scenarios dealing with gifts & gains and lying, MPs from the …

Reading Development In Adolescent First And Second Language English Learners: A Comparison Using Age Match Design, Vahidehsadat Shahidi Jan 2011

Reading Development In Adolescent First And Second Language English Learners: A Comparison Using Age Match Design, Vahidehsadat Shahidi

Theses and Dissertations (Comprehensive)

Fourteen Iranian-Canadian bilingual students were tested for language ability as well as cognitive and phonological processing skills in two languages: Farsi and English. They were compared to 30 Iranian monolingual chronological age matched students and 30 Canadian chronological age matched peers. Since there were not any standardized tests in Farsi, one of the aims of this study was to begin creating the language ability measures in Farsi, and to test their reliabilities. In general, from six developed and translated Farsi tasks, three of them were found to be reliable. It was found that bilingual students perform better on memory tasks, …

Linking Cd Accumulation And Effect In Resistant And Sensitive Freshwater Invertebrates, Tony Straus Jan 2011

Linking Cd Accumulation And Effect In Resistant And Sensitive Freshwater Invertebrates, Tony Straus

Theses and Dissertations (Comprehensive)

There has been recent discussion within the field of environmental toxicology as to the viability of using the bioaccumulation of a chemical toxicant to predict toxic effects. Current literature has shown this concept to carry some merit, although there is a major flaw in that with many cases, namely those involving sensitive species, body burdens cannot be reliably linked to effects (Adams et al. (2010)). Bearing this issue in mind the goal of this thesis was to assess the viability of using bioaccumulation as a measure of effect in a different way.

The proposed idea utilized Cd accumulation in a …
