Melms v. Pabst Brewing Co. may be the most important decision ever rendered by an American court concerning the law of waste. Unless your specialty is property law, that might not be enough to stir your interest. The doctrine of waste, after all, does not loom very large in public consciousness these days.

Nevertheless, waste has held a peculiar fascination for property theorists. The reason, I think, is that it touches directly on an important line of division in how we think about property. Across the United States, communities, especially marginalized and low income communities, face challenges resulting from the “school-to-prison pipeline”—a continuum of conditions increasing the probability that people from such marginalized communities, particularly black men, will find themselves in prison rather than college.1 Dismantling this pipeline has become a significant national focus of advocates and policy makers. In New York City, a network has emerged in the last ten years to focus on building a new pipeline from criminal justice to college. This network focuses on rebuilding the lives of the over 70 thousand people who have fallen into the school-to-prison pipeline. …

Louis Henkin died in New York City on October 14, 2010, a few weeks short of his ninetythird birthday. He was in a class by himself at the intersection of international law, international politics, and the constitutional law of foreign relations in the second half of the twentieth century and the first years of the new millennium.

Combined-text picture books unite multiple genres, providing nuanced information on a single topic from the unique lens of each genre. By providing guided practice in reading and writing a combined-text picture book, teachers can help students develop sensitivity to different types of texts, to what they do and how they do it. Such sensitivity can give students a foundation for selecting appropriate strategies for reading and writing effectively in a wider variety of genres. Managerial Ability And Earnings Quality, Peter Demerjian, Melissa F. Lewis-Western, Baruch Lev, Sarah Mcvay

We examine the relation between managerial ability and earnings quality. We find that earnings quality is positively associated with managerial ability. Specifically, more able managers are associated with fewer subsequent restatements, higher earnings and accruals persistence, lower errors in the bad debt provision, and higher quality accrual estimations. The results are consistent with the premise that managers can and do impact the quality of the judgments and estimates used to form earnings.

Accounting For Lease Renewal Options: The Informational Effects Of Unit Of Account Choices, Jeffrey Hales, Shankar Venkataraman, T. Jeffrey Wilks

This study examines the informational effects of unit of account choices in the context of a proposed standard on lease accounting. Standard setters have tentatively decided that leases in excess of one year should be recognized on a lessee’s balance sheet, including optional lease periods, even though the lessee can choose not to renew the lease. We argue that this approach lacks representational faithfulness and creates an informational problem for users. Using an experiment, we show that the proposed treatment of renewal options has a negative effect on lenders’ willingness to lend to a firm with renewal options. However, we …

Five years ago, Fred Schauer published an article with the intriguing title: "Do Cases Make Bad Law?" Playing off Holmes' observation that "[g]reat cases like hard cases make bad law," Schauer explored the possibility, as he put it, that "it is not just great cases and hard cases that make bad law, but simply the deciding of cases that makes bad law.” His concern, confirmed and deepened by his characteristically balanced inquiry, was that general principles forged in the resolution of specific legal disputes can suffer by virtue of that provenance. As an instinctive consequentialist so far as First Amendment theory is concerned, I have to admit that I have never been so tempted by a non-consequentialist account as I am by what Professor Shiffrin has produced. My principal interest is the history of ideas regarding the freedom of speech. I have long been struck by how so many of the canonical writers on the subject have built their arguments from the starting point of the central importance of the freedom of thought. With Masculinity as Prison: Sexual Identity, Race, and Incarceration, he has given us another provocative Article, which illuminates a phenomenon in the world and, indirectly, in ourselves. The Article represents much of what generally makes Robinson’s work so compelling. First, he writes about tremendously complex subjects and attends to their many complexities in remarkably lucid prose. Second, despite his critical perspective, he does not hesitate to make prescriptive arguments.

This piece offers autoethnographic reflections on crossroads to which many academics come: whether to seek (or postpone or avoid) parenthood and when. The author deeply explores the personal (her own trajectories from daughter and sister to potential mother and from graduate student to full professor) in order to reflect on structural constraints associated with graduate education, the academic job market, and institutional policies and politics.

The Beauty And The Beast: Civil Society And Nationalisms In Bosnia And Herzegovina, Joan Davison

Both ethnic nationalism and liberal civic nationalism exist with historical precedents in Bosnia-Herzegovina. Many elected elites privilege extremist ethnic nationalism. The power-sharing structure of the Dayton Peace Accords institutionalizes their influence and permits the current political stalemate. Further, a legacy of authoritarianism vitiates a political culture supportive of elite accountability and mass responsibility. Yet a nascent civil society witnesses to the past and potential future of liberal cosmopolitanism. This research includes interviews with leaders and members of civil society organizations to assess the impediments to and strength of civil society as a vehicle to promote civic nationalism. The Gradient Nature Of S-Lenition In Caleño Spanish, Earl K. Brown, Richard J. File-Muriel

Whereas previous studies of Spanish s-weakening have relied on impressionistic coding, the present study examines temporal and gradient acoustic details in the production of /s/ by eight females from Cali, Colombia, during sociolinguistic interviews. We propose a metric for quantifying s-realization by employing three scalar-dependent variables: s-duration, centroid, and voicelessness. The results of linear regressions indicate that the dependent variables are significantly conditioned by local speaking rate, word position, following and preceding phonological context, stress, and lexical frequency.
