Prostitution in Burmese society, as in many South East Asian countries, is a taboo subject. Unlike prostitution in countries such as Thailand, however, prostitution in Burma does not attract strong media or scholarly debate. The state and the media in Burma, during both colonial and post-colonial periods, have tended and tend to see the problem of prostitution as one of ‘others’. Colonialism, a decline in morality and the corruption of women influenced by modernity or Western culture have often been portrayed as the culprits. The Relationship Between Tornadic And Nontornadic Convective Wind Fatalities And Warnings, Walker S. Ashley, A.W. Black

A database of tornado fatalities, nontornadic convective wind fatalities, severe thunderstorm warnings, and tornado warnings was compiled for the period 1986–2007 to assess the spatial and temporal distribution of warned and unwarned fatalities. The time of fatality and location as reported in Storm Data was compared to tornado and severe thunderstorm warnings to determine if a warning was in effect when the fatality occurred. Overall, 23.7% of tornado fatalities were unwarned, while 53.2% of nontornadic convective wind fatalities were unwarned. Most unwarned tornado fatalities occurred prior to the mid-1990s—coinciding with modernization of the National Weather Service—while unwarned nontornadic convective wind …

A number of recent studies have argued that municipal governments have so significantly modified elements of their form of government that it is now difficult to distinguish form. However, none of these studies considers the influence of state government on these choices. This study uses a comprehensive data set of U.S. municipal governments with populations of at least 10,000 and a data set of state legislative provisions related to form of government to investigate the influence of state law on municipal form of government choices. Hearsay And The Right Of Confrontation In American Trials By Jury, David H. Taylor

This Article discusses the origin and history of the hearsay doctrine, including the goals it seeks to achieve and the many exceptions to the rule against hearsay. It then discusses that when exceptions to hearsay are offered into evidence against the accused in a criminal prosecution, a conflict exists with the Sixth Amendment right of confrontation. Finally, the two very different approaches the Supreme Court decisions has taken in defining the relationship between hearsay doctrine and the right of confrontation, and how hearsay exceptions are presently reconciled with the Confrontation Clause, are discussed.

Padilla V. Kentucky: A New Chapter In Supreme Court Jurisprudence On Whether Deportation Constitutes Punishment For Lawful Permanent Residents?, Anita Maddali

In this Article, I argue that the deportation of lawful permanent residents on account of a criminal conviction is punitive, and therefore enhanced constitutional protections must be afforded to lawful permanent residents during removal proceedings. To support this argument I rely, in part, on the Supreme Court’s recent decision in Padilla v. Kentucky. The Padilla Court held that counsel must inform a client when a plea carries the risk of deportation. The Court’s analysis throughout the decision is groundbreaking in its recognition of the modern day realities of deportation - specifically the growing relationship between the immigration and criminal justice …

In 2010, the Illinois Supreme Court invalidated certain statutory caps on non-economic damages in medical cases because they “unduly” infringed “upon the inherent power of the judiciary.” Such judicial authority originated within the separation of powers clause of the Illinois Constitution. The caps were deemed to “encroach” on the judiciary’s “sphere of authority” because they impeded “the courts in the performance of their function.” Elsewhere, American state statutory damage caps have also been challenged on state constitutional separation of powers grounds. These challenges include settings where the caps operate for non-medical cases and where the limits extend beyond non-economic damages. …

The new Illinois Rules of Evidence (IRE), which took effect January 1, 2011, primarily reaffirm earlier laws dispersed throughout cases, statutes and rules. They modernize many evidence guidelines by incorporating “uncontroversial developments” found in the Federal Rules of Evidence (FRE) and in the laws of forty-four other surveyed jurisdictions. The new rules are said to change Illinois evidence laws in only two areas: they add opinion testimony as a method of proving character and they eliminate certain requirements within the hearsay exceptions on statements of then existing mental, emotional or physical condition. Research indicates that people with disabilities who participate in sports and are physically active rate themselves higher in psychological well-being. The primary purpose of this study was to observe differences in the satisfaction of psychological needs through sports participation based on one’s impairment level. Participants in the study included 50 English-speaking individuals with cerebral palsy who were 18 years of age or older and who were competing in the 2005 World Cerebral Palsy Championship in New Haven, Connecticut. $100 Bills On The Sidewalk: Violations Of No-Arbitrage In 401(K) Accounts, James J. Choi, David Laibson, Brigitte C. Madrian

We identify employees at seven companies whose 401(k) investment choices are dominated because they are contributing less than the employer matching contribution threshold despite being vested in their match and being able to make penalty-free 401(k) withdrawals for any reason because they are older than 59½. At the average firm, 36% of match-eligible employees over age 59½ forgo arbitrage profits that average 1.6% of their annual pay, or $507. A survey educating employees about the free lunch they are forgoing raised contribution rates by a statistically insignificant 0.67% of income among those completing the survey.

Background: The VSNL1 gene product, Visinin-like-protein-1 (VILIP-1), is a member of the neuronal EF-hand Ca2+-sensor protein family. Previously, VILIP-1 mRNA and protein expression were shown to be altered in animal models and in schizophrenia patients. VILIP-1 influences cytosolic cAMP levels, cell migration, exocytotic processes and differentiation in the periphery. This raises the question, whether similar to other potential schizophrenia susceptibility genes, such as Disc1, PDE4B and Akt, VILIP-1 may be associated with schizophrenia-related measures, and if it could mechanistically affect cAMP signaling and neurite outgrowth in neurons. Ceramic thin film thermocouples are being developed to replace noble metal thermocouples operating within the harsh environments of advanced turbine engines used for power generation and propulsion. Seebeck coefficients as large as 158 V/°C were determined for indium oxide (In2O3) at 950°C and 256 V/°C for zinc oxide ZnO at 1250°C relative to platinum reference electrodes. Because these Seebeck coefficients are appreciably larger than those for metallic thermocouples, alloys in the system indium zinc oxide ZnxInyOx+1.5y were investigated by cosputtering from high purity ZnO and In2O3 targets. We investigated the relationship between renal function, blood pressure variability (BPV), and nitric oxide (NO) in a group of African Americans with normal or mildly impaired renal function. 24-hour ambulatory blood pressure monitoring was performed, NO measured, and glomerular filtration rate (GFR) calculated in 38 African Americans. Participants were categorized as having normal (GFR > 90 mL/min per 1.73 m2) or mildly impaired (GFR 60–89 mL/min per 1.73 m2) renal function. Diastolic BPV was significantly lower in the mildly impaired renal function group. Regression analyses revealed a significant positive association between GFR and diastolic BPV for the entire study group. Plasma …

The IceCube Observatory at the South Pole is composed of a deep detector and a surface detector, IceTop, both of which use Cherenkov light to detect charged particles. Cosmic ray air showers contain multiple particle components: in particular, electrons and muons detectable at the surface by IceTop, and high-energy muons detectable by the deep IceCube detector, in relative amounts that depend on the primary cosmic ray mass. Thus, coincident events can be used to measure both the energy and the mass composition. This article is about English‐to‐Russian voiceover translating as a translation technique and a medium that responds to and shapes sociocultural identities. It is also about a trend in Russian film translating to enliven – in various degrees – the translation text as compared with the more neutral language in the original films. And, finally, given the multiple translations of the same cultural products, films included, it is an attempt to make a case for a strand of research and translation quality analysis that that may be called “translation variance studies.”

The cluster of three related articles offered here represents what the authors propose to call “translation variance studies,” or TVS, a subfield of translation studies concerned with semantic, pragmatic, and stylistic equivalence and divergence between a single source text and its multiple translations into a specified target language. Multiple translations of a single source text into a single target language have become a widespread phenomenon. The notion of audio remastering seems to inform the way literary “consumers” conceive of retranslations of classic works today. This is almost certainly because the two operations—remastering and retranslation—are such natural cousins. Retranslation seems to imply, at the very least, continuous improvement of the literary product in the target language, that is, the elimination of earlier translators’ errors in construing the source text and the ever more adequate recreation of the original author’s stylistics. There is a crucial and underappreciated distinction between the task of translating a hitherto unknown foreign language literary work for the purpose of making it available for the first time to readers in the target language, and that of re‐translating a classic. The worldwide proliferation of the Internet as a fundamentally new media technology has coincided with a radical social and linguistic liberalization in Russia. This junction changed drastically the interrelationship between the standard language and the non‐standard language varieties. A paradigmatic manifestation of the new Russian linguistic reality is the prevalent Internet trend of alternate spellings and non‐normative lexical use. The phenomenon is frequently referred to as an “Olbanian” language and associated with the counter‐culture of the so‐called “padonki.” Disregarding the fundamental principles of Russian orthography, spelling, and even morphology, the padonki have created an idiom that seemingly allows complete freedom …
