The Relationship Between Music And Visual Arts Formal Study And Academic Achievement On The Eighth-Grade Louisiana Educational Assessment Program (Leap) Test, Richard Allen Baker Jr.

The purpose of this study was to examine the policy implications allowing administrators to exempt a student from required arts instruction if the student obtained unsatisfactory scores on the high-stake state mandated tests in English and mathematics. This study examined English language arts and math test scores for 37,222 eighth grade students enrolled in music and/or visual arts classes and those students not enrolled in arts courses. There were more than 12,000 students who were eligible, but not enrolled in arts courses. There are many Hawaiian identities currently in effect. This dissertation explores several representative and contested Hawaiian identities, and how these identities develop through key performances, plays, and other representational practices by Hawaiians and by Locals. Due to its unique situation as one of only two U.S. states formerly with its own government, and as one of only two U.S. states not connected to the main land-mass of the United States, Hawaiian identity is complicated by multiple factors: sanitized historical constructions, sovereignty, intermingling ethnic identities, tourism, and reclaimed cultural practices. This research sought to explore the experiences of students during their transition to a senior college. The senior college was established in response to the amendments to education policy in Western Australia that made it compulsory for students to remain in full-time education, training or employment until the age of 17 years (Department of Education and Training, 2008). Senior colleges were established to teach Years 11 and 12 exclusively, to promote a school environment that suited the maturity of senior students. This thesis examines aspects of dramaturgy delivered by a dramaturg, and the practical contributions of dramaturgs to both the writer and the theatre industry in Australia. It investigates elements of the working relationship between dramaturgs and playwrights, looks at the chameleon-like nature of the theatre dramaturg and examines how Australian writers, directors and dramaturgs perceive the role/s of the dramaturg. In Claude Debussy's Premiere rapsodie for clarinet and piano, the composer is beyond the realm of "music just for listening", but has become a designer, an architect of musical structure. During the early 1900s, Debussy began to develop a different Paris, France, was a cosmopolitan city in the early 1880s and on into the outlook for his compositions. La mer (1903-1905), a piece for orchestra, begins to exhibit Debussy's new focus on and compositional purpose of design and structure during his late career. This article looks at the "top ten" environmental laws enacted in the 1970s, including the Clean Air Act, the Endangered Species Act, the National Environmental Policy Act, and the Resource Conservation and Recovery Act. It asks: What were the pin-up qualities that made these laws look good on paper? What were the features sponsors bragged about or critics deplored? How were they understood and described at the time of legislative birth? What was thought to be new, different, and better?

Art authentication boards are powerful; their determinations of authenticity can render artwork worthless or add millions of dollars to market value. In the past, boards that denied authenticity of artwork typically risked tort liability for disparagement, defamation, or fraud. In Simon-Whelan v. Andy Warhol Foundation for the Visual Arts, Inc., however, an art collector alleged monopolization and market restraint after an authentication board denied the authenticity of his Andy Warhol painting by stamping “DENIED” on the back of it. The case is the first antitrust lawsuit against an authentication board to survive the defendant’s motion to dismiss. The decision …

On Monday, May 2, 2001, Canadians will vote in a federal election. It remains unclear whether the results will be significantly affected by deep concerns amongst many Canadians of authoritarian, deceitful and multifariously unethical behavior by the governing Conservative Party since becoming a minority government in 2006 (re-elected in 2008). My purpose in this article is to raise awareness of the threat to open democracy in Canada posed by the nearly pathological extent to which secrecy and manipulation of access to the truth has taken over Ottawa and Parliamentary affairs in Canada. This paper is a qualitative study of Movimiento Pacto por la Cultura , a group of cultural activists that operate in the hyper-violent reality of 21st century Ciudad Juárez. This work looks at Pacto as a case study to explore the possibilities of culture as a tool of activism in a particular time and place, exploring in the ways in which economic development policies, deficiencies in infrastructure, and rising violence both effect and can be affected by cultural processes. This Essay focuses on two clashes between national security and the First Amendment - the Pentagon Papers case and the WikiLeaks controversy. The two cases are hardly exact parallels. In the Pentagon Papers case the government was seeking to enjoin publications, asking for the imposition of a prior restraint. In that context, the press received the benefit of the "heavy presumption" against prior restraints. In the WikiLeaks controversy, because the discussion centers on the possibility of a criminal prosecution against Julian Assange, there is no equivalent "heavy presumption" against such a prosecution. Government speech creates a paradox at the heart of the First Amendment. To satisfy traditional First Amendment tests, the government must show that it is not discriminating against a viewpoint. And yet if the government shows that it is condemning or supporting a viewpoint, it may be able to invoke the government speech defense and thereby avoid constitutional scrutiny altogether. Government speech doctrine therefore rewards what the rest of the First Amendment forbids: viewpoint discrimination against private speech. The relationship between property and speech is close but complicated. Speakers use places and things to deliver their messages, and rely on property rights both to protect expressive acts and to serve as an independent means of expression. And yet courts and scholars have struggled to make sense of the property-speech connection. Is property merely a means of expression, or can it be expressive in and of itself? And what kind of “property” do speakers need to have – physical things, bundles of rights, or something else entirely?
