Since wars have existed, there have been soldiers for hire. As the state evolved, originating during the peace of Westphalia, and matured, the definition and the business of mercenarism have gone through many mutations. Today, and particularly since the 1970s, mercenaries have banded together, incorporating themselves as private military firms, some of which are units of multinational corporations. Private Military Corporations (PMCs) offer expertise ranging from construction to logistics but a number of contractors have been accused of human rights violations, particularly in the current theatres of war in Iraq and Afghanistan. Research has indicated that Funeral Directors and Embalmers are stigmatized for their work. Studies have shown that, although the decay of dead bodies is a stigmatized process in American culture, these particular deathcare workers are able to shift the focus of their services from the dead to the living. However, there remains a lack of research regarding deathcare workers who are not employed as Funeral Directors or Embalmers— those whose positions are not as obvious to the general public. Scholarship on biracial persons has been primarily focused on those of African American and White heritages. The dominance of research on this one segment of the biracial population has in turn led to the myth of a universal biracial experience. There is a critical need to hear the voices and experiences of those who are members of two or more communities of color. As confident as Byers, Schabas and many others are in their assertion that Canada has committed war crimes, the matter is unfortunately far more complex and far less certain. One of the primary reasons for this complexity is that Canada is not the party that allegedly committed torture. It is widely agreed that the acts of torture were undertaken solely by Afghan authorities, making them the perpetrators in this case. If the allegations against Canada turn out to be founded, Canada’s participation could at best be characterised as accessory. This brings the matter into an exceptionally murky area of law …

Domestic Violence And State Intervention In The American West And Australia, 1860-1930, Carolyn B. Ramsey

This Article calls into question stereotypical assumptions about the presumed lack of state intervention in the family and the patriarchal violence of Anglo-American frontier societies in the late nineteenth and early twentieth centuries. By analyzing previously unexamined cases of domestic assault and homicide in the American West and Australia, Professor Ramsey reveals a sustained (but largely ineffectual) effort to civilize men by punishing violence against women. Husbands in both the American West and Australia were routinely arrested or summoned to court for beating their wives in the late 1800s and early 1900s. This article solves two puzzles in copyright law. First, it has long been blackletter law that games are not copyrightable. But the origins of this rule are lost to history, and the reasons for it are not obvious. Second, it has never been adequately explained what makes something a “system” excluded from copyright protection under Section 102(b) of the Copyright Act. Modern courts interpret “system” as merely a synonym for “idea” or “process,” two other categories of exclusions. Others have interpreted it using the broadest definition in the dictionary, which would sweep in large amounts of copyrightable material as well. …

In the summer of 2010, the Immigration and Customs Enforcement Division of the Department of Homeland Security began "Operation In Our Sites," an enforcement sweep targeted towards websites allegedly dealing in counterfeit goods and copyright-infringing files. The operation targeted the websites by proceeding in rem against their respective domain names. For websites targeted for copyright infringement, ICE Agents used recently-expanded copyright forfeiture remedies passed under the 2008 PRO-IP Act, providing no adversarial hearing prior to the websites being removed, and only a probable cause standard of proof.

Feminist ethnographic methods stress the role of empathy for research subjects and researchers’ willingness for their work to be useful to their subjects. When the research subjects are “unloved groups,” though—people whose actions or beliefs are hateful or harmful—some ethnographers argue that such empathy and empowerment is misplaced or leads to uncritical scholarship. In this reflection on the author’s ethnographic study of Westboro Baptist Church, a small Kansas-based congregation infamous for preaching its anti-gay theology at funerals, including the funerals of fallen servicemen and -women, she questions the usefulness of denying an emotional connection with “hatemongers.” Instead, she argues for …

The recent acquittal of the first Guantanamo Bay detainee to stand trial in U.S. federal court on all but one of the 286 charges he faced stemming from the 1998 bombings of two U.S. embassies in Africa has reinvigorated the discussion on indefinite detention under the laws of war. While the issue has been raised in the past, the discussion hasn’t extended beyond stating that the law of war, or law of armed conflict (LOAC) as it is often called, provides a legal basis for detention, including detention for the duration of hostilities. "Traveling Salesman Problem (TSP) solution techniques are often used for route planning for automated vehicles. Most TSP solution methods focus on path length as the fitness reference, however in many cases, traversal time is of more practical importance. Mutual Attraction Guided Search (MAGS) is a novel solution method that uses an iterative process to simultaneously optimize both angle of travel through each target as well as the ordering of the targets in order to optimize path traversal time. This article reports findings from a study of the motivations of college students to choose or not choose a career as a K-12 teacher. Five hundred-seventeen college students majoring in education and non-education programs enrolled in undergraduate courses were surveyed as to their motivations for choosing/not choosing a career in K-12. If they chose teaching as a career, they were also asked what might motivate others to enter the teaching profession or if they chose a non-teaching career, they were asked what things that if changed might increase their interest in becoming a teacher. Queer culture is finding an ever-increasing voice in the arts. Plays like The Laramie Project, Rent, and Angels in America have contributed to making queer identity a very present voice in popular culture. In this thesis, I investigate the excitement and complexity of a straight actor becoming a gay character on stage. Using my interpretation of "Jack" in Debbie Lamedman’s new play, Triangle Logic, as a case study, I catalogue a three-month journey towards the effective embrace of truthfulness on stage.
