Diabetes is the 7th leading cause of death in the United States, and accounts for $116 billion in direct medical costs (American Association of Diabetes Educators, 2011). For those who are at risk for developing this lifelong disease, education for prevention is key. Education for this disease is generally covered by one's private insurance, but is not available to those who have public insurance or to those who self pay. Technology killed slander. Slander, the tort of defamation by spoken word, dates back to the ecclesiastical law of the Middle Ages and its determination that damning someone’s reputation in the village square was worthy of pecuniary damage. Communication in the Twitter Age has torn asunder the traditional notions of person-to-person communication. Text messaging, tweeting and other new channels of personal exchange have led one of our oldest torts to its historic demise.

Thirty to forty percent of Americans suffer from Communication Apprehension (CA) to a degree that impairs their ability and willingness to speak publicly (McCroskey, 1984). McCroskey (1984) defines CA as “an individual’s level of fear or anxiety associated with either real or anticipated communication with another person(s)” (p.13). There are many forms of CA, but “the most common [form] is Public Speaking Anxiety” (McCourt, 2007, p.6), which can be defined as the fear of speaking in front of a group of people. Hollywood remakes of East Asian films clearly change more than just the language of a film, and the choices that producers and directors make in order to tailor a foreign film so that it better appeals to American audiences creates an entry point that allows for a more direct comparison of aesthetic styles, cultural tastes, and narrative conventions. Between 1938 and 1940 approximately 18,000 Jews from Central Europe went to the Chinese city of Shanghai to escape Nazi persecution. While almost every nation in the world refused to accept these desperate refugees, thousands found refuge in Japanese occupied Shanghai, which was an open port and one could immigrate there with no visa or passport. In an incredibly short period of time the refugees were able to develop a vibrant Jewish community. Relying primarily on the testimony of former refugees, this thesis seeks to address three main questions: What did exile in Shanghai feel like for the refugees? How …

The purpose of this Article is to explain why the D.C. Circuit got it wrong. Part I provides an overview of the facts and relevant law that formed the basis for the decision. Part II shows that the court misapplied the basic factors set forth initially by the Court in Eisentrager and later clarified in Boumediene. Part III contains a proposed framework that reorients and reframes these factors in order to make habeas jurisdiction analyses more workable and consistent with the historical justifications for the writ, separation of powers considerations, and governing case law. Readers familiar with Susanna Rowson as the author of Charlotte Temple (1791, 1794) do not think of her as an abolitionist. But in 1805 Rowson articulated an anti-slavery position in Universal Geography, a textbook addressed to schoolgirls such as those she herself taught at the Young Ladies Academy in Boston. Condemning those who viewed sugar and slavery as a winning equation that would make them rich, Rowson denounced the “purchase and sale of human beings,” and insisted that anyone “enlightened by reason and religion” would oppose the “horrid trade,” and see it as she did, as “a disgrace to humanity.”1 …

I begin with an introduction to the history and basic themes of documentary theater, including its relationship to both history and historical theater, and its own fragmented artistic heritage. I examine the two central and continuing challenges for the documentary stage: how facts are best and most fairly presented, and to what audience they are, with readings of David Hare's Stuff Happens and Moises Kaufman's Gross Indecency. The nature of documented fact has changed, now that modern technology allows for almost any object or image to be easily reproduced, to become a document. Donald McGavran and Peter Wagner, the early leaders of the Church Growth Movement (CGM), longed to see conversion growth as the primary source of church growth. Yet one of the common criticisms of church growth today is its lack of emphasis on conversion growth. This article discusses this criticism and argues that the church can learn from Charles H. Spurgeon’s commitment to conversion growth, calling church growth back to its theological and missiological roots.

This Article discusses the case of Al-Marri v. Spagone, which the U.S. Supreme Court unjustifiably dismissed as moot on March 6, 2009. By dismissing this appeal, the Court ignored its duty to determine whether the military detention of a non-citizen residing lawfully in the United States was authorized by law. And that failure has in turn contributed significantly, and unnecessarily, to the cloud of legal uncertainty which now hovers over the preventive detention measures adopted and proposed by the Obama Administration.

In Claude Debussy's Premiere rapsodie for clarinet and piano, the composer is beyond the realm of "music just for listening", but has become a designer, an architect of musical structure. During the early 1900s, Debussy began to develop a different Paris, France, was a cosmopolitan city in the early 1880s and on into the outlook for his compositions. La mer (1903-1905), a piece for orchestra, begins to exhibit Debussy's new focus on and compositional purpose of design and structure during his late career. Art authentication boards are powerful; their determinations of authenticity can render artwork worthless or add millions of dollars to market value. In the past, boards that denied authenticity of artwork typically risked tort liability for disparagement, defamation, or fraud. In Simon-Whelan v. Andy Warhol Foundation for the Visual Arts, Inc., however, an art collector alleged monopolization and market restraint after an authentication board denied the authenticity of his Andy Warhol painting by stamping “DENIED” on the back of it. The case is the first antitrust lawsuit against an authentication board to survive the defendant’s motion to dismiss. The decision …
