The theory of “civilizing processes” was developed by Norbert Elias in the 1930s to describe and explain the generation of higher standards of various forms of conduct in the context of unplanned but structured changes in state formation and lengthening chains of social interdependencies (Elias 2000). The idea of civilized conduct may seem a strange companion to popular understandings of consumer culture, when the latter phrase is often associated with hedonism, individualism and excess. But consumer cultures do refer to the meanings, values, emotions and practices surrounding the use of goods and services, including how people use their bodies through …

Effects Of Goal Maintenance Training On Executive Control In Older Adults, Jessica Paxton

Due to the fact that executive control abilities are necessary for successful execution of many cognitive and real-world tasks, interest has arisen in determining how these abilities can be improved. A previous study demonstrated that both practice and strategy training improved performance in older adults on an executive control task requiring goal maintenance abilities: Paxton et al., 2006), but no previous research has investigated the amount of exposure to this executive control task during training. Thus, questions remained about whether amount of exposure: e.g., extended experience with one task or limited experience with multiple tasks) or type of intervention: e.g., …

National History And The Novel In 1930s Britain, Erica Delsandro

Although indebted to scholars whose work has illuminated the distinctiveness of 1930s Britain, "National History and the Novel in 1930s Britain" argues that rather than seeking distinction, writers of the period were more concerned with the task of contextualizing their decade and their own position within a national historiography from which they felt the Great War and military masculinities had excluded them. Focusing on the novelists Christopher Isherwood, Evelyn Waugh, and Virginia Woolf, and the philosopher of history, R. G. Collingwood, I describe how the 1930s inheritors of British cultural privilege found themselves symbolically disenfranchised from a national identity inextricably …

The Roberts Court And The Limits Of Antitrust, Thom Lambert

This article first describes the fundamental limits of antitrust and the decision-theoretic approach such limits inspire. It then analyzes the Roberts Court’s antitrust decisions, explaining how each coheres with the decision-theoretic model. Finally, it predicts how the Court will address three issues likely to come before it in the future: tying, loyalty rebates, and bundled discounts.

In German criminal trials, the common law instrument of the guilty plea is unknown. Consequently, one cannot speak of plea bargaining in the strict sense. Nevertheless, informal negotiations, which center on the exchange of a confession for a sentence concession, play an increasing role in the German criminal process. It is claimed that in today’s Germany “the criminal procedure cannot be imagined without the phenomenon of informal agreements.” After years of academic debate and developing case law on informal agreements, the German Federal Parliament (Deutscher Bundestag) has now passed new legislation that regulates agreements and makes them part of the …

The purpose of this senior project is to provide a perspective of how women are treated within the film industry and women’s obsession with beauty and sexuality, as well as how the media portrays women. It focuses on the pressures that women deal with in the film industry and the construction of beauty and sexuality concepts. Holy Cow: Staging Boucicault's The Shaughraun, Patrick Michael Finelli, Jason Winfield

Examines the design process, fabrication of settings and production of Boucicault's 19th century melodrama using a large (10' by 16') fiberglass cow on a turntable. The setting called for multiple locations ranging from a cottage to cliff tops and a ship's dock. Computer CAD Photoshop modeling used for previsualization and special construction techniques were used to create acting areas inside and on top of the cow set piece.

Games And Other Uncopyrightable Systems, Bruce E. Boyden

This article solves two puzzles in copyright law. First, it has long been blackletter law that games are not copyrightable. But the origins of this rule are lost to history, and the reasons for it are not obvious. Second, it has never been adequately explained what makes something a “system” excluded from copyright protection under Section 102(b) of the Copyright Act. Modern courts interpret “system” as merely a synonym for “idea” or “process,” two other categories of exclusions. Others have interpreted it using the broadest definition in the dictionary, which would sweep in large amounts of copyrightable material as well. …
