I examine the question of realism and idealism in terms of a tension in Martin Heidegger’s thought between entity realism and being idealism. Entity realism is the idea that entities exist independently of humans, whereas being idealism is idea that the being of entities is dependent on humans in some way. The question then is how to reconcile entity realism and being idealism without collapsing to an unattractive position like subjectivism or naïve realism. I appropriate Heidegger’s tension to answer the question of realism and idealism in terms of what I call ecological realism. Ecological realism is a way to …

This study investigated the influence of perceived spatial distance (PSD) on students’ intentions and decisions to relocate to pursue graduate education. The framework of the theory of planned behavior (TPB) provided the basis for measurement of the components of PSD, that is one’s attitude, subjective norm, and perceived behavioral control about spatial distance, as well as an understanding of how PSD may influence relocation intentions and decisions. The components of PSD were hypothesized to be positively related to relocation decisions, with relocation intentions acting as a moderator. Energy producers, developers, legislators, policy makers, and the public are searching for alternative energy sources to alleviate energy demands and dependency on fossil fuels. Of the renewable energy sources, biomass from forestry, crop, and animal residues offer a clean and sustainable solution to help mitigate climate issues and stabilize energy needs. However, most forests and farms in the U.S. are privately owned. It’s important to understand forest landowners’, agricultural producers’, and poultry producers’ attitudes and perceptions towards management activities intended for producing bio-based products. The development of the orofacial structure in mammals is a highly ordered process that is coordinated activity of epithelial and mesenchymal cells. Chondrocytes and osteoblasts work in close association for development of many cartilaginous skeletal structures and cartilaginous orofacial structures. Two major orofacial structures are the palate and the temporomandibular joint (TMJ). The transcription factor, Runx2, is obligatory for differentiation of mesenchymal cells into chondrocytes and osteoblasts. However, specific contributions of chondrocyte in cartilaginous and mineralized structures of the craniofacial skeleton are not known. Looking At The Lanham Act: Images In Trademark And Advertising Law, Rebecca Tushnet

Words are the prototypical regulatory subjects for trademark and advertising law, despite our increasingly audiovisual economy. This word-focused baseline means that the Lanham Act often misconceives its object, resulting in confusion and incoherence. This Article explores some of the ways courts have attempted to fit images into a word-centric model, while not fully recognizing the particular ways in which images make meaning in trademark and other forms of advertising. While problems interpreting images are likely to persist, this Article suggests some ways in which courts could pay closer attention to the special features of images as compared to words.

Academic achievement in foster youth can be influenced by factors related to the foster care experience. The purpose of this study was to determine if gender, ethnicity, time in placement, type of placement, number of placements, and special education status could predict high school graduation in foster youth. To conduct the study a group of foster youth that graduated from high school (n=390) was compared to a group of foster youth that did not graduate from high school (n-400). Converging lines of evidence suggest that AKT1 is a major mediator of the responses to insulin, insulin-like growth factor 1 (IGF1), and glucose. AKT1 also plays a key role in the regulation of both muscle cell hypertrophy and atrophy. We hypothesized that AKT1 variants may play a role in the endophenotypes that make up metabolic syndrome. The Patient Protection and Affordable Care Act is a major achievement in improving access to health care services. However, evidence indicates that the nation could achieve greater improvements in health outcomes, at a lower cost, by shifting its focus to public health. By focusing nearly exclusively on health care, policy makers have chronically starved public health of adequate and stable funding and political support. The lack of support for public health is exacerbated by the fact that health care and public health are generally conceptualized, organized, and funded as two separate systems. This study assessed the value and efficacy of in-home services offered by The Hilltown Elder Network (HEN). Pre-existing data first obtained through an annual "Client Satisfaction Survey" issued by HEN administration to HEN clients during FY 2010 was examined. Of the 100 surveys mailed, sixty-nine program participants between the ages of 62 and 95 years, the median age being 84, responded. The agency-designed mixed methods survey functioned to solicit program input, to gauge participant satisfaction and also operated as a tool to gather necessary data for program funding. The United States and United Kingdom have different approaches to quarantine law that reflect each country’s unique historical context and constitutional structure. Under the Tudors, England vested quarantine authority in the monarch, with its subsequent exercise conducted by the military. As the constitutional structure changed, the manner in which quarantine was given effect subtly shifted, leading to constitutional reforms. Authorities transferred first to the Privy Council and, subsequently, to Parliament, where commercial interests successfully lobbied them out of existence. By the end of the 19th Century, quarantine authorities had been pushed down to the local port authorities. In the United …

Animal welfare has emerged as a pervasive concern in modern international law. The purpose of this study is to situate the international legal principle protecting the welfare of animals within the broader framework of international law. The study uses a constructivist model to develop a theory of the place of animal welfare in the international legal regime that has due regard for cultural differences and the diversity of international society. The objective of this study was to assess the sexual and reproductive health needs of adolescents living with HIV in Kenya with a view to identifying and developing interventions that integrate these needs within the existing HIV/AIDS treatment, care, and support programs in the country. The study was a result of collaboration between Population Council, APHIA II Rift Valley and Coast (Family Health International), the National AIDS and STI Control Programme, and APHIA II Nairobi and Central (Pathfinder International). Major findings indicate that many of the adolescents living with HIV are vulnerable, and that programmatic gaps exist in addressing the …

Poly(D,L-lactide-co-glycolide-) (PLGA-)chitosan nanoparticles are becoming an increasingly common choice for the delivery of nucleic acids to cells for various genetic manipulation techniques. These particles are biocompatible, with tunable size and surface properties, possessing an overall positive charge that promotes complex formation with negatively charged nucleic acids. This study examines properties of the PLGA-chitosan nanoparticle/plasmid DNA complex after formation. Specifically, the study aims to determine the optimal ratio of plasmid DNA:nanoparticles for nucleic acid delivery purposes and to elucidate the location of the pDNA within these complexes. We describe a new method that allows cloning of double-stranded RNAs (dsRNAs) that are generated in RNase protection experiments. We demonstrate that the mouse C/D box snoRNA MBII-85 (SNORD116) is processed into at least five shorter RNAs using processing sites near known functional elements of C/D box snoRNAs. Surprisingly, the majority of cloned RNAs from RNase protection experiments were derived from endogenous cellular RNA, indicating widespread antisense expression. The cloned dsRNAs could be mapped to genome areas that show RNA expression on both DNA strands and partially overlapped with experimentally determined argonaute-binding sites. The monooxovanadium(V) complex of composition [VO(OC_6H_3(NO_2)_2-2,4)_3] (I) was synthesized by the reaction of VOCl_3 with Me_3SiOC_6H_3(NO_2)_2-2,4 in toluene and characterised by elemental analyses, molar conductance, and IR, ^1H- and ^{13}C-NMR, and mass spectral studies. The reactions of (I) with alkali metal 2,4-dinitrophenoxides [MOC_6H_3(NO_2)_2-2,4] (M = Li, Na, K) yield complex salts of composition M[VO(OC_6H_3(NO_2)_2-2,4]_4 authenticated by physicochemical and IR spectral studies. Thermal behaviour of complexes was studied by TG and DTA techniques. The molecular modelling calculations of the parent complex and its complex salts were performed to visualise the probable geometry around vanadium metal, which, coupled with spectroscopic evidence, suggests …

When new predators invade a habitat, either through range extensions or introductions, prey may be at a high risk because they do not recognize the predators as dangerous. The nine-banded armadillo (Dasypus novemcinctus) has recently expanded its range in North America. Armadillos forage by searching soil and leaf litter, consuming invertebrates and small vertebrates, including salamanders. We tested whether Ozark zigzag salamanders (Plethodon angusticlavius) from a population coexisting with armadillos for about 30 years exhibit antipredator behavior in the presence of armadillo chemical cues and whether they can discriminate between stimuli from armadillos and a nonpredatory sympatric mammal (white-tailed deer, …

Background: Calcitonin gene-related peptide (CGRP), a neuropeptide released from trigeminal nerves, is implicated in the underlying pathology of temporomandibular joint disorder (TMD). Elevated levels of CGRP in the joint capsule correlate with inflammation and pain. CGRP mediates neurogenic inflammation in peripheral tissues by increasing blood flow, recruiting immune cells, and activating sensory neurons. The goal of this study was to investigate the capability of CGRP to promote peripheral and central sensitization in a model of TMD. Although salamanders have been shown to respond to classical conditioning, spatial learning has been largely unstudied. We tested whether salamanders could learn to locate foraging areas by using landmarks. We trained 10 salamanders Plethodon angusticlavius to use landmarks (small rocks) to locate patches within the arena containing food (blackworms Lum-briculus variegatus). At the corners of each square testing arena were four plastic dishes, one containing blackworms and the other three empty. Hemangioblastomas are extremely rare in supratentorial locations, and to date, approximately 128 cases of supratentorial hemangioblastoma have been reported in the literature. Here, we report a female case of supratentorial hemangioblastoma, not associated with von Hippel-Lindau disease. We describe its clinical, neuropathological, and neuroradiological characteristics, elaborate the surgical protocols, and follow-up methods, and review the pertinent literature.
