Over the past two years U.S. regulatory agencies have issued fourteen regulations that take into account the effect of industrial activities and products on the global climate. The regulatory activity so far has already set precedents on which future regulation will rest. Yet despite the potentially momentous consequences, it has received no comment in the law review literature. This Article examines the record of these agencies and criticizes the methods they have used to calculate the social cost of carbon emissions. Many advocates for using compulsory licensing (CL) for pharmaceutical patents in developing countries like Thailand rest their case in part on the purported use of CL in the United States. In this Article we take issue with that proposition on several grounds. As a textual matter, the "commercially reasonable terms" language in Article 31 of TRIPS, even when qualified by the Doha declaration, prevents any host nation from using whatever royalties it wants in its CL arrangements, especially those that are below marginal cost. The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

The right to be “secure against unreasonable search or seizure” in section 8 of the Canadian Charter of Rights and Freedoms applies only where the Charter applicant has a reasonable expectation of privacy in the place searched or the information obtained. The Supreme Court of Canada’s methodology for deciding whether an applicant has such a reasonable expectation appears well settled. The Court asks first whether the applicant had a subjective expectation of privacy, and second whether, in light of a long list of factors, that expectation was reasonable. Background: Coral reefs are facing increasing pressure from natural and anthropogenic stressors that have already caused significant worldwide declines. In January 2010, coral reefs of Florida, United States, were impacted by an extreme cold-water anomaly that exposed corals to temperatures well below their reported thresholds (16°C), causing rapid coral mortality unprecedented in spatial extent and severity. Methodology/Principal Findings: Reef surveys were conducted from Martin County to the Lower Florida Keys within weeks of the anomaly. The impacts recorded were catastrophic and exceeded those of any previous disturbances in the region. Coral mortality patterns were directly correlated to in-situ and satellite-derived …

Running Head: Foram Assemblages From Three Substrata Comparison Of Foraminiferal Assemblages From Three Kinds Of Substrata, Durney Key, West-Centralflorida, Usa, K. Anderson, Pamela Hallock

As part of a project that assessed a proposed artificial reef site, this study compared benthic foraminiferal assemblages from three substrata: sediment, natural lime rock and recruitment tiles. The assemblage from sediment samples included 21 foraminiferal species representing 12 genera and was dominated by stress-tolerant taxa, especially Ammonia and Elphidium. Natural lime rock and recruitment tiles yielded 21 foraminiferal species representing 11 genera, which were dominated by miliolids. Intersample variability was characterized by “pulsating patches” as has been previously described forFloridaestuaries. The predominance of stress-tolerant taxa in sediments was consistent with other observations from the site, which indicated that …

The southern Bellingshausen Sea (SBS) is a rapidly-changing part of West Antarctica, where oceanic and atmospheric warming has led to the recent basal melting and break-up of the Wilkins ice shelf, the dynamic thinning of fringing glaciers, and sea-ice reduction. Accurate sea-floor morphology is vital for understanding the continued effects of each process upon changes within Antarctica's ice sheets. Here we present a new bathymetric grid for the SBS compiled from shipborne multibeam echo-sounder, spot-sounding and sub-ice measurements. Artificial reefs (ARs) are becoming a popular biological and management component in shallow water environments characterized by soft seabed, representing both important marine habitats and tools to manage coastal fisheries and resources. [1] Arsenic (As) concentrations and stable hydrogen (δ2H) and oxygen (δ18O) isotope ratios of surface and groundwaters from a representative site in West Bengal, India, are reported. Shallow groundwaters (≤35 m) from the study site have among the highest As concentrations measured in the entire Bengal Basin, reaching values in excess of 4600 μg kg−1. Stable isotope ratios of waters from constructed, perennial ponds indicate the ponds are chiefly recharged during the summer monsoon, and subsequently undergo extensive evaporation during the dry (winter) season. Evaporites are climatic indicators that depend on two main variables: mean annual temperature and mean annual precipitation. This study constructs a model that predicts the localities of ancient evaporites based on paleo- temperature and paleo- precipitation data. A climate envelope, a bivariate plot of temperature and precipitation, is constructed by intersecting the modern temperature and precipitation with climate data obtained from Fast Ocean Atmosphere Model (FOAM). Modern evaporites have a limited extent hence in this research, the yermosols- solonchak soil type was used as a proxy. The predictions were made for 16 time intervals. Several applications involve the use of signals that are piecewise constant. Often, their measurements or observations are contaminated with noise. Detecting the steps and recovering the true signal from its noisy measurements is an important problem.There are a number of methods in the literature that address this issue. We use two different approaches. First, we use the idea of phase congruency in detecting singularities in a 1-dimensional piecewise constant signal. American film has chronicled the evolution of the zombie mythos for nearly eight decades. Originally constructed as a projection of the plight of the enslaved population of Haiti, the zombie as introduced to American film remains a symbol of societal anxieties. I argue that, to reflect the changing zeitgeist, the zombie shifts into three general forms. The Haitian Zombi is generally a passive creature subject to the will of its creator; it reveals desire to control people that either pose a threat or that have something that the creator covets and is otherwise unable to attain. It is generally believed that interannual variability in the areal extent of the Gulf of Mexico hypoxia is driven primarily by the magnitude of the Mississippi River freshwater and nutrient fluxes. It has recently been proposed that outwelling of carbon from deteriorating coastal wetlands into the surrounding Gulf of Mexico could be an important mechanism promoting the development of hypoxia. We used a coupled hydrology-hydrodynamics model of the Barataria estuary, a site of massive wetland loss, to calculate the fluxes of nitrogen, chlorophyll a and carbon at the estuary-ocean interface. The presence of photosynthetic organisms on the seafloor may indicate whether oxygen evolution contributes to the bottom water oxygen pool in the hypoxic area of the northern Gulf of Mexico. We sampled 3 stations (depth: 14, 20 and 23 m) 100 km west of the mouth of the Mississippi River over 3 hypoxic annual cycles to determine whether microphytobenthos or settled phytoplankton existed on the sediment surface. Microscopy and high-performance liquid chromatography were used to determine the presence and composition, and to estimate the biomass of microphytobenthos and phytoplankton in surface and bottom waters and sediments. Early environmental stressors may play an important role in the development of alcohol abuse and alcoholism in humans. An animal model of early environmental disturbance, termed maternal separation (MS), has been shown to affect alcohol self-administration in adult animals with short periods of daily separation (e.g., 15 min) resulting in lower alcohol intake in adulthood than longer periods of separation (e.g., 180 or 360 min). Neocortex is the largest region of the cerebral cortex in the mammalian brain. It is composed of multiple functional areas that process discrete types of information including visual, somatosensory, and auditory input and motor control output. During embryonic development, the relative size of each area is determined by transcription factors such as EMx2. The goal of our work is to identify proteins that interact with Emx2 to influence its role in neocortical arealization, the process by which the specific areas of the neocortex are formed with discrete boundaries.

Breast cancer cell growth can be inhibited in vivo by retinoid X receptor (RXR) specific retinoids. In both animal and cell culture studies, omega-3 fatty acids share growth regulatory effects similar to those ofRXR specific retinoids (rexinoids). One synthetic rexinoid, bexarotene (LCD 1069, Targretin), is used clinically to treat cancer patients. Of concern is that some patients are unable to tolerate high doses of such treatment drugs. We hypothesized that n-3 fatty acids and bexarotene may work synergistically to slow breast cancer cell growth. Inlets provide a critical ecological link between restricted bays and estuaries to the coastal ocean. The net fluxes of water and suspended sediment are presented in this study. These fluxes are obtained based on data from a multidisciplinary, full tidal cycle survey across Barataria Pass in southern Louisiana on 31 July to 1 August 2008. The velocity profiles were obtained with an acoustic Doppler current profiler mounted on a small boat continuously crossing the inlet, which contains swift and turbulent tidal currents.
