Between Conflict And Compromise: Lessons On Sharia And Pluralism From Nigeria's Kaduna And Kebbi States, Eyene Okpanachi

Emory International Law Review

Utilizing documentary sources and interviews carried out in Kaduna and Kebbi States between 2008 and 2009, this Essay asks the following questions: what forms of discord or compromise emerged over the Sharia policy and what were the implications of these transformations on the dynamics of these states? Women In The Aftermath Of The 2010 Haitian Earthquake, Benedetta Faedi Duramy Jan 2011

Women In The Aftermath Of The 2010 Haitian Earthquake, Benedetta Faedi Duramy

Emory International Law Review

This Article examines women's and girls' struggles in the aftermath of the Haitian earthquake. In particular, it focuses on the grievous conditions in the displacement camps that foster gender-based violence and abuse, often perpetrated by members of armed groups or prison escapees. Indeed, the lack of lighting, private sanitary facilities, secure shelters, and police patrols in the encampment areas endanger women's and girls' safety. The devastation and traumatic loss of family and community members following the earthquake further affect women's resilience and increase their vulnerability to abuse and sexual violence. By examining the conditions and risks faced by women and …

The Modern History Of Probable Cause, Wesley Macneil Oliver Jan 2011

The Modern History Of Probable Cause, Wesley Macneil Oliver

Law Faculty Publications

We often assume that those who wrote the Constitution understood its terms in a way that bears at least some similarity to the way we understand those terms today. This assumption is essential to the legitimacy of using Framing Era sources to inform the meaning of Constitutional provisions that regulate this system. This assumption is incorrect for one of the most important terms in criminal procedure. Probable cause meant something very different to the Framers than it means to modem lawyers. Probable cause was, as a practical matter, often nothing more than a pleading requirement for victims or officers who …

Getting To A Citizens’ Constitutional Convention: Legal Questions (Without Answers) Concerning The People’S Ability To Reform California’S Government Through A Constitutional Convention , Steven Miller Jan 2011

Getting To A Citizens’ Constitutional Convention: Legal Questions (Without Answers) Concerning The People’S Ability To Reform California’S Government Through A Constitutional Convention , Steven Miller

Loyola of Los Angeles Law Review

In 2009 and 2010, a reform organization named Repair California worked to place on the November 2010 general election ballot a pair of propositions that would have called for a citizens’ constitutional convention to substantially revise the California Constitution. The movement for reform eventually dissipated, and the propositions did not make it to the 2010 ballot. However, the call for a citizens’ convention presented novel legal questions, including whether voters could call for a convention at all, whether a convention could be called in a single election by two complementary ballot measures, whether delegates could be selected rather than elected, …

Due Process In Civil Commitments., Alexander Tsesis

Faculty Publications & Other Works

In one of its most controversial decisions to date, United States v Comstock, the Roberts Court upheld a federal civil commitment statute requiring only an intermediate burden of proof The statute provided for the postsentencing confinement of anyone proven by "clear and convincing evidence" to be mentally ill and dangerous. The law relied on a judicial standard established more than thirty years before. The majority in Comstock missed the opportunity to reassess the precedent in light of recent psychiatric studies indicating that the ambiguity of available diagnostic tools can lead to erroneous insanity assessments and mistake evaluations about patients' likelihood …

A Story Of Privileges And Immunities: From Medieval Concept To The Colonies And United States Constitution, Thomas H. Burrell Jan 2011

A Story Of Privileges And Immunities: From Medieval Concept To The Colonies And United States Constitution, Thomas H. Burrell

Campbell Law Review

Commentators often advocate that the privileges and immunities language found in the United States Constitution represents authority for some right along the spectrum of natural law, the Bill of Rights, or fundamental law in general. This Article provides contextual background for the argument by examining medieval royal privileges and immunities and tracing the crown’s charter to the American colonies and the United States Constitution. This Article goes beyond merely providing a short background for the use of the language in revolutionary pamphlets and the U.S. Constitution; rather, this Article discusses the concept of royal privileges and immunities and traces its …
