The Effect Of Identification Style On Confidence Inflation In Eyewitness Testimony, Kelsey L. Stratton
The Effect Of Identification Style On Confidence Inflation In Eyewitness Testimony, Kelsey L. Stratton
Honors Theses
The purpose of this study is to determine whether confidence inflation in eyewitness testimony can be altered by the effects of self-perception and public commitment, as manipulated by identification style. In order to investigate these specific effects, identifications and confidence reports were made using both private and public methods. Additionally, target-present and target-absent lineups were used in order to assess their relative effects and to control participant accuracy.
Results revealed that the best confidence-accuracy correlations, as determined by a comparison from pre-lineup measures, were a result of post-lineup, private identifications. This indicates that self-perception may be more responsible for confidence …
Prosecutorial Decisionmaking And Discretion In The Charging Function, Bennett L. Gershman
Prosecutorial Decisionmaking And Discretion In The Charging Function, Bennett L. Gershman
Elisabeth Haub School of Law Faculty Publications
A prosecutor's charging decision is the heart of the prosecution function. The charging decision involves an extraordinary exercise of discretionary power that is unreviewable. As a result, the decision is difficult to guide except in the broadest terms. The proposed revisions to the ABA's Criminal Justice Standards for the Prosecution Function attempt to address several key issues that inform the charging decision, by broadening the language of several provisions of the current Standards as well as adding several new provisions. To be sure, the proposed Standards significantly change the current Standards with respect to the proper factors and considerations affecting …
The Zealous Prosecutor As Minister Of Justice, Bennett L. Gershman
The Zealous Prosecutor As Minister Of Justice, Bennett L. Gershman
Elisabeth Haub School of Law Faculty Publications
As my contribution to this Memorial tribute to Professor Fred Zacharias, I have chosen to write about Fred's 1991 article in theVanderbilt Law Review entitled Structuring the Ethics of Prosecutorial Trial Practice: Can Prosecutors Do Justice? I have always seen this article as a classic, one of the finest and most important discussions of the special role of the prosecutor in the criminal justice system and of the meaning of the prosecutor's ethical duty to “do justice.” This article is cited repeatedly for numerous points: the conception of the prosecutor's duty not to win a case but to see …
Changes To The Culture Of Adversarialness: Endorsing Candor, Cooperation And Civility In Relationships Between Prosecutors And Defense Counsel, Lissa Griffin
Elisabeth Haub School of Law Faculty Publications
Following a brief history of prior versions of the relevant Standards in Part I, Part II describes the current draft of the proposed Prosecution and Defense Functions, focusing on new requirements for candor, civility, and cooperation. The article concludes that the proposed revisions represent a healthy step toward a more reliable, trustworthy, and efficient criminal justice system. The revisions explicitly recognize the central, powerful, and multidimensional role of the prosecutor and attempt to respond accurately and realistically to the needs and demands of that role. As the drafting and approval process continues, certain specific areas need greater clarification and thus …

A Discourse On The Aba's Criminal Justice Standards: Prosecution And Defense Functions: The Physical Evidence Dilemma: Does Aba Standard 4-4.6 Offer Appropriate Guidance?, Rodney J. Uphoff
Faculty Publications
Since 1966, when criminal defense lawyer Richard Ryder was disciplined for retaining physical evidence that connected his client to a bank robbery, lawyers and courts have struggled with the ethical dilemma of how defense lawyers should deal with physical evidence that potentially incriminates one of their clients. When a lawyer takes possession of an evidentiary item, must she always turn it over to the authorities, as required by most courts that have addressed this dilemma? Or, can defense counsel return the evidence to the source from whom counsel received it as recommended by Standard 4-4.6 of the ABA Criminal Justice …

A Perspective From Honduras' Civil Society Truth Commission, Craig Scott
A Perspective From Honduras' Civil Society Truth Commission, Craig Scott
All Papers
The present document formed the basis for a presentation by the author to the Standing Committee on Foreign Affairs and International Development of the House of Commons of Canada during a March 9, 2011, hearing on the situation in Honduras. After referencing the June 28, 2009, coup d’ état in Honduras, the author describes how the post-coup political situation led to the creation of two commissions – a Truth and Reconciliation Commission (Comisión de la Verdad y de Reconciliación, or CVR) given its mandate to investigate the “crisis” of June 28, 2009, by the current holder of the Honduran Presidency, …
