The Adam Walsh Act: Juveniles And Sex Offender Registration And Notification, Kallee Spooner
The Adam Walsh Act: Juveniles And Sex Offender Registration And Notification, Kallee Spooner
Undergraduate Review
Increased public concerns of juvenile sex offenders fueled the passage of the Adam Walsh Child Protection and Safety Act in 2006. The media coverage of these adolescents and public perception were influential in the enactment of this policy. Public fear is aroused by isolated incidents of deviance or crime. Media accounts highlight extreme cases, instead of more common incidents of sexual assaults (Harris & Lurigio, 2010). The fear culminates in the forming of groups of experts and concerned citizens that demand reform. Legislators cite media and views of their constituents as their primary sources of information about sex offenses and …
The Effects Of Massachusetts’ Decriminalization Of Marijuana Law On Use Patterns, Keriann Speranza
The Effects Of Massachusetts’ Decriminalization Of Marijuana Law On Use Patterns, Keriann Speranza
Undergraduate Review
The practice of smoking marijuana was imported to the United States from Mexico in the early 1900s. Fear around the use of marijuana provoked sixteen states to pass laws prohibiting the use of marijuana by 1930 (Becker, 1963). It was not until 1937 that the United States Congress passed the Marihuana Tax Act to stamp out use of the drug after the Bureau of Narcotics presented to the public in a series of propaganda films and news articles the perceived dangers of marijuana use – including violence (Becker, 1963). Since that law, the United States government has attempted to create …

Material Support: Counternarcotics Vs. Counterinsurgency In Afghanistan, Jonathan D. Kulick, Jonathan P. Caulkins, Mark A. R. Kleiman
Material Support: Counternarcotics Vs. Counterinsurgency In Afghanistan, Jonathan D. Kulick, Jonathan P. Caulkins, Mark A. R. Kleiman
School of Public Policy Working Papers
Microeconomic analysis of counternarcotics strategies in Afghanistan suggests that current policies lend material support to the enemy. Vigorous enforcement can increase the flow of funds to insurgents and other parties that profit from trafficking. Rural-development programs, promoted as elements of a counternarcotics strategy, are open to some of the same objections. The benefits of drug-fighting in Afghanistan for consumer countries in Europe and North America are likely to be modest. Anti-corruption efforts in Afghanistan and demand-reduction programs both in Afghanistan and in consumer countries, insofar as they are feasible, could serve both counternarcotics and counterinsurgency objectives.

I Can Has Lawyer? The Conflict Between The Participatory Culture Of The Internet And The Legal Profession, Lucille A. Jewel
I Can Has Lawyer? The Conflict Between The Participatory Culture Of The Internet And The Legal Profession, Lucille A. Jewel
Scholarly Works
The Internet allows citizens to comment on public affairs with an amplified and unfiltered voice, creating an open, community-based culture where robust debate flourishes. However, many of the ideals and practices of participatory culture clash with the traditional legal culture as it exists in the United States. This cultural conflict can be seen in emerging narratives, in the form of web blogs and lawyer emails that go “viral,” in which lawyers comment on the lack of humanism within big law firm hiring and firing practices; expose the alienating work environments experienced by low-level contract attorneys; or criticize judges who show …

2011 Maine Crime Victimization Survey Report: Informing Public Policy For Safer Communities, Mark Rubin, Jennifer Dodge, Eric Chiasson, Carmen Dorsey
2011 Maine Crime Victimization Survey Report: Informing Public Policy For Safer Communities, Mark Rubin, Jennifer Dodge, Eric Chiasson, Carmen Dorsey
Justice Policy
Executive Summary:
The purpose of the Maine Crime Victimization Survey (MCVS) is to better understand the nature and extent of crime in Maine. This report discusses findings of the 2011 survey and highlights areas of comparison with the original MCVS, which was conducted in 2006.
Many states, including Idaho, Utah, and Minnesota, have conducted state specific crime victimization surveys because the National Crime Victimization Survey (NCVS), a national data source on crime trends, cannot be parsed to the state level. Maine has been and is following this trend to better understand the frequency, characteristics, and consequences of criminal victimization.

Reform In Motion: The Promise And Perils Of Incorporating Risk Assessments And Cost-Benefit Analysis Into Pennsylvania Sentencing, Steven L. Chanenson
Working Paper Series
Actuarial risk assessment and cost-benefit analyses have become increasingly commonplace in many areas of criminal justice. The integration of these tools in sentencing represents a natural and logical next step. In Pennsylvania, the pace of this development has recently accelerated, as reform legislation now mandates the inclusion of actuarial methodologies into the sentencing architecture. This article considers the promises and the perils of this integration in light of Pennsylvania’s sentencing structure. The authors conclude by presenting four key questions that legislators in Pennsylvania- as well as other jurisdictions beginning to addresses the use of empirical data in sentencing- should consider …

New England Faculty And College Students Differ In Their Views About Evolution, Creationism, Intelligent Design, And Religiosity, Guillermo Paz-Y-Miño C, Avelina Espinosa
Arts & Sciences Faculty Publications
Public acceptance of evolution in Northeastern U.S. is the highest nationwide, only 59%. Here, we compare perspectives about evolution, creationism, intelligent design (ID), and religiosity between highly educated New England faculty (n = 244; 90% Ph.D. holders in 40 disciplines at 35 colleges/universities) and college students from public secular (n = 161), private secular (n = 298), and religious (n = 185) institutions: 94/3% of the faculty vs. 64/14% of the students admitted to accepting evolution openly and/or privately, and 82/18% of the faculty vs. 58/42% of the students thought that evolution is definitely true or probably true, respectively. The Limited Diagnosticity Of Criminal Trials, Dan Simon
The Limited Diagnosticity Of Criminal Trials, Dan Simon
Vanderbilt Law Review
Few political institutions play as palpable, ubiquitous, and solemn a role in the U.S. public life as the criminal justice system. The task of determining the defendant's criminal liability with a high degree of certitude is performed through the ritualized and highly proceduralized adjudicative process, with the trial at its core. The United States Supreme Court has portrayed the criminal trial as a "decisive and portentous" and "paramount" event. Trials are considered "the central institution of law as we know it," the "crown jewel" of the legal system. Amidst its multiple purposes, an essential objective of the criminal trial is …

Assessing Common Variance In Psychopathy Measures, Rochelle Taormina
Assessing Common Variance In Psychopathy Measures, Rochelle Taormina
Electronic Theses and Dissertations
Youth who demonstrate callous and unemotional traits along with aggressive antisocial behaviors are more likely than youth who do not display callous and unemotional traits to continue those acts into adulthood. Similarly there is support in the literature that the psychopathy construct measured in adulthood are evidenced in youth. For example, psychopathy traits measured by the Psychopathy Check List-Revised (PCL-R), noted as the gold standard assessment measure of psychopathy in adults, has been slightly modified for use with youth (i.e., Psychopathy Checklist - Youth Version [PCL-Y V]). The PCL-YV has been identified as a useful predictor of aggressive behaviors among …
Establishing Connections: Gender, Motor Vehicle Theft, And Disposal Networks, Christopher W. Mullins, Michael Cherbonneau
Establishing Connections: Gender, Motor Vehicle Theft, And Disposal Networks, Christopher W. Mullins, Michael Cherbonneau
Articles
As with most other serious street crimes, motor vehicle theft is a male-dominated offense. Yet, women do engage in motor vehicle theft, albeit at a reduced rate of participation. Here we examine the gendered nature of motor vehicle theft through direct comparison of qualitative data obtained from 35 juvenile and adult men and women actively involved auto theft in St. Louis, Missouri. By tracing similarities and differences between men’s and women’s pathways of initial involvement, enactment strategies, and post-theft acts, we provide a contextual analysis of offender’s perceptions and behavior. Such an approach allows a more precise discussion on gender’s …
