A Comparative Analysis Of Genocidal Rape In Rwanda And The Former Yugoslavia: Implications For The Future, Jessica Kruger

Master's Theses and Doctoral Dissertations

This work examines the genocidal rape policies that occurred in the Rwandan and former Yugoslavian conflicts. Traditionally, rape has been considered an unfortunate yet inescapable consequence of war. In the early 1990s, the Hutu and Serbian regimes developed a new tactic and utilized rape as a genocidal weapon. Following a comparative analysis framework, the present study will examine the similarities and differences of the genocidal rape in Rwanda and the former Yugoslavia. Five points of comparison were established: perpetrators, victims, global economics, social disorder, and militias. Results of this analysis show that Rwanda and the former Yugoslavia possessed common pre-genocidal …

Enhanced Expense Practices For Higher Education: Enduring Continuous Reductions In State Appropriation, Ralph E. Mckinney, Lawrence Shao

Management Faculty Research

The way forward for higher education to survive and to endure reductions in state appropriations is the enrichment of practices associated with traditional expenses. Because consistent reductions in state appropriations threaten to cause major changes to educational services within Higher Education, this paper advocates enhancement to program management and changes to teaching practices without sacrificing students' expectations. In fact, these practices strengthen learning through practical and team teaching environments while promoting unity of colleges and integration of courses. Module learning and transition programs encourage students to complete degrees faster and step up to the next advance degree. Flexibility can be …

Conflicts Over Conflicts: Challenges In Redrafting The Aba Standards For Criminal Justice On Conflicts Of Interest, Laurie L. Levenson

UC Law Constitutional Quarterly

Currently, an ABA Task Force faces the considerable challenge of redrafting the ABA Standards for Criminal Justice. Prosecutors and defense counsel need clear guidance on how to handle conflicts of interest rules. However, the initial challenge is in identifying those questions a code of ethics should answer when it comes to conflict situations. With the help of prominent lawyers, academics and judges who participated in a series of roundtables on the new ABA standards, this article identifies forty of the key questions to ask about conflicts of interests. These questions allow real progress to be made toward creating a code …

Witness Preparation: Regulating The Profession's Dirty Little Secret, Roberta K. Flowers Jan 2011

Witness Preparation: Regulating The Profession's Dirty Little Secret, Roberta K. Flowers

UC Law Constitutional Quarterly

Although all attorneys understand that coaching a witness to testify falsely is unethical, additional ethical restraints surrounding witness preparation in criminal cases are not clearly defined by case law, rules of professional conduct or even the newly drafted Criminal Justice Standards for Prosecutors and Defense Attorneys. Many have suggested that the line between proper witness preparation and improper witness coaching is not clear. This article explores some of the gray areas of the practice of witness preparation and why criminal attorneys from both sides of the aisle need guidance on permissible and impermissible conduct in this routine practice of criminal …

Mindfulness-Based Substance Abuse Treatment For Incarcerated Youth: A Mixed Method Pilot Study, Sam Himelstein

International Journal of Transpersonal Studies

The current study investigated the effects of an 8-week mindfulness-based substance use intervention

on self-reported impulsiveness, perceived drug risk, and healthy self-regulation in a sample of 60

incarcerated youth. Forty-eight participants completed questionnaires pre and post intervention.

Additionally, 16 participants from two of the final 8-week cohorts were interviewed in focus groups

about their experience of the program immediately following its completion. A mixed-method

embedded model was used, in which qualitative data was used in support of quantitative data. Paired

t-tests revealed a significant decrease (p < .01) in impulsiveness and a significant increase (p < .05)

in perceived risk of drug use from pretest to posttest. No …

2. Organizational development; and

3. Collaboration.

The stated project goal was to build learning organizations that reduce recidivism through the systemic integration of evidence-based principles in collaboration with community and justice partners. NIC provided technical assistance to Maine during the course …

Emerging Characteristics Of Education Deans’ Collaborative Leadership, Dee Hopkin, Virginia Johnson, Sandra Damico, Shelley Wepner

Academic Leadership: The Online Journal (2003-2012)

Ever increasing opportunities-and demands-for partnerships between P-12 and higher education have created the impetus for deans of education to become collaborative leaders. Deans serve a critical institutional role in charting the direction of a school or college (Rosser, Johnsrud, & Heck, 2003), and there is ample research on the general roles and responsibilities and leadership behaviors of education deans that focus on the biographical, structural, and contextual factors affecting their work (e.g., Bowen, 1995; Bright & Richards, 2001; Bruess, McClean, & Sun, 2003; Clifford & Guthrie, 1988; Gardner, 1992; Gmelch, 2002; Gmelch, Wolverton, Hopkins, Merz, & Anderson, 1999; Howey & …

Closing The Door On Misconduct: Rethinking The Ethical Standards That Govern Summations In Criminal Trials, Daniel S. Medwed Jan 2011

Closing The Door On Misconduct: Rethinking The Ethical Standards That Govern Summations In Criminal Trials, Daniel S. Medwed

UC Law Constitutional Quarterly

Closing argument is the most pivotal moment in a criminal trial. It represents the last opportunity for prosecutors to convince jurors of the defendant's guilt and for defense lawyers to show reasonable doubt. As a result, criminal lawyers may be tempted to conclude with sweeping arguments that pull at the heartstrings of their target audience, the jury. Scholars dating back to Aristotle have warned that the most persuasive arguments often contain an appeal to emotion-and that emotionally laden rhetoric can distract people from making rational choices.

Legal ethicists have struggled with the issues surrounding closing arguments, trying to reconcile the …
