The Stability Of Self-Control Among South Korean Adolescents, Ilhong Yun, Anthony Walsh May 2011

The Stability Of Self-Control Among South Korean Adolescents, Ilhong Yun, Anthony Walsh

Criminal Justice Faculty Publications and Presentations

Gottfredson and Hirschi’s General Theory of Crime has been widely tested. Yet, one of their key hypotheses—the stability of self-control hypothesis—has received little attention from researchers, and no known study has examined the applicability of the stability hypothesis in a non-western context. Given Gottfredson and Hirschi’s claim that their low self-control theory transcends cultural and national boundaries, we tested the hypothesis with a nationally representative sample of South Korean adolescents using five year panel data. Consistent with studies conducted in the U.S., our results offer partial support for Gottfredson and Hirschi’s stability hypothesis. We also provide comparative interpretations of our …

Faculty Senate Newsletter, May 2011, Louisiana State University And Agricultural & Mechanical College

LSU Faculty Senate Publications

Message from President: Contradictions are easy to find. One need only listen to the prattle at the state capitol about workforce development and then look at the support for any step along the K–20 educational pilgrimage to find stark contrasts. It is simple enough to survey any campus, compare the actions against the capacities and against the habits of assorted administrators, and come to the conclusion that confusion, if not hypocrisy, rules the academic world. That recognition, along with the proverbial twenty-five cents, will get you the stirring stick for a far pricier coffee. The question that might be asked, …

Weak-Form Judicial Review And American Exceptionalism, Rosalind Dixon May 2011

Weak-Form Judicial Review And American Exceptionalism, Rosalind Dixon

Public Law and Legal Theory Working Papers

Recent Commonwealth rights charters, various scholars have argued, represent a new "weaker" model of constitutional rights protection than the U.S. constitutional model: unlike the U.S. Bill of Rights, they give legislatures broad formal power to override rights, and therefore also court decisions. The article argues, however, that in practice such powers have rarely if ever been used by Commonwealth legislatures, and therefore, that if judicial review is in fact weaker in Commonwealth countries, compared to the U.S., it is only because Commonwealth courts have been more willing than the U.S. Supreme Court to uphold ordinary legislative attempts to override court …

The Role Of The Prosecution And Defense Function Standards: Stagnant Or Progressive?, Ellen S. Podgor May 2011

The Role Of The Prosecution And Defense Function Standards: Stagnant Or Progressive?, Ellen S. Podgor

UC Law Journal

This Essay examines the role of the ABA Criminal Justice Standards: The Prosecution and Defense Function Standards, looking at language when initially drafted to language being considered in the proposed fourth edition. It focuses on the preliminary sections of the Standards that outline the intended role of the Standards and considers how courts have used these Standards in court decisions. It also notes how the Standards serve a hortatory role, providing internal guidance to prosecutors and defense counsel. An overriding question is whether these Standards serve a legitimate function in the criminal justice process? Placing the question of the role …

The Aba’S Project To Revise The Criminal Justice Standards For The Prosecution And Defense Functions, Rory K. Little May 2011

The Aba’S Project To Revise The Criminal Justice Standards For The Prosecution And Defense Functions, Rory K. Little

UC Law Journal

In late 2005, I was asked by the ABA Criminal Justice Standards Committee whether I would serve as ‘Reporter’ to a Task Force that was being formed to consider revisions to the Criminal Justice Standards for Prosecution and Defense Functions. The call did not come out of the blue; I had previously worked with the ABA in various capacities. In the mid-1990s, I had served as a member of the ABA’s Standing Committee on Professional Responsibility. In 1999, I published an article bemoaning the lack of specific guidance in the ABA Criminal Justice Standards for prosecutors acting in an investigative …

Quieting Cognitive Bias With Standards For Witness Communications, Melanie D. Wilson May 2011

Quieting Cognitive Bias With Standards For Witness Communications, Melanie D. Wilson

UC Law Journal

Last year, as part of a project to revise the ABA Criminal Justice Standards for Prosecution and Defense Functions, the ABA Criminal Justice Section initiated roundtable discussions with prosecutors, criminal defense lawyers, and academics throughout the United States. The Standards under review provide aspirational guidance for all criminal law practitioners. This Article stems from the Criminal Justice Section’s undertaking. It considers the wording, scope, and propriety of several of the proposed changes that address lawyer-witness communications. It begins with a discussion of the effects of cognitive bias on these communications and explains why carefully tailored Standards may lessen the detrimental …

How Effective The International Criminal Court Has Been: Evaluating The Work And Progress Of The International Criminal Court, Moses Retselisitsoe Phooko May 2011

How Effective The International Criminal Court Has Been: Evaluating The Work And Progress Of The International Criminal Court, Moses Retselisitsoe Phooko

Notre Dame Journal of International & Comparative Law

There are serious challenges facing the International Criminal Court (ICC). Two of these hindrances are that: firstly, the ICC has been accused of only targeting the African continent; and secondly, the Rome Statute of the International Criminal Court (Rome Statute) has no enforcement mechanism against the state parties who refuse to cooperate with the court. In light of these challenges, the question is whether the ICC would be able to meet the expectations of the international community. The significance of this study is to contribute to the effort of making the ICC an independent, credible and effective tribunal to end …

Brain Scans As Evidence: Truths, Proofs, Lies, And Lessons, Francis X. Shen, Owen D. Jones May 2011

Brain Scans As Evidence: Truths, Proofs, Lies, And Lessons, Francis X. Shen, Owen D. Jones

Mercer Law Review

This Brain Sciences in the Courtroom Symposium is both timely and important. Given recently developed and rapidly improving brain imaging techniques that enable non-invasive detection of brain activity, civil and criminal courts increasingly encounter attorneys proffering brain scans as evidence.' The reason is simple. In addition to caring about how people act-such as when they cause a person's death or sign a will-the legal system's inquiries frequently turn on determining what people were thinking, or were capable of thinking, when they acted.

In criminal law, for example, the same act can yield anything from mere probation to decades in …

High School Students’ Knowledge Of Careers And Non-College Post-Secondary Options, Mariel Stein May 2011

High School Students’ Knowledge Of Careers And Non-College Post-Secondary Options, Mariel Stein

Renée Crown University Honors Thesis Projects - All

This Capstone Project discusses high school students’ knowledge of careers and non-college post-secondary options. The problem this project addresses is the fact that many high school students lack adequate knowledge of careers and non-college post-secondary options, and therefore they often make poor decisions regarding their post-secondary plans.

The methodology used was research, observations, and personal communication. I conducted inductive research because I felt that my information of high school vocational education was too narrow and I wanted to broaden my knowledge to see what the trend is across the country, what the causes of the aforementioned problem are, and what …

Community Expectations Of College Attendance And Completion, Michael Wade Derden May 2011

Community Expectations Of College Attendance And Completion, Michael Wade Derden

Graduate Theses and Dissertations

Communities relay expectations of behavior that influence residents' decision making processes. The study's purpose was to define and identify Social, cultural, and human capital variables relevant to understanding community expectations of postsecondary attainment. The study sought an operational model of community expectancy that would allow policymakers and higher education leaders to recognize the community-level factors affecting student outcomes and then to make appropriate policy adjustments to encourage better outcomes.

Predicting Dating Violence Victimization Among College Women: The Role Of Previous Exposure To Violence And Acceptance Of Dating Violence, Marie Elisabeth Karlsson May 2011

Predicting Dating Violence Victimization Among College Women: The Role Of Previous Exposure To Violence And Acceptance Of Dating Violence, Marie Elisabeth Karlsson

Graduate Theses and Dissertations

Dating violence is a worldwide problem (Straus, 2004). The majority of empirical studies and conceptual models of dating violence have focused on perpetration, and examined the impact of prior exposure, positing an intergenerational transmission model. More recently, researchers have examined the influence of other moderating and mediating variables and hypothesized that attitudes, such as acceptance of dating violence, are an important variable to examine (Flynn & Graham, 2010; Lichter & McCloskey, 2004). Focusing on victimization, this study attempted to assess the applicability of the intergenerational hypothesis (previous exposure to violence, such as witnessing interparental abuse and childhood abuse) as well …

Modern Day Utopia: An Examination Of Internal Social Control Among "Rainbow Family", Ashleigh Elain Mckinzie May 2011

Modern Day Utopia: An Examination Of Internal Social Control Among "Rainbow Family", Ashleigh Elain Mckinzie

Graduate Theses and Dissertations

This thesis employs ethnographic fieldwork and interviews to examine internal Social control, ideological embeddedness, and resistance to mainstream culture and ideology in a utopian, counter-cultural group called The Rainbow Family of Living Light. Combining theoretical perspectives on emotions and re-integrative and dis-integrative shaming with symbolic interaction, I examine the experiences of Rainbow during a national Gathering in the summer of 2010. Through interviews and observations, I illustrate the rituals, organization of camp, stratification based on work, and solidarity building activities, that Rainbow Gatherers create to resist mainstream ideology and culture. Further, I show that they Rainbow Gatherers redefine deviance in …

The Symbolic Creation Of Cultural Performance At The Walnut Valley Festival, Maggie Colleen Cobb May 2011

The Symbolic Creation Of Cultural Performance At The Walnut Valley Festival, Maggie Colleen Cobb

Graduate Theses and Dissertations

Through two years of ethnographic fieldwork and 19 interviews, I synthesize symbolic interaction and a sociological framework of culture to examine the ways in which the Walnut Valley Festival is created and experienced as a unique form of cultural performance, one that is always shifting in response to the emergent cultural creation and reception of attendees. No work to date combines the dimensions of both production and reception of music festivals as a unique form of cultural performance. In bringing back the oftentimes ignored affective dimension in cultural studies, I use Griswold's (2004) metaphor of a cultural diamond, examining the …

An Ecology Of Philanthropy: Community Composition And Nonprofit Revenue In The United States, Wendie Neesa Choudary May 2011

An Ecology Of Philanthropy: Community Composition And Nonprofit Revenue In The United States, Wendie Neesa Choudary

Graduate Theses and Dissertations

There is little doubt that most American cities are currently troubled places because of massive economic shifts that have marked the last two decades. Charitable giving has consistently been seen as the lifeblood of communities around the United States (Backman and Smith 2000). The primary purpose of this study is to examine the relationship between community composition and charitable giving. The impact of community characteristics (community composition, organizational composition, and community deterioration) on charitable revenues will be assessed using revenue data from the 2006-2007, 501(c)(3), 990, charitable organization forms along with United States county census data. One-way ANOVA and regression …

Spatial Variations In Willingness To Pay For Water At The Local And Regional Scales Using Geographically Weighted Regression, Robyn Lane Dennis May 2011

Spatial Variations In Willingness To Pay For Water At The Local And Regional Scales Using Geographically Weighted Regression, Robyn Lane Dennis

Graduate Theses and Dissertations

Two decades of rapid urban growth and increasing per capita water consumption has left water providers in Northwest Arkansas concerned about their ability to meet future demand for water. Beaver Water District (BWD) is the largest of four regional water providers that draw from Beaver Lake, the only source of potable water in the region. Growth projections and per capita consumption patterns indicate that BWD could exhaust its raw water allocation as early as 2031. Municipal water customers served by BWD were surveyed about their stated priorities for water use, their water conservation behaviors, and their attitudes and perceptions about …

Profiling By Any Other Name Could Be The Foreign Intelligence Surveillance Act, Evan M. Malloy May 2011

Profiling By Any Other Name Could Be The Foreign Intelligence Surveillance Act, Evan M. Malloy

HIM 1990-2015

The undergraduate thesis began with the research question of whether the Islamic community is being profiled by the use of the Foreign Intelligence Surveillance Act (FISA) following the terrorist attacks on September 11, 2001. At the beginning of the project, the researcher's hypothesis was that Muslim community had fallen victim to profiling through the use of electronic surveillance conducted by the American government. The research presented reveals a pattern of profiling and injustices against many different groups of Americans throughout the history of United States surveillance laws starting with the illegal alcohol producers in the 1920's. Amendments to FISA have …
