Widening Batson's Net To Ensnare More Than The Unapologetically Bigoted Or Painfully Unimaginative Attorney, Jeffrey Bellin, Junichi P. Semitsu

Vanderbilt Law School Faculty Publications

In Snyder v. Louisiana, the Supreme Court reaffirmed its commitment to rooting out racially discriminatory jury selection and its belief that the three-step framework established in Batson v. Kentucky is capable of un- earthing racially discriminatory peremptory strikes. Yet the Court left in place the talismanic protection available to those who might misuse the peremptory challenge-the unbounded collection of justifications that courts, including the Supreme Court, accept as "race neutral." To evaluate the Court's continuing faith in Batson, we conducted a survey of all federal published and unpublished judicial decisions issued in this first decade of the new millennium (2000-2009) …

It's Like A Giant Game Of Telephone: Physicians' Perceptions Of Effective Communication In The Emergency Department Context', Marleah Dean Jul 2011

It's Like A Giant Game Of Telephone: Physicians' Perceptions Of Effective Communication In The Emergency Department Context', Marleah Dean

Communication ETDs

Despite the growing number of emergency department visits, effective communication between patients and physicians are often overlooked because of the fast- paced nature of the emergency department (ED). As such, we do not know what is seen as effective communication within this particular context. Therefore, the goal of this study was to learn how emergency department physicians define effective communication and identify the barriers and facilitators to communicating in the ED. Seventeen semi-structured, open-ended interviews were conducted with ED physicians. Interviews were recorded and transcribed into a Word document. Data analysis included two steps—the constant comparison method (Lindlof & Taylor, …

Kneejerks And Fresh Starts: A History Of Speakers And Authors Of Protibaad, Atreyee Majumder

Socio-Legal Review

I hadn't seen a michheel in close to a decade. Until yesterday. Middle-aged Writers' Buildings officials, of Congress leanings, protested the attacks on Congress leaders in Burdwan saying that it was possible due to police apathy and negligence. There were hardly any banners, mostl slogans. Even as some tyres are deflated and buses burnt down in the heart of South Calcutta. The Congress is back with a bang, say the newspapers. These attacks have reinvigorated our workers. A Congress leader is quoted. A feeble identity that was getting increasingly engulfed by the grassroot diva of the state is now fed …

Oral History And “Girls’ Voices”: The Young Women’S Studies Club As A Site Of Empowerment, Susan Cayleff, Melissann Herron, Chelsea Cormier, Sarah Wheeler, Alicia Chávez-Arteaga, Jessica Spain, Cristina Dominguez

Journal of International Women's Studies

Girls’ Voices is a collaborative research project involving multi-tiered community-and university-based mentorship and a Young Women’s Studies Club (YWSC) at Hoover High School in San Diego, California. Since its inception 15 years ago, the Club meets weekly and engages in activities that address the life circumstances and coming-of-age issues faced by its membership. Thirty-five to 45 students (95% female) attend weekly. They are a widely diverse population: new immigrants from various parts of the globe, and mostly lower-socioeconomic status Southern Californians of color (Mexican, Asian, and African-American). English is not the first language for several of the members.

What The Progressives Had In Common, Glen Gendzel Jul 2011

What The Progressives Had In Common, Glen Gendzel

Faculty Publications, History

When Professor Benjamin Parke De Witt of New York University sat down to write the first history of the progressive movement in 1915, he promised “to give form and definiteness to a movement which is, in the minds of many, confused and chaotic.” Apparently it was a fool's errand, because confusion and chaos continued to plague historians of early twentieth-century reform long after Professor De Witt laid his pen to rest. The maddening variety of reform and reformers in the early twentieth century has perpetually confounded historians' efforts to identify what, if anything, the progressives had in common. Back in …

How Mental Health Challenges Impact The Sexual And Relational Health Of Young Adults, L. Kris Gowen Jul 2011

How Mental Health Challenges Impact The Sexual And Relational Health Of Young Adults, L. Kris Gowen

School of Social Work Faculty Publications and Presentations

Sexual behavior is a normative aspect of young adulthood—90% of young adults have had vaginal intercourse and/or oral sex before the age of 30.1 Similarly, engaging in romantic and/or intimate relationships is seen as an essential developmental task of young adulthood. However, little is known about the sexual and romantic relationships of young adults with serious mental health conditions (SMHC), despite the fact that there is evidence that this population is disproportionately affected by poor sexual health. This article will outline what is known about the sexual and romantic relationships of young adults with SMHC and highlight the importance of …

First-Year Library Mentorship Opportunities, Crystal Goldman Jun 2011

First-Year Library Mentorship Opportunities, Crystal Goldman

Urban Library Journal

The first-year experience at any university library sets the foundation for the future relationship between the new faculty member and the library as a whole. Not only is the librarian being acculturated to the organization, but he or she must decide if the library and university will provide a supportive environment for his or her career goals. In this probationary process, the tenured librarians evaluate their tenure-track colleagues’ professional progression and merit. Many libraries institute a formal first-year mentoring program in order to facilitate the immersion of new faculty members into the organizational culture of the library and university. There …

Disability, Vulnerability And Citizenship: To What Extent Is Education A Protective Mechanism For Children With Disabilities In Countries Affected By Conflict?, Jean-Francois Trani, Maria Kett, Parul Bakhshi, Nicola Bailey Jun 2011

Disability, Vulnerability And Citizenship: To What Extent Is Education A Protective Mechanism For Children With Disabilities In Countries Affected By Conflict?, Jean-Francois Trani, Maria Kett, Parul Bakhshi, Nicola Bailey

Brown School Faculty Publications

Humanitarian crises as a result of conflict are often characterised by failure of the social contract between the state and its citizens. For a variety of reasons, children with disabilities are often particularly vulnerable in time of humanitarian crisis. This paper draws on research undertaken by the authors in a series of countries affected by conflict, and looks at how the politics and policies of such countries, and the humanitarian and development agencies working in them, continue to exclude children with disabilities from formal and informal education structures. It will be argued that this exclusion not only impedes progress on …

Perceived Racism And Mental Health: A Meta-Analytic Review, Hokulea D. Conklin Jun 2011

Perceived Racism And Mental Health: A Meta-Analytic Review, Hokulea D. Conklin

Theses and Dissertations

The present study provides a synthesis of extant research examining the association between perceived racism and mental health. The aims of this study were to identify the overall magnitude of this association and to elaborate on the possible influence of participant characteristics (acculturation level, age, gender, race, education, and socioeconomic status) and study characteristics (year of data collection, geographic region of the study, and research design) in moderating this association. A total of 130 studies were included in the final analysis. The omnibus effect size for this meta-analysis was r = -.188 (p < .001), which indicates that higher instances of perceived racism were associated with lower levels of mental health. The overall magnitude of this association suggests a moderately small relationship between these two constructs. None of the participant characteristics moderated the results. However, studies conducted in more recent years appeared to be associated with effect sizes of greater negative magnitude than studies conducted in previous years. The implications of these findings for multicultural psychology are discussed and suggestions regarding future research in this area are presented.

Frequent Users Of The Emergency Department: Guiding Patients To Comprehensive And Coordinated Care, Anne L. Draeger

Theses and Graduate Projects

The purpose of this project is to implement a rural community-based collaborative care network to assist high frequency emergency department users navigate a comprehensive system to access a full range of health care services and decrease reliance on the emergency department. Patients who frequent the emergency department are less apt to receive coordinated treatment of pain and other chronic disease which leads to suboptimal care focusing on symptoms rather than disease management. Nurses who practice in the emergency department identify the pattern of frequent use and lack of care coordination but struggle to provide a connection to preventative services and …

Promoting Successful College-To-Workplace Transitions: Examples From Bethel University, Charles Hannema, Joyce Lemay, Bethany Opsata, Stephen Whiting

Business Faculty Publications

Life is filled with transitions. One of the toughest is from college to the workplace. Many graduates experience culture shock as they move from the comfort of a Christian college to the reality of the business world. This paper will look at the context and the challenges for workplace transition. It will then review the practices used at one Christian university that have shown effective in preparing students for employment along with theories currently in development to improve workplace transition.
