Networked Justice: Judges, Ideational Contagion, And Reform Movements In Mexico, Matthew C. Ingram
Networked Justice: Judges, Ideational Contagion, And Reform Movements In Mexico, Matthew C. Ingram
2011
How do legal institutions change in new democracies? More specifically, what are the origins of justice reforms in Mexico? Existing research establishes the important role of ideas in shaping both the design of courts and the opinions of judges who inhabit them. In short, ideas shape jurisprudence and institutions. However, while we know ideas matter, there is little empirical evidence regarding the content or distribution of these ideas, and even less evidence regarding the manner in which ideas diffuse among judges, institutions, and geographic locations. Why do some judges hold these ideas while others do not? Addressing these empirical and …

Perceptions Of The Effectiveness Of Not-For-Profit Board Development Opportunities, Daniel R. Abben
College of Liberal Arts & Social Sciences Theses and Dissertations
Human service not-for-profit organizations provide goods and services that support the well being of members of society. While these organizations can vary in the goods and services that they provide and in the models that they use to provide those goods and services, they are all similar in that they are accountable to volunteer boards of directors. The literature contains myriad prescriptions boards can follow that will help them provide adequate governance to their organizations. In addition, researchers have identified specific competencies that are able to distinguish between low-performing and high-performing boards. Finally, research has suggested that a relationship exists …

Differentiating The Federal Circuit, Elizabeth I. Winston
Missouri Law Review
In 1982, Congress created the United States Court of Appeals for the Federal Circuit. Often referred to as an experiment, the Federal Circuit has flourished Born again from the ashes of its predecessors, the aptly nicknamed Phoenix Court continues to grow in significance, stature, and strength. As it grows, however, the court remains rooted in its history and in its unique nature. This Article explores the Federal Circuit's structure and its impact on the development of Federal Circuit jurisprudence. The Federal Circuit is distinguishable by more than its national jurisdiction - the very essence of the court sets it apart …

A Centrist Solution To Central American Violence And Inequality, Devin Joshi
A Centrist Solution To Central American Violence And Inequality, Devin Joshi
Human Rights & Human Welfare
The northern triangle of Central America (El Salvador, Guatemala, and Honduras) has experienced horrific violence, poverty, and a vicious cycle of human rights violations for decades. Repeated natural disasters and the re-routing of the drug trade through Central America are not helping the situation. On the other hand, nearby Costa Rica has achieved a much higher standard of human rights, public safety, and political stability. Why? Costa Rica has put in place four pillars of development and stability lacking in most other countries in the region: a stronger state, an educated population, inter-racial cooperation, and a more inclusive democracy. For …
Randomization And The Fourth Amendment, Bernard E. Harcourt, Tracey L. Meares
Randomization And The Fourth Amendment, Bernard E. Harcourt, Tracey L. Meares
University of Chicago Law Review
Randomized checkpoint searches are generally taken to be the exact antithesis of reasonableness under the Fourth Amendment. In the eyes of most jurists, checkpoint searches violate the central requirement of valid Fourth Amendment searches—namely, individualized suspicion. We disagree. In this Article, we contend that randomized searches should serve as the very lodestar of a reasonable search. The notion of "individualized" suspicion is misleading; most suspicion in the modern policing context is group based and not individual specific. Randomized searches by definition are accompanied by a certain level of suspicion. The constitutional issue, we maintain, should not turn on the question …

Relief From Deportation: An Unnecessary Battle , Christen Chapman
Loyola of Los Angeles Law Review
A removal hearing in immigration court focuses on two predominant issues—whether the noncitizen is deportable and whether the noncitizen should be granted relief from a deportation order. Because it is relatively easy for the government to prove deportability, most removal hearings turn on the noncitizen’s application for relief. Currently, an Immigration and Customs Enforcement (ICE) attorney serves as a relentless adversary throughout the removal process, even though few noncitizens are represented by counsel. Although the entire removal hearing lacks the elements that are essential to a fair adversarial proceeding, the ICE attorney’s participation in initially establishing a noncitizen’s removability is …

Cal Poly Power System Design & Analysis, Minesh D. Patel
Electrical Engineering
The scope of this project encompasses the design and analysis of the Cal Poly Power System at the distribution level using the SKM software environment. The purpose is to accurately model the power system in software so theoretical calculations and analysis can be executed. This requires sufficient preliminary research to obtain data for the main buildings on campus, sound interpretation of one line diagrams, designing the system within the software using realistic values and then performing analysis to model real world situations. The data collected is under maximum load conditions for a specified time period using medium voltage parameters. The …
