An Ethical Rabbit Hole: Model Rule 4.4, Intentional Interference With Former Employee Non-Disclosure Agreements And The Threat Of Disqualification, Part Ii, Maura I. Strassberg Jan 2011

An Ethical Rabbit Hole: Model Rule 4.4, Intentional Interference With Former Employee Non-Disclosure Agreements And The Threat Of Disqualification, Part Ii, Maura I. Strassberg

Nebraska Law Review

Whether or not a lawyer can be found to have acted unethically in violation of Model Rule 4.4 initially depends upon whether the lawyer would be liable for intentional interference with the NDA between the former employee and their employer. In part, this is a matter of tort law, and in Part I of this Article, published separately at 89 NEB. L. REV. (forthcoming June 2011), I evaluated the possible application of this quite complex tort to a lawyer’s informal communication with such a former employee for the purpose of obtaining information relevant to proposed or pending litigation. What emerged …

Using A Flow-Chart To Reduce Juror's Pre-Existing Biases In Cases Utilizing The Insanity Defense, Lauren M. Schlumper Jan 2011

Using A Flow-Chart To Reduce Juror's Pre-Existing Biases In Cases Utilizing The Insanity Defense, Lauren M. Schlumper

College of Graduate Studies: Theses & Dissertations

Many people believe that the insanity defense is used to avoid responsibility for committing a crime and that it returns dangerous individuals back to the streets. Due to the fact that it is difficult to separate such pre-existing attitudes from evidence presented throughout the trial, many jurors use their attitudes to assist them when deciding a verdict and punishment. For example, Steblay, Hosch, Culhane & McWethy (2006) found that not only is it difficult for jurors to disregard information that is not relevant or presented during trial, but that pre-trial information and attitudes can actually influence their verdict. The present …

Why Do Restaurants Fail? Part Iii: An Analysis Of Macro And Micro Factors, H.G. Parsa, Amy Gregory, Michael "Doc" Terry

Dick Pope Sr. Institute Publications

Restaurants are a significant part of American life. According to the National Restaurant Association (2009), total revenues for the restaurant industry exceed $580 billion with nearly 1,000,000 operating restaurants in the US; providing jobs for over 13 million people. The sizeable economic impact of the restaurant industry can be measured by the 4% contribution it makes to the Gross Domestic Product in the United States. In addition, the restaurant industry has been expanding at a steady rate of 2 to 4 % over the past three decades. In 2009, despite the economic downturn, the restaurant industry grew by 2.5% (NRA, …

A Climatological Analysis Of Heatbursts In Oklahoma (1994–2009), Renee A. Mcpherson, Justin D. Lane, Kenneth C. Crawford, William G. Mcpherson Jr. Jan 2011

A Climatological Analysis Of Heatbursts In Oklahoma (1994–2009), Renee A. Mcpherson, Justin D. Lane, Kenneth C. Crawford, William G. Mcpherson Jr.

United States Department of Commerce: Staff Publications

Heatbursts are characterized by a sudden and highly localized increase in air temperature, a simultaneous decrease in relative humidity and dewpoint temperature, and strong gusty winds, typically associated with decaying thunderstorms. The small spatial extent and short duration of most heatbursts makes detailed study of these events difficult using the standard federal observation network (e.g. hourly observations) established in most countries. Thus, many discussions of heatbursts note that they are ‘rare’ phenomena. However, observations from the Oklahoma Mesonet indicate that although heatbursts are meso-alpha scale phenomena, they are not rare. Using multi-criteria analysis, 207 heatburst events of various magnitudes, areal …

United States Army: Publications

I magine you are the warden of a prison or the administrator of a jail, you enter the facility, and the heavy metal door clangs shut behind you. A riot breaks out and several members of your staff are taken hostage. Fires are set in various locations. The rioting inmates, members of a gang, attack other inmates who want no part in the rebellion and are only concerned for their safety. The decisions you as a leader make are literally matters of life or death, not only for yourself, but also for your staff and those incarcerated. The dynamics of …

Ethics In Dangerous Situations, C. Anthony Pfaff, Ted Reich, Walter Redman, Michael Hurley

United States Army: Publications

To protect soldiers repairing a vehicle on a road, a platoon leader in Iraq provided protection for them by positioning two manned vehicles along possible routes that other vehicles, potentially laden with explosives, could use. In doing so, he decided not to follow the platoon's standard operating procedure (SOP), which called for controlling traffic along the road by separating nonthreatening Iraqi vehicles from suspicious ones. He believed that he was being"paid to exercise judgment," so he broke from routine. Because he knew the enemy had used snipers against soldiers on this road in the past, he calculated that the risk …

Proceedings From The National Pipeline Safety Forum

United States Department of Transportation: Publications

The Forum was organized around three panel discussions intended to prompt discussion related to and culminating in the actions that PHMSA, states, and industry can take to increase pipeline safety. First, discussions were focused on both the known and perceived risks posed by pipelines, including the means by which these risks and threats are identified, measured, and evaluated. The second objective was to discuss the nature, scope, and extent of the challenges facing the industry and regulators as they decide how best to address and eliminate or mitigate these risks, and prevent future incidents. Financially-driven challenges were addressed along with …

The Gay Of The Land: Queer Ecology And The Literature Of The 1960s, Jill Elizabeth Anderson Jan 2011

The Gay Of The Land: Queer Ecology And The Literature Of The 1960s, Jill Elizabeth Anderson

Electronic Theses and Dissertations

In this dissertation I argue not only that queer ecology is a legitimate and important next step for ecocritics and queer theorists but also that its literary application does a great amount of good in exploring and dismantling the natural/unnatural binary and exposing the ecological impact of the choices humans make everyday. I take as my method a combination of queer and environmental theory and literary criticism, as well as the foundational queer ecocritical works and include important historical and political perspectives influencing the emergence of the environmental and gay and lesbian movements. Through this dissertation, I legitimize more recent …

Storm Spotting And Amateur Radio: A Field Guide For Volunteer Storm Spotters, Michael Patrick Corey Jan 2011

Storm Spotting And Amateur Radio: A Field Guide For Volunteer Storm Spotters, Michael Patrick Corey

Electronic Theses and Dissertations

Volunteers have played a critical part in relaying weather information since the middle 19th century. The effort of these volunteers has helped safeguard life and property when severe weather threatens. For almost 100 years Amateur Radio operators have played a critical part in severe weather preparedness and response. Amateur Radio operators not only bring a willingness to serve, but communications skills that provide an added benefit to any storm spotter program. The National Weather Service recognized this when developing the SKYWARN program during the 1960’s. Amateur Radio and the National Weather Service have developed over the last 40 years a …

Best Practices For Disaster Coverage: An Analysis Of How The Herald Newspaper And Wlox-Tv Covered Hurricane Katrina, Nicole R. Sheriff

Electronic Theses and Dissertations

A substantial amount of research has been done on Hurricane Katrina and its effects on New Orleans, Louisiana. However, few studies have focused on how the Mississippi Gulf Coast was affected by the hurricane. The purpose of this study is to bring attention to the reporting efforts of WLOX-TV and The Herald newspaper to cover Hurricane Katrina. This case study analyzes the practices WLOX and The Herald used to cover the hurricane and to explore which practices could be implemented in other newsrooms in the future. A total of four interviews were conducted with members from the newsrooms who had …

Guns, Fruits, Drugs, And Documents: A Criminal Defense Lawyer's Responsibility For Real Evidence, Stephen Gillers Jan 2011

Guns, Fruits, Drugs, And Documents: A Criminal Defense Lawyer's Responsibility For Real Evidence, Stephen Gillers

Faculty Articles

A criminal defense lawyer may need to read a document, test a weapon, or analyze a substance in order to advise a client. Or there may be no such need but a client may show up at a law office with an illegal weapon, contraband, or stolen property. In either event, what should a lawyer do with the item following any evaluation? What should she do if her client reveals where a weapon, contraband, or stolen property is hidden? Some cases say that a lawyer who receives or retrieves an item of real evidence must give it to the authorities …

American Policing At The Crossroads: Unsustainable Policies And The Procedural Justice Alternative, Stephen J. Schulhofer, Tom R. Tyler, Aziz Z. Huq Jan 2011

American Policing At The Crossroads: Unsustainable Policies And The Procedural Justice Alternative, Stephen J. Schulhofer, Tom R. Tyler, Aziz Z. Huq

Faculty Articles

As victimization rates have fallen, public preoccupation with policing and its crime-control impact has receded. Terrorism has become the new focal point of concern. But satisfaction with ordinary police practices hides deep problems. The time is therefore ripe for rethinking the assumptions that have guided American police for most of the past two decades. This Article proposes an empirically-grounded shift to what we call a procedural justice model of policing. When law enforcement moves toward this approach, it can be more effective at lower cost and without the negative side effects that currently hamper responses to terrorism and conventional crime. …

Community-Based Operations Research: Introduction, Theory And Applications, Michael P. Johnson Jr. Jan 2011

Community-Based Operations Research: Introduction, Theory And Applications, Michael P. Johnson Jr.

Public Policy and Public Affairs Faculty Publication Series

Community-based operations research is the name of a new sub-discipline within operations research and the management sciences. CBOR synthesizes previous practice and research traditions within OR/MS to address problems within the public sector that are often of a localized nature, that address the concerns of citizens affiliated through characteristics of race, ethnicity and class and other ties and that are solved using diverse qualitative and quantitative methods. Solutions to these problems are developed and implemented by formal and informal organizations, and embody a critical perspective towards traditional notions of decisionmakers, stakeholders and analytic methods. The most proximate antecedents of CBOR …

Outcomes, Adaptations And Performance: A Local Evaluation Of Shelter Plus Care, Sloan R. Herrick Jan 2011

Outcomes, Adaptations And Performance: A Local Evaluation Of Shelter Plus Care, Sloan R. Herrick

Wayne State University Theses

Individual outcomes and barriers to program implementation for Shelter Plus Care are presented in an exploratory study investigating the impact of a permanent supportive housing program - Shelter Plus Care - in Detroit, a city that faces unique challenges and complicated needs. Individual outcomes including improved housing stability, increased income and reports of enhanced self-sufficiency suggest the program is achieving the goals projected by the U.S. Department of Housing and Urban Development (HUD). Despite positive outcomes for individual consumers, barriers to program implementation emerged as thematic problems for organizations running the program. The study provides recommendations that may increase the …

Essay: How To Hold A State Constitutional Convention In The Twenty-First Century , Ann M. Lousin Jan 2011

Essay: How To Hold A State Constitutional Convention In The Twenty-First Century , Ann M. Lousin

Loyola of Los Angeles Law Review

Although few states have held constitutional conventions in recent decades, there is renewed interest in holding state constitutional conventions in the twenty-first century. This Essay explains the author’s views on holding such a convention, based on her experience in Illinois and with a view toward a California convention. The author believes that the two keys to a successful convention in the twenty-first century are extensive preparation and transparency. Only with preparation can the delegates and staff of a convention draft a document worthy of adoption. Only with great transparency of the process, especially in the Internet age, can the citizens …

The Marcellus Shale is by far the largest natural gas shale play in the United States' and the largest known shale deposit in the world.

Located beneath a large part of the Appalachian basin, it extends north into upstate New York, south into West Virginia and Virginia, and west into Ohio, and geologists estimate that it may contain as much as 489 trillion cubic feet of recoverable natural gas. The Commonwealth of Pennsylvania currently owns 117 parks and three conservation areas in Pennsylvania, making up 2.4 million acres of land - approximately 1.5 million of which are above the Marcellus …

Caught In A Preventive Dragnet: Selective Counterterrorism In A Post 9/11 America, Sahar F. Aziz

Faculty Scholarship

While post-9/11 preventive counterterrorism policies have adversely impacted various groups of Americans, no group has been more profoundly affected than the Muslim, Arab, and South Asian communities. Mosque infiltration has become so rampant that some congregants assume they are under surveillance as they fulfill their religious obligations. Government informants have ensnared numerous, seemingly hapless and unsophisticated young men such that Muslims no longer know whom they can trust among each other. Aggressive prosecutions of Muslim charities and individuals across the country have embittered communities that now feel under siege by their government and distrusted by their non-Muslim compatriots.19 Selective counterterrorism …
