Animal Violence Court: A Therapeutic Jurisprudence-Based Problem-Solving Court For The Adjudication Of Animal Cruelty Cases Involving Juvenile Offenders And Animal Hoarders, Debra L. Muller-Harris
Animal Law Review
Cases involving cruelty to animals are currently handled by the traditional criminal courts. These courts, however, are not effective at punishing animal abusers or protecting animal victims. Although all states have laws criminalizing various forms of animal cruelty, the reality is that most cruelty cases are not prosecuted; even when cruelty cases are successfully prosecuted, punishments are weak. This Comment proposes the creation of an Animal Violence Court, using juvenile animal abusers and adult hoarders as ideal candidates for a pilot animal cruelty justice system. The Animal Violence Court will provide for the ongoing safety and care of animal victims, …

State Animal Use Protection Statutes: An Overview, Jen Girgen
Animal Law Review
Although much attention has been given to the Animal Enterprise Terrorism Act, a federal statute enacted to deter and punish extra-legal animal rights activism, comparatively little attention has been afforded the various state versions of this law. This Article is an attempt to help remedy this deficit. It offers a comprehensive overview of existing state animal use protection statutes and describes legislative trends in this area.

Structurally Unbalanced: Cyclical And Structural Deficits In Arizona, Matthew Murray, Kristin Borns, Susan Clark-Johnson, Mark Muro, Jennifer Vey, Brookings Mountain West, Morrison Institute For Public Policy
Brookings Mountain West Publications
Though the Great Recession may be officially over, all is not well in Arizona. Three years after the collapse of a massive real estate “bubble,” the deepest economic downturn in memory exposed and exacerbated one of the nation’s most profound state fiscal crises, with disturbing implications for Arizona citizens and the state’s long-term economic health. This brief takes a careful look at the Grand Canyon State’s fiscal situation, examining both Arizona’s serious cyclical budget shortfall—the one resulting from a temporary collapse of revenue due to the recession—as well as the chronic, longer-term, and massive structural imbalances that have developed largely …

Drug use among Minnesota youth is a leading health risk behavior. This study examined rural adolescents' and parents'/guardians' perceptions of teens' substance use. An electronic survey was administered to high school students (n = 62; adjusted response rate = 84.9%) and sent by email to 79 parents/guardians (n = 22; adjusted response rate = 27.8%). Analyses included descriptive statistics, independent and paired sample t-tests, and chi-square. 56.5% of teens reported using alcohol in the past 12 months whereas 12.9% reported using marijuana. R. V. Conway: Unchartered Territory For Administrative Tribunals, Christopher D. Bredt, Ewa Krajewska
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
In R. v. Conway, the Supreme Court of Canada reformulated and simplified the test for when an administrative tribunal is a court of competent jurisdiction for the purposes of considering constitutional questions and ordering Charter remedies. Previously, there were two different tests for when a tribunal was a court of competent jurisdiction: one for when an administrative tribunal was considering whether a legislative provision was constitutional, and a second when it was considering whether it had jurisdiction to grant a Charter remedy. Conway amalgamated and simplified the tests. In so doing, the Supreme Court made clear that administrative tribunals should …

Federal Rules Update: Rules Amended As Of December 2010, David A. Schlueter
Faculty Articles
Amendments to the Federal Rules of Procedure and Evidence become effective three years from initial drafting by an advisory committee. Proposed amendments are considered by the respective advisory committees, then circulated for public comment, and then forwarded to the Judicial Conference’s Standing Committee on Rules. If approved by the Judicial Conference, they are sent to the Supreme Court for any appropriate changes. If Congress makes no changes after approval by the Supreme Court, the amendments automatically become effective December 1. Two proposed amendments in 2010 did not become effective because they were not submitted to Congress under the procedure outlined …

Let The Sunshine In: The Aba And Prison Oversight, Michael B. Mushlin
Elisabeth Haub School of Law Faculty Publications
2010 may be remembered as the year in which prison oversight finally found a place on the national correction agenda, thanks in significant part to the attention that the American Bar Association has focused on this topic. In this article, we briefly describe the state of American prisons, trace the recent movement toward prison oversight, describe the rationale for oversight and the benefits it provides, and describe the contribution made to this effort by the ABA through the passage of its landmark resolution in 2008, through its Standards on the Treatment of Prisoners calling for prison oversight, and through the …
