The Unified Sealed Theory: Updating Ohio's Record-Sealing Statute For The Twenty-First Century, Michael H. Jagunic Jan 2011

The Unified Sealed Theory: Updating Ohio's Record-Sealing Statute For The Twenty-First Century, Michael H. Jagunic

Cleveland State Law Review

This Note will argue that Ohio's record sealing statute is still a viable means to achieve this balance, but that it must be supplemented by additional laws in order to remain effective. Part II provides a short history of record sealing and expungement in the United States and explains how Ohio's record sealing statute effectively deals with some common criticisms of record sealing. Part III then briefly examines why sealing and expungement statutes are becoming increasingly ineffective due to the proliferation of electronic criminal records and the rise of the data-mining industry. Part IV critiques some of the proposed solutions …

Emergency Management Standards For Ncaa Division I-A Football Stadia, Joshua R. Hoogstra Jan 2011

Emergency Management Standards For Ncaa Division I-A Football Stadia, Joshua R. Hoogstra

Walden Dissertations and Doctoral Studies

In the best of times, emergency managers of athletic event venues struggle with the responsibilities of venue security. The possibility of terrorist threats exacerbates the situation, especially when security threats can involve a critical mass of spectators at an event. Emergency managers at the National Collegiate Athletic Association (NCAA) athletic venues were the focus of this study. The overarching research question examined whether the minimum core competencies and qualifications for NCAA emergency managers were perceived by the same managers as being sufficient and in alignment with the work that is expected of the position. Research questions were designed to study …

Effect Of Clinical Laboratory Practitioner Licensing On Wages, Mary Hotaling Jan 2011

Effect Of Clinical Laboratory Practitioner Licensing On Wages, Mary Hotaling

Walden Dissertations and Doctoral Studies

Professional licensing directly affects about 29% of U.S. workers and is considered a primary means to establish and maintain health care practitioner competence. Clinical laboratory practitioner licensing was largely ignored in the literature with only 2 studies 30 years apart that provided conflicting conclusions regarding wage effects. This research provided the first study of clinical laboratory practitioner licensing effects on wages after controlling for human capital and individual characteristics wage determinants. This nonexperimental correlational study extended the literature on licensing effects on wages, including women's wages and professions not uniformly licensed across 50 states. The theoretical foundation relied on the …

Community Policing By Part-Time Police Leaders, Steven W. Minard Jan 2011

Community Policing By Part-Time Police Leaders, Steven W. Minard

Walden Dissertations and Doctoral Studies

The majority of police departments across the United States are led by part-time police leaders who are expected to provide high quality public safety and policing services. Research results have not been conclusive on best practices for community policing in larger cities, and the community policing model has not been researched for small police organizations staffed by part-time police leaders and police officers. The purpose of this qualitative multiple case study was to explore the community policing experiences of 12 part-time police leaders in a northeastern U.S. state. Ecological theory provided the conceptual framework. The research questions examined the participants' …

The Effectiveness Of Exercise And Nutritional Counseling On Decreasing Body Composition And Increasing Fitness Levels In Firefighters, Michelle R. Mcnear Jan 2011

The Effectiveness Of Exercise And Nutritional Counseling On Decreasing Body Composition And Increasing Fitness Levels In Firefighters, Michelle R. Mcnear

Walden Dissertations and Doctoral Studies

Cardiovascular disease is the leading cause of death in the United States; firefighters are at a greater risk for both the disease and death. Their exposure to stress, toxic fumes and smoke, unhealthy eating habits, excessive weight, and low levels of physical activity are all contributing risk factors to this disease. The purpose of this quantitative study was to determine the effectiveness of a multi-faceted program of exercise and nutritional counseling to decrease body fat composition and increase fitness levels nine months after initial implementation among a sample of 202 firefighters. Social learning theory was the theoretical foundation for the …

Analysis Of Variance In Recidivism Between Special Needs Offenders And Regular Offender Populations In Texas, Park Esewiata Atatah Jan 2011

Analysis Of Variance In Recidivism Between Special Needs Offenders And Regular Offender Populations In Texas, Park Esewiata Atatah

Walden Dissertations and Doctoral Studies

A Specialized or Super Intensive-1 (SI-1) supervision level refers to a contact requirement imposed on special needs offenders (SNOs) under Texas parole supervision. SI-1 supervision requires greater contact with parole officers and treatment providers than supervision levels used on regular offenders (ROs), yet little is known about whether SI-1 supervision offenders violate terms of their parole or commit new crimes at a different rate compared to the regular offender population in the State of Texas. Reconstruction theory and the social construction of reality were used as theoretical underpinnings of this study, which examined whether differences in offenders' supervision levels created …

A Nerche Annual Report: Profiles Of Public Engagement: Findings From The Ernest A. Lynton Award For The Scholarship Of Engagement For Early Career Faculty, John Saltmarsh, Elaine C. Ward, Patti H. Clayton

New England Resource Center for Higher Education Publications

Community-campus engagement has evolved significantly over the past quarter century, shaped by a number of factors. One has been the effort to reclaim the civic mission of American higher education. Frank Newman, while at the Carnegie Foundation for the Advancement of Teaching in the early 1980s, asserted that "the most critical demand is to restore to higher education its original purpose of preparing graduates for a life of involved and committed citizenship,” and concluded that “the advancement of civic learning, therefore, must become higher education's most central goal" (1985, xiv). Another factor has been the increased understanding that colleges and …

Why Misdemeanors Matter: Defining Effective Advocacy In The Lower Criminal Courts, Jenny M. Roberts Jan 2011

Why Misdemeanors Matter: Defining Effective Advocacy In The Lower Criminal Courts, Jenny M. Roberts

Scholarly Articles in Law Reviews & Journals

Most individuals accused in our nation's criminal courts are not charged with murder, rape, drug sales, or even less serious felonies. The vast majority of charges are in the lower courts, for misdemeanors such asmarijuana possession, driving with a license suspension for failure to pay tickets, assault, disorderly conduct, or public intoxication. Misdemeanor adjudications have exploded in recent years, with one recent study estimating that the volume of misdemeanor cases nationwide has risen from five to more than ten million between 1972 and 2006. At the same time, violent crime and the number of felony cases across the country have …

Rule-Based Decision Support System For Sensor Deployment In Drinking Water Networks, Natthaphon Prapinpongsanone Jan 2011

Rule-Based Decision Support System For Sensor Deployment In Drinking Water Networks, Natthaphon Prapinpongsanone

Electronic Theses and Dissertations

Drinking water distribution systems are inherently vulnerable to malicious contaminant events with environmental health concerns such as total trihalomethanes (TTHMs), lead, and chlorine residual. In response to the needs for long-term monitoring, one of the most significant challenges currently facing the water industry is to investigate the sensor placement strategies with modern concepts of and approaches to risk management. This study develops a Rule-based Decision Support System (RBDSS) to generate sensor deployment strategies with no computational burden as we oftentimes encountered via large-scale optimization analyses. Three rules were derived to address the efficacy and efficiency characteristics and they include: 1) …

Investigating Social Capital And Political Action In The Middle East, Amr Abdel-Wahab

Electronic Theses and Dissertations

This study addresses the relationship between social capital and political action in the Middle East. The research uncovers indicators of how social capital correlates with democratic action. Using data from the 2005 World Values Survey, the examination centers on indicators of trust and membership in civic organizations and how they relate to political action in the region. The paper concludes with discussion of how trust-building and reciprocity can be interpreted within the political context of the Middle East, and how the relevance of social capital will be an unavoidable consideration in the transition away from autocracy in the region, especially …

The Campaign For Bias-Free Policing In Vermont: One State’S Resistance To The Localization Of Federal Immigration Agency, Amanda L. Park Jan 2011

The Campaign For Bias-Free Policing In Vermont: One State’S Resistance To The Localization Of Federal Immigration Agency, Amanda L. Park

Capstone Collection

There are roughly 1,500 immigrants from Mexico and Central America currently working on farms in Vermont, helping to sustain approximately half of all milk produced in the state. But the lack of adequate visa-to-work options leaves these individuals without proper documentation to be in the US. As such, they are vulnerable to exploitation by their employers, susceptible to harassment from the communities in which they live, and under constant threat of deportation by federal immigration agents. Now, the US Department of Homeland Security—in charge of domestic defense and immigration—is attempting to use local and state law enforcement officers in the …

Police Mistakes Of Law, Wayne A. Logan Jan 2011

Police Mistakes Of Law, Wayne A. Logan

Emory Law Journal

Blood Sugar Sex Magik: A Review Of Postconviction Dna Testing Statutes And Legislative Recommendations, Justin Brooks, Alexander Simpson Jan 2011

Blood Sugar Sex Magik: A Review Of Postconviction Dna Testing Statutes And Legislative Recommendations, Justin Brooks, Alexander Simpson

Faculty Scholarship

Forty-eight states, the District of Columbia, and the federal government have adopted some form of postconviction DNA testing law. Some significant challenges arise when these laws are applied to cases like Richards, which do not involve rape kits but rather require a broader view of how DNA testing can prove innocence. Furthermore, the laws are not uniform, and in the politically charged atmosphere of criminal lawmaking, some of the laws are poorly thought out. This Article reviews these postconviction statutes from the perspective of practitioners who litigate these cases, while also exploring the major questions that ought to be addressed …

Protecting Immigrant Workers Through Interagency Cooperation, Jayesh Rathod Jan 2011

Protecting Immigrant Workers Through Interagency Cooperation, Jayesh Rathod

Scholarly Articles in Law Reviews & Journals

Stephen Lee’s Monitoring Immigration Enforcement offers a promising prescription for resolving the long-standing tension between the workplace enforcement priorities of the Department of Homeland Security (“DHS”) and the efforts by the Department of Labor (“DOL”) to protect the rights of immigrant workers. Lee convincingly describes - often with the aid of rich historical examples - the origins of the chronic imbalance of power between DHS and the DOL, and the limitations of past efforts to synchronize the work of the respective agencies. Lee’s proposal for interagency coordination, in the form of ex ante monitoring by the DOL of worksite enforcement …

"Constitutional Chicken": National Security Confidentiality And Terrorism Prosecutions After R. V. Ahmad, Kent Roach

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This paper examines the Supreme Court’s decision in R. v. Ahmad to reverse a decision made by the trial judge in the Toronto terrorism prosecution and to uphold the constitutionality of Canada’s unique two-court system to decide public interest immunity questions involving state claims of national security confidentiality. Parliament’s decision to allow only a few specially designated judges of the Federal Court to decide such questions will be related to Canada’s anxieties about being a net importer of intelligence and excessive concerns about secrecy. It will be suggested that the trial judge who ruled that section 38 was unconstitutional had …

Health, Human Rights, And Violence Against Women And Girls: Broadly Redefining Affirmative State Duties After Opuz V. Turkey, Cheryl Hanna Jan 2011

Health, Human Rights, And Violence Against Women And Girls: Broadly Redefining Affirmative State Duties After Opuz V. Turkey, Cheryl Hanna

UC Law SF International Law Review

This Paper was initially presented at the Hastings International & Comparative Law Review symposium Heath as a Human Right: The Global Option. The symposium was held in memory of Professor Virginia Leary, a leader in international law. Professor Hanna takes this theme and applies it to global problem of violence against women and girls and makes two assertions. First, while there has been tremendous progress in our understanding of how male violence against women and girls undermines gender equality and impacts their right to autonomy and full citizenship, the most fundamental and basic consequence of such violence - physical and …
