Federal Regulation Of Greenhouse Gas Emissions A Practical Certainty: How Will The Texas Energy Industry Survive-Maybe Thrive?, Nicholas G. Morrow Jan 2011

Federal Regulation Of Greenhouse Gas Emissions A Practical Certainty: How Will The Texas Energy Industry Survive-Maybe Thrive?, Nicholas G. Morrow

Texas Wesleyan Law Review

This article asks the policy question: How is the Texas Legislature preparing to protect the Texas energy industry from the federal regulation of greenhouse gas emissions? The article begins with an explanation of why federal regulation of greenhouse gas emissions appears to be a practical certainty. In 2007, a 5-4 U.S. Supreme Court majority held the Environmental Protection Agency must regulate greenhouse gas emissions or find some reason rooted in the Clean Air Act why it should not act. This article will explore this decision, as well as the executive order that followed and the American Clean Energy and Security …

Bull’S-Eye: How The 81st Texas Legislature Nearly Got It Right On Campus Carry, And The 82nd Should Still Hit The X-Ring, Riley C. Massey

Texas Wesleyan Law Review

This Comment examines recent legislative proposals for reform of the current limitations on concealed handgun licensees in Texas and their inability to readily defend themselves or others against armed attackers while on the premises of institutions of higher learningboth public and private-in this state.8 It suggests that the modifications to current law, as proposed by 2009's Senate Bill 1164, set clear workable boundaries between balancing campus safety versus reduced intellectual freedom, and the necessary evolution of the law to answer the evils of our times. Part I of this Comment frames the seriousness of the score of mass school shootings …

Tangled Up In Knots: How Continued Federal Jurisdiction Over Sexual Predators On Indian Reservations Hobbles Effective Law Enforcement To The Detriment Of Indian Women, Suzianne D. Painter-Thorne Jan 2011

Tangled Up In Knots: How Continued Federal Jurisdiction Over Sexual Predators On Indian Reservations Hobbles Effective Law Enforcement To The Detriment Of Indian Women, Suzianne D. Painter-Thorne

Articles

Consequently, tribal lands have become safe havens for sexual predators, who can commit their offenses with little fear of prosecution. As Fort Peck Tribal Chairman A.T. “Rusty” Stafne explained, “Our people are afraid because there are persons committing crimes against us at night and in broad daylight....We have criminals that are simply unafraid of prosecution.” Indeed, “[t]o a sexual predator, the failure to prosecute sex crimes against American Indian women is an invitation to prey with impunity.”

Congress has responded to the epidemic of reservation crime with the Tribal Law and Order Act27 (TLOA). But, as this article explains, the …

A Moral Contractual Approach To Labor Law Reform: A Template For Using Ethical Principles To Regulate Behavior Where Law Failed To Do So Effectively, Zev J. Eigen, David S. Sherwyn Jan 2011

A Moral Contractual Approach To Labor Law Reform: A Template For Using Ethical Principles To Regulate Behavior Where Law Failed To Do So Effectively, Zev J. Eigen, David S. Sherwyn

Faculty Working Papers

If laws cease to work as they should or as intended, legislators and scholars propose new laws to replace or amend them. This paper posits an alternative—offering regulated parties the opportunity to contractually bind themselves to behave ethically. The perfect test-case for this proposal is labor law, because (1) labor law has not been amended for decades, (2) proposals to amend it have failed for political reasons, and are focused on union election win rates, and less on the election process itself, (3) it is an area of law already statutorily regulating parties' reciprocal contractual obligations, and (4) moral means …

Safety First? The Role Of Emotion In Safety Product Betrayal Aversion, Jonathan Koehler, Andrew D. Gershoff Jan 2011

Safety First? The Role Of Emotion In Safety Product Betrayal Aversion, Jonathan Koehler, Andrew D. Gershoff

Faculty Working Papers

Consumers often face decisions about whether to purchase products that are intended to protect them from possible harm. However, safety products rarely provide perfect protection and sometimes "betray" consumers by causing the very harm they are intended to prevent. Examples include vaccines that may cause disease and air bags that may explode with such force that they cause death. Expanding research on betrayal aversion, this study examines the role of emotions in consumers' tendency to choose safety options that provide less overall protection in order to eliminate a very small probability of harm due to safety product betrayal. In five …

Public Engagement For Informing Science And Technology Policy: What Do We Know, What Do We Need To Know, And How Will We Get There?, Lisa M. Pytlik Zillig, Alan J. Tomkins Jan 2011

Public Engagement For Informing Science And Technology Policy: What Do We Know, What Do We Need To Know, And How Will We Get There?, Lisa M. Pytlik Zillig, Alan J. Tomkins

Alan Tomkins Publications

This article examines social science relevant to public engagements and identifies the challenges to the goal of meaningful public input into science and technology policy. Specifically, when considering “which forms, features, and conditions of public engagement are optimal for what purposes, and why?” we find social science has not clarified matters. We offer a model to guide systematic research that defines and empirically connects variations in features and types of public engagement activities to specifically defined variations in effective processes and outcomes. The specification of models, as we have done, will guide policy makers, practitioners, and the public in determining …

Sanctuary From De Facto Deportation: The New Sanctuary Movement And De Facto Deportation Claims For Children Challenging Illegal Immigrant Parents' Removal Orders, Kristin Maun Jan 2011

Sanctuary From De Facto Deportation: The New Sanctuary Movement And De Facto Deportation Claims For Children Challenging Illegal Immigrant Parents' Removal Orders, Kristin Maun

Richmond Journal of Law and the Public Interest

This comment will give an overview of past and present sanctuary movements, the legal strategies they have formulated to defend those whom they shelter, and their impact on immigration law and policy. Then it will examine the particular strategy of de facto deportation-the NSM's legal strategy of choice-to understand what is necessary to establish the claim, and whether it could nullify an alien parent's removal order. Next, it will analyze two legal principles underlying de facto deportation claims: the right of a child to be raised by his parents and the right of a citizen child to reside in the …

Pakistan’S Failed Commitment: How Pakistan's Institutionalized Persecution Of The Ahmadiyya Muslim Community Violates The International Covenant On Civil And Political Rights, Qasim Rashid Jan 2011

Pakistan’S Failed Commitment: How Pakistan's Institutionalized Persecution Of The Ahmadiyya Muslim Community Violates The International Covenant On Civil And Political Rights, Qasim Rashid

Richmond Journal of Global Law & Business

The United Nations (“UN”) adopted the International Covenant on Civil and Political Rights (“ICCPR”) in 1966 and officially implemented it in 1976 to ensure, among other guarantees, that no human is denied his or her right to equal voting, freedom of political association, due process of law, freedom of life, freedom of religion, freedom of speech, and freedom of assembly. The Islamic Republic of Pakistan is among 166 nations that have signed and ratified the ICCPR. Since signing the ICCPR in 2008 and ratifying it in 2010, however, Pakistan has perpetuated state-sanctioned and violent persecution of religious minority groups such …
