Mercy, Justice, And Politics: John Paul Ii On Capital Punishment, Kevin E. Miller Apr 2011

Mercy, Justice, And Politics: John Paul Ii On Capital Punishment, Kevin E. Miller

Dissertations (1934 -)

Pope John Paul II's 1995 Evangelium Vitae teaches that capital punishment ought not be used "except ... when it would not be possible otherwise to defend society." Several interpretations of this teaching have been proposed. Through a close reading of the encyclical in itself, in light of John Paul's other writings on the human person and morality, especially the 1980 Dives in Misericordia, and also in the context of such important influences upon him as Thomas Aquinas and Henri de Lubac, I dispute, on the one hand, the interpretation according to which John Paul is pointing toward possible acceptance of …

Imsa360: Spring 2011, Imsa Fund

IMSA Fund Reports

When I speak to parents, students, educators and legislators about the concept of “career readiness,” I emphasize that IMSA is preparing learners for careers that do not yet exist. Through learning experiences based on imagination and inquiry, IMSA students, whether enrolled in our residential program or in our statewide enrichment programs, learn to pursue compelling questions of interest, work collaboratively, conduct investigations and communicate findings. In the words of our Standards of Significant Learning, students learn to “think about thinking,” “extend and integrate thought,” and “construct questions which further understanding, forge connections and deepen meaning.” In short, they learn how …

After The Fire Is Out, Elise Lequire Apr 2011

After The Fire Is Out, Elise Lequire

Joint Fire Science Program Digests

Even before firefighters have left a burn site, a second wave of specialists is deployed. Their task: to assess the burn site; determine the level of risk to life, property, and ecological resources; and determine quickly the most effective postfire treatments for emergency stabilization and initial rehabilitation of the site. For the past 13 years, the Joint Fire Science Program (JFSP) has funded research on this critical phase of work, which often goes unnoticed after the fire is out. With support from the JFSP, scientists have made great strides in improving the tools available to assess postfire risks and evaluate …

Japan's Quasi-Jury And Grand Jury Systems As Deliberative Agents Of Social Change: De-Colonial Strategies And Deliberative Participatory Democracy, Hiroshi Fukurai Apr 2011

Japan's Quasi-Jury And Grand Jury Systems As Deliberative Agents Of Social Change: De-Colonial Strategies And Deliberative Participatory Democracy, Hiroshi Fukurai

Chicago-Kent Law Review

Direct participatory democracy touches Japan anew in its current attempt to reform and reconstruct the criminal justice system through the introduction of two tiered systems of quasi-jury (saiban-in) and grand jury (kensatsu shinsakai) institutions. Not only did the twin systems of lay deliberation help create an effective and investigative mechanism against the corporate predation and governmental abuse of power, they also allowed the prosecution of military crimes committed by U.S. Armed Forces personnel and their families stationed in Japan. My paper then examines the historical evolution of these newly established lay justice institutions, exploring the increasing adoption of lay forms …

The Political Consequences Of Population Consolidation In Nebraska, Diane L. Duffin Apr 2011

The Political Consequences Of Population Consolidation In Nebraska, Diane L. Duffin

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

In recent decades, the migration that has long been characteristic of life in the Great Plains has meant the steady relocation of population from rural to metropolitan counties. While much has been written about the social and economic consequences of this migration, far less is known of its political consequences. In Nebraska, the least-populated counties experience the most severe out-migration, and are the most reliably Republican. To discern a relationship between population migration and political outcomes, this study analyzes the six open-seat races for United States senator that have occurred in Nebraska since 1976. An econometric model that explains Democratic …

A Modeling And Simulation Framework For Electrokinetic Nanoparticle Treatment, James Phillips Apr 2011

A Modeling And Simulation Framework For Electrokinetic Nanoparticle Treatment, James Phillips

Doctoral Dissertations

The focus of this research is to model and provide a simulation framework for the packing of differently sized spheres within a hard boundary. The novel contributions of this dissertation are the cylinders of influence (COI) method and sectoring method implementations. The impetus for this research stems from modeling electrokinetic nanoparticle (EN) treatment, which packs concrete pores with differently sized nanoparticles. We show an improved speed of the simulation compared to previously published results of EN treatment simulation while obtaining similar porosity reduction results. We mainly focused on readily, commercially available particle sizes of 2 nm and 20 nm particles, …

Faculty Senate Newsletter, April 2011, Louisiana State University And Agricultural & Mechanical College

LSU Faculty Senate Publications

Message from President: In my last “welcome” column, I addressed the question of Louisiana universities after the economic crisis, suggesting a variety of adjustments that would increase morale and promote economic justice in institutions that reward fashion and momentary stellar performances more often than they recognize adventurous dissent or long-term projects. Although not inexhaustible, the topic of higher education after our present calamities merits a bit more consideration, especially with regard to structural changes that might advance our institution even in the midst of economic distress. Having commenced its career as the cultural equivalent of a fortification, LSU has always …

Part II examines Chevron27 and the Bureau of Prisons' extraordinary justification exception rule. Part III turns to the threshold matter of obtaining judicial access to challenge the Bureau of Prisons' new rule, with Part III.A arguing that the federal courts should relax their standards when faced with exceptions to the exhaustion requirement and Part III.B arguing for the adoption of a federal public importance exception to the mootness doctrine. The article concludes that these changes will further Congress' dual …

War, Politics, Law - And Love: Italy 1943-1946, Eric Stein Apr 2011

War, Politics, Law - And Love: Italy 1943-1946, Eric Stein

Michigan Journal of International Law

In this piece I tell my story from four perspectives, ranging from the "highest"-institutional-to the "lowest"-personal. From the first perspective I offer a glimpse of the Allied military command structure during the Italian phase of World War II. From the second perspective, I focus in some detail on Allied military bodies established under the international law of occupation of enemy territory: the Allied Control Commission for Italy (ACC)-later the Allied Commission for Italy (AC)-headquarters of the Allied Military Government (AMG) and a point of communication with the King after the Italian surrender. Italy became a "co-belligerent" of the Allies and …

Texas Elective Workers' Compensation: A Model Of Innovation?, Jason Ohana Apr 2011

Texas Elective Workers' Compensation: A Model Of Innovation?, Jason Ohana

William & Mary Business Law Review

Workers' Compensation is often described as a bargain between employers and employees. Employees give up the right to sue their employers in negligence for workplace injuries, and, in return, employers agree to pay predictable, statutorily mandated benefits to injured employees. Over time, this “bargain” became compulsory in every state but one. Texas is the only state in which employers and employees can decide whether or not to enter the workers' compensation bargain. This elective system has some fairly serious problems, and many have advocated its abandonment. This Note analyzes the system's history, compares the system to conventional compulsory systems, analyzes …

Turning The Watchdog Into A Lapdog: Why The Proposed Newspaper Bailout Is The Wrong Solution For A Failing Industry, Andrea Priest Apr 2011

Turning The Watchdog Into A Lapdog: Why The Proposed Newspaper Bailout Is The Wrong Solution For A Failing Industry, Andrea Priest

William & Mary Business Law Review

Current economic conditions have hastened the decline of the American newspaper trade, creating an industry-wide crisis. Following decades of declining advertising revenue and circulation rates, the newspaper industry has plunged into a historic downturn. In search of salvation for the American newspaper, some legislators and scholars have called upon the government to bail out the newspaper industry. This Note will explore the decline of the American newspaper industry, and examine proposals for government intervention to revive America’s newspapers. Although the industry crisis will not abate without action, this Note will conclude that governmental support would ultimately harm newspapers. Instead of …
