Interpretation's Contrapuntal Pathways: Addams And The Averbuch Affair, Marilyn Fischer Oct 2011

Interpretation's Contrapuntal Pathways: Addams And The Averbuch Affair, Marilyn Fischer

Philosophy Faculty Publications

In March 1908 the Chicago Police Chief shot Lazarus Averbuch, a young, Russian Jewish immigrant, claiming self-defense against an anarchist plot. Jane Addams refused to join the public's outcry of support for their chief, declaring that she had the obligation to interpret rather than denounce the incident. Her analysis of Averbuch's killing, given in her essay, ““The Chicago Settlements and Social Unrest,”” provides a focal point for seeing how interpretation functions as a unifying theoretical category for Addams, bringing together her activism, her style of writing, and her philosophy of social change. Addams's conception of interpretation is multi-faceted and dynamic; …

Building A New Bridge Over Troubled Waters: Lessons Learned From Canadian And U.S. Arbitration Of Human Rights And Discrimination Employment Claims, Shelley Mcgill, Ann Marie Tracey Oct 2011

Building A New Bridge Over Troubled Waters: Lessons Learned From Canadian And U.S. Arbitration Of Human Rights And Discrimination Employment Claims, Shelley Mcgill, Ann Marie Tracey

Cardozo Journal of International and Comparative Law

The article critiques the U.S. Supreme Court's decision in 14 Penn Plaza LLC v. Pyett, which upheld the enforceability of collective bargaining agreements that waive individuals' rights to pursue statutory discrimination claims in court, favoring mandatory arbitration. The authors argue that this ruling undermines access to justice and the societal goals of anti-discrimination laws, advocating for legislative reforms to preserve judicial forums. They contrast this with the Canadian system, which allows concurrent jurisdiction between labor arbitrators and human rights tribunals, emphasizing transparency, accountability, and public policy goals. The authors propose that arbitration should not preclude access to judicial or …

Have Truth And Reconciliation Commissions Helped Remediate Human Rights Violations Against Women? A Feminist Analysis Of The Past And Formula For The Future, Margaret (Peggy) Maisel Oct 2011

Have Truth And Reconciliation Commissions Helped Remediate Human Rights Violations Against Women? A Feminist Analysis Of The Past And Formula For The Future, Margaret (Peggy) Maisel

Cardozo Journal of International and Comparative Law

The article argues that Truth and Reconciliation Commissions (TRCs) have largely failed to adequately address human rights violations against women due to their male-centered frameworks, which prioritize public sphere violations over private sphere abuses. While some TRCs, such as those in Sierra Leone and Peru, have made strides in incorporating gender considerations, others, like the South African TRC, have excluded women's experiences, perpetuating gender inequality. The article advocates for a gender-inclusive approach to ensure women's voices and violations are integral to reconciliation processes, emphasizing the need to address both civil-political and economic-social rights.

The Manual Scavenging Problem: A Case For The Supreme Court Of India, Samuel D. Permutt Oct 2011

The Manual Scavenging Problem: A Case For The Supreme Court Of India, Samuel D. Permutt

Cardozo Journal of International and Comparative Law

The note addresses the persistent issue of manual scavenging in India, a practice where predominantly Dalit women and girls clean human waste under deplorable conditions. Despite legal prohibitions, the practice continues due to caste-based discrimination and inadequate sanitation infrastructure. The author argues that the Supreme Court of India, through Public Interest Litigation (PIL), can effectively tackle this issue by implementing a three-step solution to eradicate manual scavenging.

Desmond, Erica Zinsser

Journal of Counselor Preparation and Supervision

This mixed method study examines the perceptions of both elementary and secondary principals in two northeastern states regarding the American School Counselor Association (ASCA) National Model, state-specific models of School Counseling and the role of the school counselor. One state surveyed has mandatory administrative training of the ASCA National Model and a state-specific model of school counseling while the other does not have such state mandates or an implemented model of school counseling. A fifteen-question survey was sent to four hundred ninety-eight school administrators. Results indicate little difference in knowledge of the ASCA National Model between principals in both states. …

The author provides practical suggestions for teaching APA to counselors-in-training and offers a teaching resource for use in the classroom. Suggestions include: addressing why APA style is used in the profession, joining with colleagues to emphasize the importance of writing style, modeling strong style, requiring the use of APA, providing feedback specific to style, using style focused peer review, and providing examples of strong APA style.

Aging Gracefully: Emerging Issues For Public Policy And Consumer Welfare, Vanessa G. Perry, Joyce M. Wolburg Oct 2011

Aging Gracefully: Emerging Issues For Public Policy And Consumer Welfare, Vanessa G. Perry, Joyce M. Wolburg

College of Communication Faculty Research and Publications

To be an aging consumer in a youth culture means facing several challenges, including maintaining self-esteem in the face of negative media portrayals, redefining the meaning of being sexually active, coping with vulnerability, planning for retirement and investing for the final years. Despite tremendous differences and contradictions among aging consumers, many policymakers take a narrow, single-minded approach to issues of consumer welfare and public policy, which fails to address the wide variation among members of this group.

An Investigation Of Brain Games As A Potential Non-Pharmaceutical Alternative For The Treatment Of Adhd, Stacy C. Wegrzyn

Dissertations, Theses and Capstone Projects (Full IR Collection)

This study sought to determine if the daily use of brain games such as Nintendo DS Brain Age could increase the engagement of students with ADHD. The findings bridge the gap between prior research on the frontal lobe’s connection to ADHD and the studies that have indicated brain games can stimulate this area of the brain. Based on the compilation of data, there is hope for ADHD patients searching for an alternative to medication. Data from seven of the nine instruments utilized in this study support the overarching hypothesis that the daily use of brain games can help decrease the …

Teaching For Global Learning Through Telecollaboration: A Case Study Of K-12 Educators' Conceptualizations And Practices About Global Education, Holly Gooding Oran Oct 2011

Teaching For Global Learning Through Telecollaboration: A Case Study Of K-12 Educators' Conceptualizations And Practices About Global Education, Holly Gooding Oran

Dissertations, Theses and Capstone Projects (Full IR Collection)

A plethora of literature discusses the flattening of the world we live in (Friedman, 2007) and the need for teachers to educate K-12 students for global learning. However, the literature is critically lacking in empirical evidence in how this is to take place in classrooms. In addition, existing empirical studies have focused primarily on American social studies educators at the secondary school level. Scholars differ in their own understanding of what global education means and should look like in schools, how teachers are to incorporate it into their curriculum, and how it benefits K-12 learners. The purpose of the present …

A Qualitative Study Of The Use Of Content-Related Comics To Promote Student Participation In Mathematical Discourse In A Math I Support Class, Jeni M. Halimun

Dissertations, Theses and Capstone Projects (Full IR Collection)

The purpose of this study is to contribute to existing research on classroom discourse by investigating whether a content-related comic that is closely linked to the learning task can stimulate mathematical discourse in a real high school classroom. To build a math-talk learning community and to analyze the effectiveness of content-related comics in eliciting student participation, I employed the combined theoretical frameworks consisting of a Hufferd-Ackles’ et al. (2004) math-talk learning community and Nathan and Knuth’s (2003) social and analytical scaffolding. The combined frameworks provided a multilevel analytical tool for studying classroom interactions. The results suggested that the content-related comic …

Dissertations, Theses and Capstone Projects (Full IR Collection)

To comply with federal accountability requirements, English learners (ELs) in Georgia must demonstrate progress in academic English language proficiency (ELP) and academic content-area achievement as measured annually by two state-mandated Title I and Title III assessments, the Accessing Communication and Comprehension in English State-to-State for English Language Learners® (ACCESS for ELLs®) and the Criterion-Referenced Competency Test (CRCT). Using a critical ELP assessment validation framework, the intent of this study was to investigate the relationship of students’ performances on Title assessments, analyze student level variability in the predictive power of the ELP assessment for academic achievement, and examine claims made when …

Mentoring Within The Minority Population: How To Retain And Matriculate Minorities In A College Setting, Brent Matthias Obleton Oct 2011

Mentoring Within The Minority Population: How To Retain And Matriculate Minorities In A College Setting, Brent Matthias Obleton

Dissertations, Theses and Capstone Projects (Full IR Collection)

In an ever-changing educational environment, it is pertinent that higher education institutions proactively implement strategies and programs that foster growth for the modern day college students. The establishment of effective support mechanisms is an essential component to aid in the development of students. Minority students, in particular, have shown a growing need to receive additional guidance outside of the traditional adherents (i.e., parents, personal ambition, educational advisors, etc). Historically, mentorship has been more prevalent in the private sector, used as a means to groom subordinates to take on new roles within their respective companies. However, assessment and the positive impact …

Talking To Yourself: Garfield Minus Garfield As An Introduction To Techno-Companionship, Andy Engel Oct 2011

Talking To Yourself: Garfield Minus Garfield As An Introduction To Techno-Companionship, Andy Engel

Reconstruction: Studies in Contemporary Culture

[First paragraph]

A year ago while surfing the Internet, I came across a website called Garfield Minus Garfield (GMG), operated by artist/businessman Dan Walsh. Walsh received notoriety for his adaptations of the popular Garfield comic strip in which he removed its title character [1]. This act results in Garfield’s human counterpart, Jon Arbuckle, alone and talking to himself in the now empty space of the strip. A radical transformation occurs because of Garfield’s deletion that serves to emphasize the crucial role Jon and Garfield’s relationship plays in our perception of the world within the strip. Walsh begins the site with …

'I Believe Whatever Doesn't Kill You Simply Makes You...Stranger': Discourses Of Terrorism And Counter-Terrorism In The Dark Knight, Barbara Wopperer Oct 2011

'I Believe Whatever Doesn't Kill You Simply Makes You...Stranger': Discourses Of Terrorism And Counter-Terrorism In The Dark Knight, Barbara Wopperer

Reconstruction: Studies in Contemporary Culture

Christopher Nolan's Batman film The Dark Knight was viewed by a wide range of commentators as a depiction of contemporary terrorism, pivoting on iconic villain The Joker. Perhaps surprisingly, a mainstream superhero movie has made an accidental (?) intervention in the ongoing discussion of counterterrorism and its ethical restraints. A close reading of various scenes in the movie reveals an upfront debate over means and ends, civil society and the state. Moreover, the moral discourse in The Dark Knight suggests a response to timeless ethical considerations rather than the more historically specific reference points of its recent admirers.
