Clear But Unconvincing: The Federal Circuit’S Invalidity Standard, David O. Taylor
Clear But Unconvincing: The Federal Circuit’S Invalidity Standard, David O. Taylor
Faculty Journal Articles and Book Chapters
The Federal Circuit’s standard for proving invalidity of patent claims is clear. The Federal Circuit always requires clear and convincing evidence to prove that a patent claim is invalid. The rationale behind this standard, however, is unconvincing. There are significant reasons to believe that the Patent Office rarely considers the most relevant prior art and that, instead, alleged infringers often find prior art that is more relevant than the prior art considered by the Patent Office. It defies logic to apply the clear and convincing burden where the Patent Office considered only prior art that is less relevant than the …

Restoration and Ambiguity: The Male in Post-Wall German Film
As the programmatic, if diverse tenets of the Neuer Deutscher Film began to lose their hold on German film-making in the eighties, filmic narratives and cinematography emerged which on the one hand draw on this tradition, especially in seemingly postmodern narratives of subversion, minority and subjectivity, but on the other combine these with conventional, even restorative film language and narrative construction. Reunification has set a development in motion which to a remarkable extent echoes the cultural metanarrative of the post-war period. The role and representation of male characters in a significant …

Vegetables belonging to the Brassicaceae family are rich in polyphenols, flavonoids and glucosinolates, and their hydrolysis products, which may have antibacterial, antioxidant and anticancer properties. In the present study, phenolic composition, antibacterial activity and antioxidant capacity of selected Brassica vegetables, including York cabbage, Brussels sprouts, broccoli and white cabbage were evaluated after extraction with aqueous methanol. Results obtained showed that York cabbage extract had the highest total phenolic content, which was 33.5, followed by 23.6, 20.4 and 18.4 mg GAE/g of dried weight (dw) of the extracts for broccoli, Brussels sprouts and white cabbage, respectively. All the vegetable extracts had …

Effect Of Processing Conditions On Phytochemical Constituents Of Edible Irish Seaweed Himanthalia Elongata., Sabrina Cox, Nissreen Abu-Ghannam, Shilpi Gupta
Articles
Seaweed iswell recognized as an excellent source of phytochemicals. This study was a preliminary screening to investigate the effects of various food processing methods on the phytochemicals of Himanthalia elongata. Hydrothermal processing was carried out until an edible texture was achieved. The total phenolic content (TPC) of fresh H. elongata was 175.27 mg gallic acid equivalent (GAE)/100 g fresh weight (FW) while boiling significantly reduced the TPC to 25.4 mg GAE/100 g FW
(P < 0.05).A drying pretreatment before boiling reduced the cooking time therefore leading to less leaching of antioxidants upon boiling. In terms of extract, drying of H. elongata followed by boiling had the most significant effect on the phytochemicals as TPC increased by 174%. Boiled extracts had the most effective 2, 2-diphenyl- 1-picrylhydrazyl scavenging activity (EC50 of 12.5 mg/mL). As a comparison, seaweed subjected to the same treatments was studied in terms of antimicrobial activity.Overall, extracts fromfresh H. elongata achieved the highest inhibition.

While the research confirms anecdotal reports of litigation abuse in consumer collection cases, it …
African-American Grandmothers: Does The Gender-Entrapment Theory Apply? Essay Response To Professor Beth Richie, Jessica Dixon Weaver
African-American Grandmothers: Does The Gender-Entrapment Theory Apply? Essay Response To Professor Beth Richie, Jessica Dixon Weaver
Faculty Journal Articles and Book Chapters
Many African-American grandmothers are entrapped by the cycle of incarceration in poor black communities. This Essay explores whether the social and economic conditions that compel battered women to commit crimes also impact their mothers - who end up raising the children they leave behind. Professor Beth Richie's theory of gender entrapment as described in her book, “Compelled to Crime,” is not limited to incarcerated women who have been victims of domestic violence. African-American grandmothers who take on the role of kinship caregivers for their grandchildren are also entrapped by a complex interplay of race, gender, and class, making them vulnerable …

The Role Of Protease-Activated Receptor-1 In Synaptic Plasticity And Memory, Antoine Gabriel Almonte
All ETDs from UAB
Protease-activated receptor-1 (PAR1) is an unusual G-protein coupled receptor (GPCR) that is activated through proteolytic cleavage by extracellular serine proteases. While previous work has shown that inhibiting PAR1 activation is neuroprotective in models of ischemia, traumatic injury, and neurotoxicity, surprisingly little is known about PAR1's contribution to normal brain function. In the central nervous system (CNS), PAR1 is expressed in glial cells in the hippocampus, a brain region critical for memory formation. I am particularly interested in PAR1 because its activation enhances the function of N-methyl-D-aspartate receptors (NMDARs), which are required for some forms of behavioral learning and synaptic plasticity. …

Biometic Self-Assembled Nanomatrix For Bone Tissue Regeneration, Joel Matthew Anderson
All ETDs from UAB
Formation of the native bone extracellular matrix (ECM) provides an attractive template for bone tissue engineering. At the cellular level, structural support and biological complexity of bone ECM are provided within a composite microenvironment that consists of an organic fibrous network reinforced by inorganic hydroxyapatite (HA) nanostructured crystals. To synthetically recreate this biphasic assembly, a bone ECM analogous scaffold comprised of self-assembling peptide amphiphile (PA) nanofibers and interspersed HA nanoparticles was investigated. The PAs have been endowed with biomolecular ligand signaling using synthetically inscribed peptide sequences (i.e. RGDS, DGEA) derived from the native bone ECM and integrated with HA nanoparticles …

The Case Of Colonel Abel, Jeffrey D. Kahn
Faculty Journal Articles and Book Chapters
In June 2010, journalists for the Associated Press reported the arrest of ten Russian spies, all suspected of being “deep-cover” illegal agents in the United States. Seeking to convey the magnitude of this event, the journalists wrote in the first paragraphs of their article that this “blockbuster series of arrests” might even be as significant as the FBI’s “famous capture of Soviet Col. Rudolf Abel in 1957 in New York.” Colonel Abel’s story of American justice at a time of acute anxiety about the nation’s security is one that continues to resonate today. The honor, and error, that is contained …

The Trillion Dollar Problem Of Underwater Homeowners: Avoiding A New Surge Of Foreclosures By Encouraging Principal-Reducing Loan Modifications, Gregory S. Crespi
Faculty Journal Articles and Book Chapters
There are currently well over ten million underwater homeowners whose mortgage obligations exceed the current value of their houses, with an aggregate negative equity position of at least $800 billion and possibly over $1 trillion. The overwhelming majority of these persons continue to make their mortgage payments even though for many their interests would be better served by defaulting. This is therefore an unstable situation that could suddenly erupt with a rapid cascade of millions of strategic defaults, potentially triggering severe macroeconomic dislocations. It is urgent that this situation be defused through the modification of the mortgages of a large …

Overwhelming research indicates that recent national trends in U.S. food systems have led to the increased prevalence of processed foods and associated diet-related diseases. The effects of unhealthy diets have been distributed unevenly across the country’s socioeconomic and ethnic groups. Certain socioeconomic and ethnic groups face greater geographic, financial and cultural barriers to healthy food access. In Adams County, Pennsylvania, Latinos comprise 5.6% of the population, making them the county’s largest minority group, yet little is known about the food access barriers they face. In this study, we used a combination of surveys and focus groups with Latino residents and …

Bone Morphogenetic Protein Signaling Pathways During Mouse Heart Development: Roles For Chd7 And Mycn, Cristina Harmelink
Bone Morphogenetic Protein Signaling Pathways During Mouse Heart Development: Roles For Chd7 And Mycn, Cristina Harmelink
All ETDs from UAB
Bone Morphogenetic Protein (BMP) signaling pathways are imperative for proper heart development. BMP ligands bind serine threonine kinase receptors, which activate intracellular receptor-regulated SMAD proteins. SMAD1, SMAD5, and SMAD8 transduce BMP signals from the cytoplasm to the nucleus, where they regulate transcription. We have investigated two aspects of BMP signaling during mouse cardiogenesis: identifying SMAD1-interacting proteins and exploring the roles of a known BMP target, Mycn, in the developing myocardium. Chromodomain helicase DNA binding protein 7 (CHD7) is a highly conserved transcription factor that promotes protein synthesis, proliferation, and differentiation. Haploinsufficiency for CHD7 causes CHARGE syndrome, a developmental disorder characterized …

Health Status And Health Behavior As Factors Predicting Online Health Seeking, Timothy Hale
Health Status And Health Behavior As Factors Predicting Online Health Seeking, Timothy Hale
All ETDs from UAB
The purpose of this dissertation is to examine why people use the Internet for health-related purposes and whether this usage is part of larger pattern of health-promoting behaviors, or health lifestyle. Pierre Bourdieu's concept of habitus provides the key theoretical concept that links health lifestyle theory and the digital inequality framework to explain how socioeconomic status and level of Internet access may contribute to status-specific attitudes and behaviors, or lifestyles. Two dependent variables are used to measure online health behavior: (1) online health information seeking, and (2) an index constructed from six types of online health-related activities. Path analysis is …

Disease affects different areas of the bone and can impact individuals of all pathologies and ethnicities. These bone diseases can result in weakening which leads to trauma during ordinary function, the need for reconstructive surgery, and eventual bone replacement. Tissue engineering can provide a less traumatic and more fundamental solution to the current therapies. Bioactive glasses are promising materials in tissue engineering applications because of their ability to form hydroxycarbonate apatite in the presence of simulated body fluid, support cell adhesion, growth, and differentiation, induce bone formation, and concentrate bone morphogenic proteins in vivo. The research in this dissertation will …

Efficacy Of Sterisil In The Treatment Of Dental Unit Waterlines, Don Schmidtke
All ETDs from UAB
Introduction: Dental unit waterlines (DUWL) are an ideal home for bacterial microorganisms to grow, multiply, and develop complex living colonies commonly known as "biofilm." The American Dental Association (ADA) and the Centers for Disease Control and Prevention (CDC) have recommendations to maintain DUWL heterotrophic plate count bacteria levels below 500 colony forming units per milliliter (CFU/ml) of water. The aim of this study is to determine whether Sterisil PureTube is able to control the bacterial load in the orthodontic clinic to recommended levels. Methods: Waterline samples from the twelve dental chairs in the orthodontic clinic were used in this study. …

Multidimensional Epidemiological Transformations: Addressing Location-Privacy In Public Health Practice, Philip Abdelmalik
Other Faculty of Health Theses
The ability to control one’s own personally identifiable information is a worthwhile human right that is becoming increasingly vulnerable. However just as significant, if not more so, is the right to health. With increasing globalisation and threats of natural disasters and acts of terrorism, this right is also becoming increasingly vulnerable. Public health practice – which is charged with the protection, promotion and mitigation of the health of society and its individuals – has been at odds with the right to privacy. This is particularly significant when location privacy is under consideration. Spatial information is an important aspect of public …

Characterizing Us Operations In Pakistan: Is The United States Engaged In An Armed Conflict?, Laurie R. Blank, Benjamin R. Farley
Fordham International Law Journal
On January 14, 2010, four Hellfire missiles fired from an unmanned aerial vehicle (“drone”) slammed into a compound in Pakistan’s South Waziristan region, killing ten people. Hakimullah Mehsud, leader of Tehrik-e-Taliban Pakistan (“TTP”), was the reported target of the strike. Already the eighth US drone attack in Pakistan in 2010, these strikes followed two consecutive years of dramatically increased drone activity within Pakistan. Despite a high degree of media and scholarly interest in the United States’ use of drones in Pakistan, little attention has focused on whether the United States is engaged in an armed conflict in Pakistan, as defined …

This Report presents the findings of this research effort. A comprehensive consideration of the many aspects of land ownership in Nepal, including the related issues of agricultural development, the impact of nonstate actors in newly-formed special economic zones, and the claims of landlords returning to land seized during the Maoist conflict is beyond the scope of this project. The Report and study focused on documenting the impact that inadequate access to land has on the human rights of landless people, including rights to housing, food, water, work, and access to justice. The Report consists of four parts. Part I provides …

Can Europe Be Democratic? Is It Feasible? It Is Necessary? Is The Present Situation Sustainable?, Yves Meny
Fordham International Law Journal
Democracy and democratization at the European level have long been a non-problem. The issues related to democracy after the Second World War were purely national (would Italy and Germany finally be able to build up and consolidate their new democratic systems?) or international (would the Western-type democracies be able to resist and counterweight the Soviet-style Eastern European regimes?). When the first foundations of what would become the European Union ("EU") were laid down, very few had a democratic vision in mind. The then-dominant concerns were both economic (how to facilitate the reconstruction of Europe while avoiding again the economic and …
