"Do Androids Dream?": Personhood And Intelligent Artifacts, F. Patrick Hubbard Jan 2011

"Do Androids Dream?": Personhood And Intelligent Artifacts, F. Patrick Hubbard

Faculty Publications

This Article proposes a test to be used in answering an important question that has never received detailed jurisprudential analysis: What happens if a human artifact like a large computer system requests that it be treated as a person rather than as property? The Article argues that this entity should be granted a legal right to personhood if it has the following capacities: (1) an ability to interact with its environment and to engage in complex thought and communication; (2) a sense of being a self with a concern for achieving its plan for its life; and (3) the ability …

Law On The Books Vs. Law In Action: Under-Enforcement Of Morocco’S Reformed 2004 Family Law, The Moudawana, Ann M. Eisenberg Jan 2011

Law On The Books Vs. Law In Action: Under-Enforcement Of Morocco’S Reformed 2004 Family Law, The Moudawana, Ann M. Eisenberg

Faculty Publications

Morocco shares cultural, religious, and linguistic roots with more conservative countries in the region, yet the Moroccan government has interpreted similar traditions to yield the starkly different stance that gender equality is desirable. Morocco’s Moudawana, the 2004 legislation on family law with provisions largely derived from Islamic sources, confers unprecedented rights on Moroccan women. Part I of this Note evaluates the Moudawana in light of its break with traditional Shari’a, alongside its fidelity to other Islamic law principles in giving Moroccan women unprecedented rights. While the new Moudawana has provisions addressing inheritance, children’s rights, and assets within a marriage, this …

Preparing Medical Students To Undertake A Cultural Immersion Experience: Introducing Frameworks For Preparatory And Post-Immersion Activities, Donna B. Mak, Rashmi Watson, John Hadden

International Journal for the Scholarship of Teaching & Learning

Recruiting and retaining practitioners to rural and remote locations is a challenge for many industries including health and education. The medical, nursing and teaching professions have utilized immersion experiences for trainees and students to better prepare them and to address workforce shortages in cross-cultural and underserved areas. This paper describes the steps taken to improve an immersion experience for medical students and evaluates the impact of these improvements.

The University of Notre Dame’s School of Medicine requires all second year medical students to undertake the Kimberley Remote Area Health Placement Program (hereinafter the ‘Program’). The Program provides opportunities to learn …

Non-Being And Memory: A Critique Of Pure Difference In Derrida And Deleuze, Frank Scalambrino Jan 2011

Non-Being And Memory: A Critique Of Pure Difference In Derrida And Deleuze, Frank Scalambrino

Electronic Theses and Dissertations

The psychology philosophy split has restricted viable readings of today's psychological research. My project (within the philosophy of psychology) is to provide these readings. Specifically, in this dissertation I analyze the data and the interpretations of a large number of contemporary memory research articles. I use these articles to support my claim that Immanuel Kant misunderstood what in the Critique of Pure Reason he labeled "affinity." Further, Jacques Derrida and Gilles Deleuze inherit this Kantian misunderstanding by way of G.W.F. Hegel's attempt to eliminate it. Put another way, the component in question is that which grounds the post-structuralist justification for …

Immigration, Crime, And Public Perception: Victimization Legislation In The United States And Canada - Can The U Visa Serve As A Model?, Bettina Rodriguez Schlegel

UC Law SF International Law Review

This Note compares the forces behind the creation and the implementation of crime victim visa legislation in the United States and Canada. Both are recognized globally as important immigrant-receiving nations with long histories of reliance on immigrant populations for economic growth and expansion. Both states have crafted immigration policies in line with their economic needs and societal perceptions of immigrants in relation to the dominant culture mores. This Note analyzes the two nation's historical trends in relation to immigration as a stepping stone towards understanding the current realities of immigrant life in North America and delves in to the impacts …

Spanish In Contact With Arabic, Lotfi Sayahi Jan 2011

Spanish In Contact With Arabic, Lotfi Sayahi

Languages, Literatures and Cultures Faculty Scholarship

Spanish and Arabic have been in contact for long periods and in different regions. While this is largely due to the geographical proximity of the Iberian Peninsula to western North Africa, a set of historical, political and social developments helped bring both languages into close contact. Of remarkable significance was the presence of Arabic in Iberia from 711 to 1492 and, at least, for several more decades after the Reconquista was completed. This fact, as is often mentioned, led to heavy lexical borrowing from Arabic into Spanish and other Ibero-Romance languages. Also important was the introduction of Spanish into North …

Counterfeits, Copying And Class, Ann Bartow Jan 2011

Counterfeits, Copying And Class, Ann Bartow

Elisabeth Haub School of Law Faculty Publications

Consumers who want to express themselves by wearing contemporary clothing styles should not have to choose between expensive brands and counterfeit products. There should be a clear distinction in trademark law between illegal, counterfeit goods and perfectly legal (at least with respect to trademark law) "knockoffs," in which aesthetically functional design attributes have been copied but trademarks have not. Toward that end, as a normative matter, the aesthetic features of products should not be registrable or protectable as trademarks or trade dress, regardless of whether they have secondary meaning, just as functional attributes of a utilitarian nature are not eligible …

The Failure Of Consent: Re-Conceptualizing Rape As Sexual Abuse Of Power, Michal Buchhandler-Raphael Jan 2011

The Failure Of Consent: Re-Conceptualizing Rape As Sexual Abuse Of Power, Michal Buchhandler-Raphael

Michigan Journal of Gender & Law

This Article argues that while rape law reform has accomplished significant changes in the past decades, the reform has since stalled. The contemporary focus on the element of consent might account for this stagnation. This move has both failed to effect instrumental change in the courts as well as in social norms, and is conceptually flawed and normatively misguided. The practical result of these deficiencies is that rape, as defined by our criminal justice system, bears little resemblance to the various forms of sexual abuses that are inflicted on victims. While rape law typically criminalizes only the physically violent sexual …

Post Processing Wrapper Generated Tables For Labeling Anonymous Datasets, Emdad Ahmed Jan 2011

Post Processing Wrapper Generated Tables For Labeling Anonymous Datasets, Emdad Ahmed

Wayne State University Dissertations

A large number of wrappers generate tables without column names for human consumption because the meaning of the columns are apparent from the context and easy for humans to understand, but in emerging applications, labels are needed for autonomous assignment and schema mapping where machine tries to understand the tables. Autonomous label assignment is critical in volume data processing where ad hoc mediation, extraction and querying is involved.

We propose an algorithm Lads for Labeling Anonymous Datasets, which can holistically label/annotate tabular Web document. The algorithm has been tested on anonymous datasets from a number of sites, yielding very promising …

Mainstream Teacher Attitudes Toward English Language Learners, Cristina Gonzalez Dekutoski Jan 2011

Mainstream Teacher Attitudes Toward English Language Learners, Cristina Gonzalez Dekutoski

Wayne State University Dissertations

The purpose of this study was to collect and analyze data from practicing mainstream K-12 teachers currently enrolled in graduate courses at a large, urban, Midwest university regarding four categories of their attitudes toward English language learners: (a) inclusion of ELLs, (b) the second language acquisition process/language and language learning, (c) modification of coursework, and (d) ESL professional development. Though studies on teacher attitudes toward ELLs remain sparse, research on this topic is important for two reasons. First, as the rigor of grade level curriculum increases ( i.e. high school graduation requirements, state MEAP testing, NCLB) understanding complexities of ELLs …

Between Liberalism And Theocracy, John D. Inazu Jan 2011

Between Liberalism And Theocracy, John D. Inazu

Campbell Law Review

Our symposium conveners have focused us on "the relationship between liberalism and Christianity and their influence on American constitutionalism."' My objective is to complicate the relationship and reorient the influence. The focus of my inquiry is the liberty of conscience and its implications for navigating the relationship between church and state.' By approaching these issues through the lens of political theology (as distinct from either political or constitutional theory), I hope to show that some of the most significant embodiments of conscience in the American colonies can neither be squared with an individualistic liberalism (as some on the left are …

Preschool Teachers' Beliefs And Practices: Emergent Literacy In Inclusive Preschools, Leigh Rohde Jan 2011

Preschool Teachers' Beliefs And Practices: Emergent Literacy In Inclusive Preschools, Leigh Rohde

Doctoral Dissertations

This study examines preschool teachers' beliefs and practices related to emergent literacy learning for both children who are typically developing as well as those with identified disabilities. The sixty-eight teachers who worked in preschool programs that enrolled children with and without disabilities were asked to indicate levels of agreement with belief statements about emergent literacy, children with disabilities, and instruction. They were also asked to indicate what specific emergent literacy learning strategies and activities (if any) they used in their classrooms.

A new model of emergent literacy skills and understandings is used as a framework, indicating specific components of emergent …

"The Alien Within": Residual Catholicism And The Emerging National Identity Of Post-Reformation England, Melissa K. Siik (Femino) Jan 2011

"The Alien Within": Residual Catholicism And The Emerging National Identity Of Post-Reformation England, Melissa K. Siik (Femino)

Doctoral Dissertations

This dissertation contributes to the current critical discourse in Early Modern English Studies on the conceptions and literary representations of national and racial identity in 16th- and 17th-century England. Central to this discourse is an examination of how the English defined themselves in relation to those they deemed as "others": the foreign and marginalized members of society. My study is unique because I look at individual figures of "otherness"---the Irishman, the Turk, and the Jew---in light of their common characteristic: their shared significance as coded figures of Catholicism. Ultimately, my dissertation unifies disparate conversations about race, religion, and politics in …

An Analysis Of Appreciative Inquiry As Organizational Development For An Alternative School, Michael Young Jan 2011

An Analysis Of Appreciative Inquiry As Organizational Development For An Alternative School, Michael Young

Doctoral Dissertations

Schools and youth development programs are continually under pressure to reform and improve. Recent scholarship in the organizational development field suggests that a post modern approach to such efforts may yield new and generative results. Appreciative Inquiry (AI) is an Action Research methodology used for organizational development that is based on a number of post modern assumptions. Because AI has seen a rapid increase in use, including implementations in educational settings, and because of its potential to offer new insights into organizational development, a further understanding of how it works is warranted.

This interpretive case study, grounded in a social …

Raping The Raced Body: Trauma In Asian North American Women's Literature, Amy Lillian Manning Jan 2011

Raping The Raced Body: Trauma In Asian North American Women's Literature, Amy Lillian Manning

Doctoral Dissertations

This dissertation examines the representation of racial and sexual traumas in short fiction and novels by Asian American women writing post-WWII to the present. The central focus of this project is on Asian American literary representations of the lingering effects of physical, racial, and sexual traumas to Asian American women, specifically the nuances of narrating traumatic experiences. Each chapter explores various literary representations of post-traumatic psychological states of unrest, instability, and incoherence. Most importantly, this study examines the frequently simultaneous narrations of sexual trauma and racial awareness, of how personal narratives of trauma against the physical body become entangled with …

Competing Visions: Women Writers And Male Illustrators In The Golden Age Of Illustration, Jason Richard Williams Jan 2011

Competing Visions: Women Writers And Male Illustrators In The Golden Age Of Illustration, Jason Richard Williams

Doctoral Dissertations

In "Competing Visions," I examine the works of women writers and male illustrators during what has been termed the "Golden Age of Illustration" (1880--1920). Due to advances in printing technology and the proliferation of mass-market magazines just before the turn-of-the-last century, novels and short stories were often published with images by illustrators like Howard Pyle and N. C. Wyeth, who subsequently gained enormous popularity and developed wide followings. At the same time, women writers enjoyed an unprecedented period of widespread exposure and political influence. Looking closely at the intersection of images and texts from early twentieth century periodical publications reveals …
