How Salazar V. Buono Synthesizes The Supreme Court's Establishment Clause Precedent Into A Single Test, Adam Linkner Jan 2011

How Salazar V. Buono Synthesizes The Supreme Court's Establishment Clause Precedent Into A Single Test, Adam Linkner

Emory International Law Review

Atop Sunrise Rock, a large Latin cross casts a shadow over the Mojave National Preserve in Southern California. This cross seems oddly out of place. It is located in a national preserve that encompasses 1.6 million acres. There is no sign explaining why it is there. The cross sits alone in the middle of this vast public land. Does its presence on public land constitute a violation of the First Amendment Establishment Clause? Would the answer change if the tiny parcel of land under the cross were transferred to a private party? If so, would the reasons why the government …

The “Definitiveness” Of Genocide And A Question Of Genocide: A Review Essay, Bedross Der Matossian Jan 2011

The “Definitiveness” Of Genocide And A Question Of Genocide: A Review Essay, Bedross Der Matossian

Department of History: Faculty Publications

Over the course of the past two decades, the historiography of the Armenian Genocide has evolved through the introduction of new methodologies, approaches, and more complex analyses of the Genocide that venture beyond rudimentary and essentialist arguments and representations. Concomitantly, denialist literature has also developed, reinvigorated in the U.S. by the presentation of alternative ways of viewing the event in order to counter “Armenian allegations.” The latest such endeavor, disguised under the cloak of “scholarship,” has been the introduction of the concept of “crimes against humanity” as an alternative designation to genocide or as a new “compromise” when dealing with …

George MacDonald received welcome publicity on BBC Television’s popular Sunday afternoon religious programme Songs of Praise on 16th January this year when I was interviewed about his life and work in a programme broadcast from Arundel in West Sussex. Songs of Praise, which celebrated its 50th anniversary this year, is centred around hymns chosen by local people and sung in a cathedral or large church, but also includes interviews with local people and others about matters of interest.

The Better Angels Of Our Fanfiction: The Need For True And Logical Precedent, Stacey M. Lantagne Jan 2011

The Better Angels Of Our Fanfiction: The Need For True And Logical Precedent, Stacey M. Lantagne

UC Law SF Communications and Entertainment Journal

Music sampling has become a well-respected form of art. So why isn't the same true of fanfiction, which follows similar parameters? Without the benefit of a true and well-reasoned legal precedent, fanfiction has existed in a gray area dominated by highly emotional arrguments. However, most of the emotional arguments offered against fanfiction actually support a finding that fanfiction is fair use. Authors would be better served by stripping the emotion from the discussion.

Punctuated Anytime Learning And The Xpilot-Ai Combat Environment, Phillip Fritzsche Jan 2011

Punctuated Anytime Learning And The Xpilot-Ai Combat Environment, Phillip Fritzsche

Computer Science Honors Papers

In this paper, research is presented on an application of Punctuated Anytime Learning with Fitness Biasing, a type of computational intelligence and evolutionary learning, for real-time learning of autonomous agents controllers in the space combat game Xpilot. Punctuated Anytime Learning was originally developed as a means of effective learning in the field of evolutionary robotics. An analysis was performed on the game environment to determine optimal environmental settings for use during learning, and Fitness Biasing is employed using this information to learn intelligent behavior for a video game agent controller in real-time. Xpilot-AI, an Xpilot add-on designed for testing learning …

But I'M Not Twenty-One Yet: How Section 3b1.4 Of The United States Sentencing Guidelines Ignored Congress's Intent To Enhance Sentences Only For Adults At Least Twenty-One-Years Of Age Who Corrupt Minors By Using Them To Commit Federal Offenses — And What Federal District Courts Can Do About It, Tory L. Lucas Jan 2011

Lucas

Faculty Publications and Presentations

If five similar-yet-unrelated criminals use minors to commit similar federal crimes at the same time in different states, justice dictates that the federal sentencing system would fairly apply a use-of-minor enhancement to sentence these similarly situated defendants. One would think. But not all similarly situated defendants who use minors to commit federal offenses will be treated fairly. Why the disparity in federal sentencing? The answer lies in a conflict between the U.S. Congress and the U.S. Sentencing Commission. Congress directed the Sentencing Commission to promulgate a use-of-minor enhancement that ensures that the defendant’s age is relevant by focusing on adult …

Two Weeks At The Old Bailey: Jury Lessons From England (Symposium Editor), Nancy S. Marder Jan 2011

Two Weeks At The Old Bailey: Jury Lessons From England (Symposium Editor), Nancy S. Marder

All Faculty Scholarship

As deeply-rooted as the jury is in the United States, it is not beyond improvement. There is no better starting place for ideas than England, which provided the model for our jury system. To learn firsthand about current jury practices in England, I spent two weeks observing criminal jury trials at the Old Bailey in London. My goal was to examine jury practices at the Old Bailey and to consider which ones could work well in the United States. I observed some jury practices that I thought we should adopt immediately, and others that would work well in the long …

Zagreb, Tenerife And Cove Neck: Revisiting The Assumptions Underlying Icao’S Language Proficiency Program, Simon Cookson Jan 2011

Zagreb, Tenerife And Cove Neck: Revisiting The Assumptions Underlying Icao’S Language Proficiency Program, Simon Cookson

International Symposium on Aviation Psychology - 2011

In 1976 a DC-9 and a Trident 3B collided over Zagreb in the former Yugoslavia; in 1977 two Boeing 747s collided on the ground in Tenerife; and in 1990 a Boeing 707 ran out of fuel after a missed approach and crashed at Cove Neck. Because they involved language issues and resulted in 832 deaths, these three accidents have been cited by the International Civil Aviation Organization (ICAO) in justification of a worldwide program to improve the language proficiency of pilots and air traffic controllers. This paper shows that: (1) both linguistic and non-linguistic causal factors contributed to each accident; …

Mirroring The Madness: Caribbean Female Development In The Works Of Elizabeth Nunez, Lauren Delli Santi Jan 2011

Mirroring The Madness: Caribbean Female Development In The Works Of Elizabeth Nunez, Lauren Delli Santi

MA in English Theses

Elizabeth Nunez is a Trinidadian author, critic, and professor who explores the development of female identity within Trinidadian society through her fictional and critical writings. Nunez's article, "The Paradoxes of Belonging," questions the identity of the white creole woman in the Caribbean as she lives in exile due to rejection from her European heritage as well as Afro-Caribbean society. Nunez questions this shaping and questioning of identity through her own fictional works with the formation of her female characters. She uses her native country of Trinidad as the main setting to develop black and biracial female characters and utilizes the …

Integrating Info-Gap Decision Theory With Robust Population Management: A Case Study Using The Mountain Plover, Max Post Van Der Burg, Andrew J. Tyre Jan 2011

Integrating Info-Gap Decision Theory With Robust Population Management: A Case Study Using The Mountain Plover, Max Post Van Der Burg, Andrew J. Tyre

School of Natural Resources: Faculty Publications

Wildlife managers often make decisions under considerable uncertainty. In the most extreme case, a complete lack of data leads to uncertainty that is unquantifiable.Information-gap decision theory deals with assessing management decisions under extreme uncertainty, but it is not widely used in wildlife management. So too, robust population management methods were developed to deal with uncertainties in multiple-model parameters. However, the two methods have not, as yet, been used in tandem to assess population management decisions. We provide a novel combination of the robust population management approach for matrix models with the information-gap decision theory framework for making conservation decisions under extreme …
